Around 11:01 AM on March 2, 2023, Patrolman Joseph Maffia and Patrolwoman Kayla Finarelli with the Pine Beach Police Department were dispatched to the scene of a motor vehicle accident involving a 2015 Nissan Xterra and 2014 Ford truck at the northeast corner of Springfield Avenue and Motor Road. As they arrived on scene, Patrolman Maffia made contact with the driver of the Nissan, who was later identified as Rafaela Rea, while Patrolwoman Finarelli made contact with the driver of the Ford. While both drivers seemed shaken by the accident, neither driver displayed severe injuries.
After conducting an investigation and checking the camera that was mounted near the intersection, it was determined that Rafaela was driving westbound on Springfield Avenue, and she rolled through a stop sign at the intersection with Motor Road. As a result of her failure to stop at the stop sign, a northbound Ford truck with the right of way on Motor Road was struck on the side. The driver of the Ford narrowly escaped being struck directly as a result of his last-minute maneuver towards the right.
Patrolman Maffia asked Rafaela for her documents, but she was unable to find her license. First responders with the Fire Department arrived within a few minutes, along with Sergeant Ryan Morris. It was determined that the wires on the poles were not electric wires, so officials with the Fire Department began the process of clearing the scene. Sergeant Morris asked Patrolman Maffia to determine who was responsible for the pole, and it was determined that JCP&L should be notified regarding the accident.
As the tow truck was getting ready to remove Rafaela’s vehicle, Sergeant Morris also told Patrolman Maffia that he could conduct the Horizontal Gaze Nystagmus (HGN) test on Rafaela. Patrolman Maffia only asked Rafaela to lift up her sunglasses so he could look at her eyes, but decided against administering additional field sobriety exercises. It is not clear if the officers checked Rafaela’s driving record before releasing her at the scene, because she had 2 previous DWI arrests from October 22, 2024 in Toms River and May 16, 2022 in Atlantic Highlands.
After Rafaela declined further medical attention from the Berkeley Township First Aid Squad and the officers were ready to release her from the scene, Patrolwoman Finarelli transported Rafaela to her friend’s residence nearby. Based on the outcome of their investigation, Rafaela was issued the following citations: careless driving and disregard stop sign
Court records indicate that on July 30, 2023, the citation for careless driving was dismissed while the citation for disregarding a stop sign was amended to unsafe operation of a vehicle with a total of $390 in fines.

Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
You would think the sunglasses, chewing gum, blowing a stop sign and two previous DUI would have rang a bell with these terrible cops.
And having multiple DWI's shouldn't be a thing. How does the legal system allow her to drive?

I can't believe they let this drunk driver walk away and, worse yet, gave her a ride home. She was sitting in the backseat lying to whoever she was talking to about how someone ran a stop sign and HIT HER. 🙄 This was an extremely poor DUI investigation!

ok, you answered my question. I was wondering how someone could lie like that when there was vid (she probably didn't know.) It was irrelevant anyways, because she had to stop til no one was coming, but it's stupid to blame the tree......she blew that stopsign like a champ. It looks as if she was speeding and didn't slow for the stopsign at all. All the best to you! (they lie like that because if you weep in front of an officer, they believe everything you say.....or if you look rich)

There wasn't any DUI investigation. Those claiming she was drunk are being presumptuous. I saw no evidence the cops thought she was intoxicated. She did lie about the accident, however, and got away with it, at least to this point.

Every time she demands to leave you can feel how panicked she is that they’re going to recognize she’s drunk! You’d be surprised at how common this stuff happens. My mom was hit by a Ford F150 one night on her way to work by a woman who was texting on her phone. The accident happened right down the road from our neighborhood, and since I live behind my mom’s house in a house along the highway, I was able to go to the scene almost immediately. The woman in the truck never one time came over to see if my mom was ok or apologize, even though she was the one who caused the accident. Another time, I was waiting outside a building for an appointment I was about to go in, and saw a woman run a red light and slam into another man. The woman who hit the man refused to even come out of her car and never once showed remorse for hitting the guy, even though she hit him & he was calm about it. It wasn’t like he was screaming or anything, but she still showed no remorse for it.
These cops are truly the most incompetent I’ve ever seen. Unbelievable, she has 2 previous DUIs and they didn’t even question her or look at her driving history. They were bamboozled.

She is a high functioning alcoholic? The girl cop almost stepped up & probed into her history enough to NOT let her go scott free! She could have killed that young man. Thankfully no one was injured badly or killed. They need to enforce traffic laws.
This is INSANE! This PD needs serious training, she should have never walked from this scene. Even without her record, even if she was 100% sober, she flew through that stop sign, could have killed/paralyzed someone in a smaller car.
After all of that her “Careless Driver” charge was dropped AND she’s had 2 DUI’s in 2 years, behaving the way she was (sunglasses, chewing gum, blowing stop signs) and they didn’t run her through Field Sobriety tests?
They do that when they smell it. Also it’s not the cops that drop charges, it’s the DA’s.
With two DUIs in two years it’s surprising to me she even had a valid drivers license to begin with. I don’t know what the DUI laws are like there, but where I’m from, just the first conviction is loss of driving privileges for one year. Then after the one year, if you’ve met the court requirements (paid outstanding fines and attended alcohol classes or whatnot), driving privileges are then restricted to only operating a vehicle equipped with an interlock device for another year. So just the first DUI conviction is minimum a two year ordeal…
You’re acting like cops have the power to just arbitrarily drop charges at will. Prosecutors do that. Judges do that. Cops don’t. If you’re going to blame someone blame the flaws in the judicial system that allow this to happen.

I’m going through a divorce after 23 years and my husband is a trainwreck of a functioning alcoholic. He has lost his wife (and I was in it forever and should have left long before I did), he recently was fired from a management position at a Publix Markets, which he’s had for 14 years, etc.etc.,etc., and everything that happens to him is always, ALWAYS someone else’s fault. I thought it was just a him thing…didn’t realize it was an actual characteristic of alcoholics/addicts, but not that I think about it, it sure does make a lot of sense.

If you pull up that intersection on google maps, the direction she was coming from had 2 sets of speed bumps to let you know there is a stop sign coming up. Plus there are 2 stops signs, one on the left, one on the right. What if that was a motorcycle instead of a big van, she could have killed someone.

To save you 40-ish minutes of your time, a woman who was by all accounts drunk off her butt is on video camera running at full speed through a stop sign, smashed into a guy who had NO STOP SIGN, and takes out a big ole pole, and claims she *stopped* and that the other guy must have hit her. The cops see her acting totally "off" and she immediately pops a big wad of gum in her mouth, keeps saying how she wants to "leave" and "when can [she] get out of there and go to her friend's house" but r the video ends with her just getting a casual ride to her friend's house.
No DUI test ever performed. So, it's basically click bait to make you think that at some point the officers say "Oh crap this woman is totally impaired!"

I’m stunned no one picked up on the fact she looked like a disheveled drunk. All the clues of day drinking were loud and clear for everyone, yet not one person picked up on them. I'm completely baffled that police did not do a thorough traffic investigation and field sobriety to see if she had been drinking nor did they run her through NCIS to see if she had any prior run ins with the law. I feel she got away with DUI. The cameras caught her running a stop sign, but she didn't get cited for not having ID and failure to obey to traffic sign. WTH!?😳

The police report says she rolled through a stop sign. She didn't slow down at all. Rolled through was probably used to help cover up the lousey police work of the woman with 2 previous DUI's.

I just watched a video of this woman who was stopped at 2:00 am wearing her pajamas and swerving over the road. She had a bunch of medicine on the seat which impairs driving. She blew zeros so clearly no alcohol at that time.
There are many prescriptions that impair driving. If someone knowingly drives while impaired being medication or alcolhol- they are guilty.

You are probably right, she didn't have the smell of alcohol on her breath, but maybe she could've been under the influence of drugs as well, who knows🤷♀️
@@LeslieA-gu2qjshe isn’t going to smell like alcohol when that’s not what she’s impaired by. In a previous DUI investigation and body cam footage she’s found incoherent on prescription pills. She likes her pills a little too much and driving when you’re messed up on pills, prescription or not, is still a DUI. They’d have to get a warrant for a blood draw and/or a UDS (urine drug screen) to prove it, though. I think that’s a big part of why she got away in this instance. She hadn’t been drinking but she definitely had her cocktail of benzo’s for her “anxiety”.

If her “ANXIETY” is so severe that she requires high dosages of controlled substances to manage her symptoms…she shouldn’t be driving. Period.
Much like those whom have vision problems, memory issues associated with aging, and those with documented seizure disorders have a restricted license or not one at all…same should apply to those with severe anxiety and/or panic disorder. 🤷🏻♀️🥴😘

Okay accident investigation time: the damage to those two vehicles and where the vehicles traveled to after the collision proves she ran the stop sign. And then the still camera proves it. She doesn’t appear to be impaired. If she had stopped first, the other car would have already passed through the intersection by the time she stopped at the stop sign.
I thought she could possibly be impaired when she fumbled her words when first saying her son would pick her up & then seconds later saying her brother would pick her up. Her immense desire to leave the scene makes me curious as well. Thank you for your service ❤
At 33:17 - 33:18 while she’s in the back of the car she also says “I’m at the police station”. I feel like she could be impaired by a substance, not alcohol.. but certainly could be a prescription drug.

For everyone saying she is a drunk driver. Her previous DUI video shows her problem is prescription medical not drinking. Her previous DUI she blew 0.00. So its probable the officers didn't detect the smell alcohol and due it to her accent didn't think she was impaired. Sober people run stop signs everyday. Not defending her, just saying officers don't always assume DUI.

And then the officer is told to perform the HGN on her yet only asks her to lift her sunglasses for a split second coupled with the fact her charges were reduced all the way down to unsafe operation of a motor vehicle($390 fine) is the very reason people continue to drive drunk.

I know Alabama is strict with their DUI laws. My cousin’s dead beat husband racked up 3 DUI’s in a short time frame. He ended up doing 10 years in prison for it, too!! This woman is ridiculous. She acted like she was so inconvenienced when everything was clearly her fault! She’s going to hurt someone or worse…

Even if she had stopped, in a 2 way stop, intersection you have to yield, after stopping at the sign. She would have to stop and WAIT for traffic to pass, before going. Even without the DUI's she sounds like she doesn't know that and needs to be informed.
About 14:03 one cop talks to her and explains it looks like she didn't stop. He asks her how fast she was going when she went through the stop sign.

It makes me angry someone that careless can claim they stops at every sign and is a good driver (and they're so angry and inconvenienced and claim they were the ones hit and didn't ask if the other driver is okay) because when someone truthful says the same thing, they won't be believed. It makes doing the right thing pointless because if liars can get away with doing bad shit, why bother telling the truth and doing right by people? I've struggled with this concept my entire adult life. She didn't roll through a stop sign. She didn't even hit the brakes. Not even right before hitting the other vehicle. I don't even think she was looking at the road yet the careless driving charge was dismissed.
If she was on her way to work, I would assume this was a route she usually drove, and knew there was a stop sign there, yet she is on the phone telling someone "stop sign here, stop sign there, trees everywhere. I don't know how it happened".
How can she possibly not even get a careless driving charge?

I think they should have tested Patrolman Joseph Maffia if he was on duty under the influence. He seems he can't retain any information. Every time he gets answer from anyone, he would ask them to repeat the information multiple times.

And the meds were in a plastic bag so I don't think they were even prescribed for her . she has a serious drug problem ..in the last video she kept saying don't throw my pills away I need them ..I'm in recovery and I knew right then oh yeah she has a drug problem
