      It shouldn't be bullshit on disability, it should be bullshit on unsubstantiated, faked or egregiously exaggerated disabilities, being a victim of a negligent transporting driver while a passenger in 1994 that grievously injured me, changed my life forever I fervently defend the rights of those actually, truly disabled, I'll equally stand shoulder to shoulder with anyone else to expose those faking and lying about their status, it's positively reprehensible to fake and feign illnesses or injuries that are nonexistent, those who fake cancer on line profiting from it (go fund me) for example, when exposed should do at minimum a year in jail, or perhaps a prison stay that matches day for day the length of time they faked their cancer and bamboozled the public, friends and family.....same for those who fake pregnancy and hurt others in a most malicious way......

      i agree with you that you don't just have to belief all , but sleep apnea can be medicaly proven (measured) and if she can show that ...
      What technically should happen if you bring it before the judge otherwise that is also a crime
      (claiming unproven medical disabilities)
      Also not all that need a cane to walk need it to stand , just like not all people that have a disability parking card are in a wheelchair.
      If you are so fast to judge i hope nobody will do same for you since you may not like the outcome.

      I'm on cpap. I'm terrible about using it. It hasn't killed me yet. Although I do need to be better about it.

      A cane isn't a crutch. The point of a cane is for balance and stability or something to lean on for temporary weakness. It's legit to carry a cane all day and never need to put any weight on it. I have a friend who needed to carry one for months, until she was able to have surgery, and hasn't used it since. (I do think that woman is pretty much a waste of skin, I only share this about canes because you will likely meet others who use one, sometime along the way, and I don't want you to think incorrectly poorly of them if they don't lean on it with every step).

      Just because you have a cane doesn't mean you will need to use it for every step you take. *Nobody cares if her client broke the law and cannot take her cpap to jail with her. It is by her own action that she is there. She might not breathe well, but she isn't going to die from not having her cpap machine.* Her lawyer really DOESN'T impress me at all either. Seems more like a gossip than a practicing lawyer. That said, it sure feels like this woman is scamming the system.

    It’s funny how her and her attorney are so concerned with her passing away in jail without her CPAP, but at no time was she concerned about her life, or anyone else’s for that matter, when she was driving while intoxicated- any of the 5 times…

      She drinks and smokes... She doesn't follow CPAP protocol. Says she needs it so badly, yet has done nothing required to be able to get off it, which should really be possible if she follows CPAP.
      Many people successfully come off it in a year, with a diet change and eliminating drinking and smoking. Jail could be a good way to follow the protocol

      @kaddy2 a few might be able to ween themselves off, most cannot because the condition is far too severe. I’ve been on mine for years , lost weight, don’t smoke. My Apnea is still just as bad as it was.

      being off the cpap isn't going to kill her. the cpap is to help your breathing control while you're asleep to make sure your airways collapsing doesn't wake you up. the worst thing that happens when you stop using a cpap, all that happens is you wake up in the middle of the night. you don't just stop breathing and die.

      Depends on the reason. If you have a life long illness that's causing it then of course you need to use it indefinitely

      Yes and reducing your weight . Some of her medical issues come before from lifelong drinking but her setting guidelines as she won’t do probation or community service . This lady could have shown going to meetings and not mentioning about regret on hitting the officers and fighting. She expected the court to do nothing as she did want to do anything not even going thru program for DUI

      My ex boyfriend has a cpap, his weight is fine though, he’s not overweight, thankfully.
      But the doctor did also tell him to be ‘careful’ with alcohol.
      Now he is not a drinker, but every now and then he would have a Irish coffee after dinner, if we went out for dinner and that would be about 4x a year (we like to cook and eat at home)
      He would notice the difference sleeping when he has had alcohol!!!
      And not just that, the hospital (well doctor) would phone him the next day because the could see a big difference on the machine (they track the machine, sleeping cycle at the hospital), to ask if everything was oke!
      He then would tell them that he had drank some alcohol……..They were not very pleased with him.
      So to make a long story short…………….She should not be drinking as much as she does with a cpap!!!
      Or is it just another excuse🤔🤔🤔

      @@annmariebarratt4213I am overweight, but nothing near these ladies. I’ve been on a CPAP for several years and the doctor that prescribed it to me said I had narrow and short nasal passages which was causing the problem.
      Years later, I find out the reason for the narrowness is inflammation and swelling from being allergic to everything where I live. I’m hoping after my allergy shot therapy, I’ll be able to breathe regularly again and won’t need the CPAP because I sleep just as bad with it as without it.

    I’m so glad the judge called her entitled @$$ out. It’s funny how her disability apparently prevented any consequences in her eyes but it didn’t stop her from drinking and driving then fighting a police officer and kicking them. Actions have consequences, ma’am. I always tell my children “you’re free to make the choices you want but you’re not free to choose the consequences”.

    The Judge is right in his opinion. How many times has she not been caught? Her get out of jail card is blotted already due to her past convictions. 6 months in jail is pretty lenient to be honest.

      Right. The system is flawed. 2nd offense should be life time ban on driving. (Unable to register a car) and jail for a year. Then it get worse for her 3rd. They don't pay fines. Have them stay in jail until the fines are paid. They have jobs in jail ..

      She was sentenced to 13 months in Michigan state prison, not jail. The range was 6 months to 5 years, but he gave her the 13 months in prison. Maybe she can lose a couple hundred pounds in prison and won’t need that CPAP when she paroles. She will be on parole/probation for 47 months after she gets out and if she violates at all, she will go serve the remainder of the 5 years in state prison. It couldn’t have happened to a more deserving bag of crap. Everything about her is repulsive… her appearance, her attitude (especially towards the court), her malingering, her manipulation and violation of social services, her disrespect and violence towards police officers, her disregard for others, her unwillingness to take accountability for her actions, her attempted avoidance of consequences, her refusal to quit drinking, her refusal to quit driving while intoxicated, even her taste in attorneys is terrible. She’s just gross.

      I have seen way worse. I seen a defense attorney on Skype the other day that was so high or drunk she caught 4 contempt charges and she left before the case was over. I’m guessing her license is now in jeopardy, at least it should be.

      I was thinking the same thing. In my experiences judges are not judges for the money, they can make WAY more money in the private sector. They are judges because the are passionate and want to help their community.
      "If you read the police report as I did" infuriating to imply the judge wouldnt have read it.

    If you don't learn after 3 DUIs, and the punishment possibility from a 4th DUI doesn't keep you from drinking, nothing will.
    I also don't buy 10 years of not drinking or even driving while intoxicated. Likely, just didn't get caught for 10 years. Apparently her crybaby lawyer didn't do much research. Michigan Corrections allows use of CPAP machines if prescribed by a physician. They even have a CPAP bank providing machines and supplies to those eligible. She better hope the judge doesn't find this out, or he could recommend sanction to the state board. As she was using this as a means of changing sentence as well as pushing a guilty conscious on the judge.

      I specifically remember that the photo of Epstein’s cell, after he suffered Clintoncide, showed that he had a CPAP, with an extension cord, in his cell (along with probably a dozen prison jumpsuits.)

      I have severe OSA and need a CPAP machine. So I'm relieved to hear prisons/jails do allow CPAP therapy for those with a prescription from a doctor. They would HAVE to allow for that, because it can be life threatening. I also have empathy for her other medical conditions...as I can somewhat relate. I was in a car accident when I was 20 years old. I am now 40. It was caused by a drunk driver. I've had multiple spinal surgeries and will have to endure more in my lifetime. I have chronic pain every day and I'm permanently disabled.
      However, just because someone has these kinds of ailments, it DOES NOT give you a get out of jail free card. And if probation is offered...you do whatever they ask of you, whenever they ask it. She was just full of every excuse on the face of the planet. And her apology was a complete joke. I was greatly disappointed in her sentence. This was the 4th freaking time. She should've done at least 5 years and never allowed a license again. She could've mamed or killed someone. I can't believe these people. They just act like what they did was no big deal. Sorry for the rant everyone. I was just going to comment on the CPAP thing, but the more I thought about it I just got ticked off. 😉 Have a good weekend!

      If anything, knowing a possible punishment of jail time for drinking and driving would be more difficult for her due to her physical ailments she’d be even MORE determined not to drink and drive. Reminds me of certain race insisting they are more often targeted by police than other races. If they truly believed that you’d think they’d be even more law-abiding than other races.

    As a social worker, I have witnessed many addicts use drugs and alcohol to self medicate. While I empathize with this lady’s health issue, it dies not give her a right to put others in harms way. I agree with the judge.

      It's really tall for her too.. I had to be on one with a moon boot thing vs a crutch as I'd torn ligaments etc, and we had to wait a few days for me to actually get the cane as all the ones in the chemists were too tall and even the adjustable not quite low enough.
      If my arm was like hers, I'd have had a brutally hard time keeping my balance or regaining it if I wobbled and stairs.... Stairs would have been hard to traverse too.

      When my mom first started using a cane she ended up just carrying it half the time. I had to constantly get on to her to use and use it correctly! It doesn't do any good otherwise. She's doing better now.

    The lawyer is concerned about CPAP, yet this is her client's 4th DUI? What does she imagine happens to her client's CNS, including breathing, when getting blotto all the time? She's not nearly worried enough to be reading about the child that her client kills the next time she drives drunk.

      It seems that they didn't charge her with assault, but rather with injury, which is a more severe crime. As they couldn't prove injury, because there was no evidence, then she is not guilty of it.

      SCOTUS has already ruled on what C & U is when dealing with defendants with health issues. CPAP use is a breathing concern, regardless of what the defendant did, not being able to breathe on your own when sleeping is something totally different.

    I am SO glad the judge called her out. Her attorney sounds like a person who is just like her, regardless of her duty to defend the client. Comparing a former judgement to your clients? That’s petulant. Habitual, aggressive drunk driver deserves consequences. What a pathetic attempt at a defence, zero remorse, every excuse under the sun as to why she should have ZERO consequences. I wonder why she’s on that CPAP machine..? I would bet good money it’s due to her own actions and disregard for her overall health.

      Defense attorneys have a job to do. They have to make some argument for an easier sentence. It's pretty obvious Herr the defendant didn't give her much to work with.
      She probably pleaded with her to offer something as remorse, but she didn't budge.. poor me, I'm harmless. No way they're going to give me jail.
      And I bet the defendant blames the judge and counsel for losing. Been ignorant for so long it's a way of life

    The judge explained it very well. Especially the part where this wasn't some astronomically improbable coincidence that she was driving drunk and got caught again.
    How about a little change in the system? Second offense means lifelong supervision at the convict's expense.

      To answer your question, I want to punish people based on their illegal actions. These actions have been made illegal to protect other people from potential harm. Driving drunk is no different from shooting into the air to me. I am a 2A supporter, gun owner and carry license holder myself. The problem is never with the guns, it is with the reckless behavior. Shooting into the air means the bullet will come back down somewhere most likely at terminal velocity. You do that often enough and it will hit something or someone. Driving drunk is no different. Both actions are illegal to protect society.
      Do you think firing live rounds into the air should be legal? If not please explain how that is different from drunk driving.

    If she's drinking, the problem can't be that big.
    Going to jail would stop her drinking, and THAT would help her breathing considerably. As would losing some weight.

    I see this constantly people with DUI's that claim that they cannot do any probation conditions, and demand that they just be let to go home with a tether the they immediately violate, tamper with, or simply cut off, and they come back to court with the same song that they can't go to jail, or prison because of their "conditions". The same conditions that do not prevent them from going to the bar, drinking, driving and hurting people. We had a case years back where a judge gave 36 months of probation and testing, where the recommendation was 24 months in prison, and the prosecutor was asking for 36 months. This was for a third offense and in each offense there was a wreck that injured people, in the last one, there was a man that was in the hospital for over three months before he got out and was still in rehabilitation therapy when she had her third wreck and injured two children. When the judge said 36 months PROBATION with testing and an interlock device (which he had not ordered on the two previous) she sat back in her chair and smiled (the family of the two injured children lost it). That night five hours later, she was in the bar celebrating because the next day she would have to have the interlock installed. She left the bar got in her car and got on the off ramp to the expressway and while going the wrong way on the expressway, she hit a car head-on and killed the entire family inside. Her BAC was 0.27 and she walked away from the crash, she was walking down the road when an officer found her and she told him that she had been at the bar and someone stole her car and she was walking home. As the officer was taking her home the report of the accident came across the radio, and when he came on the scene where people were trying to assist the family and saw her car, she claimed that the person who stole it must have done it. The traffic camera, and cameras from area businesses leading up to the expressway showed her driving and she was still insisting that she wasn't driving when the accident team found the dash mounted camera in the car of the family she hit. (the dad made extra money driving for one of the ride sharing companies and had cameras inside and forward and rearward facing cameras). At her trial the jury (yes she was dumb enough to go for a jury trial) got to see the video of her hitting the family head-on, and they got to see the video of the family in terror as they were killed. After the verdict, she, and her attorney argued for home confinement and a tether, but it was a different judge and she got 20 years. At the next election, the judge was voted out of office, and to this day claims that he did a good job.

    I can't speak to every county jail but my jail can get a cpap machine through medical if needed. We have separate infirmary for male and female inmates .The inmates that are in medical are checked on every 15 minutes or less. If she has declined health medical decide if she needs hospital.

      I found it to be an interesting question. After just a little bit of research I found that some prison systems do provide them. I believe California was on the list but it's California so does it really count?

      I can speak for every jail/prison. They receive Federal funding, therefore, they must provide any medical care and equipment that is deemed necessary by a medical professional. So, yes, if someone has a prescription for a CPAP machine, they would get it. I have been an RN for 28 yrs, and I am state certified to teach classes on regulations (among other things).

    So she will serve about 5 - 6 months total. I don't understand why these people who continue to drink and drive just don't get it. Buy a ton of booze and drink yourself senseless at HOME. STAY HOME and sober up for a few days before you drive, or have a relative or friend drive you where you have to go. Drinking isn't illegal, but why do they insist on repeatedly putting everyone in danger who are on the roads? Are they that selfish or just plain stupid?

    I like this judge. He seems fair. He was spot on with the First Lady. She didn’t want to try. I also walk with a cane and have problems with back issues. But she was able to stand for long periods, which amazed me. So her problems aren’t that bad.

    The judge is right, I am an alcoholic and when i am on probation or under court supervision i am a model citizen. As soon as i don't have big brother watching me i tend to start drinking again. What i do now is have my wife give me a breathalyzer every day to hold myself accountable. Its sad but true.

      In no way is that sad, at all. That’s called taking responsibility for yourself and doing whatever is necessary for yourself to stay on track with your sobriety. As a former addict myself, and as I’m sure you know, it’s a life long effort and everyone’s journey with sobriety will look different but the universal truth is that the addict must take accountability. Frankly, I’m proud of you for going to that extreme if it works for you, and I’m sure, I would hope, so is your wife/family. There are far too many people in the world that blame their actions and behaviours on others, use every excuse in the book (like this woman) and furthermore, addicts that make the courts responsible for their recovery. Everyone needs help sometimes, getting sober isn’t easy on your own, but there’s an onus on the addicted person to do their part and put in the effort. You’ve found a way that works for you and you’re staying on track, and I applaud you for that! Keep up the good work, one day at a time ❤

    "Sleep apnea is increasing in prisons as our patients age. At the American Correctional Association (ACA) Winter Meeting in Houston this week, James Greer, MSN, RN, spoke of efforts to manage this condition underway in the Wisconsin Prison System. Greer is Director for the Bureau of Health Services in the state’s Department of Corrections. Wisconsin currently has 450 inmates on CPAP and 70 on oxygen concentrators. That’s a lot of treatment and equipment management in a secure setting. He had some great ideas to share about how to get this condition under control."
    All prisons have medical facilities and can handle any health issue.

      She stands and walks better than I do, and I don't use a cane as a prop. I'm 51 yrs old, but have had CRPS in my right ankle for ten yrs, and a bad back, bad knees, and a bad hip for longer. I work full time, so I am too tired to go drinking and driving (not that I would). Perhaps she needs a job or a hobby to keep her busy and productive.
