Police want to talk to me will I look guilty if I get a lawyer?

  • Imagine you get a call from a police officer. They want you to call them back because they have a few questions. You may or may not know what they want to ask you about. Regardless of whether you are completely innocent and have nothing to hide, or whether you think you may be in some trouble, one common question I get is "If I hire a lawyer will I look guilty?"
    The answer is no. The reason you won't look guilty is that it is often the first thing a lawyer, police officer or anyone else that works in the criminal justice system would do, whether they are guilty or innocent. Why? Because there could be a lot at risk. Most people have heard the horror stories of innocent people being found guilty at trial, sent to prison for 10, 20 or 30 years, only to find out after all that time through DNA testing or a confession from someone else that the person that was found guilty was actually innocent the whole time. That's a long way of saying that just because you are innocent does not mean that the police, judge, prosecutor, jury, or even your own lawyer will get it right.
    Having the advice of a lawyer BEFORE you make a decision about whether to talk to the police can make a big difference. One common misunderstanding is that if you get a lawyer that means you won't talk to police. That's not accurate. There are times that lawyers will advice clients to talk to police, but if we do that, we will come WITH you so that it doesn't end up taking a wrong turn. There have also been many instances where a good criminal defense lawyer will advise our client NOT to talk to police, even when you are 100 percent innocent. Why? Because if it's not broken you don't fix it. There's too much at risk. For example, let's say you're accused of a crime and it's a classic "he said/he said." Other times it makes sense to talk, but that decision is based on the unique facts and circumstances of your situation. You're better off with legal advice.
    An experienced criminal defense lawyer can go over the pros and cons with you, including factors that you aren't even aware of. We can also act as an intermediary between you and the police, protecting your interests and safeguarding against either A) a wrongful charge; or B) making your situation worse than it already may be.
    At the end of the day, always remember this: you have an absolute right to remain silent. No amount of pressure can change that. Any good officer will absolutely honor your right to take time to talk with a lawyer before you make the important decision of whether to answer any questions that police, detectives or investigators may want to ask you.

    Don't ever talk to a detective on the phone either. They don't have to tell you ,. You are being recorded. It's all being recorded , & they don't need your consent.

    Here's a good question how do you know it's really the police it might be a scam

      @mat denis my question was about scams and telling the difference between a legit police detective calling you and a scammer calling you trying get you to use like a pre-paid gift card or something like that

    I have a detective calling my wife’s phone asking questions about me but I haven’t even been to the state he’s in in years. Do I call him or lawyer up first?
