As far as I know, the second DUI should be considered as a 1st degree premeditated murder because they were warned about the risk.
can't be prematided murder if that wasn't your intent regardless of intoxication or not only if you drank to get your " courage " level up . I think the best way to deal with DUIs would be different guidelines based on how you were arrested for example if you were pulled over for driving recklessly instant 25 year driving ban driving is a privilege and not a right. If it's those unconstitutional DUI checkpoints no ban but have a breath meter ignition starter don't ever mix emotions into laws yes we're all human yes we all mourn and ache but come on do you want to be as bad maybe even worse to the defendant ?

Failed system. Yep, that's what I immediately thought too. Why in the world does a repeat drunk driver have access to a car? As a society we simply can't let that happen. Their cars need to be confiscated. As George Bush failed to say, "fool me once, shame on you, fool me twice, shame on me". This tragedy was 100% preventable. I'll go even further and say that most car crash deaths are preventable because our streets are negligently designed like racetracks to encourage speeding, and especially here in SoCal, they have negligently built our cities around the idea that everybody will need to drive for every little thing. We badly need to change this. And we absolutely can because many middle-income countries have safer streets and better public transit than we do. We just need to make it a priority for everybody's sake.

@@1981menso, they can't take away something you own. A license is different because it's not actually yours. If you own or lease your car, they can't take that. Also, it wouldn't matter if they did, people would still drive. 1st offense DUI no accident or anything - that would be egregious. If there is a death or injury, then yes. Prison time for sure.

It happens more than you think. I think judges believe that it is a non violent crime. The aftermath for the loved ones is a hard journey. This man seems to be doing well . I hope the best for him and his daughter.

My friend's mother, and 2 brothers were killed by a drunk driver driving the wrong way hit on collision on I 54 freeway in San Diego, the drunk driver only got 14 years, and is already out of prison.
Driving under the influence should be an automatic prison sentence every time you do it. Considering it's her 5th DUI, her apology is meaningless garbage. She just doesn't care about other people and is only upset that she has to face the consequences of her actions.
That poor girl having to celebrate her birthday on the same day her mom died. I hope I'm wrong, but I feel like she'll never be able to have a full birthday, while also connecting it to her mother's death . Hopefully while she's young, it won't be a thing for her to worry about.

I remember when this happened. That baby miraculously survived in the mother's womb. Now she is 4 years old and will always know that her birthday is on the same day as her mom's death. I was hit (in my car) by a drunk driver and it was his 4th dui and his license was suspended at the time. He was sentenced to prison and ordered to restitution every month so his wife had to send a check of $300 until it was paid. It disgusts me they let these people out to just do it again.

This tragedy is on the court and judges who have the ability after the “5th” charge and a few before this, to set an example that your district will not allow a clear drug addicted person to even have a license. This could have been stopped by the courts! This could have been prevented three times ago by not being soft on repeat offenders. The judges in her 5 cases not only could have prevented this tragedy, but passed up multiple opportunities to save the drug addicted person as well. A damn shame on all!
Hopefully we won’t hear about this lady doing the same in about 11 years. She should never walk free again in her life she is a menace with that many DUI’s.
