      Also, if you watch the “arrest” body cam (what’s left of it), and listen carefully, you can hear the click of his gun coming out of the holster as soon as he left his vehicle. He went in on a possible trespass with his sidearm unholstered. He’s a coward.

      That's the thing the really infuriates me. Eyewitness testimony in trials is notoriously unreliable and yet a phonecall from a passerby can subject some poor guy walking down the street to being insta pummeled for " refusing to comply" and you've got about 2 seconds to go from going about your day to fully complying or taking a beating.

      ​​@@jeremyhodges7956I believe that that's very much as fact letting people know they know the laws letting people know they know the workings and the meanings of the Constitution just put them in liability and the city as well They have to pay or lose an officer from the ranks and they would rather pay than lose, and that's why they give raises , promotions , awards weeks after they do some of the most outrageous stuff to citizens. I'll tell you another thing you're probably not like to hear if that's the other things about problem for you and that is the blue line is not just a thin Blue line to keep us separated from them it's a thin Blue line that they are locked behind but common practices throughout the police department in this country if they get through the academy first of and are not washed out for being possibly too good a person and then they're trained by a seasoned police officer into how really police work and then put in their own car eventually called into a scene where they see what they think is somebody guilty in conflict physically with a a police they have to jump out and join in whatever's happening and if it comes to beating somebody down that's but in the end they have to write down the same statement as the season cop does and then potentially going to court and say the same later down the line they find out that the guy was probably not guilty of what it appeared they put an innocent person in prison or ruined their lives. That point they are screwed because they had no one to. They cannot turn to the upper echelon can I see any kind of psychiatric help for any conscience or guilt issues and absolutely cannot discuss this with friends or family as they know that can put their lives inJeopardy. Meanwhile they are suffering through PTSD issues from things they have to do - right or wrong- on the job you're all wrong or you did nothing wrong absolutely 100% right copy of nothing wrong those kind of people who pat.them on the back sometimes all I really want is absolution the only the truth can actually bring. That issue across the has brought self-checkout of officers to number one position which is now higher the number two car wrecks and number three at other people's hands combined. If you are going to your favorite restaurant you want those people keeping up with the numbers of changes that the health department has issued throughout the state or for that particular after everybody wants to make sure they have a accountant who keeps up with the changes of the tax laws every year diligently and would refuse to allow them to keep working for him if they did not.. so why we do not force the issue of mandatory training on a regular ongoing basis through the entire career is mind boggling. But as the old saying goes you get what you pay for .... Or in this case what we all pay for. The real question is this,: when will we end up paying final installment or will we ever reach the point of freedom that the framers envisioned..

    Lane, First , I congratulate you on your professionalism, and knowledge of the law . You are speaking up for the rights of every last American. You are amazing for not taking this lying down. Officer Moreno is so unaware of what his job entails that it's tragic. I noticed that he had his shirt tailored super tight to show muscle. Perhaps he should spend more time learning the law and less time at the seamstress. He violated your rights---arrested you unlawfully and tried to ruin your life gleefully. He should not be in L/O....a civilian job dusting shelves where he can't hurt anyone again is better suited. ..And lastly, When he drew his g++ he was prepared to unalive your dogs and possibly s+++t you as well....JUST CUZ HE COULD --------- OUTRAGEOUS. Moreno is an embarresment and liability.

This happened in Rio Arroyo County, the same county where the 'Blue' (Democrat) Police arrested their duly elected Sheriff a while back and threatened their UnderSheriff as well with turning over cellphones for evidence.     Ignorance of the law is not an excuse… unless you’re a cop, prosecutor, judge, etc. … you know- a government employee who’s job is to know and apply the law.

    It never fails to amaze me how cops turn up to a “trespassing” call without any knowledge of the actual law, or having done any investigation in to property boundaries, and ownership. It’s almost as if they just make stuff up as they go along hoping they can introduce some violence.

      My cops all understand trespassing because I trespassed them all more than two decades ago.
      They won't even use exigent circumstances. One was chasing a car, and slammed on his breaks, got out and asked permission to enter and write a ticket.
      I have a simple rule. When I can carry a gun on their property, they may carry one on mine.
      I learned about property lines and sovereignty from being shot at from an indian reservation the sheriff refused to do anything about.

      Most cops have qualified amunity and knowing this even if they are shown the law they dont seem to care. In numerous videos I've seen cops say "Let the courts sort it out or tell it to the judge" because in the majority of time they know they 99.9% of the time they wont be held accountable for anything they do includjng violating peoples rights.
      The fact is in many cases if somebody wasn't filming the police there would be more innocent people rotting in prison.
      Qualified immunity needs to be abolished in every State where the police should be personally held accountable for their actions where if sued for monetary damages no longet should the tax payers flip the bill for their crimes. Any settement should come out of their pockets.

      MY authority starts at my property line.
      They tried to pull that once. I told them I don't give a sh*t. Go get a warrant, and get out till you have one. He might have thrown something is NOT he DID throw something on my land.
      Same for armed robbery. Court said to keep the money cop has to lie he thinks it is drug money. If he is shot in the armed robbery he will never say that.
      I know in a confrontation I will be the one still breathing. Laws do you no good if you are not alive, and no cop has ever lied under oath when they are dead.

      Lane should've asked Moreno if New Mexico has any Native American Indian Reservations in their state and IF SO, does HE have authority to arrest ANYONE on any Natve American Indian's Reservation land? The answer is, YES, they have Native American Indian Reservations there, but NO, the State Police CANNOT arrest anyone on the Reservations, so IF the U.S. Forestry land IS FEDERAL, then the State Police CANNOT do the job of the FEDS, UNLESS the Feds ASK the State Police for their assistance in arresting someone. Moreno overstepped his bounds!

    This is the reason why a Law should be reached by Congress which would not allow anyone to become a Law Enforcement officer until the age of 25. This is because they would have their frontal lobe fully functional for making sound and logical decisions based on facts instead of emotions and ignorance of the Law and Constitutional rights.

    I didn't expect to spend my Saturday watching depositions, but 5 hours later I'm glad I watched this. You did an awesome job dismantling the prosecution's arguments, and officer Moreno just kept giving little nuggets of gold. I'm surprised he wasn't coached better on how to cover his ass. I get the impression none of them realized the massive pile of shit they stepped into after pointing a gun at your family and kidnapping you.

    After watching this TRULY INSPIRING deposition, you absolutely showed why there is such a divide between citizens and law enforcement. Congress should pass a law that the police MUST carry their own liability insurance, just like Dr's carry malpractice ins., that they MUST either look up the laws BEFORE detaining or arresting anyone, or call their town or state attorney. The police should be REQUIRED to know the Constitution. There's NO REASON that a cop cannot google a law if they are unfamiliar with it. They should be required to know the most BASIC laws they use!!! NO EXCUSE!!!

      5 minutes before the motion to dismiss hearing the prosecutor changed the charges so they didn't get dismissed. He's trying to cover the cops ass because as soon as he drops the charges he's getting sued. So he is using the charges to shield people from being sued. It won't matter.

      It wasn't a bon consensual detainment no reason for your consent he didn't need it, the host/manager asked the trooper to ask you to leave the trooper did so by telling you verbally to leave you refused that's trespassing you then said you aren't leaving after being verbally told for the second time you made no attempt to leave so now it's criminal trespassing after warning he then told you that you were being detained you kept moving around.
      Then when he tried taking you into custody you fought him that's resisting arrest.

    I am 20 mins into a 3 hr plus deposition and I am completely astounded by the incompetence and blatant disregard for transparency, honour and integrity.
    I am also facing criminal charges here in NZ, from NZ pooLIEce, based upon "his" lies, aggression, incompetence and lack of due process in the course of "his" public duties.

    The whole thing is that this was public property and he needed to have committed a crime to be trespassed from public property in the first place. Trespass can’t be the crime to trespass someone from public. The cop doesn’t and will not get it through his head.

      I've learned a lot as well. I was under the impression there was to be an unbiased 3rd party present. Rushing the complainant is illegal and unprofessional. I also take issue with the multiple bathroom breaks and suspect there were comms going on via text.

      You must have corroborating evidence. You can’t just take the word of one person must be evidence to back it up like another witness a video, etc..

    Man this is painful to watch,you would like to think that whoever is in charge of this case watches it and just drops any charges and settles the claim before this idiot reaches a courtroom because with every word that drops from his lips the settlement gets higher and higher,also going by this deposition i would think that any charges brought by this cop against anyone needs to be called into question and appealed and this video used as evidence.

      Facts! I have talked to so many "auditors" about this. If you need to rely on a lawyer if you get falsely arrested, you should not be out putting cameras in cops face. You need to know the laws you claim they are breaking, the rights being violated, and how to uphold violations of those rights. And it starts immediately upon arrest. I will be making a video series about "enforcing your rights in court". Its one thing to "know your rights" its another to enforce violations of them.
