Practically this will not make much of a difference. If you are looking at a ship say 8 to 10 nm away, i.e. 1852 x 8 or 10 meters away and a ship length of about 300 meters, what will be the angular difference between the bow and stern. You can work that out.

There is no criteria in rules as a general understanding once vessel is reached 5 milesfrom own vessel we cud say finally past n clear. This is also given in some court rulings.

As per Annex I, the Horizontal cutoff should be between 1 to 3 degree, and Vertical cut off is 5 degrees. Should it not be 1 to 3 degrees plus minus 22.5 degrees abaft the beam? Can Vertical sector affect the judgement of a person watching from another ship, or is it only the horizontal one?

The forward vessel , which is probably being overtaken cannot be in doubt, as it knows its own heading and can calculate 22.5 abaft the beam. Hence this vessel is sure of overtaking or crossing. Its the vessel abaft the beam that may be in doubt.

1 to 3 degrees is in the forward direction and abaft the beam is 5 degrees. The vertical sector of 5 degrees is to allow for pitching.
