      Discriminating on the basis of an innate trait (e.g. skin color, sexual orientation) is a form of impeding on someone's rights. If you are operating within a governing body that does not allow (outlaws) such discrimination then you go to jail for committing that crime. It's not a 'freedom of speech' violation to outlaw bigotry.
      Now - discrimination based on a persons choices - that's a different matter but lets be sure - sexual orientation is NOT a 'lifestyle choice' any more than being short or tall is a fashion choice.

      @@grejen711 the "gay cake" controversy is entirely about speech though. The "customer" wanted the artist to create a work of art depicting things that are against the artist's faith and religion. They were entirely welcome to shop at the shop, buy anything off the shelf, but they specifically wanted to force the artist to write things on a cake that the artist was 100% opposed to on religious grounds.
      Imagine attempting to commission a Muslim artist to depict Mohammad being eff'ed by the devil with "allah is g4y" written on it, and then the government forcing them to create it. The cake thing is identical.

      i think weve come to a place where the big differences of parties are too dividing. Like i find myself to be right of center but there are still many democratic policies that im for and several republican things that im not happy with. But politics have become hinged on a small selection of large things, IE abortion, boarder control/immigration, gas/energy productions etc. So for me, there is no room on abortion, im pro life all the way, but i can see where some who are still pro life might say " well girl under age 'blank' should be able to" or "medical condition 'blank' would kill the mother without one", and thats where i believe the state on a micro scale should be able to decide, but i feels a macro broad spectrum abortion is cool style take is terrible and its been used for years as not only a way for people to be held accountable but it also targets groups that are less stable and therefore lowering their population numbers over time.
      And i feel similar to the boarder and energy, immigration fine as long as done legally, our current situation is beyond words and biden as only made the cartels lives better. so that being said i feel that those on the other side from where i stand are unable to see things in this manner because they think it should just all go instead of having rules to structure something

    I think if you own a business you should be the ultimate determining factor on what is sold at your place of business. If a certain store doesn't have what you need then go somewhere else that does. It's that simple...

Because if you can refuse service to someone not wearing a shirt or shoes, same applies if an owner discriminates on any other factors including race/religion/orientation etc. I would emphasize I would appreciate any business not to enact those prejudices, but to lawfully prohibit their ability to do so I don’t agree.

    This was a weird supreme court case. You realize the gravity of the case when you switch the people from gay to black. Can a baker refuse service to black customers? That's what the civil rights sit-ins of the 50s and 60s were all about.

However, I am pointing out that the difference between the way people with these identities are treated legally seems unfair. After all, many racists of the time justified their beliefs through improper interpretations of the bible. Personally, I'm just hopeful that the evil woke leftist corporations will drive all the evil far-right fascists out of business, or vice versa. If the Supreme Court wants capitalism to decide our fate, then so be it.

    The problem is, he's not talking about religious freedom being impeded. What he's actually talking about is a right to discriminate under the guise of religious freedom. Freedom of religion entitles you to follow your religion and live the way your religion tells you to live. It doesn't say you have the right to tell others how to live or discriminate against them because they don't adhere to your religious views.

    Just got to the first major edit cut. Anytime I see those with a biased title I check out. Makes me feel like they edit out any decent argument someone had against them.     Pen Jillette from Pen and Teller is an excellent speaker when it comes to the topics of personal liberties and our governing laws. To summarize one of his statements: At the end of every law is a person that must enforce that law. The person enforcing the law usually carries weapon. So when the government imposes a law on its citizens it will be enforced at gunpoint.

    2 things, first they are professors most likely tenured never working outside the educational system. So they probably have little experience with private sector employment.
    Second is a question. You said not giving 2 weeks notice before quitting a job is a bad thing. Why? No job ever gives you a 2 week notice if they are letting you go or laying you off and are not expected to. I believe you should treat them like they treat you.

      Certain states have laws that can actually not benefit the person quitting without proper notice. Also, it could affect any references you may desire. Otherwise it really is just a formality.

      @@rodjacksonx That’s the problem, social stigma for you if you don’t give the employer time to find a replacement (that is what the 2 weeks is supposed to be for) but no social stigma for the employer if they have to cut back and lay you off or fire you without warning or time to find other employment. All I’m saying is It’s a double standard and and I find it suspicious that double standards always seem to favor corporations.

      @@jmc1559 - It's definitely a double standard. And I have no doubt it was first introduced by big business (or at least higher education on behalf of big business.) But it's so ingrained into society now (kind of like the scams of Valentine's Day and diamonds) that you need to weigh the cost if you are considering going against it.
      I'm not saying people shouldn't do it. But they shouldn't do it and then complain when a decent employer actually gets hurt from it, or when they get blacklisted in their community.

    The concept that a person can walk out of a job is not such a massive mic drop because the same argument can be extrapolated to things such as sweatshops and dangerous work environments that kill the people who work there such as via poisoning or over work etc. Complete lack of government control leads to anarchy which invariably leads to a new group in control and probably a worse scenario.
    Most of these issues are complex multi faceted issues that require a balance of government control for the benefit of the people and personal freedom.
    I don’t have the answers.

    it's a difference between PRIVATE and PUBLIC as far as pharmacies go. Pharmacies must be licensed to sell medication, even if it's a mom and pop shop. If CVS says "all CVS pharmacies must provide X drug" then all CVS pharmacies MUST provide said drug. However, a privately owned pharmacy that has already received a license should only be forced to STOCK what medical supplies they choose. Forcing them to stock "plan b" drugs can force them to pull actual life saving medication off their shelves. All pharmacies have a limited stock size and must make difficult choices of what to keep and what not too. When your grandfather has a heart attack because he can't get ahold of his nitro medication thanks to forced stock shelves of "plan b" meds, what are you going to say? "Some sacrifices must be made!"

    As a business owner you should be allowed to sell the products you choose to. To whom you choose to sell them. Now, if you choose to sell/do devisive things that will directly affect your businesses success. I completely understand that a business owner may have a religious/personal "crisis of conscience" with a product or service and choose to not sell it. That said a customer has a choice to buy those products elsewhere, other local businesses and from the internet and by all means post loudly on social media why they were refused service so like minded people can also refuse to buy from that retailer, but the reverse is true also.

    To add some context, this video was a debate circulating around the merits of Burwell v. Hobby Lobby, Inc. in 2015. This debate occurred BEFORE the US Supreme Court handed down its decision to strike down the Contraceptive Mandate of the Affordable Care Act (Obamacare). Hobby Lobby was a Private Corporation whose owners were openly Christian. The ACA's Contraceptive mandate required ALL employers to provide healthcare coverage which included plans which provided coverage for contraceptives such as the "Plan B" pill (an abortion inducing drug taken the day after unprotected sex). Hobby Lobby objected under the 1st Amendment and the 1993 Religious Freedom Act.
    While SCOTUS ultimately struck down the mandate for private companies for religious reasons, the case Shapiro is making here is the one Hobby Lobby was making. It goes to the greater idea that the government, under the cloak of the ACA, was forcing its ideology on the business, thereby infringing on its owners' religious liberties.

    Healthcare being an earned privilege is an absolute joke. If I had the ability to have a functioning practice with help available for free, I would. I know many would take advantage of it, but many could also seek care they truly need and not worry about a thing. The weight of stress alone is killing people. I abhor how the Healthcare availability benefits those who can afford it and fails the ones that can't. The people on roofs or in storm drains keeping cities running, working themselves to death. Not people that sit on stages and complain about how they think any one person should determine anothers life. Too much hate makes the world turn.

      I don't think it's healthcare that's the big issue. I think it's the fact that our food is detrimental to our health, our polluted environment has bred countless new diseases and has made other diseases much more prevalent, and our neglect of mental health in the way our society is built has created the perfect storm of sickness and disease. Once that has been addressed and dealt with, healthcare would become a much easier subject to handle.

    A business should be allowed to do anything it chooses to do, just as I can choose which business I work for and which ones I support with my money. We forget how powerful the regulation of profit is in our country. It wont take long for a business to act in the general community's best interests or they wont last long, and the best part is that the government isn't the entity in charge of regulating it since they absolutely suck at regulating anything.

    honestly above all else our forefathers designed the constitution, The Bill of Rights, and the declaration of independence for absolute freedom. And that means you can sell things that you want to sell and buy things that you want to buy and it’s your responsibility as a citizen to choose to participate in what you want to live by. But if you don’t like it, go away to another place WITHIN AMERICA where your beliefs align with the people that love there, ideally with respect for your neighbors as well, is what I believe the forefathers initially intended.that’s the beauty of this place is freedom to believe and choose to spend your money on whatever you want and if you don’t like something you don’t have to participate. but you should never be restricted from doing what you want to do as long as it doesn’t hurt anybody.

    I agree. You nailed it. Freedom has never been easy & it is challenging. People are so self seeking these days. It’s wrong to force what we believe on others but cry when it is done to us. Hypocrisy at its finest. People, including business owners, should never be forced. It’s supposed to be a free country. Government will always end up controlling who wins & who loses if we allow them to intervene. 2020 is a great example of that.

    The thing about the cake place was that the cashier said they were welcome to anything that was premade in the case, so it wasn't like he was throwing them out of the store. They could have easily bought a cake topper somewhere else or probably found someone else to make it. Activist groups backed by big money do this to target religious conservatives all the time. Certain reps join in, I'm sure, the in name only types like McConnell, Bush or Chris Christie. "Agree with me or you don't get a livelihood" as far as on that level needs to stop. Thanks for doing some more political stuff. It's frustrating at times, but certain things we need to know . Love ya XOXO

      factually inaccurate. The clients in the Baker case asked for an Undecorated plain white cake, they stated that THEY would provide the topper themselves. There were no words written and no decorations. they were refused.

If they really did just see they were gay and throw them out, then yes, pretty sure that's illegal, and if not, its a jackarse thing to do, but nobody should be required to write any message. If you have a private business and don't want to write a religious message on a cake, then you should be able to say, sorry, you can get the cake but I'm not writing that. I don't know about the pledge of allegiance, pretty sure that was actually brought about when they started high school in the early 1900's. Before the presidents went on the wall, Jesus was on the wall, and school started with the Lord's prayer. I don't know if I'd want that, I'm baptized RLDS but don't practice. If you had to place me anywhere, I guess I'm kind of a Viking. Schools should probably follow Marva Collins technique if anything. and yes the activists groups do that to conservatives, because they're not the same people that just wanted people to be nice to gay people. In fact, I can pretty much say goodbye to being in music because while I'm not that conservative overall, I live in Oklahoma, so it's going to be assumed. So at this point, still don't have any probably with LGBT individually, but I think the movement oughta take a look at what 90% of the world is doing, and maybe reconsider their approach.

    They're a pharmacy....supply the drug and mind your business. Get out of the business if you don't want to supply your customers. A wedding cake isn't killing anyone. If a business doesn't want your patronage, it's their choice just as it's your choice to go elswhere to contract your needs. Have to see both sides.

    ..."Ben Shapiro effect" it's called "Gish-gallop" and it's a bad form of arguing. He sprays out several points all at ones so fast you can't rebut any of them with any focus. It's not that Ben thinks fast.. it's that he's unfocused.
    And yeah the guy on our far left is exactly right in his response. "Mr. Clean" is NOT saying you don't have the right to complain. He's trying to point out that Ben's assertion that religious freedoms are oppressed or curtailed in America is - paranoia at best and more likely a flat out lie and he's using countries that do not have freedom of religion as contrasting examples. yeah then he does put an argument in peoples mouths...
    See. here's the difference between religious freedoms and what Ben is actually advocating for. Ben is trying to use "religious freedom" as a way to allow discrimination based on sexual orientation.
    So does a business have the right to refuse service? I think ... sure. why the fuck not. Have them post a sign on the door saying 'no gays are served here'. Then is another business allowed to post a sign saying 'no blacks are served here' - ah.. see.. You cannot use freedom of religion to discriminate against innate traits! THAT is facism sir.
    Yes absolutely a business must have a license to operate and they must operate within the laws of the land. One of the laws of the land is not to discriminate on the basis of sexual orientation. This is not a religious choice! It's bigotry plain and simple.
    Yes they are having difficulty understanding what Ben is saying. They're in the situation and reacting emotionally - Except Mr. Clean. Ben's use of the word gun is specifically designed to upset and distract Red dye job... and it works.
    @15:53 What do I think... well we've already argued that an employee can simply quit if they do not like the deal with the employer because it includes serving people or providing a service they disagree with. If that's fair then we can extend the same 'consensual relationship' to a business and the sphere of governing laws they operate in. If the license for operating a pharmacy includes providing plan B as a service, but you disagree with that requirement then ... well ... guess what? You can quit! Close up your pharmacy and go somewhere else. That's your right.. oh.. not so easy is it? well... just because an employee has the right to quit a job does not mean they effectively have that option available to them at no cost! What's good for an employee ... is good for an employer right?! right?!? I'll bet no one on the panel sees this.
    The body language - yeah that's a reaction to Shapiro all right. LOL Not because they don't believe what they say. It's just that Ben sucks the air out of the room.

    No. Are these businesses government owned? No. Therefore, they shouldn’t have a say in the selection of prescriptions they sell. When the government starts to control the specifics of what services or details of what inventory privately owned companies offer, they’re acting as a communist government. China does this. The business owners there don’t actually own or control their business. The government literally physically comes in to check on & control them. Our government has already overstepped regarding these issues imo. For years. There’s several laws in place that impede on a private business owners ability to actually operate in an independent way.

    You take rights by slowly cutting away small seemingly reasonable concessions to use as justification in the future for more concessions, until you have nothing left.
    The only way to protect your rights is taking a hard line stance on something no one wants to protect for it's content and instead protect it to secure the right. In the future you can point to this objectionable thing that is protected as the standard to throw against people trying to take rights one small reasonable slice at a time.

    8:20 - If he says that the "non-discrimination" applies to businesses, then that means the Constitutions protection of rights applies to _everyone,_ not just the government. As we have seen in prior case law, this _is not the case,_ as the left gleefully points out on the regular.

      Good point... we should be pissed that private citizens are using public government resources to go after other private citizens.
      Somebody refuses to serve you, vote with your wallet and go somewhere else...tell all your friends, etc.
      People should learn to protect themselves and stop waiting on the courts to come to their rescue.

    My take has always been people should be allowed to dictate what they sell and who they sell to without government intervention. If you dont sell that gay wedding cake guess what word gets around people will stop going to your bakery, if you dont sell plan b another pharmacy will word will get around and you will lose business, the greatest thing about capitalism is that soneone will take advantage of you not selling something and thrive. Its the marketplace of ideas. And if its a bad idea then it will not reap rewards.

      From what I've heard, his argument for moving because of rising sea levels is directed at the "elites" who are telling us the sea levels are rising yet many of them own multiple beachfront homes, some of which were purchased after saying it's a catastrophic issue.

      Ben Shapiro doesnt speak for the fishes..... Him saying people worried about rising sea levels is people living in an area, not ecological impact of fish population. To suggest otherwise is nonsense. I noticed you provided no statements as to why he is wrong in this clip. You also realize, it is not ben shapiro creating the edits of these debates right?     as you asked in terms of the pharmacies and should they stock contraceptives even if it's against their religious beliefs? i'm going to say yes they should have to, as it is a medical service, as long as it is medical and legal it should be supplied in a pharmacy regardless of any religious views on the matter, at the end of the day it's sitting on a shelf and not doing you harm but could help somebody else.
    of course this is a standalone for medical locations and if someone said you have to put a pumpkin in your window every Halloween then no cause that's ridiculous and you having that there won't benefit others in the same way medicines will in a medicinal shop.
    in terms of the gay cake thing, i have just went away and read up on it and i stand with the bakeries decision as back then gay marriage was illegal in the country therefore it's harder for a business to take a stance either way as would alienate customers regardless, but they went for the path that also followed their religious beliefs and denied it and gave a full refund. Nowadays if it happened i'd still side with the bakery as even though gay marriage is legal now it would still go against beliefs and lets be real here cakes aren't here to help save lives or anything so therefore it falls to the shop in question and if they feel they should or should not make said cake.
    long rambling short - if it helps save/benefit lives go ahead, if its just something indulgent then it's up to the discretion of the place
