@jrelyea828 if two people commit the same crime, one is white the other is of color, 90% chance the person of color will get more time. White sex offenders get off with a year or 2, while colored sex offenders do 15+ years (they should be locked for life)

Yep it's not fair. They are more likely to survive as they have slower reaction times and don't brace for impact, this means they are more likely to suffer less broken bones ect and the alcohol then acts as a buffer that inhibits certain chemicals that are released when a person suffers a major injury. The same phenomenon can be seen from sleeping passengers and unconscious patients in ambulance crashes.

He was so drunk I don't think he is aware and may not remember anything that happened the next day. Although, I believe anyone in a crash as horrible as this (even the perpetrator) should immediately be checked out at the hospital. He may have a serious head injury or internal bleeding. The officers could then be held responsible. They could have taken his BAL while there. This is so sad this father was killed by someone so stupid and irresponsible. Why do people continue to get in a vehicle when they are impaired? I haven't finished the video, so I don't know what happens.
How do most drunk drivers walk away from an accident with little or no injuries? The guy doesn't even wear seat belts, and he just gets a small abrasion on his forehead.
It mostly came down to the vehicle in this case, he’s in a big red fuck-you-everyone-else lifted pickup, that’s probably never even been off-road and is as clean as the day it was bought for him, the lifted suspension raised him above the impact area so the force didn’t hurt him (outside the general force that make him hit his head against the roof, mostly due to his lack of seatbelt), but totaled the truck, while the other car had the now lifted bumper of the truck crash right through the driver’s side window and into the Father/driver and killed them instantly.

That's usually the only thing they are about. We've seen quite a few videos where the drunk kills someone, or multiple people, and only cares about themselves and the inconvenience it causes in their own lives.
@jrads11 Why would anyone expect someone under the influence of alcohol to be able to make good choices? Why would anyone expect that people will not drive drunk when there are bars everywhere and alcohol for sale legally? Alcohol takes away people's inhibitions causing them to make bad decisions. So making it illegal is the only way to reduce the amount of people drinking.
While I understand the thought behind it, that's a really bad way to go. The law cannot discriminate who it is better to murder and who it is worse. What matters is if it was intentional, nothing else. Disparity of laws creates protected groups and minorities and leads to opression. After all, once we are all used to the fact one murder is better than the other, we will look as to why battery isn't. Or stealing. You can see where it goes wrong from there...

Think the suspects family has much more issues than drinking...and now editing this having watched till the end, my feelings were correct, seeing how he plead NOT guilty just confirms how cold and heartless he and his family is.
It's not "an accident". It's not a "mistake". This guy STOLE the most valuable thing a person could steal. Someones life. @californiaslastgasp6847 10 years is plenty for this crime. Premeditated murder gets you 25 years. Manslaughter gets you 10-15. This is Manslaughter. So, 10 years is plenty. You could argue it's on the high end, possibly 5-8 would have been sufficient. But, it appears that there was a decent judge on that day, because they gave him 10 years instead. People forget that emotions have no place in a courtroom. One side demands life, the other leniency. Both sides are biased. The judge is the only rational thinker. He decided 10 years was required. Families want an "eye for an eye". God will enact His own justice on everyone, according to each his/her own deeds. "Vengeance is mine, says the LORD. I will repay."
10 years is actually a long sentence for this. It's not long enough, in my opinion, but most drunk drivers who end up killing someone don't get that long.
The law only looks at intent, it will be argued he did not intend to cause someone's death, his actions can then only be considered as negligence. A moot point as the state offered a plea deal to secure the conviction, stats matter to DA's on the political track, not justice.

I would pick up a 6 pack of Michelob and drive around town drinking it by myself. Countless times I would drive absolutely smashed. I never got busted and never got into an accident so I was lucky. As I got older I started realizing I wasn’t as good at driving drunk as I use to be. I even drove drunk AF a couple of times with my infant son in the back seat. What an absolutely selfish and disgusting person I was. July 28th 2001 was THE last time I had anything to drink. My wife and I both just stopped. It’s just not worth it. From a European perspective, the field sobriety test is a stupid test. A breathalyser test would instantly determine the level of alcohol toxicity in the blood. And the severity of the charge based on the results.
As a european who lives in the EU, the european justice system is a joke, its despicable, in every single country. You don't have to like how the US does things but overall its way more effective than anything we do in the EU.
Breathalyzers are extremely inaccurate and only test for alcohol, not other substances the individual might be under. Cops in the US use the FST to determine if the driver was fit to be driving or not, which will give them probable cause to do a more accurate test like the urine test used in this case.

And only got 10 years in the end. What a fucking cruel joke that is. My heart goes out to the family of Mr. Pappas and I can only hope for a more severe sentence to be handed down to the amoeba brained waste of life Jacob L. @sethranney within 10 years is crazy. Let's say drunk drivers get caught 1/20 times they drive drunk. You can prevent drunk drivers by giving them proper sentences for homicide (1st degree) and not the slap on the wrist they always get. R.I.P. John Pappas
The problem comes with proving specific intention. "1st degree homicide" is not a real term, the legal class of that crime is called murder. In order to prove murder you have to prove beyond a reasonable doubt there was premeditation, deliberation, or intent to kill.
And put all the lawyers who stand up to DEFEND THESE DRUNKEN BASTARDS!! And any sleazy lawyer that stands up to defend these people should be in prison RIGHT WITH THEM! I had to unscrew the screws from the lid and then pick up the lid to put it to the side, all while my sister watched and was crying. It was heart wrenching to hear her say “look Jason, that is your grand dad…” The worst thing for me wasn’t seeing the shell that used to be my dad but when my sister kissed his forehead and I felt compelled to do the same, only to wipe my mouth as it felt so wrong. I got 6 years on my 2nd dope case. No sales or intent. Just simple possession. They raided my house. I did 3 years starting that morning they kicked my door in. The justice system is so flawed and pathetic here. CT laws are crazy strict. It's nicknamed "the inmate state" because we have 21k males locked up in our prisons in 2007. We had 3 county jails. And 15 prisons. Only 1 female prison which is also their county jail in a section of it for unsentenced inmates. You can't mix them. Look how small of a state we are with 3.5 million people. That doesn't include people on probation, parole, or out on bond.

10:24 "For reasons we cannot determine, the officers talk and decide to take it further down the road". I'll answer this. I'm retired LEO after 21 years. The cops KNEW this was going to be a court case, where it would be a loooong trial, and whoever the defense attorney was going to be, they knew this would be a 2-3 year case fighting everything (because of the fatality). Any officer know that defense attorneys love to say "the area where they were doing the WAT and OLS (walk and turn and one leg stand) was NOT level, so they don't count." Knowing that the defense attorney was almost CERTAIN to try to make a deal out of an uneven surface and attempt in court to invalidate the evidence, they preempted this defense by just moving to a flat surface then and redoing the WAT and doing the OLS. That's why they moved. I sure as hell would have to, knowing that was going to pretty much be either one of or the absolute key piece of evidence to get a conviction on a involuntary manslaughter charge (20+ years typically in prison).
It happens in many countries. At least the US has life without parole and means it. It's not the case here in New Zealand, where they get life, with a minimum term. Yep, never life without parole. It's a joke. What's wrong, is that this arrogant sob thought he could do whatever he wanted and fk the law. He was an accident waiting to happen. he should have been made to pay compensation to the family as well.
Meanwhile this police jurisdiction will pull you over for doing 4mph over the speed limit. I had a Jackson cop pull me over for no front plate, AFTER the law no longer requiring a front plate passed, a month before it went into effect. Actual dangerous shit is A-okay though.

@@randallanthony1794 drink driving is not negligent, it is a deliberate choice. A drunk, driving a car, knowingly endangers other road users. If someone dies as a result of impaired ability due to alcohol, it is homicide. I used to drink drive myself- people who do this (including me, back then) think we are fine to drive when we drink, but no, that is an alcohol induced delusion. I finally realised my error and stopped drink driving, thankfully before I killed anyone.
So... Drunk driving, totaling your car, wrong side of the road, having a weapon, killing another human and a dog is only 10 years? What the actual fuck?
also notice how when family members of his got on the phone w/the cops the cops never let on that this guy is their prime suspect and is potentially in criminal trouble. Because if they did, his family might have convinced him to lawyer up, refuse tests, remain silent, etc... They just said he's ok. When asked other details that the cops obviously knew the answer to because we saw the answer ourselves in the bodycam footage, they'd say they don't know, they just want to let them know he's ok. When asked if they could come to him, they tried to talk them out of it, oh sorry the roads are blocked, we'll call you later (after we're done sweet talking him into helping us to get as much evidence against him as possible). When the suspect himself asked how the other car was, they pretended they had no idea and just gave him 'i don't know'. They knew. But if they told him and he realized how much trouble he potentially was in, depending on all the evidence, then he might make it more difficult for them to get that evidence. Even letting him go can help because he might go do something that gives them even more evidence, like confess to his friends. So they did far more than it appears.

did we watch the same video? the drunk driver asked multiple times about the other car in the accident and the cops wouldn't tell him anything. and you act like he MURDERED someone, it was MANSLAUGHTER as he didn't mean to kill them drunk or not. which he proved in court and is why he got 10-13.5 years. i'm not agreeing with the drunk driver but you cant charge him with something he didn't do.
He was at fault drunk driving, answering a cell phone, and took someone's life ? I'm not understanding why they let him go home the same night . Are they saying they're gonna wait on blood work when her dad died on the scene? That's crazy.
Standard procedure with a DUI. If you act civil throughout the process, they send you home once you fill out paperwork and give samples. They can't hold you on something like manslaughter without evidence and he hadn't broken any other laws outside of driving drunk. The accident is still just an accident, until they can prove with legit evidence that you were driving while heavily intoxicated. They also need process the scene and get the death legitimized via the coroner, before they can say you killed someone. If they don't do everything by the book, hence the time taken to do the field sobriety tests, the guy can walk and not be held responsible. This was handled perfectly, and dude ultimately paid a heavy price for his poor decision making that nigh.

The saddest part is if first time offender kills someone while being drunk behind the wheel, they get charged with involuntary manslaughter and almost always get only 3-7 years in jail, some don't even get that long in jail, and are back out doing the same thing. From experience , a drunk driver killed my little sisters husband on his motor cycle ,and she got only 3 years in jail, and 1 year probation. But based on the fact this guy had so many previous infractions shows that he knew DAMN WELL what he was doing was not only wrong, but dangerous. He chose to be a piece of shit and disregard the lives of people around him after knowing better.
It’s always the drunk drivers that live, awful.
Because they flop around like ragdolls and the other people see it coming and tense up, overcorrect, etc. It's something I would NEVER want to have to live with. That's why IF I have one cocktail, I'll Uber and get my car the next day. If I'm planning on drinking, I'll just Uber there so no temptations or alcohol driving the car instead of me.
@@TheNeonNugu realize this is a myth?

When drunk your body doesn’t tense up like a sober body
It mostly came down to the vehicle in this case, he’s in a big red fuck-you-everyone-else lifted pickup, that’s probably never even been off-road and is as clean as the day it was bought for him, the lifted suspension raised him above the impact area so the force didn’t hurt him (outside the general force that make him hit his head against the roof, mostly due to his lack of seatbelt), but totaled the truck, while the other car had the now lifted bumper of the truck crash right through the driver’s side window and into the Father/driver and killed them instantly.

10 years is plenty for this crime.

10 years after killing someone else’s father due to your own negligence is such a sad thing to hear. It’s always the drunk ones that live.
From a European perspective, the field sobriety test is a stupid test. A breathalyser test would instantly determine the level of alcohol toxicity in the blood. And the severity of the charge based on the results.
I'm glad I'm not the only one who thinks that same thing that you just said. Straight simple to the point
As a european who lives in the EU, the european justice system is a joke, its despicable, in every single country. You don't have to like how the US does things but overall its way more effective than anything we do in the EU.
Agreed. Especially after a major collision.
Breathalyzers are extremely inaccurate and only test for alcohol, not other substances the individual might be under. Cops in the US use the FST to determine if the driver was fit to be driving or not, which will give them probable cause to do a more accurate test like the urine test used in this case.

To be fair, the investigation wasn't complete. He could have been the victim of the MVC for all they knew at the time.
You can gather way more evidence from a suspect when their guard is down.
its an investigation, it takes time. they got the sample of his urine and when the test came back they put out a warrant and he was caught the next day. they also are making small talk with him to build rapport (not because hes a "victim"), maybe to get him to open up or to take the test because the suspect will be more vulnerable if he feels like he can trust the officers.

10 ????? for murder ?!?!?! How in the hell
AND PRISON SHOULD BE NO TELEVISIONS NO WEIGHT ROOM THEY SHOULD BE WORKING HARD LABOR 12 TO 14 HOURS A DAY.

Ohio laws are trash. This guy took someone else life because of his poor decision and yet gets a light sentence. Our system sucks!
In a situation where it's obvious that a person ia guilty, and not some BS railroad case, then why are we so soft on crime?

also notice how when family members of his got on the phone w/the cops the cops never let on that this guy is their prime suspect and is potentially in criminal trouble.
