  • Fellow Patriots & Freedom lovers, On April 27th 2022 I was peacefully exercising my constitutional rights at the Cecil County Government Building in Elkton, Maryland. While I was gathering content for my story multiple public servants began to become unnecessarily worried about my presence, so much so that they asked me to leave, when I refused, they called the Sheriff’s Office.     Notice how the Sgt’s had a attitude adjustment after he spoke to his superiors? I’m thinking they told him who I am…which is one of the reasons why I don’t identify myself. EVERY citizen journalist should be treated the same, I shouldn’t be treated any differently because the size of my UA-cam channel. Let me know your thoughts

      the LT is half right. You can't create a disturbance or threats or be "disorderly" even while doing a protected activity. His mistake was thinking people being upset or angry at being recorded was any of those things.

      I totally agree with you, I had two relatives that passed on 9/11 they were in the second plane that hit the towers. If they were here today and could see and maybe they can see what is happening, but what I'm getting at is they would be against all are rights being violated. They would also be ticked when people say in this day and age, or in today's world or ever since 9/11 I hate those phrases. So would they if they were still here with us.

      It would be interesting to see a study on how many times an average person is "Filmed" in a day 50? - 75? times I'm guessing. My work truck Records everything and everyone in front of it whenever it is running. I bet I record a second or two of 5000 people every day!!! It's one of 6 trucks, we are all over town 10- 12 hours a day "Filming" and it's a town of 150,000

    At 19 minutes the LT was starting to stumble across a gem of truth that even he doesn't want to accept. Calling ahead of time to inform public servants of an investigation would completely ruin the authenticity of the interactions.

      He couldn't quite work his way to why he couldn't threaten to arrest solely for failing to provide ID when he "couldn't do it." At a minimum, it's 4th. Additionally, Maryland may have similar or greater protections than that. I have no clue about Maryland. (Virginia?)

      Not numbing, I've seen hundreds if not a thousand + 1A audits and it still infuriating. I can't believe how across across country 99% of public officials and servants have this chip on their shoulder, this perceived ownership of what is clearly of the people, for the people, and by the people. We are the highest rank in any public situation when we are lawful.

      If I was a resident of there I would like to have a say in if the cameras are up to what I think they should be before they are bought. Tell the citizens what model number your buying and ask for input on them on line or at the county meeting, you know what kind the cops are going to be looking for what’s best for them

      Here's the game that's now being played. Government employees tell cops to trespass you from a building. Cops trespass you. You sue. Cops claim that they were just carrying out the orders of the government employees. Government employees claim that they don't know the law which is why they told the cops. This is exactly what happened in the lawsuit against the cops that arrested the guy being trespassed from the county fairgrounds last year.

      Fundamentally, he should be correct. He may even truly hold himself to that standard, as every law enforcement officer should. But we see in reality all too many times how that statement stacks up. He himself said that their department wont be getting badge cams until 2025, as per required by law. They are essentially avoiding having to make that investment into transparency until they absolutely have to. While there's nothing wrong with that, there's also nothing wrong with getting the ball rolling early as SO many other departments already have. You can't boast about your levels of transparency while doing the bare minimum to uphold that standard. You can't have your cake and eat it to.

      Lot of copsplaing.... smh he doesn't understand that just because you're holding a camera doesn't mean you're creating a disturbance. It especially does not stop anybody from conducting their governmental business as he put it. I guarantee you this would have been an absolute fail if the major hadn't shown up. I personally feel this is a FAIL. you should be able to go into any public office get any of the publicly available information disseminated to the public not just the first floor Lobby.

    Virginia was very unfriendly and belittling. It's like she was running a day care and a kid was in the hall on the way to the bathroom without the hall pass. She was just so happy to be able to jump on someone. She didn't listen to anything you had to say and she was very rude. I'm glad the cops were able to talk it out and be reasonable.       Why didn't the auditor do his research about two party consent states before the audit!? The officer is lying! That's not how "wiretapping laws" or "two party consent" laws work at all! Wiretapping laws only apply to secret recording in places that have an expectation of privacy. Holding a camera is not a "secret recording" and there is no expectation of privacy in a public building! The auditor has not broken any Wiretapping laws... the officer is not mistaken, he's intentionally lying.. 14:25 the officer uses the word "surreptitious" (meaning secret). The word surreptitious is written into the law, so obviously the officer has read the wiretapping laws (Thus, no surreptitious recording is allowed, with exceptions for law enforcement officials who have obtained warrants to make such recordings).
      the auditor should have done his research so that he could make a educated counter argument..
      Also, the auditor's 4th amendment argument is weak and poorly researched! Handing over your driver's license is not a "seizure" of the license. It's a violation of our 4th amendment rights because "We have a right to be secure in our papers", a license, birth certificate, passport, are considered our papers!! Demanding our papers without cause is a violation of the 4th amendment BUT not because of the physical act of handing over our license. This auditor needs to educate himself, his arguments are poorly researched!
      (The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated). The auditor should have explained that a license is our papers.
      I'm shocked that an auditor of a pretty popular channel hasn't educated himself on basic law! the only way to protect your rights is to be educated about your rights. This auditor needs to learn about two party consent, wiretapping laws, 4th amendment violations, and tresspass laws (you CAN be trespassed from public property without committing a crime). For example, the act of standing at the clerk's counter quietly and blocking the counter from being used by other citizens, that would be considered an obstruction governmental business but it doesn't rise to the level of disorderly conduct. You could be trespassed for obstructing business without actually committing a crime.
      He claims that his channel is about "education" but he continually misses his opportunity to educate. instead of educating the officers on two party consent or 4th amendment violations the auditor let the cop feed him a bunch of BS about wiretapping laws.. I don't expect the auditor to know every Supreme Court ruling, he doesn't have to know all the laws involving theft, or stolen property but he should be well versed in the first amendment and recording in public if he's going to audit! Having some case law ready would help to educate the public and the police..

      Yeah especially when you realize they're not getting cameras for 3 long years and then they're only getting them because the law FORCES them to get them at that point. Their department can get cameras right now, yet they choose not to. Everyone knows why, especially after this little demonstration.

      The auditor doesn't know the law either!!Why didn't the auditor do his research about two party consent states before the audit!? The officer is lying! That's not how "wiretapping laws" or "two party consent" laws work at all! Wiretapping laws only apply to secret recording in places that have an expectation of privacy. Holding a camera is not a "secret recording" and there is no expectation of privacy in a public building! The auditor has not broken any Wiretapping laws... the officer is not mistaken, he's intentionally lying.. 14:25 the officer uses the word "surreptitious" (meaning secret). The word surreptitious is written into the law, so obviously the officer has read the wiretapping laws (Thus, no surreptitious recording is allowed, with exceptions for law enforcement officials who have obtained warrants to make such recordings).

Demanding our papers without cause is a violation of the 4th amendment BUT not because of the physical act of handing over our license. This auditor needs to educate himself, his arguments are poorly researched!
      (The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated). The auditor should have explained that a license is our papers.
      I'm shocked that an auditor of a pretty popular channel hasn't educated himself on basic law! the only way to protect your rights is to be educated about your rights. This auditor needs to learn about two party consent, wiretapping laws, 4th amendment violations, and tresspass laws (you CAN be trespassed from public property without committing a crime). For example, the act of standing at the clerk's counter quietly and blocking the counter from being used by other citizens, that would be considered an obstruction of governmental business but standing somewhere quietly doesn't rise to the level of disorderly conduct. You could be trespassed for obstructing business without actually committing a crime.
      He claims that his channel is about "education" but he continually misses his opportunity to educate. instead of educating the officers on two party consent or 4th amendment violations the auditor let the cop feed him a bunch of BS about wiretapping laws.. I don't expect the auditor to know every Supreme Court ruling, he doesn't have to know all the laws involving theft, or stolen property but he should be well versed in the first amendment and recording in public if he's going to audit! Having some case law ready would help to educate the public and the police..

    The look on that receptionist face when you said all the employees in that building was so disrespectful and shaking her head. That 1st sergeant attitude definitely changed once the lieutenant showed up. He was definitely trying to violate your rights

    How many times have we all seen them turn off cameras, mute cameras, turn away or block them. Not to mention them claiming that they lose the recordings or just refuse to release them. Then turn around and investigate themselves to find no wrong doing. Yeah...transparent alright.

      Exactly, member LIA video released this Easter... The officer was swiping his hand trying to turn off the bodycam to talk trash about his call and never managed to do it and we got to hear all the gossip! That was one epic Audit!

Endless, patronizing, condescending, cop-splaining and all the Lt. had to do was tell the public servants that Sean is doing nothing wrong, go back to work.
