    I was a judicial clerk for a federal court, and I can tell you that she racked up an unusually long string of reversals. Several of these were due to severe errors in her legal reasoning that clearly make her unqualified - and I haven't heard all of them. It's shocking, really.

    • @gregchavez1534
      @gregchavez1534 Рік тому +1

      Except that you don't have to be clerk to look up rulings. They are public and written in English. And thanks to the insipid, bad-faith questioning of so many GOP senators of Biden judicial nominees with extensive bench experience (and therefore an enormous number of rulings), their background have been widely reported.
      These are interpretations of law, not math problems. That is why our judicial system is so extensively tiered. What is truly shocking is that Trump was able to get so many judges approved who had NO judicial experience and even limited work done in criminal law.

    • @peterplotts1238
      @peterplotts1238 Рік тому +46

      @@gregchavez1534 A "clerk," in the sense I used it, is a lawyer who assists the judge in all aspects of his role as judge, including recommendations on matters before the court, legal research, and drafting (That means writing), the court's orders and opinions. Didn't anyone ever teach you that you shouldn't talk about things you don't understand? It makes you look silly and, in your case, foolish and mean-spirited.

    • @gregchavez1534
      @gregchavez1534 Рік тому +3

      @@peterplotts1238 I know what a law clerk is and in this case it doesn't give this person any ability to contribute any fine points which, incidentally, they did not offer. Furthermore, Kennedy's list of pearl-clutching partial reversals was just that: a list... you don't need to be a clerk to count. She had over 1500 rulings, less than 3% of which were overruled in any way. So I think I'll side with the judge with a proven track record, the law school professor who testified on her behalf (you know what a law school is, right? And that lawyers usually learn stuff there?) as well as the even more senior judge who recommended her over an anonymous law clerk with no receipts.
      Spare me your moralizing. And your petty insults.

      God's name is hard to nail down, as he has many. Some are more holy than others, and some can't be written down and then erased without incurring great sin.
      Jehovah is a commonly acceptable name for the Abrahamic God. You'll notice I did not say "Oh my Jehovah," nor did I use one of the more offensive to write - not say - names of the Abrahamic God. I just said "God."
      God is not Jehovah's name, and your ignorance of this fact only deepens the commonly held mentality that Christians, Jews, and Muslims are blind sheep. I invite you to not only read scripture, as I am sure you have, but to analyze it. To truly understand the Word of Jehovah, and not to simply accept it as fact. Blind acceptance is nearly as bad as blasphemous rejection, my brother. Jehovah wishes us to understand Him, not to simply exist around within His works.
      Kind regards.

What is the point he is trying to make? Is he trying to imply that, because he can show that the appellate courts are functioning well, that this means that judges are incompetent? Or only---somehow---that DEMOCRAT judges are incompetent? Either way, unless he presents data that shows that the number of her cases overturned far exceeds the average of ALL cases overturned by Republican AND Democrat judges, he hasn't made a case for anything at all. Eh to be fair, until just recently they had top cover from the doj and majority, plus there's some horse trading that goes on before hearings. So its not unreasonable to think this would go somewhat smoothly. But again its also the kind of poor judgement and incompetence that lead to that phonebook sized list of reversals. I'd be more interested in who and why they nominated this person thats clearly unqualified. Or the last one he tore into that didn't know any articles of the constitution. Its really just getting their people in spots because they are onboard with the cause, not because of their proven ability and history. That's the scary part.

      I read recently that over 1000 law profs and deans wrote in to the committee agreeing with you, stating both her ineptitude and temperament, the last of which sounds pretty strange. Weighing in on heart, to the exclusion of head and applicable law, maybe? I think that is the primary purpose of a judge, if I understand it correctly, that and mediation on protocol/procedure. I'd give you ten thumbs up, if I could. With choosing sentencing within the allowable range some heart might be applicable, as long as it is HEAVILY tempered by the real facts of the case, IMO.

Anyone who has worked in a courtroom (I was a clerk in traffic, misdemeanor, and felony courts in county and superior courts) knows that to be reversed is humiliating to a judge. It's the reason they're so careful to sustain objections and to stop hearings for multiple sidebars to make sure attorneys are following the Canons and the rule of law to a T.

      Lifetime appointments. It's actually really hard to impeach a judge for simple incompetency, you have to do something malicious, and it usually has to be pretty egregious to even get a whiff of impeachment talks in the judiciary. Likely her rulings were in line with Dem politics so they pushed her up anyways. Also useful as a talking point that the Reps shot down another female nominee because muh old boys club or some such nonsense.
