- On June 25th 2021, I was conducting a 1st Amendment Audit on the Newburgh Police Department in Newburgh, NY. As I was peacefully exercising my rights, two officers made contact. These officers were tyrants and ignorant of the law and constitution they swore to uphold. Thankfully, the Sgt. arrives and the whole dynamic changes...If you feel the need to redress your government regarding this incident, relevant contact information is below:

@@bethturner4070 Perfectly stated!!!
Sadly, some conditioned pr!mates will never comprehend the value of the US Constitution.
I love the way the Sargent Dismissed the 2 officers ...beat it.. hes a real leader ...the kind of man we need holding up the constitution from corrupt mayors, prosecutor's etc
I want to believe that sergeant, but there's been too many times watching a sergeant say one thing and doing another, plus a concerns me that his officers doesn't know what reasonable articulate suspicion is, which means these officers are detaining people for no reason whatsoever.
That cop not knowing RAS was hilarious and the Sargeant got him out of there before he made the department look even worse lol.
To be fair, I think he was nitpicking over the "articulable" part just to be argumentative (like the shoe lace thing), since many jurisdictions and case law just use "reasonable suspicion" such as the landmark Terry v. Ohio case which is arguably the most important case law pertaining to police contacts and detainment. I personally think that "articulable" is clumsy and redundant when used in conjunction with reasonable in the context of law enforcement.
Yeah he had heard enough from his tick turd of an officer. The dweeb back tracked faster than speeding bullet :) he almost spat his tongue out
I am the Captains slow nephew and big words confuse me liked how his face twisted up when he never heard that
Funny he said he never heard those words together and then when Sean told his sergeant he tried to deny it.
😅😅😅
Getting permission to do this in advance defeats the whole purpose of what he is doing.
Not even just what he actually does. If it was really about checking out where his tax dollars were going with the cars and such...why call them and tell them there is an inspection coming at X day at X time so they can fix all the problems?
Agreed, he sort of missed an opportunity to make that point.
Yeah, plus the Sargent suggesting he goes in beforehand to tell them who he is and why he's there etc (ie, show his ID) - we all know they will run his ID when he walks out that door, while then DEBATING outside with cops about RAS to get ID??.
Typical duplicitous cop thinking he's slick ...
This is the realest comment ever if the idea was to announce an audit no corruption would be found that’s the same warning a restaurant that the health department on the way
That's true and false in some ways. They'd still get educated if he goes in
The Sergeant lowers the blood pressure and de-escalates. Great work.
The way the Sargent said enough was amazing! His cops straight up walked away like kids being scolded by their father 😂
Policeman #1, when you told him he was being nice, decided to catch up with his pal!
That's true, he immediately became a dick after being praised for being respectful and deescalating.
hahahah so true
Yup
You are correct very good detail to notice activity like that
Don't forget the other guy started acting nice once he put on his body camera
I love how the Sargent stopped the arguing and then had a productive conversation with the auditor. Good job.
Respect Sergeant Sluszka
Agree, but I hope he spoke to his officers about the unlawful detention cause if he hadn't come out, it would have turned into unlawful arrest and violation of 1st and 4th amendments!!!! The Chief needs to train them. This was UNACCEPTABLE.
I'm so ashamed to say that im from ny.. this is the culture of this police department.. absolutely shameful
The one cop was unhinged and out of line. He is a ticking time bomb and I hope his superiors view the initial interaction. He is the reason cops and the public get hurt and killed. You handled it better then I ever could. Amazing work. A good bridge and ending.
"It's restricted because I said so!"
This is exactly why the public needs to educate themselves and learn that these Cops only hold the authority we authorize to them. We do not grant them supremacy over our Liberty.
These clowns had *ONE* job, to uphold their *SWORN OATH* to the US Constitution.
The failed like the fools they are.
Thank you, Sean, for documenting their ignorance.
No the courts do that
@Carl Hubbard The People have done this, not the courts. We have elections, and the people place the same parties in power term after term after term.
Our Govt is a reflection of the cultural decline.
The problem is that most ppl can't afford to fight for our rights and most tyrants know that & bet on it.
Sgt. at least figured it all out, and dismissed the two idiots.
@Rick Seconds: Yes the sgt figured it out but he struggled with it for a while.
They fed him some bad info and he went to their side a little then he reached into his experience reservoir and made the right decisions.
Well kind of
@@sk-ls8tt He should bust them down to 2nd class police band triangle operators. They were as thick as mince.

The biggest number 238 was from COVID-19!!! More cops died from Covid then being "ambushed"!!! Tell them keep that bs propaganda to themselves next time.
He tried to defend their unlawful behavior and made excuses for them. When are the supervisors ever going to hold their officers accountable? Even the so-called "good cops" are tyrants.

As a citizen concerned about the erosion of our rights, I love watching auditors. This is the best auditor on youtube. There are a few that are also very good, but in my opinion, Long Island Audit is the very best. This video is a perfect example of productive meaningful 1st Amendment auditing.
Sergeant had to shut his officer down before showing how fully ignorant the department is!
That was the best part, when he called the dogs off and demonstrated some reason.
@Rafael Felan I bet he chewed their asses off camera. They don't need the bad press.
@Rafael Felan Thin blue line
Got that right.
Well if that was the case he was to late, I suppose he may have saved part of his department, but as far as these two idiots it was way to late. The sergeant was decent but he did do his best to do the copsplain song and dance, the same old you need to come ask/ tell us you’re going to be using your rights so we can let you know if that’s allowed.

Sean you have big balls. The People’s balls!
It drives me nuts that cops will interrupt/talk over you again and again and then get upset if you “don’t let them finish”
Absolutely. It happens all the time, doesn't it? Infuriating.
Or they won't let you talk while they are talking, and then when it is your turn to talk, they would talk over you. They need to go back to communication classes and learn how to reciprocate.

Right? The camera really shines a bright light on their stupidity and ineptitude.
So, I live 20 minutes from Newburgh, NY. This video is not only doing justice for that town, but the fact that the one officer said he’s never heard of “reasonable, articulable suspicion” or “ I’ve never heard those words together in the same sentence” is not surprisingly at all.. I’ve legitimately seen those cops arrest people for not having identification on them…
Keep up the good work Sean and be safe out there! 🤙🏽 hit up Tuxedo, NY police. You’ll have a field day.. 🙈 you actually might get arrested there so if you do go there or town hall be safe man 🤙🏽
Good job Sgt. well done deescalating and being a good leader. These audits make me have hope there’s good ones out there!

Yes this coment 100% correct
Not afraid of no man but Jesus. Having the same toys they have.
This department should have two openings for employment asap.
This Sergeant is a real leader, he knows the law. The first cop was cool until the second cop came with the attitude.
He knew the law, but he still tried to hide behind excuses even when after his people left.
YOU'RE FIRED 5:09
He isn’t a real leader. He okayed the unlawful detainment and said it was wrong once they left. He’s a coward.
Is this him? 😂😂😂😂 Is this him on a fake account? Lmao!!!

Damn! Well done! I'm pretty sure this interaction led to some retraining. THANK YOU!
If you're not wearing blue, you're just a criminal they haven't caught yet. Typical cop mentality.
You dared to approach their blue line gang clubhouse and must be attacked.
I love how Sarge let them have their fun for a couple of minutes then shit it down with authority! Good on Sarge!
Yeah, I thought he did a great job.
Sarge sent them away before they could state their personal thresholds for bullshit detainment. That kind of piss poor understanding of the law is best not said out loud on video. it was to save the cops, not the citizen.

The minute the auditor speaks of the law with far greater knowledge, is the moment the supervisor dismisses his thugs. I do NOT believe it is a coincidence. He just realized they were outgunned in "legal" sense. He thought "oh shit, I better get rid of them because they're embarrassing us".

Respect to Sergeant Sluszka for that amazing de escalation.
Great role model for the two other cops !
The sergeant passed the audit for knowing the law and de-escalating the situation.
Respect for that Sgt. He’s the officer they should strive to be. He remained calm, didn’t violate any rights, respected boundaries, stood there and legitimately listened to Sean and was great at de escalation.
Another good reason for these videos is to highlight the good cops out there.
Agreed. The sergeant was good in many ways and definitely helped, but listening was NOT one of the good things he did. Like most officers (sadly) he interrupted and over talked Sean most of the time. He did get the bulk of the points and it worked, but he missed 90% of what Sean had to say! And he COULD have gleaned some really valuable information if he could just shut up for longer than 15 seconds. I couldn’t do what Sean does, that shit would drive me insane - I’d be in jail for slapping cops every time they wouldn’t shut TF up! 🤣😜🤪
Basically, the sargeant wasn't operating on ego. That's the key difference. Oh, and he knows what RAS is.
The fact that that officer didn't know what RAS was should get him sent back to Police Academy. I really prefer these interactions where you talk to somebody and it goes positively. Great job.
He knew what it was - he was lying to try and force his illegal actions.

"razz" or acronym R.A.S. are not used in everyday police work and training. The term is usually said "reasonable suspicions" or occasionally abbreviated RS (but usually said out the long way). Though I side with the auditor overall, they were UA-cam educated on how this term is used or referred to....aka incomplete education.
He shouldn't be sent back to the academy. He should be done! If ur on the street "enforcing law" & you don't know what RAS is, that's unforgivable!

Photography alone and constitutionally protected activity alone can't be deemed "suspicious". Just because someone does not know your "intent" does not prevent your liberty and freedom. This is the problem with these officers and many other officers in the country.
Exactly, and their insistence on a detailed description of the exact type of story theyre doing is tiring... does it matter? Would the law change based on whether the story is shining a positive or negative light on the department?

I strongly agree wish there were more law enforcement like sarge. He is Rational
The officer with the hat is dangerous to the community
