Drugs, Money & Miranda Rights: Tossed Drugs Goes Wrong!

  • On September 29th, 2022, at 6:26 pm, a Circleville Police Department officer was on patrol, in his marked patrol vehicle, when he saw a gold Hyundai minivan. The officer saw the driver of the minivan fail to stop at a marked stop bar when he noticed a male passenger in the minivan who he knew had felony warrants. The male passenger exited the minivan and fled on foot from the officer who began his pursuit of the suspect.
    Another officer first noticed the gold Hyundai minivan with no other cars parked in the side lot of an Autozone. A white Toyota corolla pulled up beside the minivan driver’s window, the officer in his report stated “the two vehicles had not met for more than one minute, which based off my training and experience, is indicative of narcotics trafficking.” The officer followed both vehicles before losing visual and informing other officers of both vehicle descriptions.
    The primary officer began his pursuit of the male suspect and “unholstered his handgun” and ordered the suspect back in the vehicle. The suspect continued to run with, what the officer stated was “a clear bag” in his left hand. The officer continued to lawfully command the suspect to “stop running” before “holstering his handgun and unholstering his taser”. During the pursuit the officer witnessed the suspect throw the clear bag under a truck in another residence before surrendering at the other side of the truck. The officer who earlier witnessed the minivan, at the Autozone, then arrived on the scene to assist the primary officer in detaining the suspect.
    The officers detained and handcuffed the suspect and advised him of his Miranda Rights. He admitted to the officer he knew he had a felony warrant and decided to run upon seeing the officer. The primary officer picked up the clear plastic bag containing “a large amount of rock-like substance and a white powder substance”. The suspect later went on to say to the officers he rode with the driver of the minivan to the Autozone to meet with a man in a white vehicle. He stated he saw the driver count “at least 300 dollars in cash” before reaching into the passenger window of the white vehicle and “exchanging the cash for narcotics”. The minivan driver then gave the male suspect said narcotics “to flee” from the officer.
    Once meeting with the driver of the minivan who was asked to exit the vehicle, officers began questioning her on the bag retrieved earlier. The primary officer asked the driver to hand over her handbag where he counted approximately $62 inside. The primary officer then deployed his K9 to do a “free air sniff” of the gold minivan. The K9 did not indicate anything in the vehicle and upon further search of the vehicle nothing else was found. The driver was then placed under arrest, and advised of her Miranda Rights, before being placed into a patrol vehicle.
    Upon returning to the station the officers weighed and tested the substance found in the plastic bag at the scene. The results showed that the bag contained 29.09g Methamphetamine and inside a smaller bag 2.19g Fentanyl. Both substances along with the detained female’s dashcam and cell phone were secured as evidence. She was later charged with 3rd Degree Felony of Drug Possession Offenses, 3rd Degree Felony Tampering with Evidence, 3rd Degree Felony Drug Paraphernalia and 4th Degree Misdemeanor K9 Deployment.

      That was a decent way to run but they have all that extra stuff on including the kevlar vest which weighs a hell of a lot .. I read how much the total weighs and it is a big addition as well as shouting to stop..I'd like to see you do it without being out of breath..

      @@kimmarievan-ever6599 Yea, I'm not sure how fast I'd run with 20-30 extra pounds. And I'm more of a distance runner, but these are usually sprints out of the blue. It's actually amazing the cops many times can outrun the criminals with all the extra weight. A testament that drugs are really bad for health.

Even in my youth it would have knackered me out.. imagine trying to run in those vests alone then all the other stuff jiggling up and down.. they carry so much stuff on their person now than yrs ago when it just used to be cuffs and the wooden truncheon.. mind you the collapsible one they use now is lightish but sturdy..there was a member of staff where I worked that was a special Constable and he had duty after work so brought his uniform in. .we all had a go with his truncheon 🤪🤭..

      That’s what they do. They can command the dog to sit even if there’s nothing in the car. Be very careful what you say when the dog is involved.

    I am always blown away and impressed at how cops can run wearing all of that gear… Firearms, extra ammo and clips, handcuffs, pepper spray, taser, and a bulletproof vest… And still run props to all of them.

      No joke. It's crazy, all that gear adds, easily, another 30+ lbs to the officer wearing it. And it's bulky to boot. Not made to be comfortable that's for sure. Most of the guys I know want it OFF a.s.a.p. 😂

      No, the point of calling a lawyer is not to get it resolved right away. you say it so 1, the cops legally cannot question you anymore, making you less likely to incriminate yourself. and 2 the lawyer will help you not incriminate yourself. If you think a lawyer is to resolve it on the spot you are dumb. no one in the world thinks this. Only someone in the internet who never experienced the real world thinks this.

      @@jonmcfarlane2478all depends how backlogged the court is. It is possible and pretty common to stay in county jail for up to two weeks before going in front of a judge for arraignment. Usually an initial court date for arraignment is set within two weeks of arrest date. So it is very possible to sit in jail for weeks before the case is dismissed and thrown out. Doesn’t matter if it’s non violent or misdemeanor or felony or violent type of case/charge.

      @@colingoyette3051 So, where I'm from in NYC, you must be arraigned within 72 hours of arrest. I have never heard of anyone, anywhere in this country sitting for weeks prior to being arraigned. The info you provide on that point is quite suspicious.

      Okay you think her sister is in trouble, rather than the common Assumption of innocent until proven guilty. By this scenario you could give somebody a ride to the gas station tomorrow you could get pulled over they jump out of your car and run because they got 30 grams of dope on them and then when they're caught they say you handed it to them. Innocent people go to jail all the time because of stuff like this it happens more often than you think.

A clean innocent woman was sentenced to 8 years thank God people were able to prove the damn cops were dirty and she was able to be released in just a few months

She is referring to her usual public defender, paid for by us. But she has the power! And "her lawyer" is going to drop on the scene like batman and after a pow! bam! she will be on her merry way.

    Just saying, if she is innocent, this is just a learning lesson to know the people in your car and if they are shady, no rides. They can ditch their stuff in your car and you'll be on the hook for it. Just considering the driver was innocent.

    Having worked for both corporate and criminal defense attorneys, I am quite certain those charges against Lisa won't stick. The guy had felony warrants, he had all the dope on him and he's the one who ran. She had NO dope, no warrants and stayed put! And how can they prove any of this, or that she knew he had felony warrant? That's BS. Maybe the officer knew she would at least have a bed and food to eat, crappy as it is, it's food, since she was homeless, and could sober up by the time the charges were dropped which I have no doubt they will be. They can't prove she had intent to distribute with $60 friggin dollars on her and no dope? If she had $6,000 or $60k then sure they could. But $60? That's not some big time dope trafficking money. We had cases in Houston where the mules had hundreds of thousands of dollars on them. THEN you could prove trafficking. They can't even prove that she knew about the dope. It isn't what is obvious or who is stupid or not. It's what the DA can PROVE beyond a reasonable doubt.. Dope traffickers aren't homeless, they usually drive very nice luxury vehicles, and they sure as hell don't have only $60 dollars on them! That's laughable. And what a prick that dude was who ran! He could have owned it as he was going down anyway regardless as HE WAS THE ONE WITH THE DOPE AND FELONY WARRANTS and fleeing and eluding, but no, let's drag her down with him and snitch her out. What a punk. Not saying she wasn't in on it, just that they will have a very hard time proving it because she only had $60 on her, no dope and she didn't run either. She needs rehab, not put away for 50 years as some traffickers are these days. What a waste of taxpayer money with her. Throw the book at the little punk though.

    I got to say I do like the way this officer is conducting this situation he speaks with the people nicely and treats them like human beings while doing his job he's not boasting and being a complete ass he seems to be pretty nice guy. I have personally had encounters with officers that or just plumb ugly and it's those types that give them all a bad rep. Big shout-out to this officer you are not unnoticed you're definitely respected and appreciated for putting your life out there to protect and serve

      I mean he was definitely cordial with everyone to say the least. But he did not have a legal premise to arrest and/or search Lisa’s person or vehicle or even deploy K-9. Lisa probably suffered a lot of shortcomings even if she was only in jail for an hour because of her living situation. They might have towed her vehicle. There’s so much that can go wrong for an individual going off of an officer’s judgment call based on his/her suspicions. And they’re almost never held accountable after the dust settles. Poor Lisa probably missed out on some of her vital daily living activities that day which probably helped to keep her stable because this officer was power tripping. Officer should have hauled the man off to jail and left Lisa be.

    People don't seem to get that your Miranda rights doesn't mean that you have been arrested it just is something that officers have to read you before questioning you. Having the right to make a phone call doesn't mean you can call whenever you want, it means after all the paperwork is done, you have been fingerprinted & photographed & everything is completed on your arrest, then as soon as the officers have time but not before than you can make your phone call. Not every call that you want but the 1 call that you are allowed. If they chose to let you make more calls consider it a favor.

      I've seen videos where they turn off the audio recording, sometimes for innocent reasons, and sometimes so they can concoct some bogus story. It's a little harder to tell, sometimes, if the camera was off, or what's presented isn't all that is available. Considering how hard some departments have worked to cover up wrong-doing by their officers, it isn't reasonable to assume they never turn them off, even if you don't consider privacy issues--like if the officer uses a toilet. Personally, I think police in general have earned a loss of privacy rights--the public trusts them less now than probably any point in the last hundred years...obviously, I could be entirely mistaken.

      The definition we use for drugs is redundant. Coffee, sugar, Advil etc. are drugs we just classify these chemicals substances as legal even though basic compounds like hydrogen and oxygen are deadly with over dose. Regardless the human body converts material into illegal substances all the time, the way some individuals act it wouldn’t be shocking for people to claim you are holding drugs on your person “I just need to draw fluid from your lambic center.”
