      Keep in mind that if he got caught this time, there's no telling how many times he's gotten away with it in the past. I suppose, he may have just gotten unlucky and this was genuinely the first time but anybody that's been convicted or ticketed based on his reports is likely to be rexamining the case to see if an appeal is in order.

      @@Justinlearns Most err on the side of being A compliant bootlicker and will refuse to indict or convict. Getting an indictment on A cop for virtually any reason is insanely difficult, if you want A criminal conviction you will essentially have to do the prosecutor's job for them.

    I live 20 minutes away and I work for my local city utility. Everyone in our town is talking about this and none of us can figure out why the cop isn’t being charged. What a piece of garbage.

      It is a crime. A police report is a filing affidavit of probable cause as required by the 4th amendment. This is done under oath and penalty of perjury. The problem is DAs and Judges holding them criminally liable. The DOJ could have stepped in and charged him and the others with 18US241 Conspiracy to deprive and 18US242 Deprivation of rights under the color of law. But we see that they have chosen not to enforce the law. That is why we don't see reform in law enforcement. Not because we don't have the legislation or laws.

      Yeah it's crazy we live in a country where the supreme Court is ruling on if the president has presidential immunity or not but won't look back to the 67 cases that granted qualified and judicial immunity to protect races police officers and racist judges , I'm what many would consider a racist so I don't like to bring this up but if you look up those cases those immunities were definitely created to protect racist actions. If the supreme Court rules that the president doesn't have immunity but our judges and police officers do we should be very worried and I am not for immunity in any sort I don't think the President should have it I don't think judges should have it and I definitely don't think cops should have it these assholes keep on saying no one is above the law except for us and our armed Coons

      Under 18 USC a federal crime requiring a MINIMUM of 10 years in prison as threat of force, force, unlawful entry into the vehicle (opening the door as he obviously was not making an arrest at that time) and physical harm were included. This cop belongs in a PRISON CELL, not being hired by the next juris.

      In the absence of a legal remedy, other remedies should be sought. Since the purpose of punishing someone for actions like this is to act as a deterrent, it would be best if whatever remedy is applied is done so with a vehemence and permanent consequence that it terrorizes other officers sufficiently to deter them from acting similarly in spite of their legal privilege. Optimally, the consequences to a misbehaving law enforcement officer would be so breathtaking and dependable that the very idea of special legal protection would be seen as the greater threat to an officer's safety and security.

This happens all the time because cops protect each other.     Having grown up in rural Indiana and knowing most of the police, this officer's actions are disgusting. It's downright despicable for this to happen, and the fact that the only reason the charges were dropped and the officer fired was because of the prior UA-cam video points to a total breakdown of integrity, duty, and just doing the right fucking thing. He should absolutely be sued into homelessness, prosecuted, and imprisoned.

    Filing a false report is a crime for a citizen. Why is it not a crime for a police officer? "Letting him go" is not an acceptable remedy in this case. He should be charged as would any other citizen. The only "sovereign citizens" are police and judges.

      A former Weymouth, MA police officer was for the same thing. Just received a ten year prison sentence with supervised release, and has to pay the victim $250,000.00 thousand dollars in restitution. He also had his public safety certifications revoked. DOJ Boston office just issued a press release on the case.

      I’m 99% certain this case will not fall under qualified immunity. For starters if there was a case that is somewhat similar to this in their jurisdiction then that will take away qualified immunity. Lying on the police report also takes away qualified immunity. The fact that they fired this cop shows that they know he done wrong which will help with a lawsuit but instead of admitting they done wrong they said they fired him for safety reasons. I believe they said safety reasons that way it will be harder to win a lawsuit. Them saying it was for safety reasons was just to cover their tails. Regardless though they will win a lawsuit but when no one is hurt then it’s usually under 50 thousand. Most times if someone wins millions in their lawsuit then someone either died or was seriously hurt.

      Unfortunately, in Indiana, he gets his pension no matter what. I asked my state senator about it when the police chief in Carmel was fired and was informed that, by statute, they keep their pension regardless of why they're not a cop anymore.

Her window was down, the officer opened her door and got impatient and yanked her out and tossed her to the ground. Her ID fell onto the ground next to her. She probably was starting to freeze up because she felt threatened by his anger, but was still following his orders. She said please at all times and talked respectively.

      The City prosecutor has to rely on the information his or she is given by the police. There is no way in the world that he can investigate every charge for veracity. I do agree that the now ex-cop should be charged for filing a false police report (among other things), which his a crime.

      @@Shylock10 you can't honestly do your job if you don't have some sort of way to verify the info provided by police is true. this case exemplify the reason why. once you decide to prosecute someone, surely the gas station video as well as the dash cam and body cam are available. these would be crucial to make your case in court. why did the prosecutor ( and his office) not catch this but TCRL did? someone isn't competent at their job.

      Absolutely. But what I'm dying to know is; since we all know that pretty much the entire pretext the officer gave for assaulting and falsely arresting (kidnapping) this poor girl is an outright lie, what is the *REAL* reason why he decided to abuse his authority and attack her? She's obviously being completely compliant in the video, so what was this asshat's problem with her? Was he just in the mood to belittle and kidnap some innocent girl that day and thought she'd fit the bill?

      They fired him and they really want this gone so probably they won’t uphold his qualified immunity. I would look into all the arrests he made. I’m guessing this is not his first power trip arrest! Every one of his cases is subject to review!

      I think it works both ways. I've seen good people join the police that have these naive, grandiose ideas of "making a difference" or whatever. Usually one of two things will happen. They either 1) quit the police force soon when they find out what it's really all about or 2) they spend so much time with these psychopaths that they become one themselves, like the good kid from high school that fell in with the wrong crowd.

      In my experience, it's always the case. This is just the one that a) had video b) got exposure c) got exposure by a lawyer who knows what he's doing. Guaranteed, this guy has done this before.

      I just saw a video of the same officer escalating a situation at a racing event and trying to throw a man down who didn't do anything. He just seems like he wants to assault people and hide behind a badge.

      @@dhtango In the first video it showed the now fired cop saying to his supervisor on scene what happened, he explained how she cracked the window and then says how because she did not get out the car he pulled her out and slammed her to the floor. During all of this the supervisor is seemingly accepting everything he says as routine procedure. The supervisor should have asked "why did you want her out of the car, did you suspect she had a weapon? Why did you reasonbly suspect her to have a weapon?" "Why did you slam her to the floor? What reason was there for that level of force?" Supervisor and the culture of US cops is the problem.

      Title 18, United States Code, Section 1519 is an obstruction of justice charge. The statute allows for a 20 year maximum sentence. In reality, he will not get more than 5 years under the Federal Sentencing Guidelines.
