    As a lawyer, I must say this is one of the better pro se litigants I have seen. Stuck to common sense and plain English, didn't try to put on an act, but also alerted the Court to certain cases he says are favorable to his cause. It's a good recipe
    For people talking about the excessive questions -- this is common and expected, for lawyers and pro se litigants alike. This is an appellate court, not a trial court. Therefore, the focus is (generally speaking) on the _law_ , not the _facts_ . You should expect, when you are before a higher court, to be grilled with questions, because they are really trying to get to the nitty gritty legal implications of the case. They will ask you "What about this case ___ , and what about that case"; they will ask you "But isn't your case different than that case, because of XYZ? And isn't your case more like this case ___ because of ABC?" "What about this statute?" "Why do you think this language ___ means this?" It's not bullying, and it's not because he's a pro se litigant, this is just a function of what appellate courts do. They are inquiring, it's not like the trial court where it is on the parties to present the evidence and the judge just sits there as a referee.
    Doesn't mean you will always get a lot of questions. Some cases (or at least the argument) is relatively straightforward and doesn't require it. But lots of questions should usually be expected. You go in there with a big speech prepared and you just end up answering questions the whole time.

      I'm guessing all the questions were due to the fact that it can set a precedent on record.
      Is that any court of record? Or just certain higher courts or certain jurisdictions?
      For example, could a case from a county court(or the "common law" version) be cited in a federal court, or vice versa?

      The great part is that they weren't even saying that they were being blackmailed, they said it was cybersquatting. They could have sued me for blackmail if they wanted, but it wouldn't have worked either all they wanted was the website. 😅

      That's why I am doing what I do. My original case was so easy, it was complete bias against self represented individuals and my case means nothing compared to people who get similarly railroaded in criminal cases.

    I had a local judge here refuse to let me present my case because I was reading from my papers. She said, "you don't need to read, look up and look at me". I questioned her and she just repeated herself. She was so corrupt it was insane.

    Here is the final Ruling in case anyone else cant be bothered to read the court findings document:
    "Because we have determined that Charter West failed to produce evidence showing it was entitled to protection under the ACPA, we conclude that the district court erred in granting judgment against the Riddles for cybersquatting. The judgment of the district court is hereby reversed, its injunction is vacated, and the action is dismissed."

    I read the findings of the court, and you could hear in the judges questioning of the bank's lawyer they were leaning in this direction from the start. This guy should have been a lawyer with how he was able to find the gap in the defense the bank left.

      Im an old Nebraska boy... my ancestors planted their roots in West Point... im from the western panhandle, UNL grad. Live elsewhere now but i most definitely understand the small town rural farming agribusiness banking atmosphere edemic to these communities...even Sarpy County with the big city goings on see things much the same...Folks looking to borrow ...farm loans, home loans... car loans ...business loans... will easily recognize the harm to their reputation this entity did to themselves... So why not just fix the glitch when it was small and containable? ...and compensate your damages?... easy and no one knows... no one cares...duh... Now its embarassing to see it broadcast through the heavans for eternity... a major pr failure on their part. Imho.🫡

    1st, congrats, well done!!! Much respect for your persistence and hard work. 2nd) People complaining about not knowing the outcome should do a little homework (as others here have) and you can read the Supreme Court's decision. It took 5 min to find and 2 min to read the summarization and another 2 to skim the decision as written by the court. This video isn't a TV show.

      I totally agree. I think people are a little annoyed that they stopped me a few times, but realistically, it was a good thing, because I knew they were engaged.
      Every judge and justice of the lower court, and 8th circuit, didn't ask anything because they already had their backroom meeting and decided I was the loser.
      That being said, I made sure to get everything in that I needed to. 😅

      Most courts will be, as long as the pro se litigant shows sincere actions towards learning what they need to do to represent themselves, and in a professional manner, as a licensed attorney would.

    even if he had actually bought the domain for malicious reasons and for no other reason, if he obtained it fairly and the company didn't already own it, there is no societal argument in favor of the bank and against the free citizen that should allow the government to force the citizen to hand-over his property to this private company... absolutely insane that it's even written into law that they might have to under any circumstance with the previous facts held.

    Why did this court basically highjack the guys time with explanations to the audience? It's like they wanted to prevent him from delving too deeply before them into the unfair tactics of the corporation. PS I would suggest never have anything to do with Charter West. From the lawyers arguments, you know it is a rip off company with low morale values and a conman's ethics.

      When the courts travel to law schools for cases, it is common for them to do this so the law students can fully grasp what is going on.
      If you notice the lights beside the speaker’s podium, the time limit expired on both litigants but the court kept going.
      While this is a fully legal proceeding, it’s for the benefit of the students so there’s not nearly as stringent of timeframes.

    We do not understand how technology works.
    We do not understand how website redirection works.
    We do not understand how search engines work.
    We do not understand how gripe sites work.
    We do not understand what "commercial purposes" means.

      I've never attempted a civil action pro se before, but I have kicked a few DA's asses in court on a couple of illegal arrests pro se. I'm gearing up to file a 1983 suit in the most recent one against a city and its police department and the arresting officers. Not going to try to do that one by myself, though.

      Civil Plaintiff is so much different than criminal defense. I've come to find that the Court goes out of their way to dismiss early and often on pro se civil suits.

      @@ThePro-Se, yeah, criminal defense can be much less complicated (mine were only misdemeanor charges) because the defense doesn't actually have to do anything. The burden is 100% on the prosecution. But, like you said, after having my rights violated yet again, I said no more. Prosecution didn't include surveillance or BWC in discovery nor did they call the actual arresting officer as a witness. I had multiple angles of the entire thing with audio that I didn't have to disclose because it was purely rebuttal evidence. They didn't stand a chance.

    The judges definitely could have eased up a bit in their questioning of the litigant, but regardless, good job. Also for the bank's attorney: coming to court with no documentation of losses or potential loss when that's a required element? Like.. nothing? Jesus, bring in a media or PR expert to testify as the impact to typical businesses, build a foundation. Also, relying on a customer being confused when it literally says it isn't their site...
    Whether or not anyone agrees with the law or judges on this, the bank's attorney clearly didn't take this seriously and showed up having done little to no legwork and not having the bank's arguments worked out. Maybe they should be hiring the pro se litigant.

      Check out alphonse faggiolo. Can charge the cpurts for going pro se, sincr youre not a lawyer, it takes much more tine and rrsearch for us as pro se to be prepared. Hes figured it out. Get paid Mr! Lol

      He didn't need any documents since it's not his appeal, all the evidence are in the record as adjudicated.       Effectively, what happened was I see them twice and then appealed and everybody just basically cheated and lied, but then they sued me when I bought the website because I had no other recourse. The website was kind of my last ditch effort to punish them, and that's when they sued me, but that took almost 4 years because of covid and it's non-essential nature.
      Now I'm going to hold the state accountable, who was involved back then and is involved now with what I'm doing.
      They are the problem because they allow this behavior. And it's bad here in Nebraska

If citizens feel that the legal courts, through nefarious legalese, is only there to protect the big corporations then they will ultimately resolve it in the court of the streets. See this from the case: This appeal turns on whether a bank's “mark” qualified for protection under the federal Anticybersquatting Consumer Protection Act (ACPA).1 The bank claimed that a married couple threatened to use a website to “disseminate adverse information” unless the bank purchased it for $1 million.     I've always felt like trying your own case would be better than an attorney, that is for relatively small things, like traffic because it's low effort. Any competent person can represent themselves on a small scale with ten minutes of google, this takes DAYS of research. I learned the hard way that lawyers have high caseloads and will not give as much attention to you as you'd need, then there's the lawyers that think y they know it all and will tell you "no you can't do that, no they'll never work, no" this that and a third, then i go do it myself successfully. no one has your best interest in mind more than yourself. I commend you.

      The variable that makes it tough is that the opponent will have an attorney, and that attorney is in the club.
      It's truly the biggest issue. No one, not a single agency in Nebraska, is honest or does their job.
      Only one person over the years would have had to say "uh, no, they can't legally change the form". But, that was too much.

    I feel sorry for the lawyer. He's been given a loser of a case and he has to make try and make it work. The worst cases are arguing the ones you know are crap. He knows it is a 'gripe site'.
    Judges did a good job of helping the pro se litigant. I don't think he understood half the questions he got were them trying to get him to bring out his best arguments.

(They didn’t rule Charter West Bank wasn’t distinctive, only that it didn’t provide evidence of such in the trial record.)
      I’m curious because this supreme court did not address the remaining merits of the case: the appellant’s argument against Charter West’s claims that the appellant was acting in bad faith and seeking to profit from the domain name due to their offer to sell and is therefore subject to protection ACPA, which as noted by this court, is the “crux” of this case.

      ​@@Karen.Marie.24, I'm watching this video and have pulled up the ruling by the Court. Based on the facts of the case, it was Charger West Bank who, after the Riddles filed suit, made an offer to the Riddles to buy the domain name and the Riddles rejected it initially.
      So far, I can't see anything that can legitimately be defined as "bad faith" by the Riddles. That's the real crux. As Mr. Riddle argued in his oral arguments, gripe websites are Constitutionally protected SO LONG as the content he added to the site was verifiably true; if it was not true, then by definition it's bad faith as both slander and libel are considered bad faith statements.
      According to this record, it wasn't until AFTER Charter West Bank made a proffer to buy the domain name from the Riddles and the Riddles refused that Charter West Bank filed suit under ACPA. In other words, Charter West Bank tried, unprompted, to buy the domain name after the Riddles had bought the domain name and filed their own suit, and when that didn't work, filed its own suit and then tried to argue that because the Riddles' rejected Charter West Bank's proffer, the Riddles were trying to blackmail the bank.
      That's not what happened.
      There is absolutely nothing, at face value, that prevents a person from buying a domain name that someone else might want and putting their own content on it, and then selling it for whatever reason for whatever price (this *is* capitalism, after all); however, if Mr. Riddle had purchased www.charterwestbank.com and put defamatory statements on the site, and *HE* contacted Charter West Bank to tell them about it and that he would take it down if they paid him $1M, that would violate several laws, not just the ACPA. But the facts of the case do not support this conclusion based on what I've watched and read so far.
      All that said, I could be completely wrong. I'm not an attorney, but I am in IT, have been a web administrator for the better part of 25 years, and am responsible for my division's domain names and records, so understanding most of this is in my professional wheelhouse.

    Such an interesting case I enjoyed listening to the arguments. Im currently doing my own case also, but i incorporated my expertise in machine learning and using OpenAI Api on my local llm. Not only am I managing to point out systemic issues in my local community, ive managed to instruct my case to lose on purpose just to appeal to the Supreme court to point out bigger and issues of local judicial failures. 😂 I love being a pro se litigant... we have so much power.

      The crazy part is they had every opportunity to fix it, but they didn't because they knew it was a sham in the first place that they did to harm us.

    The bank’s lawyer complaining that the guy was trying to damage the bank is rich. OK. Of course he does. And justifiably so. Your client damaged the couple and continued to do so until the couple spent how much time and money to force the bank to clear up their error? If they don’t like bad publicity, don’t do bad things.

    The thing is, he never copied the bank site word for word. He simply used the URL (fair use) to obtain clicks for them to see HIS website. Surprisingly, this lawyer told his client he could win. This guys law career just got destroyed. Back to PD roster he goes

    Odd that Justice Papik is an Associate Judge of the Nebraska Supreme court but had no other time as a judge in any court room. IMO you should have to earn a spot. I mean look at Justice Cassel who has been a judge for over 30 years in various levels.

      @@ThePro-Se In court for parental rights and contact with my infant daughter. Her mother has denied me both, left me unregistered as father, and tried to make off with her in secret. I used evidence of this to get an injunction at an emergency ex parte hearing.

      To claim for damages, then effectively say “well the might be damage we aren’t aware of” when asked if it’s prospective damage or if it’s already occurred, was hilarious.
      Maybe I should sue a load of people for things that might have happened to me but I just don’t know about it.

    Look up the pruchase and the trademark registration of the town of Wenatchee Wa, back in the early 90s. A gental man noticed that the town had not secured the name throug legal terms, then he did it. Forcing the town to eithre change their name and remove the current name from all letter head and sings , as well every other thing like websites email ect.... or pur hace the trademark registration from him. He won the lawsuit and the town wound up having to buy it from him. Gives a whole new meaning to heads up ball.

      @@ThePro-Se yeah man I’ve been doing a lot of pro se cases my self and it’s been very difficult but I’m sticking to it. If you have any pointers I’ll take them you went through the whole appeal process I’m like wow. Way to fight I current have a cases in appeal court , fedral district court and our local court of common pleas of Philadelphia county and now 2 cases on appeals at the state level Smh 🙏🏽🤦🏽‍♂️.     This is akin to the the pro se buying the building the bank was in because it was for sale and they didnt own the lease. He then says if you want it you can buy it but Im putting signs outside saying this business is bad on my property. Then the bank lawyer argues they are already there he cant buy the property. If anything the bank is squatting on his website name. They should change their name so not to infringe on his web property

    The words commercial use, are open for debate because he wasnt selling it for someone to operate as another business, but more as one for a business to close. The act of selling doesn't constitute commercial use.
    I dont believe the bank would operate that site commercially to gripe about it self.

    Can you tell me if pro se is possible in all courts? Or is it just courts of record? Or maybe just state courts and not possible in federal?
    I'm from Ireland by the way, and curious about my own law system and philosophy of law, as a means to escape debt slavery in general. Though i must use American cases to learn the law, as information here is difficult to acquire and youtube suits my dyslexia and ADHD much better.
    A bit of an aside here, about jurisdictions.
    As soon as i saw the row of judges at the beginning, i looked for the flag. I saw immediately it did not have a gold fringe.
    This confirms for me that it is a real common law court of record, and not an admiralty jurisdiction.
    That's very interesting indeed. i wasn't sure if there were any courts of law left.
    You may note how the chief justice(i think that was his title) later in the video makes that very distinction when you mentioned a federal policy, in a court of law.
    i believe he was smiling, because federal policy might not have any standing in a court of law, aside from things like contract breach and such.

      As a retired lawyer I have had to fight for several ppl for attempting that argument and thinking....it is patriot mythology and will get u in jail ...if u do some of the other tactics in this line of thinking...same.
      I am not talking about the legiti.acy one way or another about the argument...I am talking about the result.

      If anyone I go after tries to sue me back, they are giving me the discovery they so desperately want to avoid. 😅

      Discovery is the right or privilege to know who is after you and you get all their information that might pertain to that case?
      There is a word of phrase I've heard also about "cause" or "cause of action". Maybe discovery is related to that?
      To know the nature of the cause and everything related?

      Say for example, you believe you were fired for emails that were sent in the office, but you can't see them because you don't have the authority. If you manage to get to discovery, you will find out if those emails exist.
