      Thanks to Covid vaccination developed within a year by the Modi government. It is always a pleasure to receive a criticism from a former Supreme Court judge knowing fully well his life was extended thanks to domestic vaccine!

      ​@@chander3338yes thanks, Government did very unexpected things , extra ordinary, but I think it's the scientists and Bharat biotech they deserve the praise. They could have sold the vaccines For higher profits to the world but they called government to literally give it as almost a charity. The CEO of Bharat biotech could have become one of the Richest person ever lived. Government provided machinary of logistics and distribution not development. Scientists went through all the possible conditions and combinations of mRNA that can destabilize the SARS COVID viruses in a cell. All were private scientists. Bharat biotech is the unsung, forgotten worth appreciation company for development . Government had almost no job in lock down , they provided logistics and distribution. Thank you. When we can praise the Government when it does small goodness then why can't we criticise it in cases of undisciplined behaviours and unfulfilled promises.

    Ranjan Gogoi is not eminent judge but an agent of BJP which we came to know after his retirement. When many eminent judges talk about Basic Structure of the Constitution, Ex CJI Ranjan Gogoi is against the Basic Structure of the Constitution. Very alarming for Indian Constitution and democracy.

    If they had spine then they wouldn't have been appointed. Look at justice chandrachud he is giving judgements/comments or hearings only on those cases which more theoretical or doesn't go drastically against the government. Most of important cases are not even heard in court.

      The most notable case in this context is that of Tlthe former CJI Justice Ranganath Mishra, who was appointed chairman of the National Human Rights Commission after his retirement in 1992. He became a member of the Rajya Sabha in 1998 as a Congress member; he had earlier headed the commission of inquiry into the riots in the capital following Indira Gandhi’s assassination. The commission exonerated the Congress party in the 1984 carnage against Sikhs.

      In the contemporary scene it is Mr Ranjan Gogoi who claimed his reward of a Rajya Sabha seat for judgements favourable to this government, climaxing with the Ayodhya case wherein he contradicted himself. And now trots out similar opinions, as in the Delhi government case & on the structure of the Constitution.

    Mr Karan is doing a yeomen service by interviewing stalwarts like Shri Fali Nariman. It takes a huge lot of preparation for Mr Karan and his team to prepare for such interviews. Heartfelt appreciation to Shri Nariman. At 94 years, he still has strong memory and clarity of thought and flexibility towards balanced interpretation of current events. God bless him.

    Autocracy versus democracy ..its only when we loose freedom we will begin to value what we lost .being under the control of one leader for every thing starting from schooling to marriage to life in general is unimaginable. corruption is economic in nature while autocracy will take away our basic nature of human being to be free ..we need to appreciate democracy we cant leave our future generation without freedom to grow and prosper.unfortunate

    Ours is a wounded democracy. Except for once in a while periodic on-cue voting, participation in the everyday functioning of democracy is all but excluded from most of the people, most of the time.

      Are you unable to see how much of time and tax payers money is being wasted in conducting elections throughout the year when the time of the elected representatives and the money can be put to better use for the benefit of the people. What is the disadvantage of holding both state and national elections. The advantages of holding both state and national elections at the same time far outweighs holding them separately. Think about it.

      Soli Sorabjee & Fali Nariman were neutral only when congress was in power but when bjp came to power Sorabjee caved in to the lure of the office of Solicitor general and this time it was Fali whose son got appointed as judge to the Supreme Court…One just can’t recall Fali arguing against this present dispensation in any case although there were many instances particularly of abuse of human rights and freedom of speech wherein Fali could have taken on this government…..

    "We" has a completely different meaning for the present rulers. We had taught about Gandhiji, Nehru and many prominent leaders of yesteryear respectfully as grandfathers to our kids. But can the most "so called" powerful Indian PM today be taught to kids as such. Highly questionable!!! Here lies the real meaning for "We".

      'We' is indeed different for Modi when compared to Gandhi and Nehru. Gandhi's last fast was for putting pressure to release 55 Crore rupees funds to Pakistan. Nehru didn't adhere to the Nehru-Liaquat Pact and see that the population exchange happens to the full like Dr Ambedkar strongly advocated for. Crores of Hindus have suffered unspeakable atrocities in Pakistan, and Modi brought about CAA to address that.
      "We" is different now indeed.

      The original Constitution had illustrations of Lord Rama, Krishna and Buddha. These illustrations were by famed artist Shri Nandalal Bose. Subsequently someone tampered with the Constitution and deliberately reprinted the Constitution without these illustrations. Had the illustrations retained nobody would have questioned the rebuilding of Ram Temple in Ayodhya.

    There is nothing wrong with the spirit, soul or conscience of the Indian Constituition or with how we have been interpreting it over the past 75 years ! This Constituition has faced all contingencies & has stood the test of time ! We need not pay so much attention to an autocratic, fascist & fanatic regime [with an inferiority complex] that is hell-bent on changing everything based on the belief that no one that came before them had ever had any wisdom and that they are the only torch-bearers to morality and correctness! Despite all the drastic, immoral & problematic situations that have arisen due to them during the past 10 years! For their psychopathic mentality, its "my way or the highway" all along & the public must comply & have no right to object !

    Where was the DOCTRINE OF BASIC STRUCTURE and supremacy of SUPREME COURT during the EMERGENCY period...?? DID the judges & courts be afraid of their life & cowards to Indira Gandhi ...??
    If one assumes CONSTITUTION is SUPREME.... and it's only the PARLIAMENT that can amend constitution & make new laws, then is not it ridiculous that the PARLIAMENT is NOT SUPREME...???

    Wonder what Mr. Nariman's views are on the role of the united opposition - the INDIA Alliance, in denouncing the various glaring errors, fraud and discrepancies in EVMs during past elections.     How many here know that when Congress had moved a resolution for absolute freedom (poorna swaraj) - Gandhi, the Original* himself had dismissed the resolution saying Unity with Muslims never a possibility?
    (*'the original' suffix because so many his namesake parasites are around)
    And I quote him:
    "I hope that those of you who have voted for the
    previous resolution will think fifty times before taking up this
    resolution and voting for it.
    Let Hindus and Mussulmans have
    absolute, indissoluble unity.
    Who is here who can say today with
    confidence, “Yes, Hindu-Muslim unity has become an indissoluble
    factor of Indian nationalism?”
    Who is here who can tell me that the
    Parsis and the Christians about whom you heard this afternoon-who will tell me
    that those very people will not rise against any such idea?"
    Dr Ambedkar was right in saying that he didn't consider Gandhi a Mahatma.

    Shameful one sided definition of democracy coerced to suit a narrative of the British definition of it. Mind that British don’t have a written constitution and they suit it to their needs. No one country in the world has a uniform definition on democracy and the paper by Mr Khaitan is fit for the bins.
    Democracy has evolved considerably from its conception hundreds of years and it resonates with time. Unfortunately, the constitution of India didn’t keep with time, its Hindu majority people’s aspirations and the requirements of the minorities. Judiciary has failed as did its political class till 2014 and Modi has changed it. There is no pride or necessity in having perfect democracy to please some western governments definition of democracy that even they don’t follow.
    The ramblings of Mr Khaitan also applies to the democracies like USA as well, does this mean democracy in USA is in peril.
    What’s wrong with Hindutva as hindutva allows pluralism. Why is Hidutva being shown as some negative force. India as is Bharat is the region between Himalayas and Indu maha sagar, so called Hindu. So it is the only place in the world for the people who practice religions of Hindu. There is no other place for Hindus to go if they face persecution in foreign lands.
    Mr Khaitan misinforms on CAA and mixing with NRC.
    I do not understand why Mr KT and Mr TK think they are the sole bearers of Indian democracy? The pulse of the nation is totally against the views of the people in the video. I hope a resounding victory of Modi govt in 2024 elections would silence these rabble rousers.

    Basic structure of the Constitution can only be formulated by Parliament of India and never by the collegium. Another interesting gem is that neither the Parliament of India is soverign nor the executive is sovereign. Is India that is Bharat is sovereign?? Well the 'closet view' is that the so-called Collegium alone is sovereign and the lord of constitution! Where is the 'Collegium' provided for in the Constitution? Well the Collegium as the Lord and the final arbitrar of Constitution can provide and insert for anything in the Constitution as it feels convenient. As a citizen i feel there are serious maladies to be sorted out.

    They are obsessed with judicial supremacy over the legislative and the executive i.e., Sovereignty which is not good for the country. How judiciary can override the parliament which includes the President? Judiciary already enjoys highest independence being appointed by the President and not removable by him without recommendation of the parliament. What else they want?

    English people are intelligent. They helped us have the executiv body, the parliament, the judiciary none of which is Sovereign. They never had a written constitution but bound us to a constitution which they got prepared for us. Their parliament is sovereign means their parliament is indirectly ruling us through their constitution by their proxies. This's horrible!

    We all take no small pride in the fact that ours is the biggest (by the same token unwieldy, erratic even overbearing at times) democracy in the world. But when nobody was watching, vigilance thrown to the wind, was slack to non-existent under the radar our economy was transformed into a COMMAND ECONOMY, ie at the command of a single person whose understanding of matters economic is less than vestigial.     Anti -minority view did not exist during emergency! Who were forcibly castrated?
    Muslims and Dalits were explicitly targeted by the sterilisation programme for compulsory vasectomy and tubectomy.

    Who judges the judges? Should there be a constitutional provision for that too? Judges must have their opinion too, but shouldn't it be curbed when it goes against the public good? Talking about supremacy, I like to think that not executive branch, not judiciary, not even parliament, people are supreme. The public good must trump everything else.

    This was a fantastic and honest take on the state of affairs in India now.
    It's not easy to correct without first being convinced that we ahouls should change.
    One key takeaway about the Nehru years and Vajpayee years couldn't have been a better example.

    Modi has profited and continues to profit electorally from his reputation as an anti-Muslim strongman, and Karan will be just helping him more here..

    34::4; if u look at the caste composition of the high and supreme court judges the predominance of the bania-bamman castes still continues and all these judges are the products of the casteist and communal sub-system of this nation, for these judges judicial integrity means opposing all mass welfare and secular measures initiated by the congress government particularly Indira gandhis and supporting all authoritarian and caste-communal-divisive policies of the present minority oppressing castes bjp government ….Prior to the collegium system of appointing of judges the congress govt had even supported appointment of judges who were known for being anti-establishment and many went on to give judgements against the congress party and they never experienced any vindictive action from the congress unlike the present government which shamelessly targets and acts vindictively judges who aren’t not spineless …

    I fully agree with Fali Nariman and agree with his one specific view. If the Constitution were to function rightly without pro Govt Judges then JUDGES themselves have to ensure that nothing is done against the Constitution by the Govt, and they must act fearlessly and independently. Judges must also stand up for their own rights which is not practiced at present.

    Respected Falli Nariman is greatest asset to the judicial system of this country. At this ripe old age, he has the wisest memory quoting several decades back Court decisions. Let us all pray for his guidance on legal matters to last for many many years. Astonishingly, he has authored a Bible on Indian constitution at the age of 94 years. Big salute to this superb legal luminary.

    Mr. Nariman, I appeal to you to take up the cause of a common man. I, as a citizen, am not entertained by the bureaucracy to redress my grievance. The bureaucracy doesn't reply or take action on my grievance. There is no "Citizen Charter" even after 75 years of independence. Great people like you and Karan are silent all these years. You sit on judgement on issues that don't affect me directly. I agree it may affect me indirectly and in the long run.

    We may see Emergency as bad but the intention was to protect the chair of Prime Minister Indira Gandhi. It was a shame less act. She was supported by left leaning parties and she sent to jail who whispered opposition. Sanjay Gandhi stamp was for every body to see . It mired the people specially in north. The administrators behave d like Maharajas . In south this may not be so bad . Election results indicate that. But the aim of Indira Gandhi was not to bring about radical change in our polity.Emergency had to be given a goby when it became unbearable. But the aim here is different. Use constitution to bring the polity nearer to heart’s desire.

    Aware that Fali ji will ultimately zero in on Tolerance.
    With due respect to him, he is no doubt the towering constitutional expert. Said that he should answer the following conundrum:
    Suppose, Karan Ji's neighbour plays his Dolby or cube stereo in full volume daily early morning say till he leaves for the Wire office - would Fali help him file a case without fees accepting that the very term has a saturation point or advise him that his tolerance level should be limitless and that he has only the right to shut his ears?

    Even my grandpa's & grandma's voices as well as mental health ( due to age + age related diseases ) were no where near as Mr Nariman sir's voice & mental health is .
    He definitely must be a fitness freak . I hope so .
    Apart from that . What ever is about to happen will happen & there are sufficient number of people to oppose them .
    As Somebody had said " what ever happens it happens for a reason & for good "
    Situation in this country is like that .
    What ever has happened till now has happened for a reason & it happened for good .
    Atleast people who have some amount of thinking power left are starting to or already have woken up from their deep sleep of tolerance of this decade old rule at centre .
    Even if opposition may loose but they will now stand up & fight back again !

    Parliament represent people of India. They have adopted a constitution to themselves. They have the capacity to change, modify, renew the document. You mean to say, after adoption of the constitution that has become eternal and crystallized and people are out, there after sovereignty lies with the document, not with people of India. Is n't it an idea of attempt to usurp people's power and their wisdom.
