Yes, if you hypothetically have a masters degree, yet took a position that pays less than your qualification, degree and/or certifications dictate in your industry because of favorable hours, location, benifits,... the family court judge can make a determination of your financial support capacity based upon the aforementioned criteria. Even if said financial payment stipend meets or exceeds your present income.
The ruling is based upon income capacity based on education and experience. Such determinations are definitely not an example of justice and many wonder if the 8th Amendment would be applicable under cruel and unusual punishment. Yes, support your children, yet such judgements should remain reasonable under legal definitions. There should be limits on the amounts levied against the non-custodian parent. It begs the question why one judgement can be $2,000.00 a month for one child, while another only pays $300.00 per month. Where is the equity?

That basically happen to me. I have my son half time officially but he tends to stay with me more than that. State of Florida says I have to owe her child support and provide insurance. She never helped with the daycare either.

That technically isn't true. The courts have no way to determine if money is being spent on a child based on financial records alone. You may see a purchase for heels and they could be for the mom but that doesn't mean she is not making enough on her own to pay for that herself either. Plenty of mothers have jobs and still spend on themselves with or without child support.

the workaround is to put that money into a bank card issued by the courts to be able to track the spending

This shit happend to my dad. My mom took him to court to try and get FULL custody of me. He just got back from deployment and she put him through a whole lot of shit. Instead of her winning, she got him saluted and thanked for his service. She took me home and yelled at me about stuff I didn’t need to know and blamed me and cried that I chose HIM.

My dad fought to gain custody of me for several years because I couldn't stand living with my mom. Sadly he never got custody because my mom was so good at playing the system.

This is so true, but in Louisiana you see a hearing officer and after I got laid off the woman said I was a deadbeat that didn't love my kids. The system is rigged guys, but you can still fight it. I did, and got my child support reduced from nearly 2 grand a month to 1k a month.

It’s so true, it’s scary 👺👺. I had a friend who had to pay child support. At the end of each pay period he had twenty dollars to live off of. I use to fell sorry for him and would buy him lunch everyday. He finally followed the judge home and found out where he lived. On a Saturday night he set a tent up in the judges front yard and camped out all night. When the judge saw the tent he call the cops. He told the judge he lost his home and didn’t have anywhere to live and asked if he could be put in jail so he could have a place to sleep. And guess what the judge said. No way in hell! Get your butt back to work. So he fled the state and never came back.

You give money to a very important and noteworthy reason you wouldn't mind paying for,
But once that money gets into that bitch's hands it is spent on whatever they damn well please.

Damn, I can relate. When I got custody of my son, I went from paying $800.00 a month to receiving $41.00 a month.....YES you read that right $41.00 damn dollars a month from her!!! $10.25 a week.....$1.46 a day!!! Imagine that!!!

True story, I had a female try to pin a baby on me and TOLD ME she was gonna get me for child support (since I didn't want to be with her). Turns out she was ALREADY pregnant when I met her. I used protection both times we sexed. She tried to get me to sign birth certificate at the hospital immediately after the child was born. I refused. Had paternity test done. NOT MY KID! Less than a week later I went and got a vasectomy! Never again!

I know this is late but we need to stop court bias towards women in custody women in custody battles. My cousin is going through this right now(pays a quarter his check every week and only sees the kids once a month with alternate holidays). His daughter who's eight said that momma took her in a public bathroom to pee than while she was waiting pulled off her clothes (the mom took off her clothes not her daughter's) and recorded herself. Obviously to send to men, in front of her daughter.

I actually did know a poor bastard who had a short term but high paying job and the court used that to establish his income, so after that short term job ended and he went back to his standard wage he wound up having to pay over 75% of his wage in child support despite the law at the time saying it couldn't exceed something along the lines of 50%. He ran into major debt for a couple months when he was only working part time and was paying something close to 90%.

Look no lie man. I use to work with a guy who is like 50+ years old who has a daughter who's in custody of her mother. We worked in a restaurant. He pays child support for her. He was not a wealthy man. When he left the restaurant, My coworkers have told me stories of him sleeping in his car around the neighborhood most likely because the child support was taking all his money. Poor guy he was just sad all the time and angry. He told me his daughter lives very comfortably with her mother and step father. Child support is a very expensive thing and can ruin people's lives mainly according to men on this predicament. He's best hope is waiting till his daughter is about 18 so child support can go away.. sucks man
