Paddle out to remember the lives of surfers

Surfers performed a “paddle-out” ceremony where they formed a circle on their boards in the ocean to honor the surfers killed in Mexico.

Why is the guy charged only with kidnappning? Is it some sort of scapegoat deal. "If you accept being a scapegoat for this, we will tell them to charge you only for kidnappning, and when the case is forgotten, next year or so, you will get released from prison due to good behaviour."
