I’m guessing everyone in this business knows about Convoy closing down.I am a carrier and I did a load for them.This is where it gets tricky.Booked a load from Convoy app which the actuall broker was Loadsmart.The rate confirmation was sent by Convoy with Loadsmart logo and address but there is stipulated in the rate that all payments should be directed to Convoy and not Loadsmart.What should I do next? Is there a possibility to file a claim on the brokers or go after the shipper?
Do you have to file a claim against their bond to seek payment before you can file a lawsuit? Also, can a broker refuse to payout a claim regardless of the outcome of investigation ?
Brokers can refute the claim with their evidence so it comes down to who has the stronger paper trail etc. you don’t have to file a claim before the lawsuit but getting paid out via bond claim is much less of an investment than getting lawyers involved. Brokers can’t refuse to pay out a claim if it’s granted.
I filled a claimagainst the broker. Nearly 60 days without payment. Bond is trying to contact broker and sort things out. Not sure where it is gonna take the case, but screw them. I did everything right

I don’t remove comments unless there is something offensive, profanity, or it’s advocating for another UA-cam channel. But Amazon won’t pay you you can’t wrestle with an organization that big alone Bond cases can be beaten by brokers. I helped a student Beat a bond claim the other day all it takes is for the brokers evidence and back up to be more organized than yours. I would hand this off to a collections agency who will have the ability to sue everyone on your behalf. They’ll take a small percentage relative to the work they do to help you. @freightskills Thanks, Luis. I contacted a really good collector in Olive Branch, MS. They said they are settling with Amazon at 50%. I said, "No thanks." The broker has no shot against me. Neither does Amazon. I don't care how big they are. Breach of contract is breach of contract. Why would the richest company in the world not pay a measly $3300 that I'm owed? Why would they risk having to pay additional court fees, attorney's fees, and maybe even punitive damages in addition to exemplary damages? And trust me, not all brokers are "organized". But you know that already.
US Citizenship is not a requirement for the BMC 84 bond. You can acquire one as long as you establish all of the legalities like a US bank account, US based corporation, and MC number
You can. The bond stays active for a little while for people to recover funds in these situations. Hurry though. If they screwed you they screwed many others.

both of their bonds are probably exhausted; if there is even anything left you'll get pennies on the dollar in 6 months to a year.
