Former Chief Justice Jean Toal will preside after Judge Newman recused himself from any future proceedings related to the defense motion.

I loved the original judge. He was no nonsense. Why should this piece of garbage get a second chance when his wife, his son and God only knows who else doesn’t get a second chance. Can’t bear to look at the piece of 💩.
Shocking coverage out of focus and sound is shocking. Is the camera man blind?
His victims did not get a second chance.His financial crimes were egregious. He’s a monster even without considering his guilt for the murder of his own family.
Yes he is a POS for the financial crimes but he didn't murder his wife and son.
Different case, he's been found guilty of those crimes and accepted punishment.
What do you think the punishment of a clerk whos son wiretaps the Murdaugh family phone for more info, along with writing a book, along with swaying jurors.

Judge said the burden is not just to prove tampering but to prove a juror agrees it must have swayed their decision. It’s an uphill battle for the defense at this point because the jurors have a,ready given statements saying the incident did occur bit it did nit effect their verdict.
I don't believe they have affidavits from any of the actual sitting jurors saying the statements occurred. Only an alternate and the dismissed egg juror. The supposed statement from a sitting drawer was actually written and sworn to buy a clerk of Poot's , not the actual juror.
It's ridiculous, jurors want to be low key and not to cause a fuss, so they'll say what's the easiest option.
This entire thing will be appealed at a higher court.
You can't have clerks telling jurors what to do, on any level.
I've seen cases thrown out for far far less.

Poot and Jim made a terrible mistake by lobbying to have Judge Newman recuse himself. CJ Judge Toal is tough as nails, unafraid of Poot, and very sharp. She will keep this evidentiary hearing on track and it will be a fair exercise in justice.

@@mercinalady2040yes, the judge was also clear that it isn't enough if improper statements were made to the jurors. It only matters if the jurors felt like their verdict was affected. I'd say it's about a hundred percent that he's not getting a new trial.

I get we all hate Murdaugh but you can't have clerks telling jurors what to think in order to push her books. Simply put, take her out of it, retrial and he gets sent down anyway, he's already got 18 years or something for the other crimes, he's toast.

The Judge is a retired Supreme Court Justice Judge. She came out of retirement only for this case.

Dick Harpootlian is a member of the SC Senate, I don't think he should be allowed to practice law while actively part of the state senate. He spends his time in the senate trying to change state laws while defending state criminals. I'm not sure how anyone could see that as anything but a corrupt practice, dangerous even. In a perfect world one might say he's a state senator he can be trusted, the problem is that we live in a very imperfect world.
It is in the State Constitution that sitting members of the legislature be allowed to continue to work in their law practices while serving as public servants. It is messed up for sure.

Did a juror come forward complaing that the "clerk" swayed their verdict to guilty? Because if not, why are they wasting TP's money on this.
The defense attorneys went around to the jurors trying to stir up the case. Sounds like mostly the alternate egg juror is the one with an ax to grind against the clerk.

what's clearly evident is a judges ruling is 100 percent subjective based on which case law is used to make his/her ruling, and it is horrifying to be at the mercy of it.

Most of the people making comments apparently didn’t watch the entire trial. There was not enough evidence for a conviction, mostly hearsay.
