What sucks is UA-cam Often prefers to issue restrictions on it's content creators. Rather than do reforms on their own. It's flat out lazy. I'm no content creator. This is just an outside looking in perspective. I don't know anything. That's just how it looks.

I have always hated when people tell you what you do or make is directed at and then punish you for it.
I just hate in general when someone else decides they know better about YOU and then PUNISH YOU for something THEY arbitrarily decide YOU need punished for.

While I understand the frustration, I feel I must point this out:
The FTC doesn't actually care about the content. The aim is not to fairly divide what what content is for children and what is not.
The point is to ruin UA-cam.
You ruin UA-cam by targeting their customers, because their customers are the ones who create content for the site.
Google is devolving responsibility to the creators themselves. Other than their initial fine they're unlikely to face action taken directly against them.
UA-cam was not originally a kids platform. FTC are idiots.

They need to make the existence of UA-cam Kids more widely known. Seriously, YT has an entire child-friendly version of their platform, this COPPA meltdown is entirely unnecessary.

We shouldn't protect children from stuff in this way. I feel like a lot of parents are REALLY overprotective and didn't take any parenting classes if we end up in situations like this. From UA-cam's COPPA video and the guidelines they set, a lot of the requirements are more general and lacking contextual relevancy. Within these guidelines it could be argued for majority of videos on UA-cam whether or not they are child-focused.
Argued being the operative word.
Arguing is time consuming and often proves that the bigwigs are wrong when UA-camrs, trained by years of this shit, present facts. All a process big folks like FTC don't want to spend the time on, tell YT they don't want to spend the time on, and so will let FTC scattershot down just because it's easier. I mean the press chap literally likens it to "shooting fish in a barrel"
You can still argue, if you want to lawyer up and have the cash to do it. But not everyone does and thus compliance-for-survival comes into effect.
@@EditEdward A policy like this could then infect the safety of other videos, especially with the addition of any song or poem that could be added to a video. Or even talking about media centered around content made for children. More of a purge attempt for control.
This is a blatant violation of our First and Eighth Amendment. I wish someone that actually cared had the cash to sue the FTC for this.

I hate how parents think that the games, videos, etc are the problem. Nothing boils my blood more than that. There’s a thing called saying “no” to your kids, not to the source. If my 8 year old was watching a violent bloody video then I would take away whatever device they were holding and tell them to not watch it because it was clearly not for them. If I owned a porn company and get a call from a mother telling me to stop making porn that attracts her 12 year old son and start making porn with more clothing on the stars, or something ridiculous like that, so that it’s acceptable to her preference and for her son to watch, then I would tell her to start being a parent with common sense and tell their son to stop watching porn in the first place, THEN hang up! I don’t want any government to tell me what to do because of an audience that I clearly wasn’t aiming towards was complaining to me to change what I do and love! That’s MY job and MY choice!!!

But in all seriousness this is ridiculous, you shouldn't be under any kind of legal fire if you mark your content as not suitable for children.

The issue here is that under USA COPPA, internet sites are not allowed to collect cookies from children, and youtube was sued 175 millions dollars for doing just that. So youtube wants to make sure that doesn't happen again, hence the child thing. Their concern isn't for the safety of the children. Their concern is not getting sued for collecting childrens' data, hence the choosing what is children's content vs. what isn't and why they decide what is vs. what isn't.
They want to make sure that everything that kids might possibly watch is marked so that they don't collect cookies on those videos because if they are found the be collecting cookies on a video "aimed at children" that they decided was not aimed at children, they are liable for damages.
So instead, they have put that responsibility solely on the creator and let the FTC (Federal Trade Commission, the people behind COPPA and a bunch of aging, out-of-touch politicians) police it. So long as it is the content creators who are responsible for evaluating their videos based on a list of vague, nonspecific rules, youtube can't be held accountable.

As a college undergraduate going for a BS (Bachelorette of Science for you Brits, Bachelors of Science here in the US) in Accounting and in Business Administration, I had to take a class on Business Law which is basically an overview of some topics that deal with Business.
I by no means am a lawyer nor am I specified in California Federal Law (Which is the district in which UA-cam would most likely be taken to court in), but I can say this: from what I remember, there is case law in the US which deals with someone in the business (in the case of a UA-cam channel that would be its creator most likely) claiming that something is one way, but the courts looking at it objectively and determining the case not to be so (in this case, the creator claiming the channel is not for kids-which you say you have done- and the courts overruling that claim by stating that your channel should be for kids). I will try to do a little research when I get some time off of class and work to point out which cases deal with this topic to back up the above statement ASAP.
The important thing to note is that if there is case law on this, as I believe there is, then that creates a precedent for the courts and depending on the case, judge and evidence provided that precedent can be very hard to overcome.
Once again: I AM NOT A LAWYER NOR DO I SPECIALIZE IN CALIFORNIA DISTRICT COURT LAW. Please look up the information to verify it yourself if you have an interest now.

UA-cam is a website for everyone. There are a few rules but is mostly open for anyone to do what they want. You want to do the cinnamon challenge and risk permanent lung damage? Go for it! UA-cam itself is not a kid friendly place. Punishing everyone because some didn't read or listen to the warnings is ridiculous. A simple "this video is not kid friendly" either spoke or put on the screen should be enough.
This is the same as a parent walking into a video store with a child , (people remember those right?). The parent leaves them in this kid section while they bugger off somewhere else. The unsupervised child then leaves the safe kiddie section and explores the rest of the shop,. They look at all the horror, violence, action, romance, sci fi films, possibly even the porn section. The parent returns to find little Timmy, freaks out and demands everything become kid friendly only. All because the parent didn't do their job and supervise the kid. It is the job of the parent not the store/ website/ mobile phone to raise/supervise/ babysit their child.
Unless you're a toy company you shouldn't be concerned with advertising towards chicken. This bullshit is just another excess to tighten the chokehold on creative freedom

To parents: Somehow, someday, your child's innocence will end or be shattered. if it doesn't happen by learning swear words at school or finding things above their age-grade as usual. (movies, games, magazines, older children being mean etc) being twelve and hearing the song the internet is for porn doesn't irreparably damage you. so much of this child worship weakness makes me sick. to the content creators: You've done more for this platform then it will ever concede or realize. and its about time to pool together with fellow creators in your genre or subject to get your audience somewhere where they can share and view without hinderance or bs.
