no, depends on the weight of the aircraft, rwy lenght, temperature, pressure..
it is better to use a flex value in order to save some fuel and engine life, but toga is usually used on small runway or /and aircraft very heavy

I don't remember the TOW. We use TOGA when it's called for by the W&B, or certain weather conditions.
