The plate was not in plain view. He pulled down the hatch to see it. That’s why Jeff said, “hey don’t touch my car”. The other tyrant then said that he was running his tag.

@101327 320.061 is the Florida statute that covers obstructed tag. Having the tailgate open is not "obstructing the tag". Obstructing the tag involves putting something over the plate to prevent it from being properly viewable and obstructing the tag is a non-criminal infraction imposed as a moving violation. You don't seem to get it. Jeff could have been sitting in the back of his car with his legs covering the plate or standing behind his car in front of the plate. There would be no requirement for him to move so that they could see his plate. This was not a traffic stop! He was NOT OPERATING a motor vehicle. There was no lawful reason to run his tag. If they had RAS of a crime then they would have been able to demand that he identify himself They did NOT. Suspicious activity does not equal RAS.

A police officer can run anyone’s tag for any reason. There is no seizure. Most large agencies have automatic tag readers on traffic enforcement vehicles. It checks if car is stolen, if registered owner has a valid license and if registered owner has an outstanding warrant. All of this is completed in about 15 seconds.

Not just one but an entire group of Panama City police officers, including a captain no less, Captain Marksmith of the Panama City Police, Florida, who don't know the difference between plain old suspicion vs Reasonable Articulable Suspicion (RAS), even when knowledge of this distinction is required for these officers to perform some of their most basic job duties. It certainly bears investigating how one can achieve the rank of Captain in the Panama City Police Department when one lacks such profoundly basic legal knowledge, let alone how one could even be hired as an officer in the first place when lacking such basic legal knowledge. Clearly, there are serious problems within this department. Lastly, there is some debate in the comments as to whether RAS is required by law enforcement before they can run a person's tags in Florida. Hopefully, someone can shed some definitive light on this matter. If RAS is indeed required in order to run someone's tags in Florida then these officers committed an infraction right in the video. Regardless, Captain Marksmith and his colleagues at the Panama City Police Department all but certainly have an extensive history of other infractions because they don't know what Reasonable Articulable Suspicion actually means, and incorrectly believe that it is a far lower standard than what it actually is.

Jeff, You know, in the custom car/truck circles, a kit is made that will hide your license plate with a flip of a switch. You can wire it to hide when you shut the ignition off, or wire it to a switch to hide at your choice. Now we all know that it's illegal to cruise down the road with no plate, but I don't think the law addresses a parked car with no tag........you'll have to check your local laws. VIN number, easy fix, put some papers, like junk mail on your dash that covers the VIN plate. Not illegal at all, especially since at the moment you aren't even driving and the vehicle is legally parked. Key fob......if you suspect LEO interaction, leave the the key/fob inside the car, out of sight, when you get out and lock the door. Cops have been known to take keys without legal authority to get inside someone's car. No key, no entry, they vary rarely will go as far as breaking in without a warrant. Don't have a spare key on you unless you have a unique hiding place. Years ago, belts were made with a zippered compartment to hide cash, that would work, or inside of a shoe under the lining, or a slice in the tongue of the shoe to slip in a single door key. Or, the old standard, one of those magnetic key boxes. Hide it in a place under the car that you can easily get to, but can't be seen by someone bending down to look. Also, don't depend on the magnet 100%. Rough roads have been known to knock them off. Wrap a couple turns of duct tape, or a zip tie over it. Finally, once the cops walk off, don't immediately get your key and leave. Chances are they are still watching. If you act to quickly, they may send a cruiser to pull you over and claim they smell dope. You have to out smart them at their own game!
If they get the tag and running, that is an NCIC violation, and a SEARCH! By running the tag they have just OPENED AN INVESTIGATION absent any crime afoot. Being suspicious has never met the threshold of crime. Running a tag absent any reasonable suspicion of a CRIME is a direct violation of NCIC. Hopefully they were smart enough to not run that tag.
TheBooban It's against the 'user agreement' the department signed with the state for the use of the radio equipment/program/software. It states the punishment/fines for misuse of the system. Running a tag without probable cause falls into that category of misuse of the system. No different than running a tag on a blonde driving a red BMW convertible, just because you'd like to know her name, address and age.
Alright, I get that. But they never get sued for it. Auditors and cameras have changed so much abuse that was previously routine. Not this though. Not yet. Unfortunate.
I'm reminded of an old James Bond episode where the license plate on his car "flipped" to reveal a blank, or another plate. I'm thinking how handy this would be when parked. Only when operated on a roadway is a plate required. In this case, a plaque that said "NUNYA" or "EATME" would be handy.
