    I worked in a suspected child abuse and neglect team for 7 years and was heavily involved with writing reports that went to courts. She is a dangerous, unethical, power hungry demon. That may seem harsh, but the lengths she went to to prove her own narrative is scary and shocking. Hope she is no longer practicing medicine

      She committed fraud in order to poach a patient from the patient own doctor. It was about the hospital making money that should have gone to other doctors.

      The ego is a horribly powerful thing. I've seen cops let people die became of ego. Prisoners need medical attention and the cop won't let them go to the hospital. It happens more than people think.

      That is f'd up man we had a year 11 and 12 student ordinator that physically abused a student at her former school no trial or anything legal then she came to my high school makes you wonder

    My Dad was a doctor. I have worked for hospitals and several different specialists throughout my life but I have NEVER heard one of them call another one unqualified. NEVER! This woman is judge, jury and prosecutor. O pity anyone who has her for their physician.

      You are putting your finger on the central point of this case. The hospital went after Beata because the court had no jurisdiction over medical disputs between doctors. The goal was for the hospital to use the court to poach a patient, Maya, from Dr. Kirkpatrick, who was not a doctor at the hospital. They billed the insurance company $600,000 for treating Maya for the disease Fitzpatrick had diagnosed. At the same time they told the court that Beata invented the diagnosis to abuse Maya. They lied to the court about Beata to make money from Maya. The whole thing was probably a scam to steal patients from other doctors. They can't do it directly so they accuse the family to get a shelter order.

      @@niania7022 Smith did go to JHACH. Her employer was Suncoast, although from what I've seen in other testimony, she went to JHACH, put on a lab coat, and would give the impression that she was a doctor on the JHACH staff (at least in Maya's case).

      He can't say that because settling a case isn't the same as admitting guilt, people settle all the time even when they dont think they are wrong, and honestly does this woman seem like she thinks she is wrong?

      OMG THE OBJECTIONS would have been hilarious. You'd see some of them jump up so fast lol! But YASSSS. She is all smiles at the end cause she lost absolutely not a thing in this entire situation. She's still employed, the hospitals insurance paid out the 2.5mill, she's just laughing her way back home, I'd bet, also in a Tesla.

    The judge (family court) himself said the only way he can come to any conclusion is based on how good or bad the information given to him is. It was her job to give the judge all of the facts. It wasn’t her job to omit anything she felt was unreliable. Those are the judge’s decision. Dr Sally Smith should have all of her cases reviewed. I would put money on the fact that she probably got a lot of the cases wrong.

      @@crocodillem6462 it’s not “preferred.” That’s what nobody seems to understand here. None of these doctors “wanted” a child to be abused or “wanted” to rip a kid away from her family. They simply identified what was happening. You’re all operating under the assumption that Maya does in fact have CRPS and there is ample evidence that she does not, and every respected medical institution she’s been too agrees on that EXCEPT the two outpatient quack doctors her mother found who were so called CRPS experts who were treating a 10 year old kid with a cocktail of general anesthetics and heavy duty pain meds on a regular basis with no intubation, no monitoring of vitals or physiological signs, no monitoring for withdraw symptoms, no PT/OT, no anything except drugs until she became a literal drug addict. It was not helping her by any standard. Wake up. She’s off all those ridiculous drugs today and she’s normal. She does not have CRPS and she never did. She does not have any symptoms consistent with CRPS.

    Sally Smith was definitely a medical prosecutor. She’s absolutely disgusting for doing similar things to countless other families as well, not just Maya’s.

      Apparently Anderson filed another case in 2021 with JHACH and Sally Smith. So we might get a 2.0 version of this case if Maya wins.

She specifically said that she was looking for medical child abuse not actually investigating. I’ve watched the entire case from the beginning, so I’m expressing my own opinion. You can have differing opinions and that’s fine.

    This case is absolutely horrible. If her job was to gather all the evidence and then present it to a judge, she shouldn't have been allowed to disregard physicians she disagreed with. The judge should have made that determination. She should be fired. I'm glad she's already lost millions from this case alone. Imagine how many other cases she stacked the deck against. How many other families she played God with. This is criminal in my opinion.

      The CPS case is not being litigated. Her proffer was was for the record only, to be used for appeal. She can testify in front of the jury only regarding the time she was not acting as the investigator for the CPS case. She acted in two different roles for the hospital. I think that’s why this case is so messed up legally. While it appears clear to many she’s was the problem, because she was also acting as a state agent, the judge has ruled she can’t be questioned about that aspect. That would be a different case.✌️

    Imo she has some major unhealed childhood trauma in her own life that is her driving force. Her behavior is so hyper focused on one thing-proving her theory. She’s angry and controlling. Who in the world put her in this position of power? Every case she’s been a part of needs investigating. Extremely dangerous!

      Someone like her got mine. My daughter has crps too. All proof I was innocent was left out just like this. I found out like this family, although my child never got treatment because her dx was delayed by lies and court orders they were unconstitutional, that my insurance was billed for conditions associated with crps.
      Her job is to validate the accusation, not tell the truth.

    Sounds like she had her opinion and only included data that supported her opinion, and deliberately left out anything that disproves her opinion.
    If she believed the prescribed medication regime was medical child abuse, why didn’t she report the prescribing physician(s) as abusers?

      This is exactly my question as well. If she disagreed so much with the treatment from the providers, why did they not investigate the provider, but instead went full force on the family? I can't believe they allowed her to omit all that information because she found the doctor's to be unreliable. Her line of thinking scares me for other families. Especially those living with chronic illness conditions. She could disagree with a variety of treatments and separate families.

    I am a person that was taken away from my mother due to false allegations. It does happen and it creates life long trauma. My biological father abused me and my mother. When she left him he went nuts, horrible custody battle. This was in the 90’s when women still weren’t believed when it came to abuse. He accused her of abuse and I was put into CPS twice. Short stints, but it still happened and we were both forced to undergo court evaluations. My mother was hospitalized, had concrete evidence of his abuse, but this still happened to us. Eventually my mother won full custody and the abuse allegations against her were proven false. I have PTSD and anxiety, I’ve been living with it for 32 years and I haven’t spoken to my biological father since I was 4. Always ask questions before speaking to anyone about your personal business or life without knowing who they are. CPS is sneaky, don’t talk to them without a warrant or a lawyer present.

    She horrifies me. It is so upsetting how much power she was able to exert with such tragic consequences. Total God complex. She has anointed herself as the ultimate expert. Meanwhile lives are being ruined. Dont know how she sleeps at night. Even now she is not the least bit reflective or able to acknowledge that maybe she got it wrong.

      I wish that too, because her testimony proved the hospital is guilty. She had no boundaries, she had access as an employee, as a provider with privilege, as the only trainer in child abuse for the residents and as the CPS agent. That has all levels of conflict and so unethical. She is drunk in power and they gave it to her.

    She's completely out of control! Incredibly dangerous woman to be treating children. What she did in Maya's CA/Custody hearing in family court was the equivalent of a Brady Violation in criminal court. She absolutely had information that could exonerate Beata of MBP and she kept it from the facts presented to the judge. As the medical director for CPS, I'm sure the judge expected that she was presenting ALL pertinent medical facts. She did no such thing. Having listened to her, I think any file that she was involved in for CPS needs to be re-evaluated. 300+ times she's testified??? How many families? How many kids has she caused Trauma to? How many kids were removed from loving parents (with no money to fight her, cause you can't fight cps) and tossed into the system??? This woman needs to be investigated!!! This is unbelievable!!!

There is no evidence that Maya was in danger. There is evidence that Sally Smith went against the medical advice of multiple doctors in order to separate Maya and her family.
      Beata was cleared of any possible MBP. The family was trying to find ways to treat Maya without the use of drugs before she was taken away by the hospital. The family was following medical advice from medical professionals. Maya was improving. The hospital refused to communicate with her doctors and instead immediately looked for ways to take her away from her parents with no proof. To this day, the hospital has no clear reason for why Maya should have been taken. Their reasons are contradictory, have no evidence, or are complete lies. The hospital's own witnesses contradict each other on what happened.
      Once again, there is no proof that Maya was in danger. Only the claim that she was in danger without any evidence. The only evidence has been that Maya was being treated by professionals before the hospital took her away.

      Same. I can’t help feeling her butt should be in jail. She drove a woman to suicide, leaving a sick child with no mother…I don’t even have adequate words for the disgust I feel for her. Imo, they could liquidate every single thing she owns, give every dime to the family she permanently harmed, throw her in prison forever….and I still wouldn’t feel it’s enough. I just can not with her. 🤬🤯🤢

    Did you see that stack of binders she set up on the witness stand? 5 or 6 to be exact. Look like a power play to me. She never referred to any of them. In fact, the plaintiff said something to the judge. Dr. Sally Smith is a legend in her own mind. Scary as a parent with a sick child that someone has that much power and you are helpless.

      I agree about the power play. Wonder if HIPPA would approve. She did look at two papers which were admitted to the clerk and Sally said the clerk could keep them. Judge called the books props, Smith also got lost on the way to the courthouse winding up at the Waffle House. A father who she had wrongly thrown in jail, yelled at her outside the courthouse.

      That's my thought.... Worked 30 YEARS, and testified in OVER 300 CASES???? THAT'S OVER 10 PER YEAR!!!! Her contract was once or twice per hospital per year. That's OVER 100 HOSPITALS.... I don't think there's that many children's hospitals in the surrounding area.... U.S. News has a story of a guy who spent over 300 days IN JAIL BECAUSE OF HER.... HOW MANY FAMILIES DID SHE DESTROY???? WITH ABSOLUTE IMMUNITY 😢

      No it was Cathy Beaty that was charged for assault on a little boy.
      However an innocent man spent 300days in jail for child abuse before he was proven innocent because Sally smith lied. He was protesting outside the court the day smith testified and approached her and demanded the sheriffs to justify why they weren’t investigating her

      She was charged but it was later unfounded or something, I can't remember. I tried to look it up but all I could find was the case of Maya.
      HOWEVER, there is a petition to get her fired. I did sign it.

      She does. From what I can remember, I think it was when she was at sun coast and she held a child down where apparently they couldn’t breathe. Don’t quote me because I haven’t heard anyone talk the details in a week or so and so much has happened. But regardless of the details the charges were dropped.

      @user-dx2kw1mf8e it is a legitimate medical treatment. It's in the n.i.h. as one. It said 85% of the patients reported complete remission after 6 months and 50% had a complete remission still 10 years later. It's for 5 days and very highly monitored. People are letting the name of a drug scare them. Modern medicine is still in the old ages for lots of things. If you have never been in or been close to someone in real, chronic pain that is debilitating, you really don't know the depths that you would go to in order to get or give them relief. Heck, for even 10 minutes, what some wouldn't give. I had my lung punctured in order to cut nerves to my pancreas because the pain and burning were so bad, and no amount of pain medicine took it away. Thank God that this treatment is available for the patients that decide its right for them.

      And as an ex drug rep I can tell you Drs use meds off label and at extreme doses all the time. All they need is a study or two that shows that works. People w CPS have zero good options for pain relief…esp w the anti opioid push.

      @@michelehoward4113 Totally, I use a medication that is only approved for heart failure in US for my POTS. I had to fight the insurance, but the typical options get me more sick and my doctor recommended this one because is being used with success in Europe. I presented the studies and evidence, was hard to get it approved, but they did. I know about patients that didn’t get it approved and order it to international pharmacies in Canada or Mexico. As long as is prescribed and under medical supervision, is not something as rare as they want to make it appear.

      They’ve “investigated” other medical abuse cases, one father ended up in jail for almost a year before being exonerated. Supposedly there is an unusual number of medical child abuse cases identified by JHACH. Medical child abuse is the rarest form of child abuse, most pediatricians see maybe one or two cases their entire career. It’s super, super rare. Physicians have a saying, when you hear hoof beats look for horses not zebras (which sucks for the zebras). Well, medical child abuse isn’t a horse *or* a zebra, it’s a unicorn. Smith should have considered a whole range of possibilities before latching onto the conclusion she came to.

    This woman is dangerous and still employed! She’s so dangerous. How the hell can she still be employed in ANY capacity? She has an agenda, (even in others cases!!!!) and chooses whatever information she wants to support the outcome she wants. If any parent gets in her bad side or she takes a disliking to are screwed. Wow she totally disregards all other Drs involved and goes as far as to say they are quacks. She needs to be sued for more than $2million and needs to be fired.

      I do want to correct, that thankfully, she is not employeed in this kind of role any more. Hasn't been for a year. Now I believe she just practices as a pediatrician. She no longer works as a child abuse investigator.
      That being said. She was confronted at the courthouse by a father that was cleared after 300 days in prison for... you guessed it... medical child abuse. Confronting her was wrong. But it shows that Maya was not her first time doing this. A man was wrongly imprisioned because of her.

      @@ashleypg1708 Because he could have been arrested is the big one. The other is that if he has an on going case against her it could hurt his case that he confronted her the way that he did.
      Also I don't know the details of HOW he confronted her. But if he had done so in a way in which she felt threatened she could file assault charges (you do not need to physically hurt someone for assault charges, only make them feel that they are in danger). Imagine if after getting out of jail after being wrongly put there for child abuse, then going back to jail because he confronted her and losing more time child with his kid?

    If Johns Hopkins sees this proffer and doesn’t terminate her, and if the Florida BoM doesn’t initiate an investigation, I have lost what little hope I have left in our healthcare system. To completely omit information from her report is appalling. If she didn’t agree with any of her findings, she still needs to include it along with her justification for disagreeing with it. Her actions are completely unethical.

    I have CRPS type 1 in my dominant hand from a work injury. I am currently in the middle of a lawsuit. We had a compensatory hearing where I was accused of malingering (Munchausen's) by a psychologist from the other side. Right after my 3 top hand specialists testified with all their findings. My heart absolutely breaks for Maya & her family. This trial has been so hard to watch.

    I’m a pediatric nurse in the Tampa Bay Area and I work with patients in home. I take them to this hospital. It is not unusual for parents to monitor a pulse oximeter. They learn how to care for their sick child. For her to include that was just like ???? Along with many other invalid points SS made. Would not want to work with this person. Disgraceful and biased

    I think she was completely out of line not including other professional investigations and diagnosis. She had some personal vendetta against Maya and her family and used her position to leverage the narrative the way she wanted it. Why isn’t Sally held accountable for this? Why wasn’t the jury allowed to hear her on the stand? Why was she on the stand if the didn’t get this info?
    Thank Peter for your insights, I was very frustrated by her conduct.

    This was really hard to watch. As a mother the thought of this woman or someone like her having a role in my child’s care is truly terrifying. Her position as an investigator is to present ALL of the evidence and information. She intentionally left out the information that was in support of Maya’s diagnosis. I agree with you Peter, it is ok to disagree with another doctor’s medical diagnosis, however it is 100% wrong to EXCLUDE that information because she disagrees with them. I wish Anderson had asked if she was an expert in CRPS. Maybe he did in front of the jury?

By cherry-picking evidence, especially when your role is treated as fair, you can facilitate any case you want, which is exactly what she was doing here. There were two CPS calls. The first didn't find any abuse. Then information was adjusted and the second narrative triggered the court order. So somebody decided the right outcome and then, based on their experience just constructed the right narrative for the court.

    Jules called in RA yesterday and shared how the dad who she had locked up approached her before she entered court and expressed himself!! He served 8 mos In jail from her false accusation.

    LOVE your commentary! So balanced and easy to understand! I’m a RN x 27yrs. She seems very un-likable to a jury. I testified once in a deposition against my workplace. Thank GOD my documentation was on point…pointed the finger at the multi-million dollar FOR profit company that covered up a sexual assault of an elderly demented woman that wasn’t protected from a patient who would go seek her nightly! I was nursing supervisor. Every 12 hr shift a 1to1 was assigned to the sexually aggressive male. Well that CNA didn’t switch off with another CNA on his lunch break at 3am to 4am. The woman was assaulted. He thought it was his wife. I documented my physical findings, reported it to the state abuse hotline and…got fired. BEST decision I made!

      @@basicallyno1722 I heard from employees that I was fired because I didn’t KNOW the CNA didn’t switch off. Even though I was the House RN supervisor and made sure I assigned staff to the 1:1. The corporation downplayed the sexual assault because there was light touching only. I don’t know the truth in that. The ombudsman told family. This is after the fact. The family sued and the company settled. I went on unemployment for 6 months. I won at my UE hearing.

    Things Smith never did during her "investigation":
    - Never met or examined Maya
    - Never administered the test for malingering
    - Never administered a parental fitness exam
    - Never explained how Beata, following Dr.'s orders, caused Maya's presenting symptoms
    - Never observed Maya & her mother together
    - Never reviewed the 48 hrs of covert video footage of Maya
    - Never gave any weight to the opinions of the 5 CRPS specialists who diagnosed Maya with CRPS & are also mandated reporters, required to report suspected child abuse, who never reported such concerns

    She definitely acted as a prosecutor. Based on this case, the process needs to change in two ways. 1. Reports from "child abuse specialists" need to include a mandatory exculpatory info section. 2. DCFS and hospitals need to have a time limit on evaluating cases and starting any needed therapy. I don't care what Maya's actual illness was. What I care about is that the hospital did not provide psych treatment or quality physical therapy. What they did do was inadequate and not consistent. They were more interested in proving Beatta evil and Maya crazy than actually helping the poor child.

    This is extremely troubling. It really seems that she had/has an agenda paired with limited insight into her own personal biases creeping in and clouding her professional judgment. It worries me that she still has access to vulnerable patients

      ​@@texasandersmy father is a retired police officer. They most definitely do have a quota for average tickets written in specific areas, plus bonuses for most written... plus for every ticket they write, the officer received $52.50 bonus if they showed up in court for each hearing. The dollar amount was in early 90's but I'm sure it's higher now.
      Regardless, this lady needs mental help. Anyone can see, narcism written all over her soul. No true compassion within her realm. It's all about her high and mighty self that will unfortunately never see herself doing wrong. She is what we should call a bad seed living amongst us.

    She is absolutely vile, and 100% backed herself as the only person who knew what was going on in this case. She was a prosecutor, how can a judge decide without all of the information?! Surely she is supposed to be impartial, not on either side but there to find the facts. I was so shocked seeing her excuses, Maya's whole family were let down by her. Thanks for covering as always x

    It really just shocked me how she could say that she found the other doctors to be unreliable. Not just one or two, but all of them. Then when asked if any doctors agreed with her she said yes, but couldn't provide names. Her attitude was "I am a medical doctor! Don't question me!"

      I can't do the child victims cases. They hurt my heart. I am an emergency foster parent because I realized how great the need was in my area. And I actually love when families are reunited. I see more bad social workers than abusive parents, and I am not one who stays silent when I see problem.

    Just so you know, I've been living with CRPS for 12 years now. I spoke to Beata on several occasions about Maya and her treatment in patient groups. Maya saw *every* CRPS specialist. Kirkpatrick, Hanna, Chopra, and Spiegal are the absolute best in the world for CRPS. CRPS patients travel from all over to see and get treatment from them. ACH completely wrote off the best doctors in the world because they, as doctors who rarely interacted with CRPS, somehow knew better. I'm so glad the family is getting justice. RIP Beata.
