Worked in healthcare for 49 yrs, 42 as an RN. Admistration is only conserved with the bottom line and covering its own ass. They would throw any employee under the bus for their own benefit. The more I hear about this case, the more I get disgusted. Maya was certainly abused by the system and culture at the hospital.

Today was extremely damaging to the defense. As a retired RN, I cringed with horror while listening to the failures at JHACH. I had been on the fence as to whether or not the plaintiffs should prevail, but not anymore. If I was a juror, today’s testimony would have solidified my stance that the hospital is a fault for much of what occurred with Maya.

Absolutely. As an advocate parent for a needs child for 42 years JHACH wouldn’t like me with my questions. I would be able to smell “a Sally Smith” in my presence.

You should listen to the defense closing first. It totally changed my mind.
Defense opened the door wide to all that stuff coming in. It definitely moves the needle towards Mayas case. We have a young girl with previous Dx that had been receiving treatment and went into remission. She has a relapse goes to the closest hospital and the worst nightmare unfolds. Her mother's only crime was being an RN who understood the importance of being a patient advocate, who shared everything she knew about her daughters diagnosis and treatments that had and had.not worked to date. Who pushed back on medical staff who were too busy to listen and consider, and they did what had worked.so many times before, they removed the pushy parents from the picture. Beyond heartbreaking. The system is clearly broken. I hope theynfind for Maya and throw the book at them..

Doctors have a God complex, especially when a lowly nurse and desperate mom confronts them-and knows more than they do about a given disease-which is exactly what happened here.
It is CRPS for God’s sake. This poor child would scream all night in pain when the disease flared. Ketamine was a godsend. And frankly every anesthesiologist that has weighed in on this case has called it medical gaslighting.
The hospital never called in CRPS specialists-instead they destroyed this family, physically mentally and emotionally.

To those in the chat Juror 1 did not get kicked, another Juror did get dismissed for medical reasons and then the defense wanted to kick Juror 1, but ultimately the judge ruled against that.

I have many friends who are doctors and nurses. They said if you speak up you will be blackballed and you would have to leave the State to keep working. It's truly gross, the control and cover-up.
When Dr Corcoran first testified, I looked into the Tampa Bay Times coverage and found the CMS report. When that didn't come up in the plaintiff's case in chief, I figured it had been ruled out in limine. Never would I have expected that this would come in on rebuttal, and now the actual testimony is so much harsher than I thought it would be. What a killer witness, you can see why he would say this pro bono.
Whitney was so ready for the hospital to open the door and they kicked it open 😂 they were cocky and stupid. Whitney was so ready. I bet he didn’t sleep all weekend either.
What worries me is I understand fighting for your client, but to me hiding stuff and being sneaky should not be in the equation.
It's almost as if all these people aren't honest. Who's ever heard of a lawyer not being honest.
He simply didn’t attach the IJ to the court filing because he didn’t want it to become a matter of public record. He is willing to take the sanction to protect his client from future lawsuits. It’s too bad the judge didn’t insist it be put into evidence.

And the heart institute problems included the PICU. That had a plan but weren’t following it. Jt Comm didn’t normally check that.
The defense has it.. so it’s certainly going to be public record.. they witness on the stand also reviewed it.. so it’s in discovery
@@christoph1596 the defense has it but not the plaintiff or their witness. The plaintiffs filed a sanctions motion against the defense team because they wouldn’t produce it.

What really bothers me, is Hunters arrogance and filibustering!! When they are wrong his attitude is completely different than when the plaintiff has done something wrong, then Hunter stands on moral grounds that they can’t believe plaintiffs would do something so egregious! It’s just infuriating!!!

Yes. These hospitals are causing families like mine to suffer. My 16 yr old is a victims medical kidnapping. He has a rare syndrome. For over a yr now our case just never made sense. I now know without a doubt we were targeted for Seekin care outside of the hospital. My son has been in custody now for over a yr. The big hospital has failed him to the point his health is in dire straights.

For me this would be a game changer. The defense loses all credibility by not giving the witness all the documents. As the judge says, it takes awhile to create a culture. I hold the people at the top of JHACH accountable for hiding their problems instead of addressing them. They get paid to do the right thing. This is personal to me because I live in Pinellas county. We need to be able to trust the hospital taking care of our children.
That hospital has a lot to answer for. I finally watched the Netflix documentary and it seems like the Kowalskis are just the tip of the iceberg. The amount of families that Sally Smith alone has affected so much is just absurd. She and Cathy Bedy both deserve criminal charges, which I doubt would realistically ever happen.
Do not leave your loved ones alone in a hospital.

Hunter and Shapiro played a huge part during the dependency hearings. Even after Beata died they were still trying to get the judge not to give her back to Jack. They made so many mistakes, they deserve to lose. Maya deserves all the money.

I, too, had no idea Hunter and Shapiro played a role in the dependency hearings. I’m having a rather visceral reaction to learning that. This news makes me wonder how Maya and her father remain composed during the court proceedings. If I were them, I don’t think I would be able to stay in the same room with them.
@@cqbarnieify I know right?! The Kowalskis are good people. I would have a really hard time being civil to any of the defense lawyers, but they have kept it together all this time.
I believe this is the way you get these institutions to do things correctly.. by suing!.. so glad Maya and her family are doing this.. 👍
But suing isn't so easy or simple. Most lawyers will not bring a big case like this against a hospital on a contingency basis. Preparing for trial (including depositions) and actual trial costs big bucks!

I heard this hospital wanted to settle out of court, but Maya and her family didn’t want to settle because they want ppl to see what they were put through and I believe they want change in these hospitals.. it would’ve been easier for the plaintiffs to settle if money is all they wanted…
A friend civilly sued over being overlooked for a change in departments. She asked the operating room manager why she didn't get the transfer, and she replied, "Because you're too old."! BOOM! Lawsuit and won in federal court! She's now 55 and is retired $$$$$$$
No game changer for me. You could tell by the actions of the hospital that Maya’s issues came from the attitude of the hospital…from the top down! “We know best! how dare you question us? “ Can’t wait to see how many zeros the jury comes up with!
My son has Prader=Willi syndrome. Cincinnati Childrens did to us what they did to the Kowalskis. Except that my son is in foster care with a social worker having complete control over him thanks to her misleading the court. Her belief was that my son sample needed to "make better decisions" and I was to blame for his incurable disease. My son has been tortured and neglected. HIs health has only declined. we have no voice. CPS has taken over $20,000 from us. Please pray my son doesnt die alone while being bounced around foster care now in his 6th placements. He has a home. We almost lost but sold everything possible to save it ...for now. THese social workers are dangerous. Our case worker accused me of medical neglect for my son not being on a certain medication. ITs been over a yr in custody and hes still not i it. Hes on insulin now though because hes developed diabetes. CPS and Childrens has refused to acknowledged or work with my treating physicians outside of Cincinnati Childrens. These people exposed in this case need accountability.

I’m so sorry to hear this. I worked in child welfare and finally left when I couldn’t take dealing with the systemic problems anymore. I nearly had a stroke from the stress of dealing with incompetent supervisors who held all the control and didn’t listen. Keep fighting and keep your hope alive
I'm sorry for what you and your family is going through. My daughter spent a short time at a facility in TX that specializes in Prader-Willi syndrome. All these children had hypertension and diabetes, amongst other medical issues. She's a mental health RN and studying for NP licensure. She couldn't handle how some treated the children but also the staff were abusive to one another. She ended up moving back to AZ to her autism children (unit) where she's physically abused at times, but it's better than where she was at. I'm also an RN and thank goodness have not witnessed stories as yours or others. Prayers for a positive outcome.

I find the fear of retaliation and retribution finding extremely damaging. Personally, it puts the testimony of all of the JHACH employees that testified at question in my head. Sure, they say they did campaigns to fix company culture, but it's difficult to rebuild trust if you've seen a company retaliate. Maybe that's not what's happening here, but it makes me wonder and devalue their testimony a little bit.
Wow, that is an excellent point. Dr. Smith gave off an aura of dominance over those who worked under her.. they were to all fall into line. I can't speak as well as you but hope you get my point.
I am absolutely suspecting the testimony of the employees especially 1. given the nervousness of some of them 2. the arrogance of S. Smith of doing things "her" way 3. the pervasiveness of the "culture"
I have been in that situation at a corporate subsidiary where the top boss was committing sexual harassment (not of myself, thank you Baby Jesus!) The victim sued after being fired for refusing to comply, and people who were truthful to the corporate investigators were also fired/"laid off." I was a single mother with three kids to support and I kept my mouth shut, basically same as how inmates in prison never see nobody doing nothin' to nobody. I received a Christmas bonus of a month's salary.
I suppose I could have stood up for truth and justice then sued for retaliation after I got fired. But how would I have kept a roof over my family's head? Paid for food, electricity, etc? And health insurance to keep my kids alive? So, I sold my soul for my family.
I haven't believed any of the doctor's or nurses.
SUCH a huge and important observation. Retaliation culture is alive and well. I know firsthand that "Protected Whistleblower Retaliation" is thriving at Abbott Laboratories. And the people with integrity and courage to report it are the ones who lose everything. 💔
This witness was great for Myas case. Came across as knowledgeable, direct and trustworthy.
It seems quite obvious to me that JHAC are doing everything they can to get out of taking any responsibility for their part in this situation. They will sink to any level they can and don't really care about their patients.
This is what concerns me. Still a culture with no accountability. Still bullying this family.
Maya is an amazing young woman. It's terrible how the hospital stole her mother and childhood from her.
Her mother killed herself not the hospital.
@@applehead498yes, Maya’s mother did commit suicide but this was because the hospital accused her of medically abusing her child and everything that went along with that. After trying everything that they they could to get Maya back home her mother knew that the only way that the hospital would release Maya back to the family was if she was completely out of the picture. The hospital also tried to (and actually succeeded in many ways) to turn Maya’s father against her mother by making her father say that he would agree to a court order which stated that Maya could return back to his custody only if he would not allow Maya to have any contact with her mother, so basically breaking up their marriage and kicking her out of her home. Maya’s father did say that his wife felt very betrayed by this when her husband agreed to kick her out of the house in order to get Maya back. One of the hospital doctors or the social worker (I can’t remember which) actually asked Maya’s father whether he had thought about divorcing his wife!!! Also the denying Maya’s mother from having any physical contact with her daughter became unbearable. It was the hospital that gave the judge the report that stated incorrectly that Maya’s mother was medically abusing her, which made him place the Shelter Order on to Maya and therefore allowing the hospital to hold her and not let her mother have any physical contact with her. Even the few telephone conversations between Maya and her mother were listened in to and they would continually but in to their conversation saying that they couldn’t talk about anything related to Maya’s treatment, what she ate, what she did etc and then they would cut the call of after a very short amount of time. The judge who was there whilst Maya and her mother were in court wouldn’t even wouldn’t allow Maya’s mother to hug her daughter before she left to return to the hospital. I believe that this was the final thing that tipped her over the edge as she was absolutely deviated over this and extremely up set for the rest of the day as it was all she could speak about. Then she then killed herself shortly after this. I think it was the next day but I may be wrong. There were lots of other things going on as well which also contributed to Maya’s mother committing suicide but I can’t remember them all. I hope this helps.
@@applehead498BS. Her mother was pushed to suicide by the hospital. She did the most selfless thing a mother could do in her mind. She knew the only chance Maya had at going home was to not have her mother their. Which is garbage. This started and ended with the hospital.

I was on the fence on this case until his recent info about how pervasive and system-wide this hospitals behavior seems to be. In particular, if I were a juror, it has to affect my decision on punitive damages. It'll be interesting to see the appeal on this one! Thanks Peter for keeping us abreast...

I had been in the dental field for over 35 years from dental assistant to office administrator. Twice as administrator in community clinics that rely on state and federal funding. Our charts were audited to see if they were complete. EVERYTHING had to be documented!! This includes any issues with the patient and/or parents. Each night, I went through each chart. If in complete the chart was given to the provider that saw them. We ALWAYS added discussion or issues that were observed. It would include both sides of the conversations. I don't know why JHACH didn't think this was important in the Maya Kowaski case. How many times Cathi Bedy said she was told this or that was given to her by Risk Management but NOTHING was documented in Maya records. I sure hope they have corrected this!!
I think the prosecution got this. Justice for Maya.
I think it's the plaintiff instead of prosecution- but I totally agree, a last minute unforced error. I hope this case changes the way hospitals use and abuse their power
I worked in healthcare. Working in Nursing care facilities and Hospital, know all about JC and survey and reporting injury and incidents to the state within 24-48 hrs depending on the situation. They are guilty!

Maya’s family DESERVES TO WIN and I hope the jury drains the hospital of their last dime. If not for them Maya’s mother would probably still be there with them. I know if this had happened to our son who was hospitalized so many times for his asthma I can’t even count there would have been fireworks from my husband. In fact when he was just 8 months old his pediatrician couldn’t diagnose his problem after him being in the hospital for a week he sent him to St Luke’s in Houston. When we got there he was admitted through the ER. I don’t know if anyone on here has ever had a blood gas done but it’s extremely painful. They get the blood from an artery in the wrist. Remember he was only 8 months old. The lab tech/doctor stuck his little wrist at least twice with other people holding him down. After not getting it in the second time my husband told them if they tried again he was going to beat the s@@t out of him! Needless to say we were admitted and put in his room immediately. That’s what Maya’s mother was doing. Trying to protect her child just like anyone else would.
The defense attornies are embodying the hospital culture: keeping things hidden to avoid consequences.
I am so sad about this case. First, for Maya, her suffering, her family and their suffering. And also for Johns-hopkins, which I had always trusted and held in the highest esteem. How did their standards become so eroded?? Can medical ethics and standards be upheld in an American medial system that has forced its institutions to surrender themselves to profit and efficiency to the sacrifice of its own staff and of it's patients?
Money that’s how this prestigious hospital lost all its credibility their greed and their evilnesses not caring for their patients. No matter what the cost is.

How aren't they sanctioned and fined for charging their insurance for crps when they claimed she didn't have it. How isn't this also insurance fraud?

It totally is fraud however the insurance carrier aren’t aware in most cases of fraud in the insurance industry they start an investigation when the party being fraudulent has been turned into their insurance carrier by someone sounding the alarm in regards to the fraud
It is one of the counts that the jury has to decide. The way it was explained was that if the jury finds for Maya regarding the billing, then the damages would cover the excess amount Jack had to pay for the billing based on CRPS v. Conversion disorder, et al and I believe the insurance company will work that out with Jack.
They also billed the Kowalski's for it. One of the most crazy aspects of this case is there's still a lien on their house for it.
While JHACH doctors were swearing under oath in family court that Maya didn't have CRPS they were billing the Kowalski's for treatment of it.
This case breaks my heart. They were supposed to take care of this child and instead did the opposite. They destroyed a family.
I commented on another video that CMS concern was about the flow of information up the chain of command. I’m a nurse and have worked in facilities post IJ, it’s like all the managers have PTSD.

Hi Peter, if I were a juror on this trial, I would instantly suspect suborning perjury by Defense, and I'd discount their witnesses and their lock-step claims about Maya and Beata. I'm finding for Plantiff.
From reviewing the CMS findings it appears that Maya’s treatment was a symptom of their management issues.
Lack of objections by the Defense during his testimony speak volumes
Lawyer here, I believe the Judge was correct with inclusion of testimony and agreed with objection fairly. Real wince moment for defense. 😣
I like how this judge gets across he is 'not amused' (understatement) but without totally losing his cool and still making an impression on the lawyers that they cannot mess around any more than they did.
Doesn't it make sense it is systemic issues since Cathy Bedi worked both the heart unit as well as others? Employees attitudes are infectious.

That's exactly what I was thinking. This is what panic looks like, and I hope the ABSOLUTE TRUTH AND ALL OF IT comes out so that no child tragically loses a mother like Maya did.
I wonder if mayas name was involved in this at all! There's a major subject relevant to this case for them to try this hard to keep it out imo

Surveys absolutely look back 3 yrs, but can go back further, and in this instance, some went back 5 yrs! They covered when Maya was at JHACH.

I am in Virginia and an IJ on a CMS survey immediately shuts down the ability to admit or treat any patients with Medicaid or Medicare. It hits right in the bottom line. That is why ANY facility will do their best to get it knocked down or sweep it under the rug. I can believe that they tried to hide it and am so glad that Maya's family has brought it to light. Medical facilities need to be so much more transparent with practices! 25 years of nursing here and that is a company I would walk away from and report.
31:25 he’s a Doctor, his name is Doctor Corchoran. (sp?). He’s a OBGYN and he owns a hospital. He also has a Master’s Degree in Business. He also worked for the government and helped to implement Obama care for all the hospitals. He worked and consulted with the boards of with John’s Hopkins Children’s Hospital , in building a Children’s hospital within his hospital to better serve the needs of patients in an urban area in Las Vegas. Also, he knows his stuff! His testimonies have been mind blowing. He really cares about getting justice for Maya. And it’s not just Maya, this specific hospital (and I suspect this team) has done this to tons of parents! Thank you so much for your explanations. You make all this hospital/court stuff easier to understand! ❤

One of my huge pet peeves in life is asking a specific question but getting an answer to a different question that I did not ask.
The Defence does not want those documents admitted because it becomes public record and therefore can be used by other litigants in their cases. The jury will now look at the Defence case with a jaded eye after this testimony.

Meanwhile… doesn’t turn over the report…

Really probably one of thee best and MOST credible expert witnesses l've seen in a trail, not evasive and will straight up say if he doesn’t agree with either lawyers. Doesn't get intimidated or pushed around at all by the opposing counsel. Plus he is working pro bono, seems like a really remarkable person in general. So PROPS to you Dr.
IMO the best witness in this case.
One thing that bothered me was how Hunter kept talking about the importance of how the surveys and reports are all about looking forward; however, they are really about the problems of the past (recent or far past) and how they are NOW doing better based on the findings and fixings. In other words, the problems happened during the time she was at the hospital and however great the hospital is now, years later, doesn’t matter.
Thank you for covering this case. I unfortunately can’t bring myself to watch anything about it. It’s just so horrifying and scary to even consider this happening to someone I love, let alone my child.
Dr Cochran was the best witness. He was sharp and very knowledgeable.
Infection control: don’t forget they didn’t clean her port for 3-4 weeks. Omg.
I have CRaPS, and I know that I have been biased for Maya from the start. That aside, watching the defense try to slimeball their way out of this extremely damaging and true information represents- to me - exactly what is wrong with our health care system. I have been gaslight, mischaracterized ad flat out lied to more times than I can say.
The defense infuriated me, but it feels so validating to have this truth come to light in Maya’s situation. I can only pray that health care providers across the board take notice, and treat their patients, no matter the problem, with the respect they desire.
And I hope the defense attorneys and everyone defending the hospital gets coal in their stockings for Christmas.
This really impacted how I viewed the hospital and the people they put up as witnesses. If these were findings on a regular JACHO, they look back over the last three-year period. As I understand it JACHO found against the heart institute, but then the Feds came in and found the culture of the hospital as a whole was involved.
Mya, and her family have endured more pain than any family that has gone through this so called system set up to protect childern. Were there mistakes made..." YES" but it does not give the hospital a free pass to cover up what was admissible or kicked out of court. She was not protective by any services available allowing or dis allowing by blocking phone calls, visitis, card, letters and the ability to hold and touch her child should be worth billions of dollars as far as Im concerned. Those things will never be able to be given to her, her dad or brother. I have watched the documentary and this case closely and if I were on that jury, my vote would be against John Hopkins....end of story!!!
I live in Ohio. Mayas case sadly is not rare. Us families with children who have rare disorders are targeted by big hospitals when we seek care outside of their monopoly.
This happens a lot but try finding a law firm that wants to go up against the big boys...you may get unalived so it is a very big gamble.

Ive been thinking about this one juror question and Im pretty sure it was asked to witness anderson, the juror asked something like were any training polices or procedures changed at the hospital since maya left the hospital. He scoffed it off and say nope, no. In light of these investigation reports that is clearly not true. Changing those things is how they claimed they fixed the issues and got the accreditation cleared again.

As a retired RN , Maya will own John's Hopkins. I've worked at hospitals just like this & I'm happy to see justice served. Better late than never!!!

How can an IJ have nothing to do with patient care within the hospital? It sounds like an attorney arguing : "Your honor those 3 previous DUI's were resolved before this last one."

Case over. I hope the Kowalski’s get every red cent. We have a son with an extremely rare condition that no one could figure out. People didn’t look like they were believing us so we began video taping his events. Through God’s grace he landed in Boston (we live in FL) but I considered other places in FL, Philly and Ohio. My son’s surgeons are both now at this hospital (recruited) and they are amazing but I’m afraid to go there because I’m worried some of this horror is still there. I am waiting for this to teach them a lesson before considering it further. I had to give my son a medicine to rescue his life and it was uncommon the way it had to be done. I started getting worried about it all and had BCH write me a letter of authority to give it to rescue him. This could have been us and so many others with rare children! I, too, have a nursing degree and advocated strongly for my child. Beata was vilified for no good reason and these people were egotistical evildoers who lack sense and compassion. Honestly, they deserve jail and to be stripped of their licenses for the abuse she sustained. That’s essentially what they did to Beata. They stripped her of her child, her family, her medical knowledge and credibility and they sentenced her to death! Disgusted!

People who don’t believe this could ever happen at a John’s Hopkins hospital-or ANY hospital-need to have their eyes opened. This happens at the majority of hospitals, and fear of retribution for reporting failures at any level is absolutely true. Which is why the most reliable, knowledgeable, highly qualified and trustworthy nurses with pride in their work have left nursing in droves and are being replaced with poorly educated, lower-quality workers.
This evidence is far from surprising to me, and I absolutely believe it to be true. However, the hospital has deep pockets and will most certainly appeal, which will drag this out for years. I hope they eventually get their *sses handed to them and that the plaintiff prevails.

What concerns me is that the door had to be opened to expose this. It should have been part of Maya’s case from the beginning!
If I was a juror, and I haven’t been following this case, I would doubt the credibility of the defense’s case because it presents itself like they are trying to hide something.
This reminds me of the Massachusetts Drug Lab cases, where the Judge makes a premature decision that the lab tech caught doing meth at her station only occurred within a 7 month period. When they had done no investigation and evidence that the defense fought to see for years showed that she had been doing drugs the entire 9 years she worked for the lab. You can't say that there is systemic issues with the hospital from the date of the report. The issues had to have been going on for some time for the findings to come to light.

As far as I understood it, sanctions will be decided after closing statements and jury instructions so that the jury can start deliberating.

The defense doesn't get to be mad at the judge right now. This is the second time they've majorly stepped in it and asked questions that have opened the doors to things that would have initially been deemed more prejudicial than probabative. The last time the judge ruled in favor of the defense, but made it clear they set up a situation where no matter the judge's decision, a mistrial could be declared. The plaintiff just decided not to ask for one.
This happening a second time, and i think it was the same lawyer, i can't help but wonder if it was intentional and they just thought they could get away with it
Curative instruction sounds to me like a bailout for the defense.
