Bringing somebody to a location to have them say whether or not a person is somebody who committed a crime, when you have that person being detained by a cop, being talked to by a cop, is THE most unreliable witness testimony there is.

@@kapekodbob Doesn't matter. Anytime cops want to bring a witness to a location to have them look at somebody who is being held at that location, there is a good chance for a strong heavy bias for that witness to say whoever is there is the person they saw.
This is standard practice across the United States, just so you know.

@@timb7775 that isn't the way police reports work. Your name in a police report is not the same as being flagged as a suspect of a crime. Which is a seperate report that is handed over to detectives and potentially the da. Yes detectives can search those reports. But they are more likely to use google to search for info on a suspect.

Man, you don't have to look like the details - they take it for granted the details are wrong and go for the vague picture, with any distinguishing facts like vehicle type, general appearance, etc. I got cornered in a Walmart parking lot last year... because I am a "middle-aged man with a gray beard" (although it's been a while since I was middle aged :), and I drive a company truck, which is a white Dodge Ram with a tool camper on it which is NOT remotely the same thing as a "utility truck". I'm just glad they were able to get the person there so fast to verify it wasn't him and get him on his way. I was stuck there for hours. It blew the whole day.

Thank you for not going crazy on the officer. I got stopped once years ago. Officer came up to the window and told me the reason I was stopped was they had a report of a kidnapping by a woman in a red station wagon. I was driving a red station wagon, but as soon as he saw me in the empty car, he said "You're good to go man!"

The 2nd walkup asking you to step out for a lineup was unnecessary & possible violation of your rights especially after the original officer made the determination you were not the POI. Asking for your ID was also a bit suspect & you were under no obligation to provide unless they stated you were being detained. Just imagine if the accuser had mis-identified you as the person who chased them...
Zero violations of his rights since he fully cooperated. He gladly handed his ID over and gladly got out of the car. If he said no and then the cops threatened to arrest then he would maybe have a case for rights violations.

The one cop gave him the headsup that they would ask him to stand outside to let them drive by with the witness. That's a fairly common procedure
I hate people that just state they had no right to ask for this or to have you do this. This man handled it perfectly because he knew he broke no laws and didn't want to be a dick and say I don't need to give you my ID. I'd gladly have done everything he did as long as they didn't ask to search my van (which they didn't). This cop was a nice guy and was just doing his job.

Man I just watched an old black lady probably in her late 60's doing Uber driving and she got shot by and old white guy who she was picking up a delivery from. He told the police she was trying to rob him. But the lady had a dash cam that recorded the whole thing. Imagine if she didn't get the recording how differently the story would have been. She died unfortunately. It was all a set up. Someone set her up to go to his house. These moments out here really are life or death moments. And all too often the way you carry yourself wont be enough to escape being killed on the job. But you did wonderful in trying to keep everything from escalating. I could see the frustration in your eyes though. I saw the same thing in your eyes that I saw in mine. Frustration and why is this happening.

That was a scammer trying to scam the old guy by saying something along the lines of someone is going to come and assassinate you or whatever. Then the scammer called an uber to pick up a package at the house (There wasn't a package) and the old guy shot her thinking it was the person the scammer was warning him about that was coming to kill him or some nonsense like that. The old guy is still in the wrong regardless, you don't shoot someone who is unarmed and backpedaling away from you. She was a Mom of young kids that no longer get to have a Mom because of this old guys actions albeit he thought the call was real but, still use some common sense. Anyone can say the things the scammer said, it doesn't mean you have the right to shoot just any person who comes on your driveway without reason.
That was very tough to see her back away and the old white guy was determined to kill her. He kept coming towards her and he already had his mind made up that he was going to kill her. Sad, sad thing.

Truth be told, don't even open the door, call the cops and wait. She was outside his house. Then he saw that she was an older woman and still persisted. He could have stopped after the first shot when she retreated into the car. But no, he assaulted her, took her phone according to police, then shot her a second time. She screamed for help and he fired a third round into her torso, killing her. On the video you can even hear him mocking her cries for help. That was cold blooded murder, period.

How was your driver's license going to help him in that moment knowing the vehicle didn't match?! He had no reasonable suspension to ask you for your ID. You could've said no because he asked, it wasn't a lawful order.

Can't argue with video! I'm in a situation where my neighbor called some lies into the police on me and I didn't have any video to prove myself innocent. Now I've been fighting charges for a year and a half, over $5,000 in legal fees and no end in sight. Now I wear a body camera any time I am outside and have casino level surveillance around my house. The eyes in the sky never lie.

That could've gone different if he'd hadn't made them aware of the fact he'd been recording for his channel. How many times he was black, oh close enough . Cuff him ! I myself having had crimes pinned on me and gone to court to plea no contest at my public defenders advice reason being they tell you they the courts if you pled not guilty you now have to fight a case from inside if you can't afford baile . Speedy trial is not as one may believe. No contest plea as long as it's not a felony will get you 3 years of probation and a get out of jail card on the same day . I've got numerous cases on my jacket when I was in my early twenty that should've been DA rejects, but due to not knowing any better there you go. No matter how you handle it, if you're black or brown guilty until proven innocent . Why ? He was in fact a suspect in a crime. Police had RAS. Probably not the best time to answer a lot of questions but they had the right to ID him, detain him and ask questions. Of course he has no obligation to answer the questions.

Love your attitude. It is more than a little ridiculous they had that many squads there. Unless there was a complaint of a gun being used Im not sure why that was their response. But thats unlikely given the way they handled the stop in the first place. Regardless you handled yourself in a manner so refreshing. Goes a long way and you gained a viewer because of it. Never cooperate like that again unless the police say you're being detained or arrested. Never get out of the vehicle unless you're under arrest. Speak respectfully and know your rights.
Getting out of the vehicle and standing and facing a direction was a big mistake. That is so a "victim" or "witness" can come and identify you. Many times, the victim is traumatized and could mistakenly identify you as their assailant, and off you go to jail even if it wasn't you!
Lastly, interview and find a criminal attorney BEFORE you ever need their services. That way, when something like this occurs, you can consult with that attorney to avoid making a costly mistake and going to jail.
I love how the cop explained that the victim can get colors wrong under high stress situations, but if that same victim said "yeah that's him".,,, he'd be shafted. No consideration of the mindset of the victim the moment they point a finger.
My quibble is that PA v Mimms states that you *_MUST_* get out of the car when police order you to do so. The Supreme Court decided that in 1977, so it's been the case for a minute.

Yeah, there's a famous case (Oscar-winning documentary on it is "Murder on a Sunday Morning", fantastic) where a random black kid walking down the street agreed to a victim ID. The crime was murder. The victim a white tourist from the Midwest had just seen his wife murdered by a young black guy. He immediately ID'd the kid. The police then wrote out a "confession" and forced him to sign it.

Our forefathers fought a Revolution because they were “so into their rights.” He’s a genuinely decent human being, for whom things gone wrong. He could’ve easily been misidentified (remember black van/gray van) by a possibly traumatized victim. Then his smile and effervescent spirit wouldn’t have been wiped away in bewilderment after being thrown face down to the asphalt with knees in his back, guns pointed at his head as he’s being cuffed and wrongfully arrested. Thank God, this young man is both lucky and blessed his cooperation didn’t cost his safety, freedom or his life.

That is crazy. I had it happen to me when walking to work at a Kroger. I had to wait until they identified me not as a suspect in some robbery that had happened. I supposedly fit the description until I didn't. My thought was what if they said it was me? Needless to say you feel a little nervous until it's over.
Don't show your ID if you didn't commit any crime, that's a 4th ammendment violation

There is no probable cause, the vans aren't even the same color🤦🏾♂️. They need R.A.S in order to see his ID. The victim could've seen his face still w/o showing his ID🤷🏾♂️

you are correct however, you also know that if he had not shown ID, those cops would have been butt hurt and escalated things beyond where they needed to be. If that was me I would have done the same thing.

Shouldn’t have given your drivers license to him, especially since their description of the vehicle was the wrong color & the officer even said on the radio that it’s probably not him.
Never give up your rights to the government, especially to a cop. They’re not your friend & they’re not trying to help you, they’re just trying to generate revenue & hem you as well as everyone else up.
Stand on & exercise your rights or you don’t have them.
Just because it ended well this time, doesn’t mean that it will next time. Definitely be cool & remain calm but be cool as you exercise your rights.
