    Whether you believe in it or not, “god bless the homeless vets” really is the perfect sign and shows Jeff’s level of genius when doing audits. It covers so many different avenues of the bill of rights.

      Sort of, that is like saying you didn't get food poisoning so you say a restaurant is outstanding, haha..... The cop did get one thing wrong by suggesting if he "wave his sign around" and talk to people about his message that would be a problem, which is obviously rediculous since that is free speech. The officer should have said "as long as you don't physically block or touch anyone or threaten to, this is a free country, I can't stop you from speaking you mind.". I guess the cop gets a pass even with the silly "copsplaining"

      It´s YOU who got something wrong in this case. THe cop didn´t say he might not talk with people about his message but he might not block them or hold the sign right in their face to harrass them.

      This situations need to be taken case by case , and in this particular case we can say the cop did his job in a decent manner. We already see way worst but how many times did we see better that this ? Legit question guys. Not everyone can agree or be happy/mad about the cop interaction , and personaly i hope more and more cops will act like this one in the positive way , i doubt will happen but hope stay.

      @@IamFantastic Call the DA before making every arrest? No? Rarely do cops call the DA for civil right clarifications. Fairly sure the only reason they do do it is to cover their asses. Do you think this cop would have acted the same way if the DA told him to arrest Jeff?

      In my city they put no soliciting signs at freeway off-ramps but the code only applies to highway rest areas, also no skateboard signs at public School campuses and that code only applies to business districts.

      The COP gets the same grade as the woman. He said he called the CA to ask what to do. If Jeff had been a stranger, or a homeless person, do you believe the COP would have done that, or do you believe the COP would have arrested Jeff?

      Visitor center employees was not poorly informed. They’d obviously gone thru the motions of having that area designated as not a public forum as it would normally be assumed to be. The Supreme Court has held that reasonable time place and manner restrictions may be placed on the expression of individual rights generally protected in the Bill of Rights. You may contest the ruling ir order that designated that area as not a public forum, but you won’t succeed in arguing that you have an absolute right to protest in any and every place you so choose, even in any and every public place you should so choose.

    towns/cities/counties/states have been criminalizing homeless population more and more recently. homelessness isn't the problem, it's the RESULT of a problem. hats off to you fir challenging this. america is on a fast track to becoming a third world country. the people and our government LOVED these vets when they served, and have completely abandoned them after many returned home incredibly damaged.

      Not only true , but from personal experience like a non american veteran i can tell to everyone that are many third world countrys who treat way better their veterans. I have many direct contacts with Romania , Moldavia , Ucraina and Bulgarian veterans and there don't exist homeless veterans , the military absolutly do not allow something like this to happen ... and think all those 4 countrys put together don't have 1% from american military budget.
      I am from italy (not a third world country) and even here , we do not allow to have brothers homeless.
      Respect for all and my blood for my brothers in arms.

      I was homeless for years and that resolution on that sign is in direct response to not wanting homeless people sleeping there.. I'm sure of it.

    This was a good officer. He knew that sign had a bad odor and proactively consulted with the city attorney office. Sounds like he was advised not to enforce it. Good for the attorney's office. A lesser cop would likely go hands on if necessary to enforce it. Thanks for all you do and following up.

    Unlawful sign...this video-with the city lawyers's response to LE query-should be enough to get the sign removed.The fact that you were not trespassed was not officers' discretion; it was the city's abandonment of enforcement. Rock on...

      @Ralph H ●● Just remember: (1) Cops are allowed to lie to you, so we only have the cop's "word" that he talked to the assistant city attorney, and (2) Cops DO have some discretion whether to arrest or not - unless it's a felony or something like that.

      @@edhartgrove7552 In a trespass issue, I'm not sure they have discretion not to enforce... if the lady said "do it, want him gone", and there is a city ordinance attached, not sure they can deny that. The officer, if gentle, would probably get QI, but the city would be sued up, down, and sideways.

But with that unconstitutional sign with the unconstitutional ordinance # on it... a city representative could (in theory) tell the cop to enforce their dictate to have Jeff trespassed... and I'm saying if she did that, the cop would have to comply. Again, big suit afterward, but complainant, insistence, and ordinance = no real option for the cop. (Who seemed nice, and would be protected but the city sure wouldn't be)

    The problem with a sign like that is selective enforcement. It's there to intimidate people who can't afford to fight it. For someone like you they don't enforce it do you don't have standing to sue to take it down.

      Yea, while you could file suit before they enforce it on you all they (ruling body) have to do is revoke the law. Then the court rules it moot and dismisses, allowing them to later redo the law, when no one is looking. Getting arrested or otherwise violated, due to the law, means you have been harmed by its enforcement, and they can't just nolle prosequi and say no harm was done. If your compelled to give up your info so they can cite you, or otherwise remove you from an area against your will then the harm is done. So you retain standing for the suit even if they revoke the law. Thereby forcing the court to review the legality of the law in the 1st place.

Traditional public forum property occupies a special position in terms of First Amendment protection, and will not lose its historically recognized character for the reason that it abuts government property that has been dedicated to a use other than as a forum for public expression. Nor may the government transform the character of the property by the expedient of including it within the statutory definition of what might be considered a nonpublic forum parcel of property. The public sidewalks forming the perimeter of the Supreme Court grounds, in our view, are public forums, and should be treated as such for First Amendment purposes.
      However, see United States v Kokinda:
      “The postal sidewalk is not a traditional public forum. The fact that the sidewalk resembles the municipal sidewalk across the parking lot from the post office is irrelevant to forum analysis. See Greer v. Spock, 424 U. S. 828. The sidewalk was constructed solely to provide for the passage of individuals engaged in postal business, not as a public passageway. Nor has the Postal Service expressly dedicated its sidewalk to any expressive activity. “

I’m not mad at a guy that’s down and out, and really hit rock bottom, and he’s sleeping in his car or on the streets to get on his feet. But in my neighborhood for example you ha e homeless people that are drug addict’s that sit outside the store all day, and they’re the only ones causing trouble. They need to do something more productive, but I guess if they choose to live that way….. (sigh) but don’t make us pay for it….

      However, I have a problem with the idea of addressing "pre-crime". If a certain individual commits a crime, deal with that case on its own merits. Don't punish everyone else in the associated group.
      Another issue for me is that if they're on public property, then it becomes a Constitutional question. They shouldn't be allowed to block public sidewalks and thoroughfares, though.

    That resolution is toothless. And say that someone was trespassed or arrested, they can point to your video and ask, "why the selective enforcement?"

    Please keep doing your audits. You are the best I've seen. I recently heard how this all started for you witnessing from public, school bus drivers not performing their pre trip inspections which are required by both State and Federal law, especially for anyone with a SCHOOL BUS endorsement on their CDL. I hope someday soon that school district reforms itself and reverses its ridiculous trespass notice against you.

      IT is a Right, that overrides any ridiculous City ordinance or Policy, and They cannot Tress-pass People going to City Hall, where They have put Public benches!
      Absolutely deplorable!

    I wished I had time to take on the very task you are undertaking. What you are doing is just as important than military service because in my views it backs up what all those that fought and gave their lives for would want.       It's actually "I'm your Hucklebearer". A huckle is a handle on a casket. In Doc Holliday's time, it was what we call a pallbearer today.

    This is an awesome video. I love it.
    Kuddos to Officer Fischer. What an awesome cop. We need more like him. If all cops were like Officer Fischer, first amendment auditing wouldn't be a thing - it would be so boring nobody would watch the videos.
    The city employee that called the cops? Naw, she needs to find a job in the private sector, instead of trying to impose her will on other people. Hopefully not as an HOA president or anything like that.
    That sign should be taken down. Disgusting indeed.

    You, sir, are a hero. A voice for the voice of oppressed (yes, homeless are oppressed). That officer was a great example of how one should act. He even contacted the city attorney's office so he wouldn't misinform the public.

    I have often stopped at Visitors Centers while driving through other states. If I saw a No Trespassing sign, I would think: Well, what an awful way to promote your state.
    Great job on forcing the issue!
