    While I was exercising my first amendment right to film in public. The receptionist, security and library director all became hostile and attempted to violate my rights. They called the south hampton police insisting I was violating "policy" I explained forcefully and respectfully that policy doesn't trump the constitution of the United States. After speaking with her chief the SGT. Relayed to the director that I was withing my rights and promptly left. Everyone in the situation was educated. Another win for the constitution!

      He's just showing all of us what our tax dollars are spent on.
      Total idiots throwing a fit!
      Because of a CAMERA?
      You got to be kidding me!
      When those public buildings have cameras all over the place.
      What's up with that?, and their thought process coming to a conclusion of throwing's fits in front of the public with our tax dollars.

    This is interesting. As a former police officer I can tell you that we are trained to stand a certain way, and to present ourselves in a certain way, and to speak in a certain manner because it has a psychological effect on most people, and will cause them to subliminally (mostly) comply in general. Once you have an obedient citizen you can do just about whatever you want. I watch all of your videos, and today I realized that when you request "name and badge number" it has the same psychological effect on most/many police officers. Once they comply to your request it's like you are taking the power away from them. They know they're going to be held accountable, and that THEY work for YOU, the public. Being compelled to speak their identifying information (name and badge number) makes them know they do not have the control they thought they had. I like this. We can use some of the same tactics they use to keep ourselves safe. Thanks for the videos!

      @Emma It will be very instructive to see how some of these court cases pan out. You do make a valid point, but I think it would be hard to get a conviction against someone quietly filming in public, whether in a sidewalk or in a library. Time will tell.

    • @dennismood7476
      @dennismood7476 2 роки тому +12

      @Emma You are right. There are limited forums such as public squares and sidewalks. You are also right mentioning time place and manner restrictions in certain public areas and buildings concerning the first Amendment. Those time place and manner conditions are TIME: When public spaces are open to the public access. Parks, other public outdoor areas MAY be closed during set times of the day /night. TIME refers to the hours in which the library is open to the public. The Library was open for business. Place: The legal condition refers to wherever the public is allowed to go. The public, meaning ANY person, is allowed to be there. If the public is allowed to be there, so is the PRESS. Manner: Not making any intentional actions to disrupt the business of the building. Quietly recording is NOT a disruption of business. The justification is the number of cameras within the building itself. If the library can record you, you can record the building and it's employees and patrons. That should satisfy the requirements of time, place and manner qualifications. Additionally, as it was mentioned in the video, the Constitution takes precedence over ANY policy AND, by definition, the police are LAW ENFORCEMENT, NOT policy enforcement. Nowhere, not EVER, has policy enforcement been the duty of police. Their job is to enforce the LAW.

      @Rodney Iskander The "security guard" you mean? Yeah, I would agree.
      Look at how he was groveling for that older White woman. I mean, I get that older married White broads are promiscuous and don't hesitate hugging or wrapping their arms around other guys DESPITE being married, but for she to do that in that particular setting -- public library -- is plain inappropriate.
      Libraries are frequented by families with children. And I'm sorry, but no child should have to see some younger Black security guard and an older White woman (library director) hit it off. I say that both should be fired. Because if they're touching each other and violating their own social distancing protocols on camera (see 3:06 and 18:00), then they have no place running the library. Anyone know whether this library director is married? I would be embarrassed if my wife behaved in that manner.

      @dennisjohnsen7297 2 роки тому +11

      It’s not that they don’t understand, it’s that they don’t want to understand. If cops know the law, then they can’t claim to be acting in good faith. Law enforcement is the only career I know of where the less you know about what you are paid to do, the better off you are. If that’s not absolutely insane, I don’t know what is.

    • @dennisjohnsen7297
      @dennisjohnsen7297 2 роки тому +6

      @Emma there is such a thing as disorderly conduct in a public library, but not for cursing. To say can you curse out loud is irrelevant. Can you scream ala ak bar, hail Satan, or glory to God? That’s freedom of speech AND freedom of religion, correct? No, you cannot. There are what are known as traditional public forums for such things, but the library is not that forum, but could they have a policy that says no Bible reading, no Quran reading, no Torah reading? In Pyongyang, yes, but in Anywhere, USA, of course not. The right to privacy is not one of those “limited public forums” you are talking about. A public restroom is a good example. It’s simple, if you see surveillance cameras, then there is no expectation of privacy. Have you ever seen a surveillance camera in a public restroom or a fitting room? Are you allowed to peek under a bathroom stall, or into a dressing room? No. A public library has a long standing tradition of public cooperation, the peace and quiet, and it’s a normal expectation of the public that it is such, but if is established that the public is allowed access and the public can view it with their own eyes and hear it with their own ears, then it can be recorded. Surely you don’t expect to be blindfolded and wear earplugs when entering a public library. A person peacefully photographing a publicly funded facility, regardless of whether their actions are not welcome, is not, nor can it be construed as disruptive. It is no more disruptive than the cameras mounted in the ceiling, peacefully recording the public.
      This all started with the refusal to give a proper name. Once they realized they could not lawfully demand his name and could not refuse service, that just infuriated them, so they went to the illogical video recording and they were like a dog on a bone and could not see the unconstitutionality of the policy. You can write anything you want as a policy, but if it is publicly funded and publicly accessible, then it cannot infringe on constitutional rights. You can put a sign on your treehouse, “No Boys Allowed,” but if taxpayers pay for the treehouse, then your sign means nothing.
      Didn’t mean to go on for so long, but I hope it helps you understand.

      I think people are well aware of their rights, even to a degree of excess. Unfortunately, we don’t seem to recognize the rights of others; that our feelings don’t trump their rights.
      Anybody can write something on a paper and call it a policy. If the policy said whites only, everyone would be aware that although it’s a policy, it cannot be lawfully enforced. But for some reason, public photography seems to escape the rationale of a large proportion of the population, right up until it’s them (like the old man) recording in public. Wicked Witch of the West didn’t see a problem with that. 🤔

      They haven’t stopped teaching the Constitution in school. Not sure where you live, but both my kids were taught the Constitution at the elementary, middle, and high-school level, with age-appropriate content in each. Additionally, high school seniors have to take Government as well, which covers the Constitution again, as well as how local, state, and federal governments function. They’re even taught the state constitution.
      The problem is that people don’t take advantage of the education they’re given and popular youth culture treats ignorance as something cool and academic success as something for nerds and losers. Also, our poorly-funded schools lack the resources necessary to teach effectively to all types of learners. That’s why we continue to graduate illiterate kids with little understanding of the world in which they live, the Constitution included.

    You handled yourself excellently here today. Really impressed and good on you to keep that low and slow cadence in your voice patterns as much as possible. Like the UA-cam comment that guy pointed out when you ask for their name and badge I do agree with him it has a psychological effect on the situation instead of a normal citizen sometimes starting off their interaction by starting to talk fast and elevating their voice. The difference in approach I really think helps control these situations instead of the cops just dominating you and getting physical with you. Sometimes they will push you around regardless if they are enough of a pig but these ones actually seemed to let you talk and listened for the most part. It’s pretty sad though to see our public servants constantly acting rude and refusing to listen and then accommodate you after they have been informed of their miss understandings of laws. I’m sure some blame does go to the management even above the directors level as I am sure they are trained to that policy but they are being trained to a policy that vilolates the public’s rights. It takes a strong person to take a step back willing to say “wait a minute this guy has a point, I know this is a public space and in public spaces you have no right to privacy so this policy is legitimately in odds with the constitution so it must be wrong, oops silly me”. Very fascinating to see this play out in so many different ways.
