- The plaintiff brought her diamond ring into the defendant’s jewelry store to have the diamond reset. Unfortunately, the defendant lost the ring and offered to give her another ring of similar value. The plaintiff got the replacement ring appraised, and they told her it was a piece of junk, so the plaintiff is suing for the value of her original ring, as well as pain and suffering. The defendant insists the original ring was stolen, and he offered the plaintiff a Tiffany-cut diamond ring of equal value, which she was perfectly happy with until now.

Whoever made that ring counted on her never getting it checked out by anyone else and they were wrong. Glad for her.

When people need money, they have zirconia, and it is sold on the cheap. The person who gave her the zirconia ring knew it was just plastic to get her out of the store. And they the owners sent someone instead who knew nothing about the fake ring.
@@trekgirl65 The plaintiff wasn't given a cubic zirconia ring. She was given a "clarity enhanced" diamond. Cubic zirconia is obviously fake and therefore, isn't the same as a real diamond. A "clarity enhanced" diamond on the other hand, is a real diamond that's had carbon injected into it in order to remove some of the inclusions. Sean clearly explained all of that during his testimony. The ring given to the plaintiff wasn't fake. It was simply a lower quality diamond of lesser value than her original diamond. You can find out more information about quality enhanced diamonds online. But like I said, they're real diamonds and are NOT the same as cubic zirconia which is fake.
I feel sorry for this defendant-in-name-only. He did nothing wrong, but his boss threw him under the proverbial bus, likely, in part, because he didn't dare face the plaintiff in court.

When the plaintiff said she didn't have the appraisal from the other jeweler I thought she was going to lose. But when the "color enhanced" BS came out.....that did it for the defendant. New jewelry store owner is super shady. Poor Sean!
Sean - the defendant - was put in a bad spot. I think he did the best he could under the circumstances not having been there to handle the original transaction. That aside, he's a well-dressed, handsome man. Good call, judge. ❤

His boss didn’t lose that diamond, he switched it with his wife’s “diamond”, and was hoping she was too stupid to get it appraised. That boss has that diamond, that’s why he didn’t want to show his lying face on tv.

The Plaintiff is a smart lady by getting that ring appraised at another jeweler right away. I agree that any jeweler is going to downgrade to pull in her business from the scammer(owner) of the store, but they were correct in their appraisal that it was not of equal value to the stone that was lost(stolen) by the the repair shop.
The defendant(owner) should've been filing a lawsuit against the repair shop, instead of sticking it to the Plaintiff.
The defendant(representative) is a good man & I hope he finds a better employment situation. He's definitely not getting paid enough to litigate for a dishonest(coward) employer.
She was trusting of his family when they owned the store. But when the new owners...lost...her ring, she was not going to trust them just on their word. And she was right. The new ring was not equal value to her original ring. They lost a good customer and by word of mouth other customers who don't want to be scammed. That young man needs to find another job in jewelry at a reputable store. Now that he knows what they do.

The plaintiff needs to learn to shut her mouth when she's winning, because I think she was two seconds from losing her case (if she said she knew what quality enhanced meant).
The new store owner, has shown his true colors.... I would not do business with that store... he tried to pull one over on the client. He counted on the client's ignorance of diamonds.
Too bad they sold the family business to work for someone else who seems to be tarnishing their good name.

Winning is good, but being compensated for dishonesty is justice. The plaintiff should have received at least 1,000 for fraud. The defendant already knew he was the scapegoat for the company.

In the future, people need to get agreements that say, "Client has x days to get replacement diamond / stone appraised." They should also ask for information on the stone in writing. I find it HIGHLY suspicious that her replacement stone was from another ring. This so-called jewler sounds like someone the police need to keep an eye on.

'Tiffany' rings aren't just referring to the gold band part, but it is a guarantee that the diamond is also a 'Tiffany' diamond, so it is registered and authenticated. If the defendant's boss switched the 'Tiffany' diamond for a cheap low quality diamond, that is called FRAUD. But why was she only awarded $2900 when her ring had been valued at $3500. Quality jewellery doesn't devalue, the judge was just being cheap...

Did they even tell her that the diamond was cracked and needed to be recut? Or that it was just going to be reset by fixing the broken prongs? Diamonds don't crack by just falling out of the setting when a prong breaks. This new jewelry is shady.
SHE NEVER PROVED the ring was worth $2900. The problem she still has is that SHE HAS NO APPRAISAL of her original diamond. In real life she would have probably LOST.

@@AdamLuiTube like judge millian said, any jeweler will not accurately appraise a piece of jewelry that isn’t theirs. they will down grade it everytime because they want you to buy from them instead. i highly doubt the ring was only worth 200. and sean gave a range he said about 2500-3000. how accurate that is, idk i didn’t see the ring but of course they will be on the higher end of appraisal because it’s their ring. i don’t think he intended to be dishonest because like judge millian said, he was honest the whole time.

This is a classic case of new owners of a business purging their client list. Sometimes it's expensive but it's common practice. Regular customers get shafted because the new owners have a different set of clients they want to bring in / their own clients they want to bring over. In other words, they set this kid up and he probably got canned for failing. Such a sad situation for him and awkward. He could only say "yea we screwed her..." Poor kid you could tell he did NOT wanna be there!

This is a typical thing that happens at jewelry stores! Always get your diamonds appraised and checked before and after! If possible buy from a reputable dealer and o my take it to them. Less likely they will have incentive to steal since it’s what they have on-hand everyday

Never get your jewelry fixed without getting it appraised. 😮 This happened to me.. please take pictures of the person you give it to and take pictures of the diamond.. never leave the premises and watch them reset the diamond in person.. 😢I’m heartbroken for her..

Yep. I worked for a family business, jewellery, and you are 100% correct. Emeralds and rubies, that's where the money is. Opals are getting more rare as well. Diamonds weren't even a thing until Queen Victoria, who also popularized the white wedding dress. DeBoers picked up the ball and ran with it ... the most successful ad campaign EVER, and still.
You NEVER get pain and suffering on a case like this. Only on actual INJURY cases. Jeesh.
