  • As a Notary, you may be asked to notarize a jurat, which is called a “verification upon oath or affirmation” in some states. Jurats are often used with important court documents in legal proceedings. In this video, you’ll learn how to notarize jurats correctly.
    TIPS FOR NOTARIZING JURATS
    What is a jurat?
    A jurat is a notarial act that states the person before you is declaring that the contents of the document they are signing is true. Jurats are often an important part of affidavits or depositions, which may then be used as evidence in trials or other legal proceedings.
    What is being certified by a jurat?
    The Notary does not verify the contents of the document, but they do need to certify four things:
    •The signer physically appeared before you.
    •You verified the identity of the signer, following the requirements of your state.
    •You witnessed the person sign in front of you.
    •The signer swore or affirmed that the statements in the document are true.
    Oath vs. affirmation: An oath is a solemn spoken pledge to God or a supreme being. An affirmation is a spoken pledge made on the signer’s personal honor.
    Restrictions on jurats: No one can take an oath or affirmation for another person. If someone is representing another person, such as an attorney in fact, they can only execute the jurat on their own behalf, not the person they represent.
    Additional rules regarding jurats: Some states may have additional rules regarding jurats, so it’s important you check your state’s notarial regulations before proceeding.

    Hello, great video. If a person writes a letter confirming they gifted a vehicle to a family member would we add a jurat or Acknowledgement? Thank you in advance!

    I know that the signer needs to sign in front of you for a jurat. In California, If the signer signed the document before you, do you tell them to resign the document in front of you or do you refuse to complete notarial act for document? Or do you just verify by asking if they are the ones who signed?

      Hello. If a customer brings a previously signed document to a Notary and requests a jurat, the signer would need to resign the document in the Notary’s presence.       Just look for the language on the document. Usually it says "subscribed and sworn"
