That method of checking the license for legintmesy and making stuff up on a ticket and report because the driver handed the license looks similar to the strategy of drugs "sniffing" cops because you let them search your car they can and too many times will take it as you just pled guilty regardless if there were no drugs in the car, they knew entirely what they were doing is wrong.

I remember a story where the cop in court said he eyeballed the person speeding without actually using a radar. The judge picked up a pencil and threw it across the room. He then asked the cop "how fast was that pencil going?". The cop was dumbfounded. Case dismissed.

ATA seems to use "A+" through "F" as a replacement for the 10-1 scale. Which I often find annoying, as many places a "D" is still a passable grade, and "F" is a whole range of grades, of varying levels of failure; ranging from barely not passable to utterly abysmal failure. I really think ATA should just switch to 1-10, as that seems to be more in line with how he wants to grade things. Or he needs to have some type of caveat on any "F" grade to explain how bad of a failure it was.
If you give these guys an F, you give no separation from the cops who would have escalated this to an arrest or worse. I understand AtA's use of a "curve" when grading - it can't all be As and Fs.
I was stopped by an officer that then turned off his lights and pulled up next to me after about a minute and said I had the wrong car. he was looking for a stolen car that matched mine. He apologized, We both laughed , I said I hope you find it and that was it. It’s perfectly fine to make a mistake. It’s the ego stroking that causes these issues
@@PiLLO360 - There were two times. In one case, the cop was looking for a car involved in some kind of crime that involved a hit-and-run (I don't know if it was just a hit & run). Apparently, it was the same type of car that I had at the time, which was a common car (a Dodge Aries / a K-car). My car had damage on it, but that damage was from a while ago. There was another time where I wasn't in a car, I was walking home from a party with a boy, and the police stopped us because apparently a couple was stealing from houses. We were walking home quite early, 6 a.m. or 7 a.m., but we weren't carrying anybody's property.

My guess is they are trained to avoid any admission of wrongdoing during interactions in the field. An apology can be construed as evidence of wrongdoing and may be evidence used in a civil suit. The same reason you should never admit wrong doing or apologize after any traffic accident.

Why charge the professional doing 100 and not the granny doing 40? How about you get charged with speeding AFTER you've caused damage? Then all of the bad drivers will get all of the tickets. Speeding tickets don't discourage me from speeding anyways, they just make me want to waste the courts time. I'd sue the department, making sure they waste tens of thousands of dollars of dollars during the defense. I'd spam them with FOIA requests and subpoenas for records that have never been digitized. I'd hire a PI to track the officers and their loved ones, then tell the targets that they're being watched. I'm also going to teach my kids to behave the same way whenever some tyrant attempts to limit their freedoms.

Texas statutes state that a public roadway has a reasonable leeway of 10% or 5 mph, whichever is less. This means a 20mph school zone is 22, not 25; residential is 33mph, not 35; but highways of 70mph are 75, not 77. This is actual Texas DPS statute and something you should know if you drive in the state of Texas, especially if you do more than 22 in a school zone, where fines are doubled.

I agree on the split grade but I would give Officer Wilson even better than a C because he actually was correct in his interpretation of the Texas motor vehicle statute - the fact that the Texas motor vehicle statute is unconstitutional is not his doing - His job is to be aware of the statute, understand it and enforce it - but all of that being said, he realized that the right thing to do was let Mr. Patriot go, and he did the right thing.

Right, I lost on a speeding ticket because I didn't have the cop recorded saying that he thought he had lost track of me on the freeway, because apparently he was supposedly clocking from the opposite direction, passed 4 lanes of traffic and supposedly had to catch up with me, despite me driving with traffic and not passing people. And how he supposedly lost track of my car visually for over a mile as he had to go around from south bound to catch up to me going north bound and I had only gotten on the on freeway like 3 miles back to start with. I believe he got me mixed up with another car, because I was doing almost 10 under what he said I was. But I lacked the video to challenge how he could know he had the right car after "losing" me for over a mile. And how he could get a clear radar hit across 4 lanes of traffic all going my speed or faster. People were literally passing me where he told me that he tagged my speed. If I had a dash cam I could have used people passing me and what he said to refute my ticket.

Cop 2 deserves a C-, the first deserves an F. If he's willing to lie about this sort of thing, I guarentee you he lies all the time in his official capacity, which means he probably doesn't stop lying when he gets to court or is writing reports. Keep in mind that police perjury is very common.

I don't think the first officer deserves an F. While what he claimed to have observed seemed unbelievable, I think he probably knows himself that he *can* gather reasonable suspicion from a visual estimate of speed, he simply did a poor job communicating this to Mr. Patriot (whether or not the officer actually believed Patriot was speeding). It appeared that the first Officer was in need of educating himself. It's important to acknowledge that he did, at one point, admit he was wrong, and that he didn't have Patriot clocked, so your "guarantee" that he "lies all the time" seems pretty ridiculous.

I work in law enforcement and my jaw dropped when the officer said the vehicle was going 10 percent over the limit but did not know what the speed limit was. Why didn't the officer just say he was sorry for his mistake about the phone and move on instead of trying to save face with the speeding charge. A police officer is human just like everybody else we make mistakes there is no shame in it take responsibility for it learn from it then move on. I used to be so proud to tell people what I did for a living anymore I don't tell people because of the response I always get because of things like this.

My parents taught me to drive 10 km over the speed limit , (6 miles) if I am in a hurry. Most reasonable cops won’t pull you over for a speed that could be a discrepancy in your speedometer , or something that could be caused by having your foot a little too heavy on the pedal for a second without looking

I remember one time I was with my brother when he got pulled over. The office walked up, got a closer look at the registration sticker, then apologized and sent us on our way. That's how this interaction should have gone, but then this video wouldn't exist.
I had a similar situation with an inspection sticker. The first thing he said was "i didn't see your sticker" as he pointed to my brand new, 5 days old inspection sticker. still demanded all my information. I was ignorant to my rights and gave him all the info, but looking back, I shouldn't have.

If anything, going 16 in a 30 zone could theoretically be called going too slow, but the cop already said "speeding" so he couldn't change his story more than he already had.
and also even if the speed limit was 25, then he'd only be going 2.5mph OVER which is over and STIIIILLLLLL not speeding. So under literally no circumstances could he have been speeding based on the cop's logic

I have a feeling this zone is well known for this kind of thing in the community and he was just trying not to get "caught" by the officer, the phone being installed on the passenger side is kind of interesting too, it would mean he had "no way" to be using it or it would have being noticeable if he stretched out to put it there.
So basically it boils down to "You were going 10% over Ugh.. let me go check the sign and it will be 10% above that. I'm really accurate at judging speeds."

It is insane that the courts have concluded that officers can continue to detain someone after RAS has been dispelled. They cannot do it when the person is NOT in a car; they should not be able to when the detainee IS in a car.

Lack of Police Accountability in the states is a real thing and is basically even when they break the law they are rarely convicted and jailed. But don’t automatically assume every cop is a bad person.

Furthermore it’s good being cautious but never assume anything. Generalizing is just illogical and divisive. It’s not like thinking a cop is corrupt gives you some sort of advantage. And even a corrupt cop wouldn’t shoot you for no reason and you can’t just arrest someone with no evidence without backlash.

I like hearing about the different state laws. Isn’t this guy already putting huge amounts of research into each video without having to make a 50 state playlist for each video. And since the First Amendment covers all 50 states, I think that is kind of selfish.

First, the beginning text of the 4th A: “The right of the people to be secure in their persons, houses, papers, and effects,against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” Driver’s licenses would fall under “papers”; they have personal information, which especially now would allow anyone to steal your identity. But even back when this was written, they recognized the right to privacy (in your own home or property) as sacrosanct. Since, as the video states, the US Supreme Court has ruled that officers of the law must have probable cause or reasonable articulable suspicion to enact a traffic stop in the first place. In this case, where the driver dispelled this officer’s PC or RAS, there was no longer any reason for the stop, thereby no reason to see (or run) his license. Texas law is clearly written very poorly on this, and seems designed to encourage what is known as “pretextual stops” (traffic stops created by officers either out of thin air which they think the driver can’t or won’t fight, or by following someone long enough that they commit a petty infraction. The officer does not care about the so-called infraction, they are just using it as an excuse to run your information for warrants, and to hopefully find a reason to search you and your vehicle). But here, I believe, is the answer to what you’re really asking: What is the big deal about officers “running your info”. Many ask this, and many get pretty defensive about it. From my perspective, these folks either have never felt the results of an officer running their info more than once in a certain period of time, and/or have no idea how these informational systems work (such as NCIC). I have had folks argue with me, that these do not put any red flag or ding on you, but they are wrong. Get pulled over twice in one month (for petty infractions, made-up infractions, or something that is not even unlawful), and see how you’re treated differently on the second stop. (“Says here you were pulled over two weeks ago by department ABC, what was that about?” Don’t let them fool you, they know full well why you were stopped, this is a test, to get you talking to say ANYTHING to give them a reason to violate you more). Think about what that supervisor in this video said. If true, Texas LEOs would never need a reason to pull you over, to randomly “check your license”. I don’t want to live in that world, do you?

I got pulled over once by a motorcycle cop as he claimed that I ran a red light. The light in question was on a street with a public school and during the summer, the light is changed to a flashing red light. I explained to the officer that the traffic light was a flashing red light but he still insisted on arguing with me and wrote me a ticket. I checked the box on the ticket that I request to challenge the ticket in court with the officer present. Court day came and the officer didn't show in court so my infraction was dismissed.
Not all law enforcement is corrupt. I religiously watch these videos to further ensure I’m doing my job properly. I enjoy watching these to further enhance my knowledge
C- is still in "average" range, and is therefore too high of a grade to give officers who intentionally lied and attempted to violate an innocent citizen's 4th Amendment rights. I can understand giving higher than an F for the reasons listed (i.e. didn't escalate to violence or an arrest), but I cannot agree with a grade any higher than a D+

It's partially because they're trained to project authority, command respect, shut down people arguing with them and force compliance. Being wrong means they lose the ability to do this, so they strive to appear to be right even when they're wrong. Training needs to change so they realise that compliance is voluntary unless you're detaining someone, and making sure that they have the training to know where they are allowed to detain someone.
I mean yeah. That applies to a lot of things. If I had a say the punishment for lying should be proportional to the damage inflicted. In this case not much.
This is probably one of the top five things people should know when being pulled over, when being questioned, when dealing with police. Super important!

The firework had then started a small fire in a bush, and I called 911 and remained on scene to make sure it got put out (which it did, by a couple of residents with fire extinguishers). 911 told me to call back if it reignited, I said okay, hung up, began to leave, and then the police pulled up and detained me for 3 hours in that uncomfortable ass squad car backseat, trying to tell me they had me on video and had witnesses saying I lit it… Don’t believe their lies lmao, I eventually got out with no charges.

This isn’t a right. Just because it’s not required of you doesn’t mean it’s a right. A right is the select few predetermined protections that are irrevocable by any court of law or congress.
It is scary and dangerous to let someone who is not honest to continue to serve as a law enforcement officer. This time he may only be lying about minor traffic infraction , what if the next time it can be a more serious crime that can wrongfully put someone in jail for life or worse.

ATA seems to use "A+" through "F" as a replacement for the 10-1 scale. Which I often find annoying, as many places a "D" is still a passable grade, and "F" is a whole range of grades, of varying levels of failure; ranging from barely not passable to utterly abysmal failure.
I really think ATA should just switch to 1-10, as that seems to be more in line with how he wants to grade things. Or he needs to have some type of caveat on any "F" grade to explain how bad of a failure it was.

I was stopped by an officer that then turned off his lights and pulled up next to me after about a minute and said I had the wrong car. he was looking for a stolen car that matched mine. He apologized, We both laughed , I said I hope you find it and that was it. It’s perfectly fine to make a mistake. It’s the ego stroking that causes these issues

@@PiLLO360 - There were two times. In one case, the cop was looking for a car involved in some kind of crime that involved a hit-and-run (I don't know if it was just a hit & run). Apparently, it was the same type of car that I had at the time, which was a common car (a Dodge Aries / a K-car). My car had damage on it, but that damage was from a while ago. There was another time where I wasn't in a car, I was walking home from a party with a boy, and the police stopped us because apparently a couple was stealing from houses. We were walking home quite early, 6 a.m. or 7 a.m., but we weren't carrying anybody's property.

My guess is they are trained to avoid any admission of wrongdoing during interactions in the field. An apology can be construed as evidence of wrongdoing and may be evidence used in a civil suit. The same reason you should never admit wrong doing or apologize after any traffic accident.

Danger shouldn't be illegal because the level of danger presented is dependent almost entirely on the driver. Some people can drive better at 100mph than others can drive at 40. Why charge the professional doing 100 and not the granny doing 40?
How about you get charged with speeding AFTER you've caused damage? Then all of the bad drivers will get all of the tickets.
Speeding tickets don't discourage me from speeding anyways, they just make me want to waste the courts time. I'd sue the department, making sure they waste tens of thousands of dollars of dollars during the defense. I'd spam them with FOIA requests and subpoenas for records that have never been digitized. I'd hire a PI to track the officers and their loved ones, then tell the targets that they're being watched. I'm also going to teach my kids to behave the same way whenever some tyrant attempts to limit their freedoms.

Texas statutes state that a public roadway has a reasonable leeway of 10% or 5 mph, whichever is less. This means a 20mph school zone is 22, not 25; residential is 33mph, not 35; but highways of 70mph are 75, not 77.
This is actual Texas DPS statute and something you should know if you drive in the state of Texas, especially if you do more than 22 in a school zone, where fines are doubled.
I'd say first cop F and supervisor C. That first cop needs to be suspended w/o pay for a week & forced to watch 20 hours of Audit the Audit before he can pull over another citizen.

I agree on the split grade but I would give Officer Wilson even better than a C because he actually was correct in his interpretation of the Texas motor vehicle statute - the fact that the Texas motor vehicle statute is unconstitutional is not his doing - His job is to be aware of the statute, understand it and enforce it - but all of that being said, he realized that the right thing to do was let Mr. Patriot go, and he did the right thing.

Right, I lost on a speeding ticket because I didn't have the cop recorded saying that he thought he had lost track of me on the freeway, because apparently he was supposedly clocking from the opposite direction, passed 4 lanes of traffic and supposedly had to catch up with me, despite me driving with traffic and not passing people. And how he supposedly lost track of my car visually for over a mile as he had to go around from south bound to catch up to me going north bound and I had only gotten on the on freeway like 3 miles back to start with. I believe he got me mixed up with another car, because I was doing almost 10 under what he said I was. But I lacked the video to challenge how he could know he had the right car after "losing" me for over a mile. And how he could get a clear radar hit across 4 lanes of traffic all going my speed or faster.
People were literally passing me where he told me that he tagged my speed. If I had a dash cam I could have used people passing me and what he said to refute my ticket.
If cops are allowed to ask for your license even in the situation where they were 100% wrong and have already admitted it, then that gives police blanket permission to pull over anyone at any time about anything. "Sorry, I thought you didn't have a windshield. license please." ""My mistake, I can see now that your wheels are round, and not shaped like triangles. License and registration."
Let’s say you made an enemy that has connections to corrupt pigs; that enemy could theoretically have his pig friends stop you everyday on your way to and from work to ensure your late to work and home perhaps leading to a termination of employment and less time at home with your family clear harassment possible if cops can stop you just to see you’re a licensed driver

I don't think the first officer deserves an F. While what he claimed to have observed seemed unbelievable, I think he probably knows himself that he *can* gather reasonable suspicion from a visual estimate of speed, he simply did a poor job communicating this to Mr. Patriot (whether or not the officer actually believed Patriot was speeding). It appeared that the first Officer was in need of educating himself. It's important to acknowledge that he did, at one point, admit he was wrong, and that he didn't have Patriot clocked, so your "guarantee" that he "lies all the time" seems pretty ridiculous.

Technically, that's all you have to do. ...may cause things to get out of hand depending on the officer, but per the letter of the law, you only have to show it to him. The Battousi does it all the time and I've seen a few others get away with it. But I've also seen cops drag people out of the vehicle.

I work in law enforcement and my jaw dropped when the officer said the vehicle was going 10 percent over the limit but did not know what the speed limit was. Why didn't the officer just say he was sorry for his mistake about the phone and move on instead of trying to save face with the speeding charge. A police officer is human just like everybody else we make mistakes there is no shame in it take responsibility for it learn from it then move on. I used to be so proud to tell people what I did for a living anymore I don't tell people because of the response I always get because of things like this.

We need egoless police officers. The guy was 100% ok to pull him over for the phone. Then he just simply needs to acknowledge the mistake and move on. As for requiring the drivers license afterwards, even IF it was legal to require it, it’s 100% ego to ask for it. He knows it, his supervisor knows it, we know it.

My parents taught me to drive 10 km over the speed limit , (6 miles) if I am in a hurry. Most reasonable cops won’t pull you over for a speed that could be a discrepancy in your speedometer , or something that could be caused by having your foot a little too heavy on the pedal for a second without looking

I remember one time I was with my brother when he got pulled over. The office walked up, got a closer look at the registration sticker, then apologized and sent us on our way. That's how this interaction should have gone, but then this video wouldn't exist.
I had a similar situation with an inspection sticker. The first thing he said was "i didn't see your sticker" as he pointed to my brand new, 5 days old inspection sticker. still demanded all my information. I was ignorant to my rights and gave him all the info, but looking back, I shouldn't have.

You could end up with a slap on the wrist for “disorderly conduct” or some other b.s. and spend the night in jail. The logic isnt proven at this point, so technically, the cop is making a ‘valid’ point. Both of them are unaware of the actual speed limit. We have the hindsight knowledge. But the cop is still an azz!
If anything, going 16 in a 30 zone could theoretically be called going too slow, but the cop already said "speeding" so he couldn't change his story more than he already had.
and also even if the speed limit was 25, then he'd only be going 2.5mph OVER which is over and STIIIILLLLLL not speeding. So under literally no circumstances could he have been speeding based on the cop's logic

I have a feeling this zone is well known for this kind of thing in the community and he was just trying not to get "caught" by the officer, the phone being installed on the passenger side is kind of interesting too, it would mean he had "no way" to be using it or it would have being noticeable if he stretched out to put it there.
So basically it boils down to "You were going 10% over Ugh.. let me go check the sign and it will be 10% above that. I'm really accurate at judging speeds."

Driver’s licenses would fall under “papers”; they have personal information, which especially now would allow anyone to steal your identity. But even back when this was written, they recognized the right to privacy (in your own home or property) as sacrosanct. Since, as the video states, the US Supreme Court has ruled that officers of the law must have probable cause or reasonable articulable suspicion to enact a traffic stop in the first place.
In this case, where the driver dispelled this officer’s PC or RAS, there was no longer any reason for the stop, thereby no reason to see (or run) his license. Texas law is clearly written very poorly on this, and seems designed to encourage what is known as “pretextual stops” (traffic stops created by officers either out of thin air which they think the driver can’t or won’t fight, or by following someone long enough that they commit a petty infraction. The officer does not care about the so-called infraction, they are just using it as an excuse to run your information for warrants, and to hopefully find a reason to search you and your vehicle).
But here, I believe, is the answer to what you’re really asking: What is the big deal about officers “running your info”. Many ask this, and many get pretty defensive about it. From my perspective, these folks either have never felt the results of an officer running their info more than once in a certain period of time, and/or have no idea how these informational systems work (such as NCIC). I have had folks argue with me, that these do not put any red flag or ding on you, but they are wrong. Get pulled over twice in one month (for petty infractions, made-up infractions, or something that is not even unlawful), and see how you’re treated differently on the second stop. (“Says here you were pulled over two weeks ago by department ABC, what was that about?” Don’t let them fool you, they know full well why you were stopped, this is a test, to get you talking to say ANYTHING to give them a reason to violate you more).
Think about what that supervisor in this video said. If true, Texas LEOs would never need a reason to pull you over, to randomly “check your license”. I don’t want to live in that world, do you?

I got pulled over once by a motorcycle cop as he claimed that I ran a red light. The light in question was on a street with a public school and during the summer, the light is changed to a flashing red light. I explained to the officer that the traffic light was a flashing red light but he still insisted on arguing with me and wrote me a ticket. I checked the box on the ticket that I request to challenge the ticket in court with the officer present. Court day came and the officer didn't show in court so my infraction was dismissed.
It also doesnt say you must remain stopped at a light if safe to proceed, just that you come to a full stop.
They don't care because they don't actually have to defend the ticket. Even if it's thrown out they get off on wasting your time.

C- is still in "average" range, and is therefore too high of a grade to give officers who intentionally lied and attempted to violate an innocent citizen's 4th Amendment rights. I can understand giving higher than an F for the reasons listed (i.e. didn't escalate to violence or an arrest), but I cannot agree with a grade any higher than a D+

Admittedly, this is far from a police exclusive thing. This is a human thing. People everywhere struggle with admitting they're wrong.
Part of the personality that drives a person to become a cop.
It's partially because they're trained to project authority, command respect, shut down people arguing with them and force compliance.
Being wrong means they lose the ability to do this, so they strive to appear to be right even when they're wrong.
Training needs to change so they realise that compliance is voluntary unless you're detaining someone, and making sure that they have the training to know where they are allowed to detain someone.

@@noodlepoodlegirl also if a cop in the states is asking if you have anything expensive on you always say “no, just 5 bucks” but otherwise if they are asking for something reasonable and you aren’t breaking any laws just show it to them. They are probably just covering all of their bases.
@@noodlepoodlegirl true lol… they once told me they had me on camera setting off a firework… the same firework that I had (out of sheer shock, in order to Snapchat it to my friends) began video-recording the ignition of when I realized that the dude who lit it was actually about to light it in the middle of an apartment complex. The firework had then started a small fire in a bush, and I called 911 and remained on scene to make sure it got put out (which it did, by a couple of residents with fire extinguishers). 911 told me to call back if it reignited, I said okay, hung up, began to leave, and then the police pulled up and detained me for 3 hours in that uncomfortable ass squad car backseat, trying to tell me they had me on video and had witnesses saying I lit it… Don’t believe their lies lmao, I eventually got out with no charges.

This isn’t a right. Just because it’s not required of you doesn’t mean it’s a right. A right is the select few predetermined protections that are irrevocable by any court of law or congress.
