I am very certain that Fez337 is correct about the fact that Canadians with a LEGAL drivers licence from Canada are ELIGIBLE to drive in the US, unless there are some exceptions, but I think there may not be. If you mean by “open borders”, then that’s something else, but borders aren’t that OPEN, in other words, “free” of letting through people, so that’s definitely irrelevant. As a Canadian, and one that travels to US a couple times per year, I know how borders are and I have never heard of that kind of policy.

Driving through Georgia with Wisconsin plates, I was pulled over for following too close to the car in front of me on the freeway. The cop actually told me I must maintain 300 feet from the car in front of me. 300 feet! He just wanted to run my license, no ticket, but clearly I was targeted.
Absolutely true. And not just Georgia. There are departments of towns and cities off major highways which basically use seizure laws to rob people blind. If an American or Canadian stays in a motel or hotel off a major highway, expect that the staff is working with police to profile people and stop them as they leave.

It's always good to hear /see a cop or former cop speaking out for the right side when cops use their might to abuse people. I do believe there are more good ones than bad and that bad behavior from officers endangers all officers, so it's good to be reminded of it with the good ones speaking out. Canadians per se are not being targeted. Any out-of-state long distance traveller is more likely to have the book thrown at them as they are unlikely to return and mount a defense. This is also a particularly touchy time with anti-alien sentiment quite high - esp. in the deep south.

Georgia is one of several states where you MUST have your Canadian Passport with you in addition to your Canadian Driver's License. The policeman was correct. Refusing to let her contact the Canadian embassy was a no no.

Most Canadians are. I was born in the US and lived there for 48 years. The last 18 I have spent as a permanent resident of Canada. The people here are wonderful, and I plan on staying.
sadly, most people from other countries don't know any better because they don't have this type of corruption. USA is really the only country that thinks about suing people. She got a speeding ticket and in many states, you are required to pay for it with cash right away or you sit in jail until someone wires the money or you post a bond. I am thinking that is what actually happened here. They are returning her bond AFTER her ticket was paid per her statement.

There is very little accountability for police in the United States. They will act above the law and unknowingly do many illegal things with zero consequence. Broadly speaking the police in the United States do not know all the laws they are meant to and will basically make stuff up if they don't know the law.
The fact that the people who are charged with enforcing the law are that goddamned incompetent at knowing the law should really be taken as more of a problem.

State rules make it difficult, but it can be done. Before you can sue the state of Georgia, you must provide ante litem notice, just as you would when suing any government entity in Georgia. This is basically an overview of how you sustained your injuries and evidence to show how a Georgia state agency was liable.

Foreigners are required to carry his/her passport with her. She was arrested because she did not enough creditable official documents to prove her authenticity (driving license in not enough).

Their name can be redacted from police reports the same as witnesses names can be redacted until they appear in court. I live in New Mexico, which is a state in the US, and a family member driving through Georgia was stopped and the cop wanted to see their Mexican passport because they have a New Mexico license plate. There is a reason we are the only state in the country that has USA on our license plates

@@creekdweller9662 - Umm... no. Qualified immunity grants government officials SOME immunity from civil suits. In other words, you can't sue them for doing their job. However, you CAN sue if you can show that the official violated "clearly established statutory or constitutional rights of which a reasonable person would have known". A reasonable person (especially a cop) should know that a Canadian driver's license is just as valid in the US as a US license is in Canada. So in this case, a lawsuit would be easy to pursue.
@@Mr.Ekshin It's way worse than that simple interpretation. The "clearly established" standard doesn't refer to laws, reasonable people, or behavior expected of cops. "Clearly established" means established by the supreme court. In this case, there is almost certainly no existing judicial precedent for a Canadian driver's license with scanned passport on a cell phone in GA so the officer would get qualified immunity, and there will never be a precedent for similar cases so cops can literally do this everyday forever in complete immunity. A great/terrible example from 2019 came when an officer in TN ordered his dog to attack a suspect who had already surrendered. The closest "clearly established" standard involved a SCOTUS case where the suspect had surrendered by laying down. But the TN suspect surrendered by sitting down and holding their hands in the air. That little difference granted the TN officer qualified immunity which was affirmed on appeal. In another recent case some federal agents beat up a patient at a VA hospital, but they beat him up WORSE than the closest "clearly established" case, so the court granted the agents immunity. It really is that bad. Cops have complete immunity for ANYTHING that SCOTUS hadn't PRECISELY address before 1982. Think about it, cell phones and digitally scanned passports didn't even exist before 1982 so nothing related to them can ever become "clearly established".
They don't even care about that. They don't have to pay the lawsuit judgements, the city/county does. so there are literally no consequences for the individual officers and/or the the police departments that order them to do this.

Official issuing building permits has to know property law, building standards etc. I am a public servant and I can't explain my errors by not knowing the law. If I did something so serious as that cop did, I'd be fired on the spot and probably facing charges. And the fact that when in doubt the cop ruled against the citizen is an aggravating circumstance. When in doubt you rule for citizen, that's standard in whole developed world.

Her Ontario drivers license was invalid because that wasn't her residence. She was living and going to school in Kentucky for almost a year. She gave the cop two pieces of ID with two different addresses. The cop had no choice, with an invalid license, her insurance is void. I was her own fault.

Qualified Immunity. Not knowing the law isn’t grounds to fire public employees. The standard is to actually prove they willfully violated rights or broke a law they “ought to know”. It a sick standard, but you’re talking about years of expensive litigation in a foreign country and an award in the 10s of thousands. And IF a settlement is declined and the settlement awarded later is lower than the original, they lose that.
Well, in almost every other profession, any and all of what you suggest might be the consequence of such egregious (or similar) conduct...EXCEPT in law enforcement. I disagree. While she did allow her room to speak and asked some good questions, she stopped short. She didn't ask about the tow fees, the bail fees or what happened to the officer and department that illegally arrested and detained her for financial reward. So it is not like it is a new thing. All states including Georgia must by federal law except a valid Canadian ID and license the same as they would New Yorks, Ks, TX or any other states legally recognized entity. However this officer violated Georgia law, also a Nexus card is a recognized visa and I quote from the Georgia statute "Non-US citizens holding a valid foreign driver’s license are allowed to drive in the state of Georgia for tourism or business purposes. In the case of a driver license issued by the driver's licensing authority of a foreign country, a law officer may consult such person's passport OR visa to verify the validity of such license, if available." Being a student is a temporary residency and does not establish a permanent residency status required for a state residency as the student from a foreign nation and who is retaining their foreign citizenship is clearly in a temporary status as is a student who goes back to their home state when not attending courses, maintains their home states residency. This also has been established as federally recognized law and was formalized by the US Supreme Court in 1973. So yes the officer and the department are subject to state and federal criminal and civil penalties all because the officer did not consult the statutes or radio for consultation from her superior as is required by the law in the US. A law enforcement officer must have probable cause that a crime was committed to effect an arrest under sworn oath to both the US Constitution and their respective state Constitutions and since she (the driver) was within both state and federal law then, and the officer was unsure of the law. Then the legal choice is seek clarification or in the absence of actually knowing a violation occurred the officer was obligated to release the individual, anything else was abuse of power, criminal violation and a violation of civil rights. So again yes the officer and the Employing Dept. are culpable and open to litigation.

What gets me is it just wasn't the ignorant police officer who pulled her over. When taken back to the station, the officer obviously had to tell other people why she was arrested etc. Not a single one of them seemed to know the law or care to correct the arresting officer on her mistake.

No need. Read the real story. She brought this all on herself. She was living and going to school in Kentucky and thus her Ontario license was void and with it, her insurance. She gave the cop two ID's with two different addresses. She never bothered to exchange her license and plates for Kentucky ones. Or change her address on her insurance.

The legal fees cost more than the money seized so they lose money even if they win. That's by design so police can abuse civil asset forfeiture and make it not worth it for people to try and get their money back.

Don't be. After watching this unfold on local news 2 years ago, she had no proper identification on her at all. She showed the police officer a picture of her Canadian drivers license on her phone. Go to any country you like. Show them a picture of your drivers license on your phone and see where that gets you. You probably won't like the results and might even play the same victim card she is playing. She was released from custody when someone showed up at the police station with her passport which she should have had on her 100% of the time traveling to another country... Any country.
@@nathanwoodruff9422 In Australia the government has issued a IOS App and a Android APP that allows you to put essential documents into your phone - drivers licence, other forms of ID, seniors cards, pension cards, disabled certificates, that kind of thing and the law says they must be accepted the same as the original items. Also it is a huge risk to travel around foreign countries carrying your original passport. It should be safely stored in a hotel safe or in the house where you are staying, and carry a copy. A passport is far too valuable a document to risk having it taken in a mugging or by a pickpocket. And if it's stolen or lost it if too difficult in many places to get a replacement quickly.

On page 4 and page 6 of my USA passport it directly says to keep it on you at all times and how to get a replacement at a local embassy. It may be difficult for you to find an Australian embassy but last time I checked there is a least 1 USA embassy in every country of the world.

Driving through Georgia with Wisconsin plates, I was pulled over for following too close to the car in front of me on the freeway. The cop actually told me I must maintain 300 feet from the car in front of me. 300 feet! He just wanted to run my license, no ticket, but clearly I was targeted.

Absolutely true. And not just Georgia. There are departments of towns and cities off major highways which basically use seizure laws to rob people blind. If an American or Canadian stays in a motel or hotel off a major highway, expect that the staff is working with police to profile people and stop them as they leave.

Georgia is one of several states where you MUST have your Canadian Passport with you in addition to your Canadian Driver's License. The policeman was correct. Refusing to let her contact the Canadian embassy was a no no.

State rules make it difficult, but it can be done. Before you can sue the state of Georgia, you must provide ante litem notice, just as you would when suing any government entity in Georgia. This is basically an overview of how you sustained your injuries and evidence to show how a Georgia state agency was liable.

I live in Utah and see plenty of Alberta license plates on trucks and a few on people's cars. I never saw it as bad or suspicious, I don't see the cops around here hassling people with those plates.

I live in New Mexico, which is a state in the US, and a family member driving through Georgia was stopped and the cop wanted to see their Mexican passport because they have a New Mexico license plate. There is a reason we are the only state in the country that has USA on our license plates

However, you CAN sue if you can show that the official violated "clearly established statutory or constitutional rights of which a reasonable person would have known".
A reasonable person (especially a cop) should know that a Canadian driver's license is just as valid in the US as a US license is in Canada. So in this case, a lawsuit would be easy to pursue.

"Clearly established" means established by the supreme court. In this case, there is almost certainly no existing judicial precedent for a Canadian driver's license with scanned passport on a cell phone in GA so the officer would get qualified immunity, and there will never be a precedent for similar cases so cops can literally do this everyday forever in complete immunity. A great/terrible example from 2019 came when an officer in TN ordered his dog to attack a suspect who had already surrendered. The closest "clearly established" standard involved a SCOTUS case where the suspect had surrendered by laying down. But the TN suspect surrendered by sitting down and holding their hands in the air. That little difference granted the TN officer qualified immunity which was affirmed on appeal. In another recent case some federal agents beat up a patient at a VA hospital, but they beat him up WORSE than the closest "clearly established" case, so the court granted the agents immunity. It really is that bad. Cops have complete immunity for ANYTHING that SCOTUS hadn't PRECISELY address before 1982. Think about it, cell phones and digitally scanned passports didn't even exist before 1982 so nothing related to them can ever become "clearly established".
They don't even care about that. They don't have to pay the lawsuit judgements, the city/county does. so there are literally no consequences for the individual officers and/or the the police departments that order them to do this.

Official issuing building permits has to know property law, building standards etc. I am a public servant and I can't explain my errors by not knowing the law. If I did something so serious as that cop did, I'd be fired on the spot and probably facing charges. And the fact that when in doubt the cop ruled against the citizen is an aggravating circumstance. When in doubt you rule for citizen, that's standard in whole developed world.

Her Ontario drivers license was invalid because that wasn't her residence. She was living and going to school in Kentucky for almost a year. She gave the cop two pieces of ID with two different addresses. The cop had no choice, with an invalid license, her insurance is void. I was her own fault.
Nah, ain't gonna happen! What she should do is find a lawyer who would take her case and work on contingency, sue for 250k for wrongful arrest and extreme emotional distress, they might get a settlement of a 100k and receive 60k after attorney's fees!

Qualified Immunity. Not knowing the law isn’t grounds to fire public employees. The standard is to actually prove they willfully violated rights or broke a law they “ought to know”. It a sick standard, but you’re talking about years of expensive litigation in a foreign country and an award in the 10s of thousands. And IF a settlement is declined and the settlement awarded later is lower than the original, they lose that.

She didn't ask about the tow fees, the bail fees or what happened to the officer and department that illegally arrested and detained her for financial reward. So it is not like it is a new thing. All states including Georgia must by federal law except a valid Canadian ID and license the same as they would New Yorks, Ks, TX or any other states legally recognized entity. However this officer violated Georgia law, also a Nexus card is a recognized visa and I quote from the Georgia statute "Non-US citizens holding a valid foreign driver’s license are allowed to drive in the state of Georgia for tourism or business purposes. In the case of a driver license issued by the driver's licensing authority of a foreign country, a law officer may consult such person's passport OR visa to verify the validity of such license, if available." Being a student is a temporary residency and does not establish a permanent residency status required for a state residency as the student from a foreign nation and who is retaining their foreign citizenship is clearly in a temporary status as is a student who goes back to their home state when not attending courses, maintains their home states residency. This also has been established as federally recognized law and was formalized by the US Supreme Court in 1973. So yes the officer and the department are subject to state and federal criminal and civil penalties all because the officer did not consult the statutes or radio for consultation from her superior as is required by the law in the US. A law enforcement officer must have probable cause that a crime was committed to effect an arrest under sworn oath to both the US Constitution and their respective state Constitutions and since she (the driver) was within both state and federal law then, and the officer was unsure of the law. Then the legal choice is seek clarification or in the absence of actually knowing a violation occurred the officer was obligated to release the individual, anything else was abuse of power, criminal violation and a violation of civil rights. So again yes the officer and the Employing Dept. are culpable and open to litigation.

No need. Read the real story. She brought this all on herself. She was living and going to school in Kentucky and thus her Ontario license was void and with it, her insurance. She gave the cop two ID's with two different addresses. She never bothered to exchange her license and plates for Kentucky ones. Or change her address on her insurance.

Delaine Embree you’re absolutely right of course. The only thing is that any award from the court will ultimately be paid by the taxpayers. Until the actual perpetrator is hit in the pocketbook and feels the sting of that consequence, they’ll continue to do it with impunity.

@@EndPoliceBrutailty but isn't there law firms that will take on a case and if they win then they will collect but won't charge you anything if they don't? i mean i am from canada and we do have that system in place. They take a certain percentage if they win the case.
@@AkbarSnackbar There is no law universally reimbursing legal fees, especially for civil suits. That's why people usually lose money even if they win a civil asset forfeiture case. The legal fees cost more than the money seized so they lose money even if they win. That's by design so police can abuse civil asset forfeiture and make it not worth it for people to try and get their money back.
Her getting her bond money back is not a win. I hope she sues the pants off that department and there needs to be serious consequences for the officer that illegally arrested her.
This woman should have hired an attorney sued for wrongful arrest and ask for punitive damages on a contingency bases.

This happened to me in NY and KY. This gal is correct in that out-of-state or country cars are honed in on as revenue sources bc they count on you paying the fees without a fight.

Don't be. After watching this unfold on local news 2 years ago, she had no proper identification on her at all. She showed the police officer a picture of her Canadian drivers license on her phone. Go to any country you like. Show them a picture of your drivers license on your phone and see where that gets you. You probably won't like the results and might even play the same victim card she is playing. She was released from custody when someone showed up at the police station with her passport which she should have had on her 100% of the time traveling to another country... Any country.

@@nathanwoodruff9422 In Australia the government has issued a IOS App and a Android APP that allows you to put essential documents into your phone - drivers licence, other forms of ID, seniors cards, pension cards, disabled certificates, that kind of thing and the law says they must be accepted the same as the original items. Also it is a huge risk to travel around foreign countries carrying your original passport. It should be safely stored in a hotel safe or in the house where you are staying, and carry a copy. A passport is far too valuable a document to risk having it taken in a mugging or by a pickpocket. And if it's stolen or lost it if too difficult in many places to get a replacement quickly.

@@afpwebworks Hey, that is great for Australia. But no other country will accept it. Keep that in mind when you travel, if you ever do. On page 4 and page 6 of my USA passport it directly says to keep it on you at all times and how to get a replacement at a local embassy. It may be difficult for you to find an Australian embassy but last time I checked there is a least 1 USA embassy in every country of the world.
