My husband and I are 56 years apart, we both draw social security and SSI I get 15 dollars in food stamps, and we live in a small 25 foot camper . Yearly income on both sides is 28,000 and I'm 22 he's 76 we got married when we were both homeless and we been together for 5 years and 6 months. Not every body who is married or with a older person is a gold digger. I'm not saying there is none out there but really it's a sterotype. We both pay bills together and we are trying to get back on our feet. And we been homeless several times we were lucky for a friend to help us with a camper .

No, the majority of relationships do NOT have a 50 year age gap. Plenty of minimum wage earners are married, just look around. The 24 year old's after one thing and one thing only. It's not that I don't believe that folks a few decades apart can't be in love, but he's old enough to be her grandfather, easily.

When my husband retired my step son demanded that he sell our house and give him 'his share'. 2 years later when our daughter died in a car accident he tried again the day of her funeral to get 'his share'. Gold diggers can be in the family as well. He never has time for his father any other time. My husband has taken legal steps to prevent this particular person from benefitting from his/ our passing.
I worked in banking and saw your situation quite often. Definitely get a lawyer that can protect your wishes. There are lots of greedy family vultures out there.

What a horrible situation. Moral: Wills need to be created regardless of marital status.
pamperedgurl there was a will and there also was a trust. Problem is the parents weren't all clear about their desires and those desires weren't properly expressed to the children. I would guess the trust was created for the children and in it was put everything that the children had coming to them. The husband probably was the sole owner of the property and that's why it was only in his name. Had it been a joint asset it would have been listed in both names.
Marriage supersedes wills , so they should be fine

My Dad did that for me for the most part. He was so sweet, he saw that I needed a car and at the time, I was heavily in debt trying to get out so he purchased me a car as a surprise for my birthday and he took care of all servicing and repairs needed along the way. He called it a "living will". After I had that car for 5 years +, he surprised me again with a new car 😅. Unfortnately this newer car has had more repairs to do than my previous car which barely needed any repairs at all. But I'm so grateful to my Dad for all he's done for me and my Mom 😁. He mentioned leaving me some money as well when he died but didn't mention how much.
I can understand where this caller is coming from because she's thinking that this outsider (the wife) is going to just collect what her mother was supposed to leave for the children. I used to feel that way about my stepmother as well. Because my parents built certain things together when they were married and if he dies before her, she, her daughter and grandson are going to benefit from it. I also nag him to update his will because if he doesn't then whatever money he was planning to leave for me, she may take it all.
That's what I've been doing w/my kids and grandkids.

They need to hire an estate attorney ASAP before they sell this asset. Also, in Texas ALL assets are owned by both individuals regardless of whose name is on the deed, ESPECIALLY if the mother's money went into the asset.

My parents were quite open about who was being included in their will. I personally never brought the subject up as I didn't think it was my right to do so. Wills can be changed at any point so I think if you do get anything it should be treated as a bonus in life not a right and you won't be disappointed.

I am a Texas Realtor. Oh yeah, this is community property and 1/2 of your mother's estate is for you and your brother. Estate Lawyers would love to take this on. Texas is a great state in protecting heirs.

I used to get these type of probate calls all the time working for the county. Best advice for real property owners: deposit your notarized will at your county records office, not with an attorney bc they die and paperwork often gets lost or destroyed. Also, learn about contracts and what your deed specifies- right of survivorship, ladybird deed, etc.
True! There are counties that provide this service but some counties (in my state) no longer provide this kind of service anymore

My wife & I know our net worth. No one in our family (not even the children) know our net worth. It’s so much easier when they are all sure you are broke and there is no one to spill the beans. They don’t hang around. They don’t hit you up because they are bad with money, and you have enough to solve their (for now at least) financial problems. Had a great uncle. He dressed like the last guy in line at the thrift store 1/2 -off sale. His rusted old wreck (oxidized ‘61 Belaire) was his daily driver. He was the wealthiest on both sides of the family.

Property owned by a married couple is 100% his and 100% hers. When one dies, the other takes control. That property is not distributable unless they both die.
Not necessarily. Some states (or maybe all states) have a couple of ways to own property. If you’re on title as tenants in common then it’s like a 50-50 split (if you’re a couple) and can be broken down even smaller if there are more investors. If they took title in joint tenancy, then there is a right of survivorship and the living partner or partners are entitled to the deceased persons interests automatically. You can Google these terms for more clarity on how they work.

Texas is a fuckdd up state, when it comes to wills. In almost ALL states, the surviving spouse inherits everything (which is a joke because it was there's to begin with). My family is from Texas and my grandma was so afraid that my grandpa would die and her drug addicts sons would try to take everything she owned. She spent a shitlload of money for attorneys to ensure their will was written PERFECTLY so if she died or her husband, that their children wouldn't leave them homeless. Only in Texas can a couple buy a home, husband works while the wife cares for the children. Wife ends up dying and the children go to their father and say "We want half of everything you own because its ours." And Texas will give it to them if a proper will is not in place. Its so jacked. His money. His wife is gone. If this dude wants to spend every penny on hookers, that's his prerogative. Only in America do people truly believe they are entitled to money they didn't earn. 😒

You have to specifically disinherit your children in your will. Otherwise, the 3 kids get Mom's share of the joint estate just as if the Mom and Step-Dad were getting a divorce.

That’s how this call went down at all. It sounded like the asset was to be divided amongst the children and the husband decided not to.
I'm facing a similar situation. But I ultimately had to admit that what belongs to my dad and step mom belongs to them and not me. The circumstances do not entitle me to take my step moms assets in the event of my dads passing. As much as I believe I'm entitled to their home and most of my dads estate, it might not end up in my hands. And I have no choice but to accept that.
No dude. That's why you need to sit down and talk to your dad. If he says it's not for you then it's not for you. But most parents want their kids to have the inheritance.

My family is from Texas and Texas has some strange laws when it comes to wills/trusts. Morally, these children are gold diggers themselves. Their mom and step Dad purchased this house together and were married for 30 years. The wife passed away so it is now, rightfully, his money. At the time, they both worked so hard for that money as partners, as a team. I bet if his wife needed that money for medical bills, the husband would have sold the home and paid her medical bill. THAT is called marriage. You save money with the hope that your savings will carry you both until you BOTH pass away. And whatever is left, goes to your children. These kids want to take money from a 77 year old man. A man who no longer has any working years left in his life. It's his prerogative if he wants to spend his money on hookers. Is it great? No. But it's HIS money. The kids didn't contribute a penny into his wealth, and now they feel entitled to it because their mom died? Most states transfer all assets to the surviving spouse. Texas is one of those strange states that does not. I remember my grandma was so fearful that if her husband died before her AND her will wasnt 100% written correctly, that one of her drug addict son's (love ya Dad) would try to steal all of her money. Which in Texas, happens all the time. Only in texas can you lose your wife and have her children sue you and legally win the money from YOUR home.. Legally, these kids have a case. Morally, they should be ashamed. I have a step Dad and he has been married to my mom for 30 years. If my Mom died, I would NEVER go to my step Dad and say "you owe me half of your assets now that my Mom is dead. Hand it over."

Maybe I don't understand whats going on but wouldn't all of the deceased assets roll over to the spouses? Why does the daughter think that she is entitled to anything?

That's where the trust comes in. My grandparents had one similar to that, where when my grandfather died, my grandmother only inherited half of their joint assets, and his half was reserved for their children.
Especially in instances where the spouse is not the parent to the children, this is an effective way to pass assets on to children instead of letting the surviving spouse spend it all.
Surviving spouse got 50% and children get the 50% too.
in this case, I would say fighting isn't worth the headache. Too many feelings and emotions are involved. But I get why the kids will be fighting, she did say that she and her husband are trying to get on track financial and I am sure the trust will be a big help.

Unless Mom that died specifically wrote a will to disinherit her 3 children, all of Mom's assets go to the kids just as if Mom and Step-Dad were getting a divorce. Half of the joint estate belongs to the 3 kids, not all to the Step-Dad.

Texas is a community property state. Unless there is some sort of a written agreement the surviving spouse owns the estate outright

In fact I signed over the part of the house that went to me because morally it was 100 percent her house but by law since it was in her and my dads name , she got her half , half of my dads half and the other half of my dads half automatically went to my brothers and I . We signed it all over to her because it was morally her house and that’s what my dad would have wanted but according to Texas law part of it automatically went to me

She needs to get a copy of the Deed to make sure her name is not on the Deed. He may be lying to her by telling her she does not have any ownership.

I would guess the trust was created for the children and it was created to put everything into it that was rightfully given to the children. The property being only in the husband's name was likely his sole set with no right of inheritance to his wife's children. It's not all that odd that a married couple could own property that's not considered a marital asset.

I love your videos....I think folks need living trust, which can include wills, etc, definitely need estate attorney to work this issue out to avoid probate proceedings....you will lose a lot of money in probate, and other problems....I am not an attorney, but set up for my mom, who just died, trust was a very big help....

It does seem like her mom had a stake in the property, unless....as a married couple, they kept their finances separate, and he bought the property out of his own money. But what do I know? I'm no lawyer.
