    I feel for the Dad, but that "17 yr old child" was out stealing cars at 10:00 in the morning! Why wasn't he in school? Why wasn't he taught better at home? Play stupid games, sometimes you win stupid prizes.

      @haroldwilson8081 You're being ridiculous. Yes, sometimes children (17) are willful, but these days, parents seem to be way too busy satisfying their own needs, instead of raising their children. After hearing the language the father used in court, I'd place him in the former, not the later!

      That is true, but the law places limits on use of lethal force in protection of property.
      The trial will determine whether those limits were exceeded and, if so, the penalty to be levied.
      You and I don't have to like it, but we do have to live with it, and ensure that our actions lie within the constraints of the law.

      Qualified. Immunity.
      There will be no justice for anyone until that and Civil Asset Forfeiture are gone. Until then, they abuse their power and then are told it's perfectly okay. Over and over and over again. If you don't believe me, just look up "abuse of qualified immunity" and start reading. You'll get the idea pretty quickly.

      @@AsmodeusMictian The prison guard wasn't engaged in official duties when he shot the person who stole his car; he therefore isn't covered by qualified immunity.
      I once had a co-worker who's husband was a prison guard. They got into a heated argument and he shot her. Killed her. He went to prison for a while.
      Yeah, qualified immunity is a problem.
      So is civil asset forfeiture.
      But neither of these apply to this case.

      I think the judge went too far in rendering his ruling on the bond and was showing predeceased. The defendant should be asking for a jury trial especially if it's in this judge's court. The guy is guilty but the judge has tipped his hand.

    Back when I was 16, in 1978, our paperboy stole one of our cars. We only found out who it was when he came with his pissed off and embarrassed father to return the car, the keys, with a full tank of gas, and an apology. He never returned to be our paperboy.

      Back around 1968, my brother who was 8 years old and with 2 friends...they each stole an apple from a local small town grocer. The grocer recognized the boys and called the fathers. My dad rarely spanked, and never more than 5 swats with a belt. He also never left welts or bruises...but he made sure we felt it.
      My brother when asked, confessed to the crime, took his spanking, then he had to walk with my dad to the grocery store to apologize to the owner. He had to tell the owner he was spanked and was grounded for 2 weeks and had extra chores to do.
      He also had to pay dad back for the apple...money that he had to work off that didn't count with the already extra chores he was doing for punishment.
      That apple probably cost 8 to 10 cents...but my brother learned there is a cost and there is a price and he paid a heavy price for that apple LOL

      You have to remember this took place in Texas. The only state in the country where it's legal to use deadly force to defend against property crimes. According to Texas law there is actually nothing illegal about what this guy did. But there is always a chance the prosecution will convince a jury to ignore the law and render a verdict based on emotion.

    I just searched this guy, Daryae Johnson, and found that when he was in middle school, he participated in an anti-violence program called "Do the Write Thing." There's a story from the Beaumont newspaper about it. Kid looked so happy and hopeful. It's pretty depressing, really.

    The judge handled this perfectly in my view. Additionally, it may be to the defendant's benefit that he's not out on the street given how upset the (as I understood it the victim's) father was.

    The judge is ASSUMING the death of the alleged car thief was due to the subsequent shot gun blasts. The defense attorney stated there were 18 9mm casings found (fired during the car theft). Who is to say the victim was even alive by the time the shot gun was fired? Perhaps it may be argued the shot gun firings were only ‘abuse of corpse’ or some lesser charge like that?

      Yes, that sounds like exactly what's going to be at issue at trial. Hopefully (for the defendant), the coroner and expert witnesses will say that the "victim" sustained fatal injuries from the handgun.

    The judge is only having a hearing to determine if bail is appropriate. The facts of the case have to be determined at trial. Bail is to make sure defendants show up for proceedings, and are they a treat to the public. But I think the judge made the correct decision

      I don't think he made the right decision. He is treating all "violence" equally. yes the defendant is alleged to have gone back for a shotgun and seems to have gone out intentionally to kill the guy for revenge which would clearly be a crime but it doesn't point to him being a threat to the public. He killed someone who had just violently victimized him (yes carjacking is violent). Imagine if a women was sexually assaulted and reached for a knife and critically injured her attacker and then went inside and got a gun and came back out and shot him in the head. It would be a crime but no one would think she is a threat to the public.

    A 17 yr old isn’t a child. Children should be taught to not steal. Consequences happen when you steal. The person who shot him was protecting his property but didn’t have the right to go back inside his house to get another gun. Wrong on both sides but had the person not stole the gun no death would have happened.

    What I find fascinating about shows like this is watching the body language of people. Not that it reveals earth-shattering secrets, but it's a great way to see examples of behavior and attitude that always seem to be consistent.....over and over...and over. It's remarkable! Some get more animated; more vocal; more agreeable; whatever, each seems almost to have emerged from some kind of mold with a programmed behavior and script to follow. It's a great way to study human behavior.

    I think the defense attorney is suggesting that the guy died from the small gun or the crash, the shotgun is moot because you can’t kill somebody who’s already dead. The trial should be interesting if the state doesn’t offer a tempting alternative that doesn’t include life without parole, he’s not a career criminal so might be inclined to accept a life, (which is normally 25 years) with the chance of parole.

    Perhaps if the father did a better job at parenting his deceased son would have not placed him in this position. His behavior speaks volumes of the behavior of his son.

      It's not an education issue it is a cultural issue. NOT necessarily a race issue, but a systemic cultural issue, that no longer values life, law, respect of humans, respect of law, lack of impulse control, a cult of self, a cult of predation, a cult of a morality. Everyone is a law unto themselves. The US has essentially gone feral.

    The purpose of a bond is to protect the community, protect the bondee or prevent the flight from prosecution by the accused. The judge is making bond predicated on the ALLEGED crime and that is beyond the scope of a bond hearing. Essentially the judge is commencing the defendant's punishment without a trial. If the defendant's attorney had any balls at all he'd object to the bond being decided based upon the accusations and not the 3 elements of a bond. I'd fire that attorney and immediately file an appeal of the judge's ruling based upon the fact that the judge used unlawful process and grounds for determining the bond.

    Ive watched the first few minutes of this video and seen enough thanks. No mattter what this judge decides.. .the prisoner has a REALLY good chance for a mistrial as the JUDGE is NOT giving his full attention to what is being said at the very beginning. IF a Judge has things to be done.. .even just for a few minutes(Sidebar questions) then a short recess should be called(or go off the record)

      If you had watched the first few minutes you'd know this is a bond reduction hearing, not a trial. You don't get a mistrial in a bond reduction hearing. The judge doesn't need to give "full attention", just enough attention, which he obviously does as he interrupts several times for clarification/further information.

Even if its just a bond hearing the Judge NEEDS to give his full attention to the matter at hand no matter how trivial it appears to us viewers. Point is, mistrials are made with this kind of activity by Judges all the time... and any GOOD defense lawyer can make a hellova case with it too? BTW, i watched this video from beginning to end 2x.(after only watching the beginning, and its kinda WEIRD i have to fully explain myself as it seems your trying to read between the lines somehow?) I was SHOCKED at the innatention of the Judge.

    This is bullshit. 100K (10k Bond?) is still alot of $$$ The murder don't happen without the GTA. Plus he's a CO, no criminal history, family ties to the state, no flight risk especially with 100K on the line. I aint saying hes innocent,but let him bond out WITH CONDITIONS (GPS, Drug & Alcohol) and be with his family. Even if he's 100% guilty, he made a mistake, the first illegal one of his life so he deserves a little bit of a break ON BAIL. And let the courts decide his fate. Again, he would be CURRENTLY WORKING AS A CORRECTIONS OFFICER had someone not tried to steal his car.
    Sometimes i love this judge but sometimes i feel like he don't know what he's doing cuz he's so set in his old fashioned ways.

      Some people laugh (and this was really more toned down than a laugh) when they are nervous. What the father was saying is INCREDIBLY inappropriate outside of a courtroom. Inside of one? It's scary. You'll also notice the defense attorney blocked his client from the father. He didn't know what the man was capable of, yet he still protected his client.
      Yeah, it's sad a seventeen year old is dead. Perhaps if that father raised him better, he wouldn't be out at 10:00 am stealing cars.

      That's because you have the luxury of not knowing what he knows. That private Santiago's death while tragic, probably saved lives. His appearance and demeanor while grotesque to you probably saved lives. He has neither the time nor inclination to explain his methods to someone who sleeps under the blanket of justice he provides,and then questions the manner in which he provides it. He would rather you just say thank you and be on your way.
