BBC raids to Article 370 - former SC judge RF Nariman highlights ‘disturbing’ incidents in India

- From raids on BBC offices in India to the Supreme Court’s refusal to look into the validity of the bifurcation of the erstwhile state of Jammu & Kashmir into two Union territories, former Supreme Court judge Rohinton Nariman spoke about “disturbing” happenings in India in the recent past.
He made these observations at the 30th Smt Bansari Sheth Endowment Lecture Friday on the theme ‘The Constitution of India: Checks and Balances’.

Justice Srikrishna along. Not a surprise a political statement in the garb of constitutional issues.
After all it's politicians are elected to act under the constitution and lawyers educate the lay people on how the job is being done. The elected leaders are not 'know all'! they need the support and advice of people trained in law, administration and a host of other things elected leaders are responsible for. The advice of a trained support system is essential.

Nariman talks as if CJI is impartial. Mr .Nariman conveniently ignores the State Govt.,creating bills that benefit only a section of the society .

I fondly hope every statesman, every politician, every governor and every judge of this country should listen to this informative lecture. Another important thing to be added here is that retired judges of all the courts of the country should be barred from contesting elections and taking part in the governments.

The retired judges, often start giving lectures on various issues which were never practised by them during their working days. For example about genocide of hindus in kashmir, genocide of sikhs in delhi by cong men so on so forth. Now, they use welfare of common man, freedom, democracy, CEC appointments, functioning trying to sound very democratic. We never heard anything earlier that during cong ruling, we, defence perdonnel were subjected to many insults in J & K by local admin even during our routine movements. Its very unfortunate. We many a time feel like these people and beuracrats are under the veil, are more corrupt than politicians. Very sad

I have seen judges giving lectures in seminars but doing nothing to safeguard therights of people to live with dignity when in power. I have filed cases in Allahabad High Court for exclusion of cerebral palsy candidates from teaching opportunities in higher education. On one hand Central Government allows people with cerebral palsy for assistant professorship but on the other hand State Government of Uttar Pradesh is not abiding to it, it is close to 2 years now and the case is moving very slowly

Judge Nariman, your point well taken if you are able to answer these questions:
1. In a singular view of Upholding the Constitution alone can your put the country at risk of Greater Problems like disinformation by state enemies, disintegration of the country, deliberate demographic change for vested reasons and holding back very necessary measures that are needed to safe guard the country.
First address the correspondence of pending cases, that way people who are aggrieved will get rightful justice and then things will fall in place, more or less.
Why do we have so much nepotism in the highest level of Indian Judiciary?
Do you agree faster disposal of cases (having economical implications) will help economic growth of the nation?
Huge respect for Judge Nariman and our constitution, and i have a few queries as to the reach of the constitution
1. Does our constitution advice on how to counter external elements and influences who are not bound by the law of the land
2. Does our constitution advice on how to counter and enforce the speed at which justice is delivered to the common man, i was deeply impressed about the 5 year delay, but also disturbed about how common man doesnt get justice even in property cases for 3-4 decadeds
3. Does the constitution prevent and protect us from multi pronged attacks on the unity of india by various factions combinedly but well within the law as to not be held accountable?
4. Does the constitution enforce and ensure the economic challenges of the common man and state in an open market economy?
5. Does the constitution hold the people responsible for not framing enough laws and enough manpower to enforce all laws of the land water tight? b cos enforcing one law and being lenient on the other has become a matter of preference and prejudice
I dont think we can quote any sections or chapters for the above, except for the power to vote equally of the common man, who inspite of being illiterate and not so eloquent in language, sensible enough to observe and decide very quickly and by heart on who will lead the nation in the right direction. And please do correct me if the constituent body was elected or entrusted to prepare the constitution.

With the help of this speech I am further guided to the belief that democracy will permanently shift to a coalition government in the coming years and decades with an assumption that these subversions are acts and can be played by any party in power to the further detriment of the spirit of constitution. I think democratic response to rogue legislation’s is coalition. This also means in my prophesy that the fracture lines in our society will widen every day.
Alas! we are failing the constitution because of our knowledge, intelligence and lack of integrity to the concept of India.
