Lover's Quarrel: Missing Car Keys, A Dog And DUI...

- On January 8th, 2023, at approximately 3:00 am, Middleburg Heights Police officers noticed a black object in the center lane of the roadway, and upon getting closer they realized it was a stopped vehicle. The vehicle was fully stopped with no headlights or engine running at the time.
The driver and passenger, both in a relationship, had both been drinking and had gotten into an argument. The driver stopped when the passenger threw the keys of the vehicle from the vehicle window. When officers arrived they spoke with both parties and began helping them search for the keys before finding them.
After finding the thrown keys officers began their investigation for a DUI. The driver had difficulty providing a breath sample on the breathalyzer but got a reading after multiple tries. After taking a breath sample officers conducted a Field Sobriety Test, which the driver failed and was subsequently arrested.
The officers then spoke with the passenger who was with the couple's pet dog informing him they would charge the driver and bring him and their pet to the hotel they were due to stay at that night. Before transporting the passenger and dog to the hotel the officer explained that he would have to sign a release form for his partner when they brought her to the hotel but it was his choice to sign the form. Officers later brought the driver to the hotel where the passenger had previously been dropped off. The driver was charged with OVI (Operating a Vehicle Under the Influence of Liquor), DUI - Implied Consent, Lighted Lights Required, and Slow Speed.

There would only be one scenario. If I don't risk it, my loved one would die and there was NO other possible means of transportation. No way to call 911, no other people around to ask, then yes, I'd do it. I can't imagine that rare circumstance ever happening though.
Those are some really cool cops. They didn’t have to do any of that.

This just goes to show you that what respect and kindness will do for you! Those police officers were amazing! They went.above and beyond which is so refreshing to see these days! Wow, a 165. She was one of the nicest drunks I've ever seen be arrested.
* Fesses up to having 4 drinks instead of the standard "2 drinks" officers always hear
* Complies with all FSTs and PBT
* Body halfway turned with hands behind her back before the officer finishes his request for her to do so
* Politely asks for her seatbelt to be fastened
* Thanks the officer for his consideration of her safety
* Compliments the choice of radio station as she gets out of the cruiser (She was probably a very pleasant transport the whole way)
* Thanks the officer again before parting ways
Driving impaired is never okay under any circumstance. That being said, she was a model of honesty, civility, and compliance throughout this otherwise regrettable event. I hope this lovely yound lady has learned from her mistake and ditched that ungrateful douche of a boyfriend.
Douche or not, that boyfriend had the right idea when he threw the keys out the window. Maybe saved someone's life by doing that.

I like this comment thread so far. Your both good people, and I am also hoping she has learnt from her mistake. Perhaps their relationship continues and they find themselves more connected and understanding the risks.

Yes because this is real life. I ran an accommodation for 30 years and we had a strict no pet policy which each guest was informed of. People snuck pets in on occasion.

This cop went out of his way to help this man, and there well behaved dog. Some people cant see that I guess. The cop is a Very cool guy.
Those cops were cool as hell. I appreciate it them telling that guy just not to say anything about the dog. I realize that honesty is always the best policy but, it showed that the cop actually cared if that dog had somewhere warm to go or not and not just take the dog to the shelter and arrest the man for public detox. Those cops were actually cool. Good job guys!
one last thing, also, HUGE amount of DUI videos ALREADY this year and they just KEEP COMING. Some of these drunks are actually otherwise intelligent PROFESSIONALS, probably making a LOT of money. Sad to see, and a worrying trend. DUI rates could be starting to SOAR in this country, stressful last three, well, really, seven, years or so now. Thanks again, we love this channel!

Parked at night in the middle of the road with no lights on...yep, maybe prevent one but could have cause another. They both should have been arrested, and the poor dog has to live with these two.

Cordial interaction. Refreshing. Over the last month or so, a BARRAGE of extremely ANGRY drunk males threatening officers and suicide have emerged on various police YT channels. These guys acted like big BABIES when busted for DUI, making threats, even TERRORIST threats, get resistant, one guy who was not angry but TERRIFIED of police took off running like a MADMAN, hooping and hollering hahaha. Thanks for these, world is going crazy!

True story! A friend of my husbands got stopped in a small town, the police had him get out and wanted to know how high he was! The friend answered, “I only had a couple of beers”. (Probably not true). The cop asked again “ no man, how high are you”? A very puzzled friend looked him and shrugged”. The cop said “you know, how high are you, 5 feet -6 feet, , how HIGH ARE YOU”!! Good ole’ small town police! Lol😅😅😅😅😅😅😅😅😅😅

As a French citizen I don’t understand why she had to do the sobriety test since she has already blow in the breath analyser, which surely said if she was positive or not. In France , if the breath analyser is positive you’ll go the the police station take another one which will show the exact amount of alcohol you have in your system. If it’s above the legal level you lose your driving licence on spot and the juge will decide on your fine and how long your driving will be revoked (1 to 5 years). If your under the legal level you lose 6 points on your driving licence (half of the points).
How can you lose points if you're Under the legal limit ???
It’s how it is here in France and you get a 90€ fine, since you were positive to the breath analyzer.
She willingly did the FSTs. They can refuse. Police like to get visual evidence, too, if they can. Usually, they are also given a blood test as well as a breath test.

She didn't pass the breathalyzer. They like to get more visual evidence of intoxication for court, because the more evidence you have, the better.

Not really sure how this would hold up in court. Possession of the keys is a standard requirement in getting a DUI conviction. Any lawyer could easily argue that.

She admitted to driving the vehicle until her fiance removed the keys and threw them. She stated she was DRIVING to the Red Roof Inn until they began arguing, she stopped, and he took the keys. Between the fact that vehicles don't randomly teleport, and the admission on bodycam, the FST, the breathalyzer, and the witness, and I suppose if they had to, they could call the bartender and patrons as witnesses, they have a solid case. Nice try, though.

Hell no, the police is being patient and diplomatic in this case. She is trying to use head gains and distraction tactics on them, by trying her fake politeness, with her fake tones, constant apologizing, etc., In most cases when people are being so cooperative in these situations, it’s a case of distraction tactics they are trying to use. It is now up to the other party, to focus, pay close attention to not only what they are saying, but also the body language, tones in the voice etc. People use this distraction tactics, even when they phone into cr. card companies on fault’s identity. Kids crying in the b/ground, another ph ringing, talking to someone else in the b/ground etc., It’s just a fraud tactic, used in many scenarios. Be aware and alert even in your everyday life for this kind. ❤

granted, don't ever drink and drive but if you do I wouldn't ever submit to FST's. All that being considered this is why being respectful and compliant can help you. Officers were more then willing to help with giving the dude and the dog a ride. This is how it should be, great job by all involved!

Some one could have unhooked a trailer and just left it there or someone could have lost something off of a pickup. I was once driving behind a pickup and their dinner table flew off and they didn’t even notice. Could have killed me. Lots of weird stuff goes on, have a retired cop friend and she’s shared some pretty wacko stories.

The moment they smile apologetically and say they are nervous and doing it (breathalyser) wrong, is them admitting they are aware they're over the limit.
I just *cannot* understand anyone drinking alcohol if they are going to drive a car.
The drink drive limit should be scrapped as people think they can drink something and drive, but alcohol affects different people differently. If the law was a *zero* limit, i.e. if you are going to drive, you aren't allowed *any* alcohol, it might fix in people's minds.
I've never acquired the boozing habit, so got invited to plenty of evenings out when I was young, because I was more than happy to drive everyone home who needed to get pissed before they could enjoy the night.

Wouldn’t the breathalyser indicate if she was over the limit? No way would I have undertaken the FST after giving a sample of my breath! But I am Australian & we don’t have FST… only breathalysers, which are more than sufficient to establish probable cause to require a further sample of breath on a non portable breathalyser.
I have never seen them do the tests after a breathalyzer?
