    I don't know why lawyers expect you to understand the legal process of your case without telling you anything. If I understood how it all works I wouldn't need a lawyer.

    • @ThinkLegal

      Good ones don't expect you to know how the legal process works; unfortunately, we get a lot of clients that think they know more than they do. They try to tell us how to handle a case so we get jaded about it. I'm not saying every client or that it is right but we are imperfect people working in an imperfect system trying to get the best result possible.

    My sister hired an attorney to help get the retirement benefits from her ex-husband. This attorney literally played games with her. He didn't file the necessary papers. He used the courts to lie. Now we have file a grievance with the State Bar. He is lying to the the State Bar.His unprofessional misconduct continues. We will fight this vigorously.

      No she did not, we filed 3 grievances with the Texas State, the so called investigator, and mind you he had to hire an attorney to defend him. The Texas State Bar sided with the crooked attorney because his father is a Texas Judge. DO NOT TRUST OR BE HOPEFUL OF THE TEXAS STATE BAR.

      I had an attorney that treated me the same way. My son was killed in a auto accident that was 100% the other drivers fault. I was under duress . looking back, all I want to do is turn him in to the Bar. Out of principal. He definitely over promised and didn't deliver. In fact, he treated me like I was out of line asking questions about anything regarding the case. He said that the insurance company was only going to pay out 25,000 dollars and me being dumb about it, that's what I agreed to.

      I'm having the same problem with my attorney. She would not file and kept requesting more money. She didn't keep me updated on the progress and kept asking for more money. I didn't have any more credit and then my sister got diagnosed with ALS. Now that my sister has passed away and I paid off the lawyer debt, I'm trying again. Mine does the same shenanigans, and when the hearing I wait months for he is sick, on vacation or tries to settle by lying to me, things I would never agree to. Hiring him made my family law case a thousand times worse filing motions I never know about. I’ll be homeless by the end of it with his nonsense billing. I find out later he is friends with the opposition, and he bills me for calls, when I haven’t even spoken two him in months. At least 2000.00 a month in charges for absolutely abusing my finances, and my child, and even the opposite defendant attorney doing the same. It’s a 50 billion dollar a year industry just in family law. Nobody wins. They kids are damaged, and their future money or memories are now trauma of the court. My son is going through a divorce so he hired an attorney who promptly took his $5,000 and then proceeded to tell him why he was going to lose. He told my son that he had no chance at split custody or full custody, and he told my son because he was self-employed that a judge would automatically assume that he made twice as much as he claimed on his income taxes. My son had videos of his wife exhibiting violent behavior toward him in his attorney said he did not want to see them. He took a few phone calls from his wife's attorney and exchanged a few emails and came to court with him for about an hour one time then he claimed he needed more money. He was absolutely worthless and made me feel as if my son's wife had two attorneys and my son had zero. And the thing is it shouldn't be a complicated divorce because they really didn't have that much in the way of marital property. I feel as if this attorney stole my son's $5,000.

    • @ThinkLegal
      @ThinkLegal  2 роки тому +9

      I don't know the terms of the client engagement agreement, but if I were your son, I would review it and a copy of your son's bill. Depending on your state, you might be able to request fee arbitration. Sometimes it looks like an attorney isn't doing something when they are, so it's essential to keep track of the costs with the bills they send. Also, they may require an ever-green retainer which means they haven't used all the funds yet but want to make sure the funds are there for when the attorney needs them. But, again, without knowing more about the situation, it's hard to speculate.

    Personality is definitely important. The attorney who helped me with my social security disability claim for my autism was honest about the strengths and weaknesses of my case, didn't promise anything he couldn't deliver on, and told we what he thought my actual chance was of winning was. He also took the time to explain everything in a way that was easy to understand. Autistic people tend to be blunt and to the point, and we typically have a very low patience level for dishonesty of any kind. And because of my social limitations and attention deficit, I need things explained to me slowly and in unambiguous terms. After talking to him for a few minutes, it was clear he was the right attorney for me. And we won the case because of both his skill and our ability to work together. That was especially important during the hearing. My attorney made his opening statement. The judge asked me some questions. And then my attorney was permitted to ask me a series of questions to bring additional evidence to light. To prepare for it, he told me to answer any question honestly but to never volunteer information. I followed his instructions and, in spite of my social awkwardness, was able to do very well during the hearing. As did my attorney. But with another attorney it could have been a disaster.

    Thanks for the insight. I have a personal injury case for a mva, back in 2017. I had two wrecks within one week. Both were cut and dry, as both insurance companies accepted liability for their insured, hitting me from behind, due to not paying attention (talk about bad luck/coincidence). One case settled back in 2019. I was left very uncomfortable as the attorney that accompanied me to the mediation were friends with the opposing counsel's rep. He spent a majority of the meeting chatting and catching up with him, in the hall. He told me not to think much into it, because it happens often. Needless to say, his tone changed and confident / "we're going to get it done," attitude, was out of the window. We departed without settling the second case. Fast forward, there has been minimal communication. Only when a possible trial setting was upon us.
    I made clear that I wanted to be apart of every aspect of my case and would be okay with monthly updates since communication isn't their strong suit. I was notified by the firm in April of this year, that trial would be in three days. Because of the admitted constant turnover, no one was prepared to go to trial. It was my absolute wish to go to trial. I was told that it was a bad decision to do so and that a jury would look at me and award nothing, as I present, "well." They procrastinated until they made me aware that it would be too late to answer the court. 🤷🏽‍♀️ Knowing that it was a bad idea now, I asked the firm, on several occasions what I needed to do to move my case to another firm, as I did not feel that my best interest was that of the firm. Of course, I was warned against it and told that they would increase their fee and after it was all said and done, that I would walk away with nothing. I was asked time and time again to allow them to fix the issues and being new staff up to par. I think it goes without saying that it was just hot air.
    Going back to April, one of the attorneys reached out and stated that they were at a point to settle. He had no idea that the first case was settled in 2019. Because of how the case went and in an effort to prevent me from continuing to insist on trial, they asked what could be done to make this go away...basically to give them a number. The litigation attorney jumped on the call and falsely stated that I signed a document back in 2019 to settle for $500. When I denied it because it never happened and asked for my ink signature, he stated that he misspoke. Per usual, I asked for the numbers and what the case settled for, in total. He told me that it wasn't important. After about three conversations, I was told $24,000 and that $12,000 had to go to medical bills. I asked if that was a firm number. I was assured that it was. Because $12,000 would be left and they could absolutely not take it to trial, I, reluctantly, agreed to split the remainder which would mean $6,000, for me. I was told that it would take anywhere from six to eight weeks. I stated that my number was contingent upon information given and that if anything change, to notify me. He agreed. When that time frame passed, I called and spoke to the new paralegal. When asked about the numbers and reductions, she stated that the case settled for $28,000 and with reductions, medical was only $7,200. When presenting this information to the attorney, he became very upset and said that it had nothing to do with me and that because I agreed to $6,000 that it was all that I would get. I did agree, but it was based upon dishonest facts.
    This attorney has been with the firm for two years, but April 2022 was the first that I ever heard from him. I have since called and tried to express my grievances with him and the fact that I was lied to, but he refuses to talk. When they transfer the call to him, he states that he's busy and has other clients to tend to. He states that he doesn't have time to deal with me (his words). Just as recent as today, he said, everything that I have to say is irrelevant because as long as I agreed to the $6000, anything else is irrelevant. There is a lot more that has happened, but I believe that these are the most egregious. What, if anything can be done? Thanks for any insight.

    • @ThinkLegal
      @ThinkLegal  2 роки тому +4

      I would start with reviewing your client engagement agreement and see what it says. It's rare that you would get a fixed amount. It's more common that you get a percentage of the net recovery. It should be outlined in the agreement and most agreements can't be modified except in writing.

      Sounds a lot like my crooked unethical greedy attorney who gets very upset when I caught him in lies after lies. Agreed to a partial $6,000 settlement to let one of the defendants out, and I got nothing. Then basically loses my case with another defendant and filed a motion to withdraw from my case with a bunch of lies, then sent medical doctors to me for payment. This was a slip and fall case. I'm definitely filing a complaint with the board of ethics and bar association. You should do the same.

      Your attorney stole your money which is unethical and he could lose his license. Did you get a copy of the original check from the insurance company? Also make sure you received a copy of all deductions from your settlement. Your medical bills should've been paid from the insurance company. Contact them to get a copy of what they paid during your treatment. Any medical bills left over can be negotiated and lowered, which is probably what the attorney did without you knowing those bills are always lowered. The doctors should be listed on your disbursement sheet of all deductions, so I would call and ask for a copy of the check that the attorney sent them. You can get proof of his lies and contact the bar association or get a legal aid attorney to assist you. It's a lot of work but he needs to be disbarred. He's done this before and he'll get audited for past cases too!!

He was by the hour & I truly think he’s in cahoots with the d.a delaying everything to squeeze more money out of me. He also over-billed me for time spent in court. I was in court with him for literally 5 minutes & he charged me 45 mins & he did the same thing all 5 other court appearances he charged for way more time then he was actually there. He was 25 minutes late to court today and then when he got there we were done 15 mins later and he charged me for 35 mins. It took him almost 3 months to send me an invoice of how many hours he put towards my case but by the time I got it he was way over the retainer fee I paid. 4 days prior when I asked he said he was getting close to using up the retainer money so in only 4 days he supposedly spent 3+ hours on my case that’s still being dragged out. He’s fired & I’m not paying his lying low life a** any more money. Never again. Now I need to find a new lawyer & I’m down $1000. Great.

      Getting you to get a statement that isn't used is common and there are a number of reasons why the statement might not be used. It could be that it wasn't useful, or it could be an additional statement that was already covered by other things. But, the rest of it seems pretty bad.
      Attorneys often times have to decide which witnesses and which statements to use at trial. I was on jury duty for about a month one time on a complicated dispute between a developer and the general contractor. There were so many counts that the judge just polled us on each count rather than asking us individually to give a verdict on each count.
      Mind you that was nearly a month after the parties and judge sat down to figure out how to reduce the amount of stuff that needed to be covered at trial. IIRC, it took over a thousand potential jurors just to get the 10 that were needed to handle the civil case. (A civil case, IIRC, that only needed 8 jurors plus 2 alternates or something along those lines)

    A couple personal tips, I ran into are, red flags. A couple of them are over sharing personal information, like health or family or other personal information, I recommend interviews and seeing how they all speak. How they engage with the client is really important. If they are trying to sell their service to you, of course they may share some personal stuff, but if they're talking about themselves or health issues alot, it can be a red flag that they may not be current on standards of professional communication, or that they might be trying to play a game with you in a way, to make you feel more attached to them or sorry for them, or become your"friend". Most attorneys don't become true friends with people they represent, although I'm sure occasionally that can happen. My communication training teaches that there is a line in sharing though, one is called inappropriate self disclosure, and one is unnecessary self disclosure. Obviously, inappropriate would be like if you're wife cheated on you and you're having a bad day, unnecessary is more like, I have a bunch of doctors appointments to go to or I'm in AA.
    If the attorney is working after hours, and/or sounds like they have been drinking or makes mistakes after hours, that's another red flag. Attorneys should not be working after hours, under the influence, or making mistakes when they're tired after hours or talking about things they shouldn't be with the family of the client. I think red flags are pretty much an encompassing nature regarding boundaries. Definitely add that to your vlog! I love your video. I'm doing a lot of research and it helps! Thank you!
    Also I would love to DM you a question that might be good for your public page. I'm stumped or at least moving really slowly in my research to this question. Thank you!

      Without knowing your specific case or attorney I can’t say why he isn’t very communicative. Sometimes there’s nothing to communicate and rather than sending you a message that essentially says nothing, he’s waiting for there something to say.
      That being said, if you don’t like his lack of communication, it’s important to discuss it with him. If he still doesn’t communicate effectively, it might be time to find new counsel.
      It also depends on how close you are to trial or settlement. Finding counsel toward the end of your case can be difficult.

      @@DJTREO650 Generally you are not stuck with them, you'd need to check your client engagement agreement to specify what your options are but you should be able to discharge them at any time. However, depending on the work they have done thus far, they might be entitled to some compensation. They will likely place a lien for the amount they have earned so far on the settlement (if there is any). Again, it depends on the state and what the engagement agreement says.

I’ve spoke with this attorney along with the 3rd attorney only once and she passed away. He got this attorney n meet with him a week ago n I’ve reached out 3 times in a week n half n left messages and still can’t get any call or response. Idk what to do? The first attorney was during Covid n all was still. He didn’t even get in touch with my son for 6 months. He withdrew when he got a let go letter. The 2nd attorney not once got in touch with my son for 7 months and when the first court date came, this 2nd attorney told the court he isn’t representing my son. I knew that attorney couldn’t take my sons case because I knew he couldn’t because he couldn’t as I knew he knew victims family. But why wait 7 months? He should of recused automatically instead of letting 7 months go by. The 3rd attorney passed away n not once even filed for discovery as the 4th attorney now told me so. But now this attorney I feel good with won’t return my calls at all. It’s been a year n he hasn’t talk to my son but once n it’s almost a year n met me once. This is terrible and very important. I have a lawyer right now, first one ever, not only didn't have any of these traits (except one I can mention in a moment) they exceed in all of the errors. The one quality I worry about is rudeness. Lots of the times it could just be that it's related to things I don't know, but I truly think he's rude to people or doesn't know that he is coming across like that. He responds to all of my comments near immediately since I started with him about a year ago. We have yet to work with the judge but one party has settled, and we have a settlement conference vs the other party end of next month. So far he has left me extremely satisfied. I could just have thin skin related to rudeness. Examples are things like "you need to pull yourself together" or telling me I don't know what I'm talking about as a few examples.

So, while not excusing his or her actions, several factors might be at issue here. First, the insurance company might be playing hardball. They could be intentionally delaying the case to get a lower settlement amount. Second, court cases usually proceed slower than most people prefer, and sometimes there's nothing to report, so the attorney doesn't. Third, the attorney could just be crazy busy. Again, I want to emphasize I am not making excuses for his or her actions but trying to at least give reasons for them. While many people attribute things to malevolence, it's equally as likely that it's something else entirely. In regards to what can be done, review your client engagement agreement. However, the engagement agreement might have a lien on future settlements, so please make sure your new attorney reviews the client engagement agreement thoroughly.

    I just read an article, the title was "9 types of difficult legal clients and how to handle them". The article proceeded to describe different types of clients with names to indicate what was difficult about them. For example something like Irritating Irma, or Defensive Dora. A desperate attempt by someone in the legal profession to put the blame on the client for not getting the job done. In fact, the truth is very much the opposite. The real problem is " how a client should handle a difficult lawyer."

    • @ThinkLegal
      @ThinkLegal  Рік тому

      There's a disconnect between clients and lawyers. Lawyers sometimes do a terrible job explaining what's happening, and sometimes clients have unrealistic expectations of what an attorney can do. The media does not portray attorneys accurately. They tend to paint us as either incompetent (public defenders) or as super heroes that can do anything without regard to the actual law. So it's important that both parties work together to achieve the desired results. Public attorneys are generally some of the best attorneys to have but they can be overworked. We have strict rules we have to abide by and can lose our license if we are not careful so we have to help clients get the best results within the confines of the law and the rules of professional conduct.

My last atty literally got half my case dismissed losing me over $500Kplus! And damages can be proven. The court of Appeals basically says this and local atty confirmed its sue-able. This guy that screwed me passed me off to his friend before I could even digest what he did. This new guy has just missed a big deadline also!! It is a $1.5 Million case involving family business stocks. I am sole heir because my brother died in accident. Lost all my family. Aunt took advantage. I am not a wayward. I am luckily middle class income well enough off on my own but being screwed over and over from out of state. These attys keep taking all my $$ and getting me nowhere.
    I am literally in tears. Feeling hopeless. How can this be EVERY atty out of 5 bad?? !! It is impossible to find a descent atty in Indiana...let alone one to sue another. Should I go to the judge and tell him what is going on? He sees that this atty just missed deadline and had to appear for request for relief. Everyone sees 5 attys and thinks it me... Unless they look and see all the missed deadlines on dockets x 8yrs. I even have this last guy on recording yelling at me for questioning why. He just left for vacay and left me in hanging with stuff due next week. I feel I need to act while he is gone. Do I alert the judge what is going on and that I feel like I am being forced to drop case due to so many bad attys? There is another $1.5Mill on line. I should NOT have to let my aunt get away with this just because I can't find descent atty.

    I got a lawyer that said he would give me 3 free court appearances and charge and $500 for each court appearance after that. I thought that was a great deal because I expect he would just request an acquittal since there was no evidence of a crime let alone that I committed it. It was just my accusers word against mine. But then he kept requesting an adjournment to a later date. I should have fired him after the third time but he did it a gain. I didn't have to fire him since he then requested to be removed from my case. Then he had the nerve to send me a bill for the 5th appearance in which all he did was quit.
    I didn't pay it, but he managed to rip me off a thousand dollars and cause me to come to court for nothing 5 times. and two more times as I requested a public defender.

    We hired a criminal defense lawyer in Aug 2021 … this is Jan 2023 and case is just now coming to end. They’ve taken $32k…. We hired one certain attorney (so we thought) and now are on the 4th attorney! There was no defense given, they claimed to mail out a copy of the evidence to me and I never received it, the state made an offer so they made one counter offer, was told to take deal or go to trial after stating trial is not a good option then they called requesting $10k more for attorney fees! They refuse to give me our case file (after requesting repeatedly) they will not give us a breakdown of where the money went! COMMUNICATION… try months of no communication from them! They dropped the ball on several issues! There was a paper signed to where court appearances was waived so a court date was missed and incarceration took place! Come to find out if was a mandatory appearance and the lawyer NEVER reached out!!! The lawyer even told judge during arraignment it was on them as to why the date was missed! There’s too much to even address!

    I had a pro bono attorney... but he wasn't really pro bono. Turns out that my case involved a statute which, if invoked, would provide an award of attorney fees from the opposing party. He filed an motion for summary judgment on the issue, and, sure enough, the judge ruled in our favor and awarded the fees. But the judge had already "pre-judged" the case, and he unwittingly "published" his intent to rule on the other issues in the plaintiff's favor in the (otherwise unrelated) order for summary judgment. This prejudice, of course, disqualified him as biased. But ALSO created a conflict of interest for our attorney: if our attorney informed us of the bias, the judge would be removed, the order vacated, and his "bonus" fees would be lost. And so he took the chance and did not tell us about either the judge's bias or his conflict of interest. (Naturally, the other side was thrilled and didn't say a word.) At mediation, however, he tried to talk us into settling for NOTHING, just as the judge intended to rule. We did not. He grew desperate and ultimately said "Look, the judge is a loose cannon who has already made up his mind and doesn't like to be told he's wrong. He will NOT change his mind." Immediately, he knew he messed up, because we knew that judges were NOT supposed to do that. We asked him to explain his remarks, and he REFUSED. So we fired him. Later, we saw the judge's biased remarks in the order for summary judgment. It turns out that not only were the judge's conclusions inappropriately expressed, but it was an incorrect legal conclusion, too. But our attorney's bad acts were not yet finished: after letting the judge's misconduct slip, he sent a lengthy email to the pro bono referral agency in which he shared massive amounts of confidential information, including direct quotes by us and other information about our case. He mentioned nothing about the judge, but spent some words calling us his "worst clients" of his career.
    OUR CONCLUSION: The judge's disqualifying remarks rendered the judgment void on its face. And by acting in his own favor in an undisclosed conflict of intrerest, our attorney's misconduct resulted in a FRAUD UPON THE COURT which we intend to have removed in a motion pursuant Rule 60. Technically, because the orders and judgments by this judge are all void, even our attorney's release is not worth the paper it is printed on.

    The probate attorney has twice not informed us a document needed to be filed, first was a inventory of assets, and now a annual estate accounting, we only learn items are needed when we get a letter from the court saying it is past due, for example on 8/19/23 we got a letter from court saying the annual accounting was due on May 27th 2023, and we have 20 days to file the document. This is maddening, not sure even what is needed for this, however if history serves, phone calls and e mails are generally not answered for on average 3 to 4 weeks despite many attempts to contact her. We hired probate attorney to guide and advise us, yet in most cases outside sources are where information is gathered. It has come to the point that she can’t be relied on even for simple standard filings to be done, it is left up to us to ensure they get done. I have tried to ask her how we can better communicate but she just acts as if it isn’t important. Not sure what to do.

    I was hit by a semi 2 years ago. The truck driver is at fault, which is stated in my accident report. My neck, shoulder and especially my wrist are damaged. I’ve had countless Injections in my neck, 2 epidural injections, prp injections and finally wrist surgery. My attorney and I have butt heads a couple times in the beginning. As soon as I say I’m looking for another firm, he blows up my phone asking what he can do to fix the situation. Now, we filed a lawsuit and my trial date is in August of 2023. I need a loan so I can survive during this whole process, which the litigation attorney said was not a problem. I moved in with my 77 year old dad out of state, I can’t work because my wrist is still injured, I’ve maxed out credit cards, etc. My main attorney is supposed to set it up for me, but he’s busy working on another law firm in a different state. The litigation attorney is trying his best, it’s been two weeks since I requested the loan, but I’m overall not satisfied with the main attorney. I feel helpless to the point I’m taking depression medication. I’ve never felt this bad in my life. I just wanted an attorney I could trust. That’s what I get for not researching enough and believing reviews on Google.

      I'm sorry to hear about what you're going through. While I've never been seriously injured in a car accident, I have dealt with my fair share of insurance companies and medical staff that could seemingly care less about my clients' and my wellbeing. It's entirely possible that it's the loan company that is the delay and not the attorney. The most common complaint attorneys get are that they don't communicate with their clients enough. While that's partially true, the wheels of justice do not turn quickly. So, many times it's that the attorney doesn't have something to report so they don't contact the client to report nothing. When a client signs with me, I send them a welcome letter that outlines my communication policy, so my clients know what to expect and they have realistic expectations. I'm sorry that your attorneys either did not provide their communication policy or do not follow it. I hope you are able to find the relief that you need soon.

    My former attorney missed a deadline, resulting in a lien placed on my home. I gave him an opportunity to correct the mistake. He continued to bill me for his mistake and then demanded more money before discovering the conversation he had with the opposing attorney. Finally he said the opposing attorney said the deadline was met and the property lien was solely my fault. WTH!! I demanded he get proof from the other attorney, but he didn't like that. He said he and his staff worked on my case, so he said. One big problem if the opposing attorney did admit that he ignored the written request was that my attorney should had informed her she is in violation of the Fair Collection Act and demanded the removal of the lien. This wasn't expressed to me by my attorney he was only trying to deflect responsibility onto me. The bottom line he wasn't hired to defend a property lien. It became a property lien case due to his neglect.

    I was only told about a retainer fee $500 not $500 an hr to do not much. Been to court 2x on victim restitution case and third one in couple weeks. I provided him the crash report and my insurance. I could litigated with other party been done. Example I had I lady hit my car I called her and insurance and already got reimbursed. So why does he not know what damages are? I had full coverage so surely up to 50k property damage should be adequate. Rule I didn’t need a bad lawyer and could have done this with my insurance and them communicating with the other party.

    You just taught me, why my attorney kept bugging me to know if I had done anything wrong. He wanted that info to use against me. When I finally got my client file, after firing him, I read through it and found no notes of him actually reading discovery. When I questioned him, he said, that was his, so according to what you just said, that was egregious. I don't believe he actually read all of the discovery, which was 50 years of medical records, and that's why I looked for proof that he did. I just sent my complaint to the bar. I don’t know your exact situation so please take this as general advice for consuming legal services. First, talk to different attorneys before deciding on one. Second, be an educated consumer. Do some basic research on your legal matter but recognize your attorney will know more. Third, write out your questions so you get them answered via email or while speaking with your attorney. Find an attorney who works based on a flat fee rather than hourly (if your jurisdiction allows it). The risk for your case is spread more equitably. If you’ve exhausted all your options with your current attorney, you can find a new and better attorney.
