    Update: The courts went after her. She was arrested and charged and the judgement is she has to not only pay back the 1.5 million she was given but she was also fined another 1.1 million for a total of 2.6 million. We know she doesn't have the money but hopefully she will be held accountable to pay something most likely forever and if not then be locked up!

      Hope he eventually sues her for malicious defamation - I know that the laws in California on that issue throw up so many hurdles for the Plaintiff that they tend to favour the guilty party - so follow Johnny Depps lead and take it to a better jurisdiction!!!

      @@YunikuYosefMomoka an attorney has an ethical duty to defend their client. The attorney failed to review all evidence. In a sense the attorney assumed he was guilty from the start. So in essence the attorney is guilty of collusion with the prosecutor as well should be sued and disbarred due to malpractice.

      It's a start. No jail time as of yet but at least she had to pay back the money plus damages. It should honestly be much worse though. And also this isn't even Banks filing it. If Banks filed it it would be way more I think.

    His lawyer was a real shit bird and should be disbarred. I would've gone to trial. It's no even close to beyond a reasonable doubt without DNA evidence and if he didn't actually do it, I'm sure there would've been some holes in her story during cross examination.

      I think the lawyer was doing what's best given the situation. Though he accepted the plea deal with 18 months to 5 years PROBATION, they still sentenced him MAXIMUM of 5 years regardless of the evidence. The justice system is a joke.

      Unfortunately, the consequences for rape and kidnapping is astronomically, disastrously dire that it would scare anyone, especially those without any experience in the justice system. Also if you're not wealthy, you cannot afford to hire the best legal defense team. So he was given very lousy advice: plea agreement with the prosecution for a reduced sentence, which the judge does not have to adhere to. And didn't. Really awful and happens more often than we'd care to think about.

    This story is heart wrenching....and the fact that so many other falsely accused victims are still sitting behind bars makes my stomach turn. There aren't any words to describe how awful this is, but the fact that Banks can move on happily with his life without going after this rotten excuse for a human being speaks volumes of his character! Very respectable and admirable.

    I myself once had to choose between serving 9 months for something I didn't do....or go to trial and get 12 years if I lost.
    From a cost-benefit point of view, it made more sense to confess to something I didn't do because there was no guarantee I'd win at trial - I'd rather DEFINITELY lose 9 months instead of POSSIBLY losing 12 years.

    His first defense attorney should be disbarred. The original prosecution team should be disbarred. The school and football team who tossed him aside should make up for his NFL salary. The woman who lied should have all of her assets seized and should be in prison for no less than 15 years. Not only did she destroy a huge part of his young life, she slapped every single real abuse victim in the face. Disgusting what was done to that man

    This case has disturbed the hell outta me since I first heard it three years ago.
    First of all, there's the question of how the hell it is possible in modern America for a man to be incarcerated based solely on the word of ONE PERSON(!), and zero corroborating evidence? (And granted, this is complicated by the fact that his trial attorney somehow persuaded him to plead "no contest", so we must ask the question of whether it was the legal system, or an incredibly stupid lawyer, who should bear responsibility here.) And certainly, we cannot dismiss race and class as having had a role here.
    Then we have the matter of this man's accuser, and the way the justice system has treated her. She basically admitted to a willingness to destroy this man's life for the sake of a quick monetary payoff. Is this not just as horrible a crime as that for which Brian was convicted? (Yes, I'm sure there are some feminists who would argue otherwise.) And what justice does she get for it? Yes, she's been ordered to pay damages to the school. But one really has to question whether even that would have ever happened had it not been for the publicity generated by this story.
    And what about criminal charges against Ms. Gibson? As far as I can see, it looks like no one has even given that a cursory consideration. Even Brian says he's not vindictive, and that's very admirable of him. But as a society, do we not owe it to ourselves to tell potential false accusers everywhere that there is a steep price to pay for deliberately destroying other people's lives?
    Having said all that, I would really like to know whether there is anything more to this story that has been glossed over? I've searched google and haven't found much beyond the basic facts. Does anyone know of a detailed accounting of the trial procedures or police reports that can be found online? It's just so troubling to think that an innocent man can serve five years behind bars based on the testimony of one solitary person, that one can't help but wonder whether there have been any omissions in the generally accepted mass-media story. For example, was there ANY other incriminating evidence or testimony, other than Ms. Gibson's? Did Brian have any kind of criminal record that worked against him at the time? I'd appreciate it if anyone can point me to a comprehensive account of what transpired during the legal proceedings.

    Imagine if he would have plead not guilty, and the judge gave him 41 years or even 20. He would have never been able to expose the wickedness of a classless young women....
    Having already served 12 months, statistically speaking, pleading No contest was his safest bet, and that's unfortunate and I believe it speaks to the justice or lack there of, in our "criminal system."

      Briz Monsta u writing to me is not going to change my point of view at the end of the day the school board didn't ask for the money back as yet, not to mention the bigger picture he is free the women recanted her story he is no longer a registered sex offender nor is he monitored by an ankle braclet, he is still playing some kind of football.     And that's why a testimony of a single person is not enough to convict someone of rape. She destroyed the life of a fellow teen and she didn't give a shit. What kind of evil human being do you have to be.
    Good for him he has good morals. Many people would have gone after her, by law or driving over her with a car 10 times.
    And that lawyer is horrible. Plea of no contest, on rape charges? Freaking kidding me. Why didn't she just put him i jail herself.

    He ended up playing with the falcons for 4 pre season games and got hired by the NFL and still works there today. That accuser was only worried about not paying the money back instead of helping him. What a piece of trash. I wish nothing but the worst for her

    And, to boot, the Deputy DA said that Brian "pleaded guilty" to the crime. He did NOT. Under advice from his attorney, he pleaded no contest. With an attorney like that, who needs enemies? Brian and his mom are VERY remarkable. I hope Wanetta gets what's coming to her.
