      Unbelievable ‼️
      I personally felt Tucker was quilty.
      However 3 grown men acting like High School kids is unreal....
      Tucker said his goons should be court ordered to stay off fb. On fb during court. I hope the Judge puts the GAG ORDER in place.
      Tucker thinks he's a big Man with a hung Jury. The Judge needs to put his cocky attitude in check.

      I agree, but they've already rescheduled a pretrial for March 7th. I hope he has a lawyer for that.

      That's exactly what I said. The prosecutor is just butt hurt because they lost to a pro se defendant. Tye did as good of a job as he could but I do think he should get an attorney for the next trial just to dot his I's and cross his T's.

    A hung jury speaks volumes about about the fact that there is reasonable doubt. Considering he defended himself without lawyers, and they still couldn't convict him, it's crazy to retry this case. They even offered him a plea deal for time already served. It's a huge waste of time and tax money to try him again.

      The only reason I can imagine them offering time served is if they know they don't have enough on him to justify the time he's already spent inside. Idk what the truth of the matter is, but something isn't right.

      Yeah I was shocked when the judge immediately said We need to get this case back on the docket... Why? Is there not more than enough reason to at least reconsider that before jumping back into it?

      @@waynefoote3781 well, I think it's safe to assume that at least the defendant will get much better the second time around.. I'm not sure about the prosecution, they seem pretty prideful so idk that they will be able to go back and give themselves an honest overview of what went wrong.

      ⁠​⁠@@TruthOnly24The law as empowered by constitution makes him innocent. You lose the constitutional/legal presumption of innocence, ONLY if you are convicted beyond a reasonable doubt.
      That has not happened yet, so this result most certainly does make him currently innocent - legally speaking of course.
      As such, in the specific context of his current legal status as “innocent”, the question left to answer for yourself is - do you support the law as empowered by the constitution, or only when it fits your personal preconceived narratives and confirmation biases?

      The truth always wins if you didn't do it. How many innocent people are in prison right now even though they had a lawyer and were told to not take the stand? If think we should see more defendants represent themselves.

    The judge is incredibly biased for the prosecution. Even with the judge and the prosecution both teaming up together pretty much, he still didn’t get convicted

      I don't think the judge was biased. I think he got close through pure frustration but I think he managed to maintain the rule of law and showed no bias.

      I agree with you. It seemed to me that the Judge was already set in his mind to be irritated with the defendant. Contrasting Ty to Darrell Brooks' defending himself I'd say Ty was much more respectful. People complain about him being arrogant. I think he's up against these prosecutors and they've been quite condescending towards him. I don't blame him for not acting as the most calm, meek guy in the room. It's his future and reputation he's fighting for.

      @@irishhoopers6899 if he got close because of frustration, then he shouldn’t be a judge. He’s supposed to keep his composure. If he was the judge of the Darrel brooks trial, he would have most certainly created a mistrial or a reason for Brooks to appeal the conviction

    If the defendant had a lawyer, the judge would never hear the prosecution's argument without allowing the defense a chance to respond. The judge cut him off every time he spoke.

    It seems like Mr. Mansfield has a personal vendetta against Mr. Tucker and that is why he did not even contemplate not wasting any more tax money to retry this. He jumped right back into this bogus case.

      I've dealt with prosecution down in key West before I was charged with 79 chargers they all got dismissed because of crooked law enforcement in prosecutors they don't like to lose they'll offer you a deal so they don't get sued they're very very corrupt in the Florida keys corruption is a pass time

    Tucker needs to go hire a lawyer who can defend him against the District Attorney's who have been taken advantage of him during the trial. Someone that knows the law.Because this case is beatable all day.

      Remember the ice cream seller trial last year? His first trial was 10 to 2 to acquit and therefore a mistral. His 2nd trial - he got convicted

    I personally have friends that have had their lives destroyed by the court system scaring them into taking plea deals for crimes they honestly did not commit so I agree whole heartedly with Tucker in his choice to have a jury trial. I would have liked to see him have an lawyer and think that if he did this time he might have won since the state couldn't even manage to get a conviction against him this time. That has to be embarrassing because it is like taking a gun to a boxing match and still tapping out. Lol. They got their MASSIVE ego's bruised this time so it doesn't surprise me at all that they instantly want to reschedule the case. I might be naive but I believe ALL the evidence should be allowed into the case so the jury can make an informed decision, Imagine a world where the cops can grab a junkie off the street and pressure them into telling a story to arrest someone else being all they need for a conviction. In that world anyone could be sent away for life at any moment if some cop decides to focus on them and that is not a world I would want to live in. I could go on and list countless other examples of cops and the courts destroying lives to stroke their own ego's but i still believe the system is a good one if the rules are followed as intended. As the founding fathers said " It is better that a 100 guilty people remain free rather than a single innocent person be convicted" they were smart people and that intention seems to be lost as of late and I hope this case helps others realize they don't have to bow to their oppressors.

      you do live in that world. so disgusting the prosecutor didn't give a shtt about the Judge keeping his word to the jury that if they couldnt come up with verdict hed declare mistrial then trippled down on well maybe they can come back tomorrow 😳 and his ego was soooo obvious its a purely a ego case. its not just the cops prosecutors are suppose to seek truth and if the cops rushed to judgement theyre suppose to not bring charges 2 things i think the head prosecutor will tell him to drop case and cant remember / oh not everyone can manage this and no money means a defender that most likely 9.9 x outta ten doesn't care if you get convicted. most are pushing as many cases so they can become prosecutors

    Seems you have a prosecution that has egos that wont allow them to take a loss. And he's right. If you are innocent don't take any deal. I can tell this guy is innocent. It shows. Any reasonable person can see it too.

    Gotta give it to this guy. He’s right the state does rely on plea deals a lot. I refused to take a plea deal on 4 serious felonies and a misdemeanor charge. I was not guilty so I refused to take multiple pleas. Took it till minutes before the trial and then they offered a plea to a misdemeanor and I did take that. I was facing a 25yr and other felonies that could have been run consecutively. My lawyer thought I was crazy but I told him I really didn’t do it. The state knew they could not prove something that didn’t happen. Don’t take plea deals and never try to talk your way out of an accusation the police are making against you. Keep your mouth shut.

    Its a rareity for a mistrial from hung jury and its even rarer that someone is pro se and isn't incompetent at best. I'm so so so happy for this outcome, the only next best thing would have been a not guilty. I'm literally married into the justice system and let me tell you..... this is a game; this is a win. Their job is to CONVICT; it does affect their jobs and their rep. This man was hounded and his whole life is ruined regardless of court room outcomes.

      @@-The-Darkside He made some serious errors. I think the main one was calling Paula and his cross-examinations weren't that good. It's clear he didn't have an overall strategy and was just playing it by ear. If he had rested his case before putting on a defense I think it would have been not guilty. He really sabotaged himself with his defense.

      I don't know if he did it or not but he's an arrogant con man. He conned a rich woman into marry him so he has money to get an attorney, but he feels he's the smartest person in the room and doesn't need one. I felt the judge was a little too wishy-washy.

      Actually he served 2 years in jail, 4 years on bond with ankle monitor. House arrest, cannot leave the walls of his home without permission first. Also drug and alcohol tearing.

    Wow! I didn’t realize they too offered him time served… for a *_murder._* That makes it even more clear to me that the DA and courts are blood thirsty on pinning him. Paired with their no mention of the victim in this case. They couldn’t care less except for maintaining their ego (for whatever reason) and failed investigation in this case. This case *reeks* of police informants left in the dark, per usual.
    Tucker got the eyes he wanted. A lot of us are paying attention now; so PLEASE get an attorney for March. I’m sure he’s caught the attention of defense attorneys by now.

    They made the deal with Travis, 5 years to be prosecution witness against Tucker instead of life! That the ONLY evidence if you call it that when admittedly lied. That judge is do obvious in his dislike as is the prosecutor. How rhis got to trial 1x is amazing yet the judge so obviously sad /mad about it brings him to trial again? Talk about waste of money. Fire that judge and prosecutor and DA shake your head!

    Franklin Tucker's guilt was not proven either way. The evidence just was not there to convince me. I agree with the jury.
    The Prosecutor's 'angry' chip-on-his-shoulder behavior toward the defendant made the defendant look like a choir boy.

      @@roberthopkins3621 The only evidence they had was one guy who took a sweet plea deal saying it was him. No other evidence could place him at the scene or anywhere new the crime. A half decent lawyer would have gotten the not guilty verdict.

    Well a person is still innocent until proven guilty, and it still applies here. Mr Tucker was not convicted. It’s sad that the tax payers are the ones that have to pick up the court tab just because Mr Mansfield’s ego is bruised.

    Perhaps a stupid question but, if the state has the burden to without a doubt show that he was guilty fails to get a conviction, why is that grounds for a re-trial and not the same as not guilty or atleast dismissal?

    He got a hung jury because he was able to make jury relate with him. If he had a lawyer he wouldn’t be able to engage with the jury.

    Am I missing some evidence? Everyone commenting on how sure they are of his guilt. There was no way this jury could find him guilty without reasonable doubt. The prosecutor went on and on about "how would Travis know that information?" Hmm bc maybe Travis was the second person? Now, don't get me wrong, I am not 100% convinced Tucker is innocent, but that argument was ridiculous. To me, the one prosecutor seems to have it out for Tucker. The way the prosecutor spoke to Tucker during his cross would have been a red flag if I were a juror. Did he really turn down a deal of time served? That is another thing that makes me question his guilt, if someone is guilty, wouldn't they jump at that deal? It also shows the prosecution doesn't feel like they have a strong case if they offered that! I think he needs to have lawyers next time, i think if he does he will be found not guilty.

      I'd imagine the only reason why the judge and prosecutor let this go hung jury so quickly is because most of the jury was willing to acquit.
      It will be interesting to hear what the final count was. I bet it wasn't good for the prosecutor. You know this wasn't a 11 jurors want to send him to prison while 1 juror holds out type of thing. Because they'll let that type of thing go on for days.

    it opens them up for a civil suit for malicious prosecution if they don't win .. I think he needs to be found not guilty though, a mistrial might not rise to the level to meet the civil elements for vindictive prosecution not exactly sure but that might be a motive for the prosecutor to keep on pursuing this

    If he was involved (and I think he was in some way) there was never enough evidence to convict.
    His behavior however when on the witness stand was very telling, at least to me.
    He acted more like a guy beating the wrap not proving his innocence.

    If he could go this far, pro se...I'm thinking an attorney could win this. Esp. knowing the little tricks the prosecution tried in their closing! And, for all the time the court was trying to accuse him of "wasting" ... I'm sure a defense lawyer will be able to show all that they need to! All in all, he did an excellent job... even without the IA investigation. &, Gag order? Cat's out of the bag, bell is rung! That's a hurdle the prosecution has to face. imho
