Health Care Manager Ignorant of HIPAA Laws & 1st Amendment! Calls Police - Gets a Free Education!

  • Fellow Patriots & Freedom lovers, I was peacefully exercising my 1st Amendment Rights at St. Clair County Health Department in Pell City, Alabama. Almost as soon as I entered I was confronted by the Office Manager who said I was in violation of HIPAA Laws…I tried my best to educate her not only on HIPAA but our constitutional rights, she decided to call Pell City Police to have me removed but end the way she thought…Please be sure to hit the like button, it truly helps spread this around for more Patriots to see it and I appreciate it!

      ​@@Dravianpn02 He's wrong in just about every sense. 1st a condition of entry can be that you aren't allowed to record. Failing to stop recording when asked- breaking the conditions of entry allows them to ask you to leave. If you fail to leave you are trespassing. I haven't read a single state law that says a crime has to be committed for you to be trespassed. Public buildings and properties are "limited public" spaces from the view of the law and you can be trespassed from them. Read up on Public Forum Doctrine if you want to understand these frauditors aren't actually in the right in their harassment audits.
      edit: re the HIPPA he's also wrong. The reason they restrict recording is the method by which they protect HIPPA which they are required to do.

    That main cop seems like a genuinely good guy. The sergeant seems like he wanted to escalate at the very beginning but the other cop's calm demeanor kept him quiet.

    It blows my mind when someone walks up to you and starts asking questions, but when you give them an answer they don't want, then they wanna call the police. Sad.

      Melanie, you could see this in many of LIA encounters. It's amazing, they ask a specific question, LIA answers it in a direct and consice manner and within seconds (not minutes) They repeat the same question.
      It's because in their heads they are preconditioned to hear a specific answer. Therefore, no matter what LIA says, if it doesn't fit the narrative within there heads, it doesn't register in their mind, hence closed minded officers, and other public officials encountered by LIA.

    Between those two cops, Officer Elmer is the one who should be wearing the stripes. He is the exact type of person who the public needs to have in leadership roles training other police officers. My respect to him for standing up for you and your right and for informing the employees that they're the ones in the wrong.

      That's because the sarg has had more time to develop an ego. There should be term limits for cops. They don't get any better with age. I don't give these cops too much credit for good behavior. I give them credit for knowing how to cover their a$$. The cop was very familiar with 1A audits. That was the first thing out of his mouth. Absent a camera, your rights have a 90% chance of being violated. The saag is racking his brain to come up with a way to manufacture a crime and give Sean the bums rush.

So all in all I still give it a pass and a great de escalation tool . I rather have that than how he got treated at the trooper station by that sergeant who physically assaulted him in front of other officers . It’s the reason for the audits it won’t be 100% but if u can bridge that gap a win is a win

      Its only going to get easier and more common to take away or restrict our (God given) rights since the government is constantly chipping away at the 2nd amendment. The 2nd amendment might not be important to you and you may feel that the 2nd amendment should be abolished but its only a matter of time until they come for something that you feel is important and it will be that much easier to achieve. We use to fight FOR our rights but people have been brainwashed to fight to restrict our own rights. wake up people

As someone who struggles with ego and anger, you inspire me to be a better person. As a veteran of the Marine Corps I am thankful for the work you do for this country.     Officer Elmer showed his professionalism along with a great understanding and didn't let his position go to his head unlike some other law enforcement professionals who think they can just manipulate you and order you to do something. Refreshing.

      Go back to 12:10 and tell me again how this slime ball is a good cop. He pretends like it’s up to the sergeant to give up the CAD number and goes to ask the sergeant while then just saying he will give it to him. Just watch that interaction. Clearly he knows he can just give the CAD number but LIES and immediately catches himself and does the right thing. That’s super sneaky and shady behavior and it absolutely does not deserve a pat on the back. He did really well at not violating his right but you can see how he’s really not trying to be of any true assistance. A good cop would have immediately given it up because he knows it’s not up to the sergeant. Just an awkward exchange from a slimey individual

      Please watch again. Only one of the cops deserves a commendation. Sgt. Cooper, who maintained a hostile demeanor throughout, said that Sean couldn't revisit the Environmental room because he's already been in there. He also told Sean he couldn't video the people waiting in the lobby. If the second cop hadn't spoken up, this would have been a very different audit.

    When the officer sees this, I hope he knows he did a great job. The only criticism I have is when he said it would be illegal to record patient records on screens. If the workers leave patient records up on screens facing the public areas, that is not anyone's fault but theirs. Recording anything you can see from a public area is legal.

    Finally an officer that demonstrates the standard of what a law enforcement official should be acting like. The officer was professional, knowledgeable, and very understanding of everyone's rights. We need more officers like him. He is the role model every public employee should look to be like. Loved this audit. Very refreshing from the usual tyrants. Hope to see more audits take a similar outcome that means you Sean and the whole community is starting to make change little by little. The fact that the officer mentioned 1st amendment auditor brings a smile to my face because I feel that change in our departments will start to come. Accountability is key and them knowing they work for the public is essential. We can not have our public official think they are above anyone or the law of the land. This officer brings me hope.       The officer is incorrect however that he cant record a screen on a computer. It is up to the public servants to make sure the screen isnt turned to public view.

      That will depend on the intent for recording the computer screen. If you're doing it casually in good faith simply because it's your right then it's not illegal.
      If it can be proven that you're taking photos or recording screen with intent on gaining patient information for an ulterior criminal motive that can get you in trouble.
      Also woke media highlights bad cop interactions. Good cops aren't rare, it's just many don't care about that. There are a lot of them, but that doesn't help ratings.

    The way you expose a person's paranoia just by holding a camera actually makes me feel a lot more comfortable and secure in my own struggles with fear and PTSD. Most of the people you encounter in these public buildings seem like control freaks.

    Actually, if a person can see a patients chart or computer screen, that is still NOT against the law or HIPAA. It is the facility's responsibility to make sure that that information is kept private.

      My wife and I are always watching out how our financial and health institutions handle our private information, and I have to say most time, there are multiple infractions, and we are sure to remind them to cover our information while in a public setting.

    I honestly think one of the biggest annoyances that I’ve found over the years watching audits is the question “How much longer you plan on being here”
    WHY DOES THAT MATTER IN PUBLIC IF THE BUSINESS IS OPEN???

      From my understanding Joba, it's the same as when an officer stops you for potentially speeding and ask you if you know how fast you were going. If you were to answer, it could be self incriminating and a basis for a violation or charge. I'm pretty sure although it's public, after a certain period of time without conducting business it could turn into an offense. I know filming with intent to collect content is conducting business but if you're filming the same area over and over it might be enough to open that door towards an arrest. State to state trespass, loitering, and disorderly laws vary in their stipulations but I think those are the main laws that apply in this type of situation.

      @@greg1503 It really isn't. On the bright side I can come back and watch the videos I listened to at work lol and they all seem like videos I've never seen before. But you're right it's nice to watch certain auditors.

    Officer Elmer, is exactly how LE should conduct themselves, de-escalate. Explaining your rights to the office manager was, I know, something she had NEVER heard before. That is why you do it, to educate!
    I'm actually very impressed.

    I just want to say, after watching the entire video that the auditor was very professional and respectful . This video should be a role model for all police officers and auditors. Remember it’s important not to violate anybody’s rights when enforcing the law. The key factor in any situation like this is to deescalate. There’s a lot of
    auditors out there that cross the line. Thank you for being respectful-and professional with all parties that were involved in this incident.
