Interesting 🤔.....so, what determines the scope of what constitutes "commercial use", if you don't mind me asking? Because, intuitively, I would think that making money from the videos on UA-cam via advertisements would constitute commercial use given he profits financially by releasing the footage to the public for $, essentially.

@masaokakihara9316 well its monetized content so it is commercial. Theres just never been a lawsuit regarding social media being used this way. Thats the reason it flies.
@@ChicCanyon There have been suits. By people gone viral. Struck down, as there is no expectation of privacy in public. But, to take legal action, it would've to somehow infringe on your rights. If you engage in an interview in public and therefore even clearly give consent, your civil case has no standing.

But even if the recording was legally obtained, how it’s used can also be subject to legal restrictions. Publishing a recording might be subject to defamation, libel, or slander laws, or it could potentially violate a person’s right to publicity. For that reason Television has always used waivers when airing street interviews. The crowd has no grounds for suit. The person youre profiting off of could. And please cite the cases of youtube interviewers id love to read up on them.
