- On April 12th I was conducting a 1st Amendment Audit on the NY Suffolk County building in Happauge NY. I was confronted by security, a Sherriff deputy and a DHS employee, who refused to identify herself to me. The unknown DHS employee accused me of violating HIPPA laws because they were giving out the vaccine in this public building and even had a "observation" area to see if you had any "side effects" after you received the vaccine. Pretty Sketchy Stuff if you ask me. Security, Deputy Sherriff and DHS worker were all educated by professional SGT. Michael Davis of the suffolk county sheriff's department. He honored his oath to the law and the constitution. He gets an A+ in my book.

You silly goose, we didn’t fight those wars for our rights. We fought them for security and safety of Americans and freedom for the citizens of those foreign countries, and to a lesser extent, resources and political/economic reasons. The last war we fought for our rights was the civil war. Also, don’t let these fools try to tell you you’re violating HIPAA laws, those apply to them, not you. You haven’t gone through a HIPAA training and you don’t work for a medical provider. They have to protect patients medical info, If they’re so concerned about it, they shouldn’t set up in the middle of a busy lobby. super geniuses.
If they are so concerned with HIPAA compliance, then they should not have placed their treatment facility in the middle of an open lobby in a public building. If any HIPAA violations are taking place, THEY are reasonable for creating said violation.
HIPPA laws are a crock of. I got home from hospital with 19 others peoples records in with my clothes. I tried to report it to HIPPA, health dept….no one cared.
Btw, it's not a HIPPA violation, seeing that you're not a government entity.

Ryan N: Not so! It applies to lnformation of protected health information (PHI) by any entity with the right to know medical information, for medical treatment.
Example: Insurance companies, for payment reasons. Law enforcement, with a warrant, family members, or friends, with power of attorney. These entities are prohibited from sharing, PHI, with others, not having a need to know.

When cops refuse to give their name you should always assume they’re a police impersonator and contact the actual police and report the illegal behavior.

That's a great idea. Call the non-emergency line right in front of him and report that you think a man is impersonating a police officer because he wont identify himself. I bet he would identify himself after that lol
The problem is that it would be a roundabout way of getting you to surrender your identity via phone number. What needs to happen is auditors must disregard anything an unidentified officer has to say, including directives, ask if they are a police officer and say that it seems suspicious because a real police officer would identify themselves...tell them to call a supervisor if they are a real cop. You won’t follow commands or interact with an unidentified armed man acting so bizarrely.
And of course you should articulate that you want their name and badge number in order to submit a complaint against them. This could mean that police who refuse to identify to a member of the public they have engaged with in their official capacity could be guilty of misconduct since they would now be actively trying to subvert the complaint process as well.

Assaulted, false arrested, spit on had my head slammed into the car door jam as they were putting me in the back, made to sit on the hood of a car that has been running for an 8 hour shift as they busted my friend head open with a Maglite and broke his tail light to say that was the reason for the stop. Telling my girl she should be with a real man and giving her his number, thrown on the ground with a knee in my neck for eating in the park after it was closed and threatened with a tarzor against my neck. YOU have no idea what you are talking about. The funny part is my record is clean cause I never did anything wrong but say something when they were acting like scum bags .

When ever they say "you are violating HIPAA", tell them that it is impossible for you to violate HIPAA. As a non medical professional, the Health Insurance Portability and Accountability Act (HIPPA) cannot apply to you EVER. It is ONLY applied to health care workers, insurers, government employees, and employers protecting the info of their employees. It CANNOT be applied to an average citizen. As soon as they start saying that you are violating HIPAA, you know they have no clue what they are talking about.

They should say that they are violating HIPAA law by allowing patients to be recorded by the public. It’s their responsibility to secure the patient records. They should have moved the vaccination site to a private area of the public building.

This is all absolutely true. Would love to see more auditors use this bit of information to educate our public officials. They apparently don't pay attention to the dozens of online trainings on this that they're required to do every year.
I worked in a temporary contract role with an insurance company and had to watch educational videos on HIPAA before I could start. They aren't educating employees correctly on what HIPAA is. They state doing such and such violates HIPAA but nowhere in the videos do they state whom it applies to.
"Sir, I know the law..." as she makes it clear how much she does not know the law. She is hopelessly clueless about HIPAA. The truth is, that if she is the one overseeing this operation, and she is allowing the displaying of patients information that is viewable from a public space, she is the one breaking HIPAA.
She is absolutely at fault but will never admit wrong. Nor will she ever learn anything because she knows it all already
Ya sadly alot of people who are in charge of things they don’t belong in charge if who just celebrate ignorance instead of admitinf they did wrong and learning from it. She would have seemed like a much better person if she admitted she was wrong and agreed on some mutual ground at very least.
The way HIPAA works is that the onus is on those who are HIPAA certified to not make private personal info visa law and viewable to the public. Not the other way around. Plus can’t be violating HIPAA if your not HIPAA certified. Most of those volunteers are not HIPAA certified so they can’t be held responsible under HIPAA either for exposing it in public.

i gotta admit it was beautiful seeing that first sheriff shrivel when when he started to interrogate you and realize he was beyond his depth. They're so used to being in a position of authority over people, so when he wasnt you could see him physically shrivel down and slink around trying to avoid being on camera. When someone starts yapping about HIPAA you need to inform them that the law applies to Health care providers and the keepers of health records. It is up to them to keep those records safe and private. It does NOT apply to the public. As health care professionals they should know and understand that law!!!!

I have to admit I started watching theses audits a couple years ago. At first I thought you were all just assholes harassing police and places. But more and more I watch, I see the absolute corruption in the PD's. I would like to thank you and all auditors for your work.

The corruption is not really what worries me. Let's be realistic, that's a minority of even the bad cops. The real bad cops are those are who are completely ignorant not only of what they are supposed to uphold, but even the foundation of what they are supposed to know not only as officers of the law. But they lack the basic information that an informed citizen of America should have.
You can't have people in positions of power, and then not at least expect some degree of knowledge and experience. That is what truly shocks me.
Hearing a police officer say, City Hall is not a public place. Stuff like that worries me more than a corrupt cop.
Because that cop will not hesitate to throw you or me and jail, or worse because they are uninformed.

She seemed more like an employee at the building, and not subcontracting for the healthcare provider... If that's the case, HIPAA doesn't even pertain to her. HIPAA only applies to healthcare providers and Insurance entities. A garbage man can post a picture of your disregarded prescription medication bottle online and he's not violating HIPAA.
Everyone in that building really needs to brush up on what they're doing if they're going to engage the public and attempt to "enforce" the law.🙄

@@wilbl7778 You’re 100% right. My wife has worked in a physical therapy office for over 20 years and I just found out that she doesn’t fully understand HIPAA privacy rules. But a cop’s ignorance can do so much damage to a person that there should be no excuse for them not knowing their jobs inside and out like a doctor.

Thank you. The health care worker said it. She has to see about changing where people get vaccinated to make it not accessible to the public. That's where a lot of people in the Child Support office, city buildings, parole, etc. Aren't getting right. If they are so worried about people being able to see the information easily, then maybe they should protect citizens information better.

You should have educated that lady on HIPAA, it is not violating HIPAA to photograph a person's face in public no matter circumstances. It's the medical professional and directors of site that are required to keep that info private.

When you violate a patient's privacy by recording their interactions with a healthcare provider without their permission, you're in violation of HIPAA and other privacy laws such as eavesdropping laws. Where did you get your law degree?

HIPAA is irrelevant. According to 18 USC 2511 you can only legally record a conversation that you have consent or a court order to record. If you're having a conversation with someone else, it's legal to record that conversation. If you are recording a conversation between two people and you are not taking part in the conversation, that's a big No-No.

Hands downs... LIA is the best! More often than not... the Auditors make themselves look like assholes (although I legally agree with them, it's hard to like them). I absolutely love LIA's style, calm deemener, and tact if it wasn't for him, I don't think I would fully respect the Auditor community.
I was declined to my medical appointment at a VA Clinic, for not answering medical questions, in a public lobby, by a non-medical, person, and a VA Police officers. These persons were making diagnosis, in public, of my health information. That is in violation of HIPPA Law.
@@michaelwoods1389 honesrly I watch most of the other audit videos (I’m Canadian; but have extensive ties to the states ) and it makes me happy Canadian police and courts have a lot of more flexibility. Cause I’m like you guys are the reason half these cops break the rules; they are people too and they do have to maintain things and protect everybody and you’re just acting a fool; which in Canada can be a thing police can stop lol.
But American police are super problematic in general relative to Canadian police (and I don’t mean all there police are i just mean they have more problems then we do) and this stuff done well seems super helpful

You guys really do need to put way more funding into your police
Honesrly that’s a big difference between the us; and countries with much better modern police forces
You guys put way less direct regular funding into police services and your cops get paid less; get way less training and are considerably less educated
You’d be better off requiring degrees
Putting them through years of training
Paying them really well (helps weed out corruption and attresft better candidates)
And the best part is it doesn’t wind up really costing more cause you just need less police
Cause they’re more effective so there’s less crime for them to deal with of the petty nature
@@ShmuckCanuck my wife is Canadian... Saskatchewan. I have had very few interactions with LEO since I met her. Mostly border, Traffic, or Parking. On both sides. Pretty even keel across the board. Assholes and super nice on both sides... however, my military Service gets me more lectures than tickets in the states and Canadian ticket prices are insane.
I'm in no way saying that auditors are bad and cops are good or vice versa. Just think Auditors should hold themselves to a standard they expect of LEOs. LIA I think does just that.
It is our duty to hold these public servants to the FULL extent of the law. Keep them humble

By the DHS lady's own definition of HIPAA, Suffolk County is violating it. I saw at least two security cameras overlooking the vaccination area; one aimed towards registration and one looking down into the area where the vaccines are being administered. So much for privacy in a public space.
Any of the public getting their vaccine at that location was waiving all rights to privacy. Most people get them at the local pharmacy nowadays for boosters. There’s no expectation of privacy there. They do it right out in the store area with just a small screen for “privacy” at my pharmacy. The waiting chairs are not at all private. They’re right on an aisle’s end cap.
There’s still a 15-minute wait afterward, Sean. I hope you got better informed about that so you’re not spreading disinformation, but I haven’t seen all of your videos. I just found you a few months ago and started binge-watching the old stuff on a whim. 😂

Bizarre how the first guy won't even make eye contact. And he's carrying a gun but seems immediately terrified when he even knows what the auditor's purpose is, so clearly knows he's no threat even. I'm sure he'd be a fine security officer, but it's terrifying who they'll give a badge and gun to without any acknowledgment of their personal demeanor and temperament.

They seem to be refusing to ID the more often they're being filmed for some strange reason. Hmmm. They won't ID because they are 100% aware that they're acting unlawfully, violating people's rights and they know they look like (because they are) tyrants and cowards. They will claim all day that it's due to "officer safety" concerns, like fear of retaliation and the things that are going on "in this day and age"...blah, blah.. we all know it's bullshit.

The law that does not apply at all, PERIOD in this situation. He does not have a relationship with anyone as a medical provider in that situation, PERIOD. The idiocy that comes from HIPAA (the correct acronym) and the ADA are at STUPID levels. People have no idea what they are talking about.

Great video. So happy to see the police upholding the 1st Amendment! The reason for the 15 min wait after an injection of any kind, be it allergy shot or any kind of vaccine shot is for your safety. If you had a vaccine and you personally would be allergic to it, it would most likely show up in that time frame. Even if you get a flu vaccine, they make you wait. While talking with the Sergeant about privacy and restricted areas she said, "we need to see about adjusting that." I don't think she fully comprehends what's going on but at least this shows the wheels are turning, be it ever so slowly.
