We own a dealership, and he paid a deposit on a car that's not for sale? With no price or listed MSRP? that's definitely not legal and what he's done is been bamboozled.
Unfortunately he didn't pay a deposit. He paid a "call me back when you hear more". Because all dealers are able to do right now is build our waiting list. Meaning you call in put your name on the list, the dealer isn't able to take 'deposits' they may ask you to PAY to be on the list. But you cannot charge it as a 'deposit' because what are they putting a deposit on? All your brother has done is pay 2k for them to "call him back".
If I was your brother I would be alarmed at the dealer already for taking it and even labeling it a 'deposit'
Call every other dealer, the price will be different. For a reason.
If every other caller after your brother pays a little extra, they will go above him in the "call me back" list.
If a car is for sale and they formally take a deposit. Then your position is secured, by law. In this case, again your brother has paid 2k for a call me back and fuck me over if you it suits you.
Funny too because as we are a toyota dealer, toyota is so strict on this as it's a worldwide brand. Would absolutely LOVE to hear which dealership did this to your brother.
Cheers, hope this helps. BTW tip, when pricing IS released. I HIGHLY suggest your brother call the dealer back and leave a formal deposit and pay again. And ask for your 2k back. Because that will formally secure his deposit in a system rather than a 'honour list' that he's on right now.

You make very valid points. It was a dealer in Nambour Qld but I can't remember the name. The dealer did say things to that effect and there is specific wording on his contract. Some of the dealers he did contact would not take a deposit so I'm guessing it's for the points you mentioned.
I always prefer to wait to find out exact specs and pricing etc but other people just have to have it immediately for their own reasons.
I'm hoping my brother and all the others placing "deposits" on cars not even for sale yet don't get shafted.
      Cheers.
