  • Around 10:22 AM on January 23, 2023, Officer James Serio with the Little Ferry Police Department observed a 2009 Ford driving without headlights in the rain on Route 46 eastbound. He activated his emergency lights to initiate a traffic stop. After initially stopping in the left lane, the vehicle drove over 3 lanes of traffic and pulled over near the intersection of Route 46 eastbound and Bergen Turnpike.
Officer Serio made contact with the driver, later identified as Jennifer, and asked for her documents. Instead of providing her documents, Jennifer kept aimlessly searching through her purse. Her passenger was also constantly going through his pockets, which made Officer Serio suspect that he may be trying to hide something. They told the officer that they were coming from Travelodge, which is known for illegal activity. Since they were both pale and unable to formulate coherent sentences, Officer Serio called for backup and Officers Convery and Fernandes arrived on scene to assist.
One of the officers who arrived as backup recognized Jennifer as someone he had arrested a few weeks earlier, and Jennifer was coincidentally scheduled to appear in the Little Ferry Municipal Court later that day in regards to that incident. Based on his suspicions, Officer Serio asked Jennifer if she would consent to a search of her vehicle, but she answered in an incoherent manner.
A few moments later, Jennifer attempted to walk directly into traffic and Officer Serio had to physically restrain her. At this time, Jennifer became physically aggressive. Officers Convery and Fernandes immediately assisted Officer Serio in restraining Jennifer and they placed handcuffs on her. After she was handcuffed, Jennifer attempted to reach for Officer Serio’s firearm, but Officer Serio moved Jennifer’s hand away from the holster. As he proceeded to escort Jennifer to his patrol car, Jennifer fell to the ground and kicked Officer Serio in his right leg twice. Officer Serio eventually got Jennifer inside the patrol car and closed the door.
Officer Lee arrived shortly afterwards, and he assisted Officer Serio in adjusting Jennifer’s handcuffs while Officer Serio conducted a cursory search. Jennifer’s vehicle was searched and impounded by A&D Towing. While her passenger was briefly handcuffed and detained, he was eventually released from the scene without being charged. Officer Serio transported Jennifer to the Little Ferry Police Department, where she was photographed, fingerprinted, and read her Miranda rights. Detective Ratto processed Jennifer’s criminal charges, and after she signed for her property, Officers Serio and Convery transported her to the Bergen County Jail. Records indicate that a judge ordered her released without any bail the following day on January 24, 2023 at 4:42 PM pending her court appearance.

The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.

Lights on when it is raining, so naturally, your wipers are on too. It is in the fecking driver's manual ffsake!
Perhaps you should review the drivers manual. 50 years old and you don't remember it? Obviously, you should review it.
It is a law because no one can see you as well when it is raining; which is, in fact, why car manufacturers began implementing the automatic feature for 'auto on headlights when the car engine is running'.

@@Userf451 well, you can learn how to reply, & defend yourself verbally from bullies taking advantage of your lack of knowledge, or roll over, kiss their ass, & open your bank account to any charges they want to ram down your throat, and then you can hope and pray that the judge and the prosecuting attorney won't try to take advantage of you as well. Your sarcasm in this day and age is one of the reasons there's a problem on the streets. You have constitutional and civil right to be innocent of a crime, and if you don't speak up for yourself, their going to do ANYTHING to get you in the courthouse, then even if they dismiss the case, you will be fined $25-$100 dollars, that's what it's all about today. It's terrible if you don't see it. They need to just be "keeping the peace" not trying to pin charges on every human being they encounter. It's all about the money

To the people who disrespect our police…Stop It! Who are you going to call when YOU become a victim? We respectful citizens are fed up with criminals kicking, biting, spiting & resisting the police!!

Watching so many videos as I have, I can't believe what they go through and how they get treated.

      ❤❤❤ So true!!!!
In Germany we also got lots of problems with insane freaks who disrespekt police and ambulance 😢 I can't understand!!!! That's so disgusting and uncivilized 🤮
They are very hard working to serve to the society, they work to help US ALL!!! People who disrespekt or even fight police or ambulance should always go to jail and when they call them for help they should NOT get it in future!!!

He used his position to assault a woman, who DIDN'T need her headlights on, during the DAY.
If you support this police brutality then you're just as disgusting as he is.
