      This is why the “good officer” or “bad apple” fallacy is nonsense. You can’t tell me there are good officers in that department when the entire chain of command supported this. Cops will slow down service for a few percent budget cuts just to put pressure on a city but torturing an elderly Woman with mental challenges? No outrage from the lower levels. NYPD came out and cried on national television when a few cops it ambushed after not a single cop had been killed in years and they spent that time dragging massless children out of public, locking up business owners for trying to stay afloat during the pandemic, and allowing the riots to happen. They wonder why the public doesn’t support them.

    She didn't fail to intervene she took part in the assault and then laughed about it, she had no intention of ever confronting him even when he told her he heard the woman's shoulder "pop" as he put it. She then left the woman in a cell knowing she had sustained injuries and still did nothing, she deserves the same as him in my opinion as does the guy who told the witness to mind his own business when he tried to tell him they used excessive force.

    She says she regrets not intervening, but how can she explain away the laughing at hurting an innocent, vulnerable person? There is no excuse. A bystander even saw the need to intervene and she STILL did nothing!

      Remember, different charges have different penalites. Normally misdemeanors have much shorter sentences than felonies, and do think she MAY now be ineligible to get a cop job back. Knowing how much they make, if they don't serve jail time but can't be a cop again is win in my book. Lot of them quickly start getting 100k/yr due to OT etc. Add in she MAY have lost her pension to boot. If this is the case, good message to send. You going to do stupid stuff, you are going to prison, You're going to sit back and watch this crap happen, we may not be able to send you to prison for a long time, but we can prevent you from being a cop again AND take your nice pension away as punishment.

    There were 3 cops on scene. The Sergeant threatened to arrest the bystander for witnessing it? He Failed to stop them, and hid the evidence, like the Captain did later.
    There are numerous Excessive Force videos of Loveland on UA-cam.

    She should of gotten more time in jail. Showed absolutely no compassion, no respect, towards an elderly woman who could be her grandmother or therefore anyone of us grandmother. I guess she wasn't thought to respect her elders when she was growing up. Anyone abusing the elderly needs to be behind bar's or six feet under.

      @@welcometoorefuge because it's very easy to slip through the cracks. The psych test is very easy to pass. There are obvious questions that nobody would answer truthfully if they are troubled and were seriously pursuing law enforcement. It's more of a test to see if you are consistent on your answers. They ask the same questions a half dozen ways and test to see if you're consistent. As a law enforcement officer, I absolutely love seeing these scumbags brought to justice, although the female deserved more time. Unfortunately, this is not an improvement because the department saw no problem with the way these animals acted. There are a few good ones but we aren't part of the brotherhood because we are actually men of morals and integrity. Most will turn a blind eye to keep their paycheck and pension. Unfortunately, too many "conservatives" are still blind to how law enforcement truly is. It's a culture of corruption unless you find a very small agency with good men at the top. They exist but they are not the majority. More people need to be exposed to videos like this that are blind supporters of law enforcement. I once was blind to it and then I was challenged to study the matter. Within a few months of subscribing to certain channels, I was almost convinced that there were no good cops anywhere. Then I decided to be that change that I hoped to see. We need more though, people that have very high moral standards and don't need the affection of our peers in law enforcement. If enough people were like that, the tide would change. One good thing is that the academy I attended was absolutely about being respectful of peoples rights and treating them how we'd like to be treated.

    While I am happy that justice is served, I am disappointed that NO ONE in that department noticed there was something "wrong" with this 75 year old "offender". She, clearly, had no idea of what was going on and the officers (not just the male) disregarded her condition. There have been incidents where people go into diabetic episodes and cops "unload" on them because they think they are drunk. A close friend died, at the hands of police, under similar circumstances. In his case, left for three days without medical care and died in a diabetic coma. I am all for, HOLD THEM ACCOUNTABLE. A person in custody has no one to help them. The police are responsible

    Also you need to know that old lady never actually left the Walmart with the good she was stopped by Walmart employees and they took the chips and soda back. And than she left sith nothing from Walmart. We need to hold Walmart accountable as well.

    The only reason she regrets it now is because she’s now facing the consequences of her failure to stop her psychopath partner. I hope this will cause tyrant cops in other states to think twice before they abuse people. There are several other Loveland cops who should be in jail.

    She laughed about breaking bones in a frail old lady. She's guilty of felony assault and battery and I am sick of these assholes being minimally charged to let them off easy. She should be tracked down and have her bones broken and left without medical care for the 7 hours that Mrs. Gardener was subjected to.

    She is only sorry because she got caught, I don't think someone laughing would be so sorry with a straight face. Justice was absolutely NOT served. As for Hopp, this annoys me about laws when it comes to officers. They are given so much more leverage than any non law enforcement citizen, these two should be sentenced for more than 5 years, if you literally took off the uniforms these charges would not only be dealt with but the sentence would've been automatic and longer. It's no wonder people hate the police and why even the good cops get hate, because the standards in which they enforce don't get the same as them. Cop defenders and Cops always want to use the "Cops are human" defense, by which yeah, they are and they should be treated like humans. If they aren't above the law and can be arrested too, they should be held just as accountable (if not more) than the people the arrest. This is why double standards in policing need to stop, it's not only harmful to the police themselves (by which it creates scenarios that make people turn on them and likely anyone of association) but it creates a divide between the people and cops. Which isn't exactly what you want to create for people who's jobs are to protect and serve. If cops were done as equally to everyone there wouldn't be so much divide (sure there would still be haters, but there's hate no matter what you do) but the fact these cops get a slap on the wrist is everything wrong with the court system and law enforcement. It also sets a terrible and dangerous precedence toward law enforcement themselves as it makes one question how these people can get past the hiring process, in that case why would the department allow people like them to even pass the first step? Do cops not background check people, it's so easy for people to lose their jobs by normal means, but so easy for a cop to be a cop elsewhere or do shit like this and get less of a punishment, it's sooo stupid and makes no sense.
    Why should people behave or obey the law if cops can't either? You can't say one should do it and not the other, cops just enforce what the law states. I also dislike how people's right are immediately violated upon interaction with a cop, as situations like this what can you do without getting arrested? You can't do anything, if bystandards were to try and fight the cops for abusing the woman they would get "jail" if they tried to so much as step in "jail" like what can people actually do? There's no reason people should be arrested for defending someone if the officer's reason is unlawful. You should be allowed to defend yourself or someone who has been wronged in any way, period. Cops included. If a police officer has wrongfully detained you or used force in a situation where force should NOT be applied, and you decide to fight back in any way (even physically, yes, if it takes using physical force to protect someone, then use it, that includes a cop if said cop is unlawful) you have that right and should NOT be charged, that's stupid. Now imagine the same scenario and you removed the uniform, fighting back would be self defense so why is it not self defense in the case of an unlawful aggressive cop? You might as well not even have rights to begin with, as your rights mean nothing in cop encounters. Which again, sets a dangerous precedence for both cops and citizens. For cops, they have a right to defend themselves if the suspect is wrong or tries to assault them, likewise the citizens should be allowed to do the same if the cop is wrong or assaults them. So if a cop were to sexually harass someone who did nothing wrong I guess they aren't allowed to fight back? There should be no reason to deal with all that court stuff if YOU did nothing wrong, it's just an inconvenience to people's lives when stuff like this happens. It also sets a negative perception regard cops and their own families.
    Sorry for this long rant, but this deeply annoys me and really makes it hard for me to get over my natural fear for law enforcement. And despite my rant I actually don't hate Cops, just have an indifference/uneasy feeling toward them. As the cops in my town are actually very friendly and interactive, they knew I had a fear of cops and talked with me and made it a little easier for me to approach them, they even understood my criticisms of law enforcement as well. So I've had positive interactions thank god, but these cops make it hard for people to open up to cops. I really want both Cops and Citizens to be of equal importance, that's why I made this rant. I also think people don't get treated like human beings in jail either and the jail system itself is also awful, but that's another rant entirely. Officer Diarrhea Jilawlie should have a bigger punishment! Bottom line, it makes sense why people hate cops and its justified for people to be against them given how laws work to favor them and how situations like these can ruin people's lives. It also creates a "Where is" Scenario.

    I disagree with ‘Failure to Intervene’ ONLY being a misdemeanour!
    Failure to intervene & violations of constitutional rights should mandate Felony charges.
    Misdemeanour conviction does not end her law enforcement certification.

      Dereliction of duty applies as well I think. There's another charge, I can't remember what it is, that will prevent them from ever being a cop again. Conduct unbecoming sounds right, but I'm not sure.
      Edit: Violation of oath of office is what I was thinking of. Unless they're being charged with that, the fix is in.

      Elder abuse is when a care facility has a rogue nurse. Cops not being gentle to a frail old woman is a lack of training and empathy. Keep in mind this isn’t a simple “13$ walmart jump to cuffs and broken bones.”. I’m pretty sure the dementia lead to a perceived resisting arrest and uncooperative movements. Police need that understanding of more than a simple situation otherwise you’ll get no enforcement of the law.

    Everyone conveniently forgets to mention that Walmart took back the products she walked out of the store with. They dislocated her shoulder and broke her wrist as well as broke a couple of ribs. They left her without medical treatment for 6 hours. She was hog tied and the cop was thrilled to use his new toy. Shame on them all. Shame on Walmart for not calling off the cops after they got their shampoo back.

      This is why we need to abolish Internal Affairs. Police should not be investigating and clearing themselves of accusations. It should be a separate agency with no law enforcement connections.

      Only because it was an Elderly White Citizen instead of a Black Male or Female, did any action take place. They've been way more aggressive with people from our community and have not yet been charged nor disciplined and never will be.

    Glad to see something was done in this case of assault on a civilian and that the cop who broke this poor old ladys arm was sentence for his cruelty. As for the other one not enough was done.

      I'm not glad to see she was given a slap on the wrist. She did far more than "fail to intervene" she was an active participant in the torture of that woman. The only justice we can now hope for is one of the inmates breaking one of her bones, you know since the judge didn't want to give her a sentence that would be satisfactory to the family and the general public who is fed up with the criminals in blue.

      The judge was only doing half the justice , the inmates are expected to finish the job . Please help the other inmates out by becoming a pen pal and let them know she's coming there or maybe already there . they will be very grateful , as will the judge and the rest of the county officials , as you will help them with finishing a grate job .

      Well cause they were also laughing at this old woman's pain for having an diabetic episode didn't she after they hurt her. My ex's mom had one of these, she was taking items off the shelf in a grocery store and dropping them before they got to the cart. Luckily one of the workers realized she was in a diabetic state and got her purse off her and her phone and called her daughter and we came and got her and took her home while they walked through the isles calmly talking to her. No police were called but then again, I'm Canadian.

      Actually officers, just like you and I, have no legal duty to intervene when crimes are being committed. Everyone has a right to self defense and therefore a right to stay out of harms way. It could be a policy violation leading to whatever the policy or leadership demands but never criminal.
      This particular case is different because of her physical involvement in the arrest. There was never any obligation for her to stop her partner but she should have not involved herself physically and called for medical at least.
      Btw, that first part is not my opinion, it's federal case law. Cops have no legal duty to protect you. If a cop decides to not go into a building with an active shooter they are not criminally responsible. Furthermore, if they witness another officer breaking the law they are not legally required to intervene, no more than anyone else.

    As a daughter & caretaker of my mom with dementia, it distressed me of the mom's treatment. I frequented a petstore, PET SUPERMARKET with my mom. Upon entering, I introduced myself, my mom to explain her condition & said that if mom ate anything or took anything, I would pay. They were always kind. (Mom lived with me for 9 years with her dementia until it had gotten really bad. Mom is now in a lockdown facility that is kind with only 15 patients). Anyway, mom would grab cat toys with feathers & eat dog cookies. They kept a tally for me. I put a GPS tracker on her & clipped a name tag that said, "I have dementia a form of Alzheimers. Thank you for understanding. My name is Xxxx. If list, b please call xxx." I also had business cards about the dementia as mom would say things; especially on elevators. Mom would also be too excited about children in a good but invasive way. Eventually I put a Med Alert bracelet on her BUT she would take all those off as well as her clothes. And a big THANK YOU to kind neighbors & Ben Posey for looking out for Mom when she escaped even with special locks. I finally figured out to turn on ALARM for IF momBbroke OUT! Mom was walking down our street in a formal gown worn over Hello Kitty Pajamas. Over the gown was a leopard printed vest. All topped off with a beret. My husband came home early and said come on, mom looked like a colorful homeless woman who would not get in his car. Thankfully Rick came home early & mom told him that she was going to her DADDY'S house. At the time, mom was 86 & Grandpa Hirouchi had passed years ago in Japan.
    For the officers to be so rough to an elderly lady who was kind but obviously senile (dementia), to laugh & not see immediate medical evaluation for her physically & MENTALLY? I would be so 😡 😞 upset with their lack of humanity.
    A side note, I would only shop @ Michaels & Target with mom. It was the employees there as humans with humanity & not necessarily the store. But it said something that the Mgt hired those kind of people as employyes that made a bright spot in my difficult time. Anyway, Target's snack bar employees & register employees would greet mom, "HEY GRANDMA which would light up mom's face. Mom would tell the snack bar employees that she just came from Japan. " & KEEP eye out for her. And a few other stores ^ restaurants. My niece & brother said that it felt like mom was a celebrity. Those employees were people with HUMANITY. Their kindness to an old lady with Alzheimers & her caretaker made the world better. A kudos to:
    Celebration's Chris with business's owners, Rococo who let mom put things on counter to "buy" & later quietly put back! My 80+ year old mom did not need a neon SKULL EMBOSSED purse!. Village Pancakes! Ale House. Ichiban. Tu Du.

      I read that with pleasure. Both my parents had dementia and I was the one in the family who noticed when dad would go wandering and I'd chase him with my car. My mom was paranoid about the bank they finally called me and I had to make other arrangements for mom or they'd call the police. I'm happy your mom had good years. My parents did too once they were accommodated at a pch that specialized in helping them. It was a sad time. This story hit me hard.

      Take heart, it's not over!! We did pass that law where cops can personally be sued. Now that they won the criminal part, the family can go after each of them. I saw the footage too, and the press conference by the family. Those cops will be ruined financially. The only way to get at the heartless is in the wallet. I can't wait to see how much the family gets! That woman was living independently before the attack! Now she needs 24/7 care. Those cops should be paying for the rest of their lives.

      Ive heard of so many officers doing things such as this but never even getting as so much a smack on the hand for.
      Police in maui Hawaii have done so many things here. Such dragging someone behind a police car in the can feilds. This was decades ago but it happened. So many were corrupt cops down here.
      Another time i heard of a guy getting ran over on purpose for being in a sleeping bag in a parking lot in the dark and the cop just about killed him. All the cops did was take him to hospital and warn him he protested this insident he would probably be dead. I told him to go talk to the FBI. BUT he just dropped the case because he was scared.
      They filleted his skin off his legs from the bumper rubbing all his skin completely off of his legs when they ran over him on purpose I could not believe that he only did that I was so pissed off I couldn't convince him to go and get an attorney he should have fought this. This was 10 years ago , now hes in a mental institution.

    The fact I’ve lived to see cops go to jail for not intervening to stop fellow officers use excessive force cases thrills me to no end! A misdemeanor (I’m pretty sure her first) and she STILL gets jail! It’s so rare to see accountability like this.

      Yes, qualified immunity is under the microscope and civil liability law suits is getting traction, especially about failing to intervene and protect public.
      There is hope, but the cops on the street are in a war zone, attacked, getting to be ineffective, and prosecution are hard to get for the criminals that need long jail time.

    I'm glad there was some justice in the case. It reminds me of another case in Huntsville Alabama in which the police stopped an elderly man just taking a walk not committing a crime as in the Karen Garner case. The officer knowing the man didn't speak English and couldn't understand what he wanted the officer grabbed him and viciously slammed him to the ground paralyzing him. The the cops tried to make him walk and picked him up and dragged him exacerbating his injuries. The cops were charged and the jury failed to bring a unanimous decision. The cop was cleared, given backpay and returned to work.

    I'd like to point out something that most people already know, yet some people keep ignoring. This isn't a "need more training" issue. No amount of training can stop cops like this from acting this way. Its down to recruitment, police departments actively seek out people like this. Its systemic. It's the "alpha" culture that we currently live in. The entire current recruitment process needs to be ripped out by the roots, and changed. Cops need to be fully and individually held accountable. Any lawsuit payments need to be taken out of the police retirement fund, and never from taxpayers. Abolished qualified immunity on all levels. Install independent civilian oversight committees, and make sure no one has any ties whatsoever with police; this includes having relatives as POs as this will create one sided bias.

    I would think that theft of items under $100 would be a misdemeanor, and would HAVE TO be witnessed by the arresting police officer, or Karen would have to have been placed under a citizen’s arrest at the Walmart. And neither of these happened.
    As the officers approached Karen, they could easily see that she was CARRYING NOTHING that could have been stolen from Walmart…..So, I ask, “what right did the police have to try and FORCE Karen to stop and talk to them”? Does Colorado’s laws FORCE a citizen, who the police cannot accuse of committing a crime to talk to them”?

    Glad the family got justice. It's a start in the right direction, but more needs to be done to send a message to these tyrants. Zero tolerance policies need to be enforced immediately! Make it well known that if you screw up, not only will there be a full investigation from an outside agency, you will be suspended without pay immediately. If they know they won't have money to pay their bills, they may think twice before they violate someone's rights.

    Until they hold the Sergeant accountable for threatening the citizen who complained about this, there still isn't justice. This isn't the first or last instance of police brutality in Loveland. How does the sheriff keep his job and why aren't the city council doing something to clean this up. The taxpayers are the ones who have to pay these lawsuits off.

      Sheriff is county and these are local police. Local Police aren't accountable to the sheriff. That's why they should be abolished. Local police answer to the municipal leadership, not the sheriff who is elected to office. The chief of police isn't so corruption is much more likely in that situation. The sheriff has jurisdiction over them, but unless he is there to intervene there's little he can do.

      @@danhansen5503 I agree, and I am an officer that loves those who record LEO. It is starting to make a small difference, so much that some municipalities are trying to pass laws that prohibit the recording of cops. I would like nothing more than to see these dirt bags no longer be able to abuse those they swore to protect and serve. Going through the academy was hard at times knowing that the vast majority of them would have no problem dishonouring their oath. Unfortunately, the same is true for the military.

    This officer did more than fail to intervene, she was involved in the arrest. 5 years in prison on felony charges wouldn't be enough.
    Both officers should have civil suits taking all their assets, their pensions, all all future earnings.

    When I was younger I respected the majority of the police officers I knew. Now it has reversed. Of all of the officers I personally know I respect very few of them. All too many of them think they are a public military whose job is to enforce their personal "will" on everyone but their colleagues. Also they escalate situations rather than defuse them.
    The female officer should have gotten a felony charge to make sure she never is a police officer again.

    What was heartbreaking was watching Karen's hands holding the flowers she picked as she smiled at them. To than watch as these Leo's laughed at the suffering they inflicted on the most vulnerable person is a memory I will never forget. What about the sgt that tried to discourage a witness from speaking out against the abuse he witnessed? Yet Leo's can't seem to understand why the public has no trust or respect for them.

    what I find amazing is when arrested she was not in possession of and stolen goods , and the call to service of police was false , the items were taken from her at store , she did not keep them so no theft

    It's really sad that police officers can't tell the difference between someone who is mentally incapable and someone who is playing games with them, but the fact that the person was not only mentally ill but she was also an elderly woman over 70 years old who was suffering from dementia and the police didn't care about her or her safety and they were physically aggressive towards her and caused her serious injuries and not only that but they put her in a jail cell for over several hours before she was able to get any medical attention and that's completely unacceptable for the police to do that to anyone in this country!!!

    I will feel that the police are holding their own accountable when the sergeant that intimidated a citizen who reported the abuse on the scene is fired and charged, when the sergeant who repeatedly mislabeled his body cam video and then deleted it out right is held responsible. I will feel the police are holding their own accountable when the chief of police who fought to protect these officers and is still fighting to protect the sergeant is fired.

    When 9NEWS covered this why did they not speak to the history of this department.? This also goes to show training is not the issue. It is the culture and character of the people departments are making conscious decisions to hire. What would have these, or any cops done if a member of the public assaulted a cop this way? They would have been shot. Just saying.

    Absolutely disgusting. I think news stations should start doing more stories on the corruption in law enforcement and government. They should be held to a higher standard. They need to be held accountable. They have been abusing their so called authority for so long they think they are above the law.

    Imagine spending 5 years in jail (guy cop), and 45 days in prison (girl cop) for breaking the arm of an elderly woman with dementia...all over $13 of goods she didn't actually steal from Walmart. Literally $13 of goods from a freaking Walmart that weren't even stolen led to two people serving time in jail and a woman being horribly beaten.
    Jesus Christ what a dystopian nightmare.

    The judge gave to the cop a very nice slap on the face of being in jail for 45 days and 36 months of probation.
    The judge on the other hand should of given to the cop 45 years of being behind bars and 60 months probation.

      As a LEO myself, I couldn't agree more. I had to view videos like this in the academy in our duty to intervene class. I was so upset that I literally couldn't sleep or focus for a couple of days. The sad part is that the academy trains us to be good cops that respect and protect and serve the public but there are very few people who are willing to do the right thing for fear of ridicule by their peers. It takes a strong person to do this job the right way knowing they will not be part of the "brotherhood" for not compromising. In reality, most people would rather be surrounded by "friends" and acquaintances than to walk alone with integrity, no matter what profession they're in.
