Their right to remain silent is so they don’t say anything that can be used against them in court thinking it wouldn’t have any affect, so they can stay silent and deny questioning until they get a lawyer to assist them, or get some legal advice. If they still say anything, it can be used against them in court, they state that when they read you your rights.
they stopped the show because a predator Louis Conradt who was also an attorney committed suicide when he got caught and the cops went over to his place. His sister then sued the show for making her brother kill himself. The sickest part about it is all is the other predators who where caught and recorded for that episode were able to walk away with no charges to their name. So they’re still out there.

Answer to Ken's question: The footage used before the police detain/arrest the suspect can be used as evidence. Because the suspect arrived at the house willingly, Hansen is not a police officer, and he was not being detained by police personnel during the questioning, it can be used. The officers gave Miranda to the suspect and questioned him only after he was arrested. Hope this helps -- it's to the best of my understanding.
@@pandaman5869 entrapment is known as police officers in an investigation that "force" the suspect to commit a crime, without the criminal being willing to commit said crime. In these cases, the suspect shows up to the house willingly, with intent that the suspect showed thru text messages, all in free will. So it would not be entrapment in this case. Hope this helps!

The right to remain silent thing is basically that IF they say anything, it can AND will be used against them in court. So if they make up some BS excuse and later change the story, it can be used in court to prove to the jury that they tried to lie to the police, which is generally a pretty bad idea. So by remaining silent they just prevent themselves from saying something they'll later regret.
Hey, this is kind of correct, but even before this comes into play, there a a couple reasons the guy doesn't have to be ready his Miranda rights. 1st Chris Hansen and production are not law enforcement. 2nd Because they aren't law enforcement, the guy isn't being detained or officially questioned, which is why he doesn't have to be offered a lawyer or the right to remain silent. But you are definitely on the right track; if he was being interviewed by law enforcement, there are reasons he still wouldn't have to be Mirandized, though that is super dependant on the context and the questions being asked. And you are also right that the basic reason he shouldn't answer questions is that his own comments could be used against him as evidence in court. THIS IS NOT LEGAL ADVICE, and anyone needing legal advice should reach out to their own representation or a personalized legal expert.

The general idea many have is that if you refuse to talk to the police or hold onto your Miranda Rights, it instantly means guilt, but that's a false feeling (though some may interpret it that way). Big brain time: They have the right to remain silent. Like, literally, not open your mouth, not say a word, nothing. The cop can say "Do you want to talk to me about this?" or "Do you want to answer some questions?" or anything like that. The only appropriate response to anything like that is "I wish to speak to an attorney." Agreeing to answer questions just to clear things up (or whatever stupid reason) is waiving your right to remain silent and is a really stupid thing to do. If you've been arrested, just ask for an attorney and STFU. Sitting quietly in jail overnight or for however long it takes to see a judge is a lot better than digging your own hole because *nothing* will make your case better. If you've been arrested, the only person you should talk to is your attorney. If you don't have one to call, they need to hook you up with one.

If you're being charged with a crime, nothing you can say to the police will make your life easier, but anything you say can make your life harder. Never talk to the police without an attorney.
Exactly right... except one thing- the cops in this country don’t hook you up with an attorney. You have to wait to go to court & tell the judge if you plan on hiring your own attorney or if you need a public defender. You fill out paperwork, and then if you still have not bailed out, your assigned attorney will visit you at the jail. Depending on how backed up the system is in your county, it could take several weeks until your attorney sees you. I have watched interrogations by police in other countries, in which the police actually do provide them with attorneys. In this country, police do their best within the law to prevent you from saying that you want an attorney, so that you will keep talking with them & incriminate yourself. And don’t fall for their “if you talk, we will help you” schtick.

Their right to remain silent is so they don’t say anything that can be used against them in court thinking it wouldn’t have any affect, so they can stay silent and deny questioning until they get a lawyer to assist them, or get some legal advice.
If they still say anything, it can be used against them in court, they state that when they read you your rights.

they stopped the show because a predator Louis Conradt who was also an attorney committed suicide when he got caught and the cops went over to his place. His sister then sued the show for making her brother kill himself. The sickest part about it is all is the other predators who where caught and recorded for that episode were able to walk away with no charges to their name. So they’re still out there.

Answer to Ken's question: The footage used before the police detain/arrest the suspect can be used as evidence. Because the suspect arrived at the house willingly, Hansen is not a police officer, and he was not being detained by police personnel during the questioning, it can be used. The officers gave Miranda to the suspect and questioned him only after he was arrested. Hope this helps -- it's to the best of my understanding.

In these cases, the suspect shows up to the house willingly, with intent that the suspect showed thru text messages, all in free will. So it would not be entrapment in this case. Hope this helps!

The right to remain silent thing is basically that IF they say anything, it can AND will be used against them in court. So if they make up some BS excuse and later change the story, it can be used in court to prove to the jury that they tried to lie to the police, which is generally a pretty bad idea. So by remaining silent they just prevent themselves from saying something they'll later regret.
Hey, this is kind of correct, but even before this comes into play, there a a couple reasons the guy doesn't have to be ready his Miranda rights.
1st Chris Hansen and production are not law enforcement.
2nd Because they aren't law enforcement, the guy isn't being detained or officially questioned, which is why he doesn't have to be offered a lawyer or the right to remain silent.
But you are definitely on the right track; if he was being interviewed by law enforcement, there are reasons he still wouldn't have to be Mirandized, though that is super dependant on the context and the questions being asked.
And you are also right that the basic reason he shouldn't answer questions is that his own comments could be used against him as evidence in court.

Waiving your Miranda Rights basically means you're giving permission to the police to talk to you about the crime. If you do not wave your rights, then they cannot talk to you. Usually, this initiates an interrogation which leads to a confession or incriminating evidence. If confessions or verbal evidence are given while the Miranda Rights are invoked, they are not admissible in court. A lot of people, both guilty and innocent, believe if they waive their rights, they can express how they're innocent and get out of trouble. There are often many cases when innocent people waive Miranda and then confess to a crime they didn't commit because they think it'll work out for them eventually.
But waiving your Miranda Rights really just gives police permission to talk to you and ask questions that can be used in court to build a case since confession is the most powerful form of evidence there is. If you have not waived your Miranda Rights, whatever you say cannot be used in court and police cannot talk to you about the crime. The general idea many have is that if you refuse to talk to the police or hold onto your Miranda Rights, it instantly means guilt, but that's a false feeling (though some may interpret it that way). You can also invoke your Miranda Rights again at any time after waiving them.

Big brain time: They have the right to remain silent. Like, literally, not open your mouth, not say a word, nothing. The cop can say "Do you want to talk to me about this?" or "Do you want to answer some questions?" or anything like that. The only appropriate response to anything like that is "I wish to speak to an attorney." Agreeing to answer questions just to clear things up (or whatever stupid reason) is waiving your right to remain silent and is a really stupid thing to do. If you've been arrested, just ask for an attorney and STFU. Sitting quietly in jail overnight or for however long it takes to see a judge is a lot better than digging your own hole because *nothing* will make your case better. If you've been arrested, the only person you should talk to is your attorney. If you don't have one to call, they need to hook you up with one.
In his, and many of the other tcap/hvp catches, the chat logs are often times damning enough, so I don’t think remaining silent would help in their cases.

Charges can be reduced or dropped. Look at how many p*dos on the show got away with reduced charges or early release rather than the max sentence. If you're being charged with a crime, nothing you can say to the police will make your life easier, but anything you say can make your life harder. Never talk to the police without an attorney.
Exactly right... except one thing- the cops in this country don’t hook you up with an attorney. You have to wait to go to court & tell the judge if you plan on hiring your own attorney or if you need a public defender. You fill out paperwork, and then if you still have not bailed out, your assigned attorney will visit you at the jail.
Depending on how backed up the system is in your county, it could take several weeks until your attorney sees you.
I have watched interrogations by police in other countries, in which the police actually do provide them with attorneys. In this country, police do their best within the law to prevent you from saying that you want an attorney, so that you will keep talking with them & incriminate yourself. And don’t fall for their “if you talk, we will help you” schtick.
