Because of these types of legal videos, the general civilian is becoming more knowledgeable about case laws. Than police,lawyers, and judges.
Still many arrests, and convictions by judges mistakenly .can only be straighten out with appeals which are financially out of reach for average working citizens.
The whole system needs rebuild its broken .
Absolutely, not just the money, but the time, stress, and life shortening toll it can take on someone. I myself would be destroyed because of my personality, I would freak out if jailed wrongly. I probably wouldn’t be able to make it that far. I’ll just stop there and try not to put myself in a situation where I would end up in the news over something unjust like this.

As part of your depositions.. you need records for EVERY trespassing case they have filed AND details on EVERY case the cop was involved in.. this shows a pattern of abuse

These rent a judges are just so used to plea deals for charges like this the actual law is beyond most of their abilities.
I had to do this in my court case.. to explain to the court that the plaintiff response indicated plaintiff may have missed contract day in law school

You are tipping your hand - you are saying too much, and someone on the prosecution side is likely watching.
Let them try to argue it. It’s a logical checkmate. If he loses, he just shows everyone how corrupt the trial court is and he’ll have to appeal.

It seems in today’s courts LAW is what the prosecutor, the DA, and the judge say it is on any given day. Even if you hired a lawyer… he’s most likely on their team too. How can the federal government own land if they're not allowed to own land
They manage our land if the government goes bankrupt it would be managed by a new government. The national parks website literally says the parks are being held in a public trust.
Cities misunderstand this concept all the time I've witnessed cops thinking the city owns the roads and sidewalks when they are public easements managed by the city. Yes they can sell these easements at times but it doesn't mean they own it confusing isn't it.

A detainment doesn't require putting your hands on someone and this cop was actually trying to hurt his arm by submission hold for no reason.

Just to be picky :) 42:48 you said that Mr Myers never entered New Mexico public land prior to the arrest. Would being in a vehicle on highway 64 be considered entering New Mexico public land, legally speaking? If so would this be a technically inaccurate statement, assuming of course you didn't hike in from Colorado.
The only things I saw that Moreno did legally was, #1 He answered a call for service. #2 He interviewed the complainant. Thats it.

I would probably argue that the state trespass laws don’t exclude public property and it doesn’t specifically exclude us property. Then I’d try to establish that the host worked for the federal agency in question and so did have the authority of a property owner to trespass.
Has the usfs told you that he didn’t have that authority of trespassing?
Does federal trespass laws override the state laws? Under which enumerated power allows federal agencies to trespass on forest service property?
On military or usps property, 100% federal law precedes state law. On federal land, usfs, I doubt it.

Iirc the contract with the company the bowl scrubber works for and the Forrest service doesn't grant them this authority explicitly and therefore he does not have any authority other than ask kindly to leave/do anything

You need that repeated this often in the record, why not file to move to federal court do to the parties being from different states. How corrupt must a court be to allow the state to argue the ability to enforce laws outside the jurisdiction, as I have let to see a direct challenge or counter to jurisdiction?

Just FYI, if you are gonna write motions, follow the template for it. That includes the font and size, spacing, structure, and length. They'll usually give you a pass as your'e pro se, but they can throw out motions on style rules alone and you broke a lot of them. That doesn't mean I don't support you, but if you're gonna go pro se, you need to write motions the same as any other attorney is required to.

Even in the Supreme Court, they would never throw out a motion because of formatting.

If your wife is clerking for a federal judge, want to explain why you spent multiple pages going over settled case law in multiple paragraphs? You didn't hit the easy button "copy and pasting" out of their legal guide, you wasted over 400 words on something that could be said in one sentence and cited to. Seriously, are we learning the legal ins and outs of writing motions when you literally summarize Terry v. Ohio? Make the point and use Terry to back it up. I learned that if you cant make your point in a sentence, you don't have one (and this isn't a complex case that would need circuitous logic to get from point A to point B).

They would at the very least have to give him opportunity to perfect it if there was an issue. But he could write it on napkins being pro se as he has not agreed to follow any arbitrary rules like someone in the bar association. Due process is the most important thing. Elmore v. Travis Hinze “let’s exchange IDs” has a current trespassing charge in Kentucky and is posting all his strategies for the Prosecutor to use against him.
