    That prosecutor needs to just start writing 0s on a check. His clients/witnesses are digging a deep, deep hole. They’re also opening themselves up to civil action that would potentially ruin them.

      The real issue is that they don't care. Taxpayers will cover the settlement costs, and the prosecutor/officers will move across the country. Nothing changes because nothing actually changes.
      End Qualified Immunity, require personal insurance to cover these violations and establish federal regulations for uniform policies across all departments in all jurisdictions, not unlike the FMCSA for commercial truck drivers. These are the types of changes that will make a difference.

      Why wouldn't somebody be a little careful when calling for criminal trespass on land he doesn't own or buildings he doesn't know. And then offer an apology at the least. The toilet cleaner should in all honesty pay Mr. Meyers legal bills and work time missed.

    His smug attitude is likely going to fade once he is sitting on a witness stand in a court room.

    Also file a complaint with the chief judge on the da for restricting your right to finish your depo then file a bar complaint on the da for violating your rights and send the clip of the vid where he says I’m ending this in three minutes. A bar complaint will cause him problems when has has to stand on the carpet to explain why he deliberately ended your depo. Lawyers hate being called up to the bar to answer for their misdeeds

    Actually, you could tell, he had a slight actually 4 advantages, one his age, two his position there, three he handed his ID over when asked, he called 911 first. That was all the cop needed to stop his investigation. You was expecting a rational cop, who would be neutral and do his job properly. But the cop based on those 3 things he heard first, and seen the man was elderly, and called first. He took his word and judged you guilty and already had his mind made up he was going to arrest you. No matter what you said, and ready to kill your dogs.

    Being threatened and feeling threatened are not the same thing. One is an overt action or statement that is clear to anyone observing that there is imminent danger to a person, the other is a perception based on feelings. Being threatened requires verbal or physical statements or actions stating that you will bringing harm to them.

Weather it changes things or not, weather somebody gets reprimanded or loses their jobs, it does not matter. The point is having them to answer for what they did.     So, a private company enforces their own rules on public land, and law enforcement does their bidding . That's the crux of the case, and I'm concerned about how this ruling goes.

      This happens when both parties have no idea what the law says, and furthermore.. don't care, so they just make shit up as they go along instead.
      Mr Downey has his own definitions of what an "attack" by a dog is, believes he has the authority to trespass people of off public lands but can't explain where that authority comes from, or who told him that.
      And the cop.. well, he's a cop, they typically pick sides based on who called 911 first and just accept the first story they're told as if it's the gospel truth, and nothing will convince them otherwise, god help you if you get in their way..

    The district attorney’s office in New Mexico cannot supply a computer that will handle an online meeting with quality syncing capability? This was pathetic watching the D.A. when he was trying to participate.
    Why did the officer not ask for credentials, showing Mr. Downy’s authority, as opposed to Mr. Downey’s identification, which showed nothing about authority?

      Actually, it sounds like the company he works for is way out of bounds. His exaggeration and lies about what actually happened is the root cause of everyone else's perception though. I think the deposition went well and really emphasized how this guy overexagerrated and misrepresented the actual facts. I heard no testimony from Dougie that he was threatening towards him or physically intrusive. Nothing said about actual abusive language or gestures. He just got scared by the dog for some reason, didn't like being told he was going to learn about constitutional rights, made misguided assumptions because of the t-shirt worn and didn't like he was upset when his dog was threatened (I am assuming based on testimony).

The lies that people tell by those who think they have some power over others. I've had lies almost cost me my life and no one believed me. I would have rather been shot.     His blue line buddy or supervisor that came out to listen to him cry and take photos of his ouchies also needs to be brought to heel. He should have advised this little brat to immediately go apologize to and release mr meyers then apologize to Downey for wasting everyone’s time while informing him no crime has occurred here.     The incident wasn't Downey's fault it was Moreno's fault. Moreno is not aware of the law and his lack of skill in de-escalating is clearly apparent. Moreno should have sorted this out and should know that just because you have complainant doesn't mean a crime was committed.

      You are 100pct correct and just accurately summarized this entire thing.
      Its actually the 911 dispatch who should have said, we can't send an officer if no crime was committed, its the National Forest.
      Then when Moreno arrived and talked to Douglas Downey he should have told him, that he didn't break any laws and I can't make him leave.
      And then Moreno should have got in his car and left, and never even came to my campsite.
      Its 100pct Angel Moreno fault and he will pay dearly for his mistakes.

    Why is it that people seem to think that a deposition isn't a serious matter and they can act snarky, give smartass replies, and answer questions vaguely. This is your testimony that will be shown in a court of law, and if the answers change between now and then, it shows that you perjured yourself.

    One thing I would like to point out on this because I don't think I heard you mention it - He says that Mr. Myers came up to him in aggressive manner with fists clenched and admits that Mr. Myers did not attack him yet he contradicts himself by saying that the dogs attacked him for running up to him. By telling the police officer that 'the dogs attacked me', he is relaying incorrect information that creates more of a dangerous situation for everyone hence the reason why the officer so quickly pulled out his weapon and aimed it at the dogs.

As adults they are incapable of admitting guilt of any kind eventhough it is obvious by body language and curt response. Quite a different story if the truth is to their advantage then they have a photographic memory. That's why a good attorney will ask simple questions that make a contradiction pop out. Eventually their narrative becomes confused and causing deceptive body language. If it was truthful there would none of this. Rarely does perjury stick even if they sign a witness report .

    That was brilliant! For pro se I thought you did pretty good. A few times I was yelling at the TV things I wish you'd said or there were a few times I was like " ok, you got the answer, move on. "
    IMO it was a little ADD, 😊 but overall I think you got what you needed out of him and sometimes questions were redundant, but sometimes in a roundabout way you got the right questions out. A little cocky at times😂, which I would be too if I was wrongfully arrested ( which I have been) but overall,

      By this point I had been standing in front of my computer 7 hours listening to the cop lie about everything. I was all over the place emotionally. I definitely would have rather had a lawyer for the deposition, but I was having trouble finding any lawyers willing to take this case against the cops. Now I have 5 real lawyers and shit is hitting the fan.

    The gentleman screwed up by talking to the police officer. The police officer was damaged goods when he walked up there. He is definitely afraid of dogs, and you can definitely see by his actions and his demeanor that he is afraid of dogs. They sent a man out to a call that had a dog and he lost his mind because there was a dog and he cannot handle Dogs. This whole situation was escalated well beyond what it needed to be. Partly because this gentleman called the police And then the officer that it was responding to the call is not mentally able to do his job. You can see from his demeanor and his already heightened awareness that as soon as the dog popped down, he had the gun out ready to go, and he was deathly afraid of the dog cursed at the dog cursed at the people in the campground. This was very bad to begin with, and it hasn't got any better. The officer is wrong, that's why they edited the video so heavily. Because they know that the officer is damaged goods. But they need the bodies, so they're willing to keep him on. Even though he is damaged goods because of all the time and training, they have taken into putting this officer through.

      This is what I always say about police and municipality management. They can’t keep cops on the job because no decent human would want to deal with all the abuses they see and know about by their coworkers, and all the lies that must be told to allow the system to continue.
      This means cities and towns have to allow misconduct because the police that actually stay on the force are low level humans and scumbags.
