- In an exclusive interview with Karan Thapar for The Wire, the leading lawyer says the Modi government's decision to change Jammu and Kashmir's constitutional status was in line with past precedents and that parliament was within its rights to act on behalf of the state assembly in demoting J&K to Union Territory status. But he said the Supreme Court could have acted faster in hearing complaints about the violation of rights.

With sufficient interruptions as always anticipated while replying by the interviewed, the cool and sedate temperament of Salveji is simply awesome.
That's why he, Mr. Salve is where he is. Not getting provoked and keeping his cool with Karan (our own Karen) visibly pushing Salve sir to accept Karen's views.
Modiji snubbed Karanji ( karanji made a seperate program on this )..it really hurt apparently.

This one-hour session provided me with valuable insights into understanding the Constitution more deeply. While Thaper's frequent interruptions were sometimes bothersome, I was impressed by the Salve Sir's calm and articulate responses. I still appreciate the host's efforts in researching and addressing issues that are often overlooked by the general public. One hour was not enough to fully explore the argument. So less. I want more...

I also noticed that. Karan Thapar is one of the most irritating interviewers. I think he just thinks he knows more than interviewee.
Karan has beaten black and blue by Harish in this interview. Karan as usual shows his true colour beyond what is required for a journalist. He is a politician and Harish is a great great lawyer. That’s it!

I salute the appreciable humbleness and cooled nature of Mr Salve in giving answers with the heavy slaps on the confused and contradictory repeated questions in spite of the aggressive attitude of mr karan thapar during the interview.

Great Interview: Now this opens an opportunity for Karan to interview any congressman and ask bluntly, if the Article 370 was indeed temporary what motivated them to keep it running in the statute book for 70 years. I would really love to see karan go after them in equal measure.

One of Faizan Mustafa's major points was that Dehli loses power over Kashmir in some respects by freezing 370. And, Salve agrees with this.

Come here after listening to first five days of SC petitions on 370. One thing Salve does not clarify was the precedent mentioned ie change from Sadr-e-Riyasat to Governor was unanimously passed by J&K assembly. Process around 370 in 2019 seems to have one gaping hole - there was no state assembly. So it will be argued that state / people of J&Ks consent was not taken. It seems there was an instrument of accession and separately integration. The Maharaja only signed the first keeping J&K autonomous except in relation to defence, foreign affairs and communications. It is interesting to follow the SC proceedings, next hearing is 16 Aug 23, first 5 days are available on UA-cam for those interested in court room dramas.
Although i could not understand 90% of what was said, it is such a pleasure to hear both of them clarify the situation.

This is not just a question about Kashmir or Ladakh... It's a question about what precedent is the government setting about the federal structure of our country if they can dissolve a state government to use its executive powers to make new laws in the state or to divide them into union Territories...
The way how Harish Salve answered the question is awesome, you know how Karan tried to manipulate the comprehension of the statements. The last sentence by Harish was sufficient to sum up what wire tries in general. To manipulate and change the understanding of something very clear.
This is what happens when the interviewer does not have a sound legal background or research. Mr. Salve (as always) is so humble. He has much more knowledge than all this but he's not throwing that around like the interviewer. Unnecessary bickering. In any case, Sire Salve is overwhelmingly good.

Karan ji tried very hard to make Salve ji speak what he wanted Salve ji to speak. Probably he forgot that he is speaking to Salve Ji. One such interview i could recall is Arfa interviewing Arif Khan Sahab.

But salve is one step ahead of faizan. He destroyed faizan argument. The most strong argument was that this type of amendment already done in the past using same article which already upheld by the Supreme Court.
@Edmund article 370 was not the issue. It's already weakened over time in the 60's and 70's. The biggest reform was 35a which prevented outsider to buy land and give 5 lakh valmiki hindus communities and 10 lakh Pakistani sikh and hindus in jammu as permanent citizenship. Bifurcation of the state and separating ladakh will also disempower kashmir hegemony in other part of j&k. All govt in the past tried to appease kashmir Muhammad's followers by giving Carrot (370 +massive budget for kashmir as healing touch+ 10 times more money for avg kashmiri than avg indian) bt it didn't work as it gave soliders bodybags 500k thousands kashmiri pundits deport and anti India protests, stone pelting, insulting national flag, soldiers bodybags . So it was time for stick.

Coming after 4 years on this video just to see how true Salve was when he propunded that the Supreme Court isn't likely to strike down Art 370 revocation bill.
Kudos to Salve for his brilliant insight and sharp edge interpretation skills which he showed while arguing this case before the SC.
The argument for the wisdom & legality by Salve ji is awesome.
Now I can happily assume that the change can’t be undone.
And the cry on the ground of constitutionality has fallen flat.

Karan Thapar is pulverised by Mr Salve in the most articulate,calm & logical manner. He conducted a Strip Tease of Thapar & the last 8 minutes were just brilliant. A must watch interview.
I haven't heard a more clinical , incisive & persistent interviewer than Mr. Karan Thapar. He really lays out every single aspect of an argument and persists until he forces the interviewee to take a stand. Mr.Salve has responded to every question with clarity , calmness and extremely sound reasoning. What an enriching interaction to watch. So much to observe and learn.

This interview is for you. Karan is like a cook. He cooks for you. The cook does not eat his preparation as it is for customers. You are his customer.
Brilliance of Mr. Salve in presenting myriad of arguments in response to monotonous and one dimensional assertions by Mr. Thapar is indicative of the depth of his knowledge.

Salve did not give Karan the prized candy he thought he would get after every question he asked and every interruption he made.
But I must admit, Karan did his homework well and prepared some thought provoking questions on constitutional law. And only a top notch lawyer like Salve could do complete justice with his balanced and nuanced replies.

This is an excellent interview to watch on two counts. First we can have an legal, logical, satisfying aspects of the subject under discussion from respected learned Senior council Harish Salve by his calm but assertive reply. The other one is that the questions asked by the brazen, callus, chicken headed Karan Thapar put more attraction to the facts put forth by the guest.
Necessary to have the patience to listen and allow another person to speak are basic things you need to follow when you interview!
Legal is also one of the profession. Harish salve is doing excellent with DNA of patriotism and Nationalism. My wholehearted wishes to Harish Salve.

The best interview that I have witnessed of Karan Thapar. It's nothing to do with Karan. It's all thanks to Mr Salve. Karan had no chance of taking on Mr. Salve.

Mr. Thapar the right to life, harmonious relations between communities and the unity and integrity of India have primacy over legal niceties. Law is for people and not otherwise. So no need to crying wolf. Modi Govt has done the right thing to ensure unity and integrity of the nation.

Limits well defined in initial dialogues. Good. Interviewer looks more knowledgeable than interviewed and his views are seconded hints on the purpose of the interview. It is good 370 is removed. How a part of india be with separate constitution and separate flag, restrictions in owning property in kashmir by other indians etc does not look reasonable. Union of states means union of states not union of states and a country type state. People do not feel 370 removal is incorrect except some belonging to kashmir. Salve sir's explanation gives clarity on the issue not disturbed by the interviewer instead corrects the views. Worth watching salve sir.
Mr Thaper had lot of questions bubbling in his mind . Some on behalf of the aggrieved parties it appears and may be because of his bias. But it was very irritating to see that he did not give enough time to a great genius constitutional lawyer Mr Salve.Thank God he kept his cool.The legal niceties involved in an abrogation of Art 370 and 35 A were seen desected "Threadbare " by this gentleman genius Lawyer in light of Art 3, Art 356.
