      I lost my mom to cancer when I was 22 and it was horrible, but at least I had time to say goodbye. I can't imagine losing someone so suddenly like this.

      the blood and gore part of seeing that is the worst,
      that picture will remain in her head for the rest of her life, and occasionally when she sits alone in silence, she will have flashbacks picturing that same image of her father,
      really sad for that poor girl and i wish her whole family condolences,
      i saw something similar 24 years ago, but it wasn't from any family of mine,

      Seeing that the truck's front driver side tire and fender completely demolished the cars driver side....I don't even want to know how the body looked.... that truck type weighs roughly 4,000-5,000 lbs..just an awful accident that never should have happened.

    It’s not a “mistake” to drive drunk. It’s a choice. Get a ride or take an Uber TO your location so you can’t drive home.

      Everything is a choice, some choices are better than others. Bad choices are generally referred to as mistakes. When somebody drives under the influence the consequences aren’t right in front of them. There’s a great chance that nothing will happen at all. Getting in a car and playing with the radio or eating food or reaching for your phone or a drink is just as dangerous as getting in a vehicle while under the influence and focusing on the road.

    The guy tried to play off what he did by acting like he didn’t know what happened and thanking the police over and over again. Then we learn he has a history of reckless driving and endangering the public. He’s a monster and deserves more than 10 years. The dad is a hero. RIP to man and man’s best friend.

      He was so drunk I don't think he is aware and may not remember anything that happened the next day. Although, I believe anyone in a crash as horrible as this (even the perpetrator) should immediately be checked out at the hospital. He may have a serious head injury or internal bleeding. The officers could then be held responsible. They could have taken his BAL while there. This is so sad this father was killed by someone so stupid and irresponsible. Why do people continue to get in a vehicle when they are impaired? I haven't finished the video, so I don't know what happens.

      The plea deal system is overused now, but it was a good tactic to get people to give up information in certain cases, but in America our prosecutors have become like the Japanese where they want the conviction no matter what.

I've seen two people with identical criminal records and the same charges. The only difference being race, and the black person gets the book thrown at them while the white person gets a slap on the wrist.

      @jrelyea828 if two people commit the same crime, one is white the other is of color, 90% chance the person of color will get more time. White sex offenders get off with a year or 2, while colored sex offenders do 15+ years (they should be locked for life)

      Yeah. It was almost palpable, just watching how unsteady he was. He almost fell over MULTIPLE times while being instructed on how to do the test before he even started.

    He was at fault drunk driving, answering a cell phone, and took someone's life ? I'm not understanding why they let him go home the same night . Are they saying they're gonna wait on blood work when her dad died on the scene? That's crazy.

      Standard procedure with a DUI. If you act civil throughout the process, they send you home once you fill out paperwork and give samples. They can't hold you on something like manslaughter without evidence and he hadn't broken any other laws outside of driving drunk. The accident is still just an accident, until they can prove with legit evidence that you were driving while heavily intoxicated. They also need process the scene and get the death legitimized via the coroner, before they can say you killed someone. If they don't do everything by the book, hence the time taken to do the field sobriety tests, the guy can walk and not be held responsible. This was handled perfectly, and dude ultimately paid a heavy price for his poor decision making that nigh.

      What about innocent until proven guilty? What if he was having some sort of issue due to head trauma or low blood sugar and hadn’t had a sip of alcohol and the symptoms were mimicking impairment, wouldn’t it be right to prove he was impaired before being guilty of it?       I can see a ptest taking a while so back it with a quicker breath test to at least book him for court. Some states do a summons but with a death it’s way strange.

    My husband passed 9.22.23 he had a heart attack while driving his dump truck. He was only 46. I remember getting to the hospital & the doctor walking in to tell me he didn’t make it. I’ve never felt a pain or let a scream out like that. Now I’m 32 and widowed. We were together 11 years. The absolute love of my life. Seeing his body was traumatic the cuts on his head and face. I had the priest re new our vowels and read his last rights. I love you Chris 7/7/77-9/22/23
    My life changed in an instant. Everything we worked for gone. Staring over while grieving is so hard. My heart goes out to the family of this man. He was a beautiful soul. God bless and help us all 🙏🏻

      That's so very sad! I'm so very sorry for your loss! That's truly heartbreaking to hear. I do know that pain. My dad passed away from a heart attack at age 52. And I still can remember that terrible pain of walking into the empty funeral home to see him lying in that casket! You never forget that. Huge hugs and internal peace to you always ❤

    my dad died in 2012 from a car crash while he was driving home from work on his motorcycle. the lady who hit him was driving a pickup truck without a license. she only did three months while i had to grow up without a father. terrible terrible world we live in.

      I am so sorry. I was slammed into at a stop light at 10am. He was a physician with a history of opioid abuse . I ended up with a broken neck and multiple surgeries.
      On deposition and in court, he stated that "he didn't recall" what happened.
      Unfortunately, my family and I recall all too well. I am reminded of it every damn day.

      A person should NOT be punished for an honest accident.

      @@davelowets i get where you’re coming from but when an accident is completely avoidable it is no longer an accident. she chose to get behind the wheel and drive while her license was revoked for previous traffic violations. i don’t care what logic you try to use to defend your argument, she WAS in the wrong, she KNEW she was in the wrong, and there’s no denying that the whole thing could have been avoided had she have been following the law and not be driving in the first place. but way to go to side with her, i highly doubt you’d feel the same way if someone close to you suffered the same fate.

    The fact that the mom was trying to keep it together for her daughter, barely able to fight back tears… I just know her husband was a very lucky man, blessed with a beautiful family who will never forget him.

      Because they flop around like ragdolls and the other people see it coming and tense up, overcorrect, etc. It's something I would NEVER want to have to live with. That's why IF I have one cocktail, I'll Uber and get my car the next day. If I'm planning on drinking, I'll just Uber there so no temptations or alcohol driving the car instead of me.

      Yep it's not fair. They are more likely to survive as they have slower reaction times and don't brace for impact, this means they are more likely to suffer less broken bones ect and the alcohol then acts as a buffer that inhibits certain chemicals that are released when a person suffers a major injury. The same phenomenon can be seen from sleeping passengers and unconscious patients in ambulance crashes.

    Let me get the straight. He chose to drink and drive knowing that he has a history with similar charges, proceeds to speed to 90+ mph while being in the oncoming lane and gets into a horrific accident resulting in the death of a husband and father along with his dog while nearly ending the lives of the other passengers.. And only got 10 years in the end. What a fucking cruel joke that is. My heart goes out to the family of Mr. Pappas and I can only hope for a more severe sentence to be handed down to the amoeba brained waste of life Jacob L. Muiter who knew what he was doing and the risks that went along with it. I hope he never forgets the pain he caused. Rest In Peace John Pappas and his loving companion Cookie- you will be sorely missed.

Why would anyone expect that people will not drive drunk when there are bars everywhere and alcohol for sale legally? Alcohol takes away people's inhibitions causing them to make bad decisions.     It's not "an accident". It's not a "mistake". This guy STOLE the most valuable thing a person could steal. Someones life. And stolen not just from the person he MURDERED, he stole that life from his family. And all he received for this was 10+ years? Driving under the influence is a conscious decision any ADULT should be able to say NO to. This is bad at ALL levels.

      10 years is plenty for this crime. Premeditated murder gets you 25 years. Manslaughter gets you 10-15. This is Manslaughter. So, 10 years is plenty. You could argue it's on the high end, possibly 5-8 would have been sufficient. But, it appears that there was a decent judge on that day, because they gave him 10 years instead. People forget that emotions have no place in a courtroom. One side demands life, the other leniency. Both sides are biased. The judge is the only rational thinker. He decided 10 years was required. Families want an "eye for an eye". God will enact His own justice on everyone, according to each his/her own deeds. "Vengeance is mine, says the LORD. I will repay."

      The law only looks at intent, it will be argued he did not intend to cause someone's death, his actions can then only be considered as negligence. A moot point as the state offered a plea deal to secure the conviction, stats matter to DA's on the political track, not justice.

      It's tough to hear the cries of someone that has lost their loved one. I felt so emotional after hearing her. One thing have never thought about(when it comes to police) is that they are placed in these situations where people have been exposed to horrific trauma and try to distract them as best they can to keep them from seeing their loved ones mangled. Normally I am pretty negative about cops and shooting everyone. The police officers here aren't like the ones I've encountered, but I've never lost someone like this.
      Trucks like this one are everywhere. When I park my normal car at the grocery store I can't help but think about one of them plowing in to be head on, and how that would most likely be the last thing I see. A big wall of filled with small dicks.

      its an investigation, it takes time. they got the sample of his urine and when the test came back they put out a warrant and he was caught the next day. they also are making small talk with him to build rapport (not because hes a "victim"), maybe to get him to open up or to take the test because the suspect will be more vulnerable if he feels like he can trust the officers.

      They had to investigate and do their jobs first. I had a misdemeanor and a felony on the same night but was only arrested for the misdemeanor first and released after I posted bail. I was arrested for the felony almost 3-4 months later. I'm not saying learn it for future crimes you may commit, just so you're not confused as to why this happens.

    I don't understand how he was not told (at the police station) that he killed a man. The officers all acted like it was nothing, and seemed to downplay the seriousness of it all.     I lost my fiance in 1982 to a drink driver, head-on on a sharp curve. I spent 32 years on Fire/EMS picking up the carnage caused by those who chose to drive when intoxicated. It is not a mistake. It is a stupid, heartless, narcissistic choice. And 10 years for slaughtering a father and husband is a travesty, an insult to the victim and his family.

    I was widowed at 23 yrs old by a drunk drive. i had married my high school sweetheart and we had so many plans. In a split second he was erased from the planet. Its been many years and I have dealt with this pain and am ok. But....the people who do drink and drive and kill others will never understand the pain, loss and emptiness when you have your world taken from you by the careless actions of a drunk. This guy served time. The drunk driver who killed my husband was also killed in the crash. So think that helps. It doesnt. Its worse because you want to see that person pay...he did...but not the way I needed him to be treated. Please if you know anyone who drinks and drives PLEASE stop them. You will save their life and for sure save the person drinking.

      Drunk driving to me is just way too accepted and common. How did society get like this? I feel like the alcohol lobby who keeps these laws for DWI loose has blood on their hands.       also notice how when family members of his got on the phone w/the cops the cops never let on that this guy is their prime suspect and is potentially in criminal trouble. Because if they did, his family might have convinced him to lawyer up, refuse tests, remain silent, etc... They just said he's ok. When asked other details that the cops obviously knew the answer to because we saw the answer ourselves in the bodycam footage, they'd say they don't know, they just want to let them know he's ok. When asked if they could come to him, they tried to talk them out of it, oh sorry the roads are blocked, we'll call you later (after we're done sweet talking him into helping us to get as much evidence against him as possible). When the suspect himself asked how the other car was, they pretended they had no idea and just gave him 'i don't know'. They knew. But if they told him and he realized how much trouble he potentially was in, depending on all the evidence, then he might make it more difficult for them to get that evidence. Even letting him go can help because he might go do something that gives them even more evidence, like confess to his friends. So they did far more than it appears.

      Not to defend him, but the driver of the red truck did ask if the people in the other car were ok at least twice if not more times. He asked when he was about to go home at the police station and even teared up about it. I agree though that he should've gotten way more time because he took a life from this world! My condolences to the family of the man that got killed because of this "drunk" self-centered kid! This kid should've already served time long before this incident because of his history of driving while intoxicated. Sick and twisted so called judicial system we have that's for sure.

      I know, after my father died I wanted to see him one last time, wish I didn’t. My sister was there with her first child, so my dad never got to see his first grandchild, but when I walked in there was just the coffin and the funeral guy. I had to unscrew the screws from the lid and then pick up the lid to put it to the side, all while my sister watched and was crying. It was heart wrenching to hear her say “look Jason, that is your grand dad…”
      The worst thing for me wasn’t seeing the shell that used to be my dad but when my sister kissed his forehead and I felt compelled to do the same, only to wipe my mouth as it felt so wrong. Been nearly twenty years but I won’t forget that experience anytime soon

      The saddest part is if first time offender kills someone while being drunk behind the wheel,they get charged with involuntary manslaughter and almost always get only 3-7 years in jail, some don't even get that long in jail,and are back out doing the same thing. From experience , a drunk driver killed my little sisters husband on his motor cycle ,and she got only 3 years in jail,and 1 year probation. After the 4 years past,she did it again and plowed into a family of 5 ,and only person survived. How many lives have to be taken by idiots who like to drink and drive before it is taken more seriously?

    Oh, his license to drive is permanently revoked, like that's gonna stop him from driving when he gets out. I bet he doesn't do the full 10. The laws need to change because 7 years for vehicular homicide isn't enough. If you drink and drive that is a CHOICE. You know you can kill someone while driving drunk. You do it anyway... That's first degree murder. And my biggest beef with the US criminal justice system is the word "concurrent." It allows criminals to get away with, literally, murder.

      No way in my opinion is second degree murder. It wasn't intentional, however it led to a death. Second degree murder is not 10 years. Driving drunk is one of the most heinous things you can do.       Absolutely!! I am tired of sentencing running concurrently to other sentences. All it does is negate consequences. For those that don't get concurrent sentencing, for example, If they get 10 years, plus 7 for whatever, to run concurrently, even if they spend 10 in prison, that seven is "time served." The clock starts for both at the same time. They should never run together, charges should be STACKED!!!! Period, 10 and 7 is 17 years!!

      The problem comes with proving specific intention. "1st degree homicide" is not a real term, the legal class of that crime is called murder. In order to prove murder you have to prove beyond a reasonable doubt there was premeditation, deliberation, or intent to kill.

    As a retired FF/Paramedic this makes my blood boil!! It seems sad watching it on UA-cam, but being there, seeing the horrific condition of the body then feeling for the family that had to be right there, hear, see, and smell it. I have ZERO sympathy or use for drunk drivers!!! TEN YEARS??? My opinion is, that when Mr Pappas can rejoin his loving family, the drunk driver can be released from prison. Bless that poor wife and daughter, they should never have lost him, but they should never have to see it

      Hell I reacted the same way two days ago watching my dog get brutally murdered by our other dog. Poor little pup never stood a chance against that put bull. My mom was a hell of a lady during that. That pit bull is heavy and strong asf and she got him limp strangling him. Luckily our other pit bull survived but Joey that cute little jack Russel died. He fought for about maybe 10 minutes. For 5 of those I had him in my hands. But it was a realization that the place I’m in is hell.

      You should not be a cop if you think it's appropriate to be anything but 100% professionally respectful to someone who is 100% cooperative, regardless of what they appear to have done.
      This guy did something horrible, yes, but he never once resisted, screamed, assaulted, or otherwise did anything that warranted the use of force or forceful commands.
      A guy is also more likely to confess if he's comfortable and feels the interactions with police are non-hostile.

      While I understand the thought behind it, that's a really bad way to go. The law cannot discriminate who it is better to murder and who it is worse. What matters is if it was intentional, nothing else. Disparity of laws creates protected groups and minorities and leads to opression. After all, once we are all used to the fact one murder is better than the other, we will look as to why battery isn't. Or stealing. You can see where it goes wrong from there...

      TBI's and concussions affect the validity of SFSTs, so they ask those questions to help prevent them from getting suppressed in suppression hearings, likely what their lawyer's attempted to do. It's the burden of the prosecution to protect the validity of the tests during the court proceedings.

      I've never understood why the cops do those roadside sobriety tests in the US, as you say anywhere else in the world they just breathalise the person immediately then take them to the station for a blood test for official court records.
      It's not like if you manage to pass the roadside sobriety test while drunk you're going to get away with drink driving, or if for some reason you fail even though you're sober you're going to be charged with drunk driving, so the roadside tests and the results are pretty much redundant.

      @ats-3693 It's because not every DUI is alcohol related, and could be drug related. Everything has different indications.
      According to the National Highway Transit Safety Authority (NHTSA), SFSTs are 91% accurate in determining intoxication.
      Horizontal Gaze Nystagmus, which is not an SFST but still part of the exercises, is 77% accurate by itself, without any other tests. So if someone is flagging positive for both, then there is a substantial likelihood that they are impaired.
      Additionally, other countries do not have something similar to 4th amendment rights, or not to the same extent the US does. In order to get blood or breath samples one of two things are needed, consent or a warrant. This is why most states have something called implied consent, which dictates if you refuse to provide blood or breath samples your license will be suspended for a period of one year.

      You have to rule out concussion or other brain injuries as a result of the accident. You also have to consider factors such as medical history of the individual which the cops don't know this person's medical records. A defense attorney could create enough doubt in the prosecution's claims of intoxication if the police failed to test him.

      A proper justice system shouldn't make assumptions about something like this after only seeing the aftermath, no matter how "obvious" it looks. After a thorough investigation, he was caught, imprisoned, and can never legally drive again. I think that's a pretty good outcome.

    Man, this one hit me hard. I lived in Stark County for 56 years before moving to S. Carolina. We weren't even here a year when my husband of nearly 35 year and I were hit head-on. My husband was killed along with the 24 year old man and his 3 year old daughter. It's a literal miracle that I survived. There was also a 14 month old found on the floor behind the driver's seat. He had only scrapes and bruises, also a miracle. No one in the car who hit us were restrained. The man was going 70 in a 55mph zone, we were going 55. His Eclipse looked like a twisted mess of metal. It's been 8 years and this video took me right back to that night. My prayers for the family.
    Edited to add, it's repulsive to me that they let this guy OUT.
    Edit to add: It was on this young man's social media that he used weed and drank. We wanted a tox screen done but we were told they don't do that with fatalities. It might not matter to them but my family and I would like to know if he was under the influence.

It should be viewed as serious as attempted murder because that's what it is every time you DWI.     This breaks my heart. I found my father lying dead in the street and I lost it. I dropped to my knees and started crying and screaming. I went into shock. One police officer kept getting upset with me and telling me to calm down! I was so pissed 😤 I just lost my father in front of my eyes and you are telling me to calm down!?! Some officers need training on how to be empathetic. The ambulance workers had tears in their eyes as I was begging them to save him 😢 My heart hurts for this family having to endure this loss especially this way.

      It doesn't feel good, but until proven otherwise everyone is presumed innocent and shouldn't be imprisoned without a trial proving their guilt. We wouldn't want a system where the cops act as judge and jury, as much as it sucks looking back with hindsight on these types of incidents. It's not perfect but it's better than the alternatives.

      It's not "the justice system," it's our outdated "sentencing guidelines!" Every state has min/max sentences they can give for each individual crime, depending on said crime, misdemeanor, felony, etc. Unfortunately, these sentences have been on the books since the initial action became a crime. And for some that can go way back. Crimes and the ability to commit them have only gotten better, it's time the sentencing also gets better, and cracks down harder in this day and age. Everything changes it seems, except the punishments for serious criminal action.
