  • It is not uncommon for law enforcement agents to call and ask you to come into the police department of your own will. But should you do it? Attorney Benson Varghese provides insights into these situations.

Police do not EVER have your best interests at heart. If they're speaking to you, then you're in their sights as a possible target. They are allowed to lie to you, but it's a crime if you lie to them. The hypocrisy is staggering, and many, many innocent people have gone to jail/prison for trusting the police and speaking to them. They see apprehensions and convictions as a means to justify their existence, so they don't really care about guilt or innocence, just whether they can make you give them an excuse to do it. The courts are complicit in this dirty little setup, as they will take police testimony as evidence, always assuming it is true, and you are guilty until proven innocent regardless of what anyone tells you. Remember this if you ever have the misfortune of dealing with a police officer of any description.

Correct, talking almost never help you. Everybody should remember the Ramsey case back from the 90s and the little girl kid in a big Chateau and nobody ever found the inside of the court room. All the police had as theory on what happen. The family member did NOT speak to the police.

Did I miss something? The lawyer didn't say what to do, so I will say it. Either don't take the call, or tell the detective you are remaining silent and will never talk to the police without a lawyer present, then request a lawyer and politely say goodbye and hang up. For an in presence encounter, say you are going to remain silent, request a lawyer, the actually remain silent except to further assert rights such as, “I don't consent to any searches or seizures,” etc.

    • @quacks2much
      @quacks2much 9 місяців тому +3

@@freddieknapp9337 Contacting your attorney is not asserting the right to an attorney. You must unambiguously ask for an attorney, or you get ridiculous court rulings that say things like "I want a lawyer [, ] dog" is ambiguous because you may have been asking for a dog, not a lawyer.
Only a lawyer who is a judge could use enough sophistry to claim asking for a lawyer, dog is asking for a literal canine.
As a former cop, I was amazed at how incompetent so many attorneys were. On the other hand, some of them were so good that on cross-examination I would doubt myself whether I was right.

"They don't have to tell you you have the right to an attorney because at that point you don't."
If you're there voluntarily, you can just leave. You can go get an attorney whenever you want.
If they decide to impede you then you are under arrest at which point you also have the right to an attorney.
But obviously never talk to cops, they're also angling for a way to jam you up. ALWAYS. ALL THE TIME. ALL COPS. Even when they aren't trying to jam you up, you have to behave as if they are because they can change their mind at any time. This means there are no benefits to talking to cops (unless you need an insurance report for stolen property). Outside of that situation talking to cops only harms you.

Unless maybe you are discussing the weather, don't ever talk to cops. They are not your friend, they are not on your side, and unless you are a cop yourself or related to a cop, they don't really give a damn about you. It's like a feudal Japanese serf talking to a Samurai and expecting anything good to come of it.

    • @hubster4477

That leads to my question.. what if you just never answer their calls or voice mails? How can they prove you ever actually received them without more warrants and work on their part? The best thing about a phone is that there are no laws that make you answer or use them for a particular purpose.

In a similar video, another lawyer says if you ignore them, they're more likely o become more aggressive - coming to your home and perhaps getting a warrant. He basically says you can buy yourself some time by calling the detective back but not giving any information other than confirming your identity (name, that's it). Then just say you aren't answering questions now, or that you will have your lawyer call them back. This other lawyer says that if he calls the detective, he generally just asks the detective questions (what is this case about, what information are you looking for, what evidence do you have, etc.) and that's basically it. Generally, he says don't answer any questions at all, even things that seem basic and like they would have nothing to do with you or anyone committing a crime.

If i was in any way, shape or form involved in anything illegal , or even if some one has a ax to grind with you , I would not say one word, not even confirm your name , And if you are 100% innocent of any possible charge i would still refrain from making a statement , but if you feel the need , don,t say anything that can not be 100% backed up with evidence or witnesses. Bottom line is you do not want to put your self in the position of needing a lawyer.

My husband got temporary restraining order against me after lying to the court that I hit and abuse him verbally and threw me out of the house, got the full custody of my 5 years old daughter but I went to the police department to tell them that I didn’t abuse or hit him,I explained everything and told them everything that happened in the last years my husband has a history of domestic violence. The police called a detective she interviewed me and said you said different things in the video interview. She’s calling me back to the police department for second investigation. Should I be worried?

A policeman once called me and told me to come to the police station to discuss an incident.
I contacted a lawyer and asked for advice.
She said, go and see him, “Say nothing”
I went online and downloaded a copy of “How to deal with a police interrogation” put out by the QLD police, what was their advice? “SAY NOTHING”
I followed her advice and the policeman after realizing I wasn’t going to talk simply walked out saying “ we will get back to you.
I never heard from him again, end of the story.
SAY NOTHING, SAY NOTHING, SAY NOTHING, SAY NOTHING, SAY NOTHING.
Tip: act confident don’t be intimidated.
There are a lot of people sitting in jail because they opened their mouths.

In the UK, I don't think that is always true. If you admit to offences they are able to pin on you anyway, you might get a better outcome. A 'conditional caution' can be dished out by the police, and then no courts are involved.

Don't answer the cop. Make no statements. Invoke your right to have a lawyer present during questioning. Give no consent to search your body, your vehicle, your phone/camera/personal property, your dwelling, your briefcase or suitcase, anyplace you happen to be visiting or a passenger inside. Just say "no, thank you. I want a lawyer". Make sure to record everything that is said on both sides. THIS WILL PISS THE COPS OFF. TOO BAD FOR THEM. DON'T LET THEM INTIMIDATE YOU WITH THREATS.
