What Country do you live in. There have been Judges dragged out of Courtrooms in cuff kicking and screaming. I've also seen police officers get their shirt badges ripped off them after arrest. Yes they are held to a much higher standard they get no immunity or lack of accountability the Idea some believes a Judge can set themselves above the Constitution in Amnesty is rather amusing. You have a constitutional right to assemble. That's what it means. It has even been used to overturn limits on how many people can live in one house. The right to assemble covers the right to attend a sporting event as much as it covers the right to attend a church session.

The judges job is not to weigh the "risks." His job is to determine if the mandate is lawful. It clearly violates the Constitution.

Basically this lickspittle judge’s answer was ‘when I made my decision, I didn’t have the benefit of later being overruled by the supreme court’.
I am not a religious person myself but I truly respect the US Constitution. This judge does not respect the US Constitution and should be rejected on that basis.
As an Atheist I agree. The *ONLY* thing I would _Kinda_ accept as a reason to distinguish between secular and religious activities, is that some Secular Activities are not "elective", as in you need to get food... you go to the grocery store. In the same manner "Needing"... going to church is no where near as "required" as getting food is. But from what I understand it wasn't *JUST* to get food and other *_ACTUAL_* "Essentials". Like even gyms were allowed to operate at 50% then Churches should too. But in some crazy *RARE* circumstance if the law was "You cannot go out except to get "What you *_Actually_* need to stay Living"... then I could understand saying no churches. But as I said, even as an Atheist, if Gyms were open... then Churches should be too. Not a fan of double standards.

This is infuriating to me, and I'm an Atheist. The judge knew exactly what he was doing, and he didn't care.

He used a case law from 1905. He had to dig deep for that case law, knowing his appeals wouldnt be combed by anyone of his fellow legal activists in his offices. Nothing over rides the Constitution.

I lived in Illinois at the time, and after pathetic rulings like this, many sheriff's departments throughout the state stated boldly that they were not enforcing unconstitutional edicts. Gov. Pritzker then turned to the state police, and they turned him down flat. During the early days a number of the businesses voluntarily complied with these demands, but by August or September the only rule being rigorously enforced was the mask mandate, and much of that depended on where you lived. I know that many people started shopping in Iowa because the restrictions by most businesses were less onorous than Illinois. The whole mess was an exercise in unConstitutional extralegal proceedings. I moved last year and have no desire to return.
